MINUTES OF MEETING HELD FEBRUARY 22, 1972
Mayor Gottfried called the meeting to order at 7:40 P.M. l PRESENT: Mayor Gottfried, Aldermen Burgermeister, DeBack, Dumke, Foldy,
Sapp, Narlock and Schaumberg. Also present were City Attorney John
Buckley and Cbty.Clerk Bette Bowyer.
a APPROVAL OF MINUTES: Ald Sapp moved for the approval of minutes held
February 8, 1972, as mailed, and that they be placed on file. Seconded
by Ald. Burgermeister. Motion carried.
COMMITTEE REPORTS
Ald. Burgenneister presented the report of the Finance Committee meeting
held on February 16, and moved that they be accepted and placed on file.
Seconded by Ald. Sapp, motion carried.
Ald. DeBack presented the report of the Public Works Committee meeting
held on February 17, 1972, and moved that it be accepted and placed on
file. Seconded by Ald. Burgermeister, motion carried.
0 Ald. Schaumberg presented the report of the Public Safety Committee
meeting held on February 10, 1972, and moved that the report be accepted
and placed on file. Seconded by Ald. Sapp, motion carried.
Ald. Dumke presented the report of the Rules, Laws & Ordinance Committee
meeting held on February 17, 1972, and moved that the report be accepted
and placed on file. Seconded by Ald. Foldy, motion carried.
The minutes of the Plan Commission meeting held on February 15, 1972,
were received and placed on file.
UNFINISHED BUSINESS
Ordinance l/213 - The Clerk gave the second reading of Ordinance #213,
entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning
Map of the City of Muskego (Kirkwood Manor and Kirkwood Additipn #l from
RS3 OED to R.92). Aid. Sapp moved for the adoption of Ordinance #213,
seconded by Ald. Foldy. Upon a roll call vote, the motion to adopt
a Ordinance #213 carried unanimously with Ald. Burgermeister abstaining
from voting.
* \ Resolution #19-72 - Initiating Action to Rezone Certain Land in Sec. 25
from R-3 to R3 with OIP Overlay (Shy Property) This resolution had been
deferred from the previous meeting. Ald. Sapp reviewed to the Council the
efforts that were made by the Public Safety Committee and some of the members
of the Tess Corners Fire Dept. in an attempt to find another suitable site
for the location of the proposed sub-station of the Tess Corners Fire Dept.
She distributed a map which showed other possible sites and the availability
of manpower who could readily respond to an emergency call. Following dis-
cussion, Ald. Burgermeister moved to defer action for two more weeks until
l the Public Safety Committee could get together with the executive committee
of the Tess Corners Fire Dept. and confirm the proposal of the study of the
Safety Committee. Seconded by Ald. Schaumberg. Upon a roll call vote,
the motion to defer carried unanimously.

The Clerk read the Mayor's veto message of Resolution f/20-72, entitled,
w ccepting Recommendation of Plan Commission to Schedule Public Hearing
for DeBack-Wallner Property. Mayor Gottfried advised the aldermen that,
upon the advice of the City Attorney, he would withdraw his veto of
Resolution j/20-72.
a Ald. Burgenneister requested a recess at 8:21 P.M. and the meeting re-
convened at 8:32 P.M.
Ald. DeBack vacated his Chair to comment on Mayor Gottfried's veto
message.
NEW BUSINESS
Resolution 1121-72 - The Clerk read same, entitled, Accepting Bid for Five
New Squad Cars. Ald. Burgenneister moved for adoption of same, seconded
by Ald. Narlock. Ald. Burgenneister moved to amend Resolution i/21-72
by adding the following to the third and fourth paragraph "after adjustment
to specifications". Seconded by Ald. Narlock. Upon a voice vote, the
l motion to amend carried. In answer to Ald. Sapp and as there were no
objections from the aldermen to having Police Chief Kraus speak, he advised
that the exceptionally low price of the Javelin cars was due to factory
assistance. Upon a roll call vote, the motion to adopt Resolution 1121-72
carried unanimously.
Resolution 1~22-72 - The Clerk read same, entitled, Accepting Offer of EPA
for Federal Funds ($188,330.00). Ald. Foldy moved for adoption, seconded
by Ald. Schaumberg. Upon a roll call vate, the motion to adopt carried
unanimously.
Resolution 1~23-72 - Accepting Bid for Two Highway Trucks. The Clerk read
same. Ald. Burgenneister moved for adoption, seconded by Ald. DeBack.
Ald. Burgenneister moved to amend Resolution #23-72 by adding the words
in the third and fourth paragraph "with power emergency brake installed".
Upon a voice vote, the motion to amend carried. Upon a roll call vote, the
motion to amend carried. Upon a roll call vote, the motion to adopt
Resolution j/23-72, As Amended, carried unanimously
Resolution #25-72 - The Clerk read same, entitled, Denying Claim of Gregory
Koeferl. Ald. Burgermeister moved for the adoption of same, seconded by
Ald. Narlock, Upon a roll call vote, the motion carried unanimously.
Resolution #26-72 - The Clerk read same, entitled, Authorizing Commencement
of Condemnation Proceedings Against Lands in the City of Muskego (Koeferl
Property). Ald. Narlock moved for adoption, seconded by Ald. Burgermeister.
Upon a roll call vote, the motion carried unanimously.
Resolution 1~27-72 - Ald. Foldy moved to suspend the rules that would inter-
fere with the adoption of Resolution 127-72, entitled, Authorizing Execution
of Easement with Wisconsin Electric Power Company (New City Hall - Library).
Seconded by Ald. DeBack. Upon a roll call vote, the motion to suspend the
rules carried unanimously. The Clerk read the resolution. Ald. Foldy
moved for adoption, seconded by Ald. Schaumberg. Ald. Foldy moved to amend
the last paragraph by adding the words "and any modification required by
the architects." Seconded by Ald. Burgermeister. Upon a roll call vote
the motion to adopt Resolution 1127-72, As Amended, carried unanimously.

Ordinance #216 - The Clerk gave the fitst reading of same, entitled,
An Ordinance to Amend Certain Provisions of Ch. 17 of the Municipal
Code (Re: Swiuuning,Pools)
Ordinance #218 - The Clerk gave the first reading of same, entitled, An
Ordinance to Amend Certain Provisions of Ch. 17 of the Municipal Code
(Re: Planned Development Requirements)
Ordinance 11219 - The Clerk gave the first reading of same, entitled, An
Ordinance to Amend Ch. 17 of the Municipal Code (Re: Preservation of
Tops-aphy)
VOUCHER APPRCVAL - Ald. Sapp moved for the approval of payment of
vouchers in the amount of $245,801.15, payable 2122172. Seconded by
Ald. Burgermeister. Upon a roll call vote, the motion carried unan-
imously.
Ald. Sapp moved for the approval of payment of sewer utility vouchers
in the amount of $255.92, payable 2122172. Seconded by Ald. Burger-
meister. Upon a roll call vote, the motion carried unanimously.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
The Clerk read a communication from the Muskego Woman's Club, directed
to the Muskego Common Council, dated 2112172, requesting the use of
old city hall after it is vacated in April. Communication referred to
Public Safety Committee.
The Clerk read a communication from City Plan Commission directed to
Mayor and Council, dated 213172, recommending denial of Richard Moser's
request to create two sub-standard lots from part of Lot 11 and all of
Lot 12, Blk 9, Oak Ridge Unrecorded Subdivision. Communication placed
on file.
The Clerk read a claim from Donald E. Wieselmann, directed to the Mayor
and Council, dated 2117172, in the amount of $85.61. Same referred
to Finance Committee, City Attorney and Insurance Carrier.
Ald. Foldy moved to set public hearing dates for Zoning Ordinance
Amendments as follows: Re: Swimming Pools, April 11, 1972, 7:OC P.M.
Re: Presentation of Topography, April 11, 1972, at 7:lO P.M.
Re: Planned Development Requirements, April 11, 1972, at 7:20 P.M.
Motion seconded by Ald. Dumke and carried.
It was the Council's decision to re-schedule the public hearings date
for the DeBack-Wallner rezoning in Resolution #20-72 to March 28, 1972,
at 7:00 P.M.
ADJOURNMENT - Ald. Narlock moved to adjourn, seconded by Ald. DeBack.
Motion carried. The meeting adjourned at 9:21 P.M.
