CITY OF MIJSKEGO
MINUTES OF MEETING HELD FEBRUARY 8, 1972
Mayor Gottfried called the meeting to order at 7~37 P.M.
0 PRESENT: Mayor Gottfried, Aldermen Burgermeister, DeBack, Dumke, Foldy,
Sapp and Schaumberg. Also present were City Attorney John Buckley and
City Clerk Bette Bowyer.
ABSENT: Ald. Frank Narlock.
0 APPROVAL OF MINUTBS: Ald. Sapp moved for the approval of minutes held
January 25, 1972, as mailed, and that they be placed on file. Seconded
by Ald. Dumke. Motion carried.
COMMITTEE REPORTS
Ald. Burgermeister presented the report of the Finance Committee meeting
held on February 7, 1972, and moved that they be accepted and placed on
file. Seconded by Aid, Sapp, motion carried.
Ald. DeBack presented the report of the Public Works Committee meeting
held on February 3, 1972, and moved that it be accepted and placed on
file. Seconded by Ald. Burgermeister, motion carried.
Ald. Foldy presented the report of the Rules, Laws & Ordinance Committee
meeting held on January 26, 1972, and moved that the report be accepted
and placed on file. Seconded by Ald. Dumke. Ald. Dumke reported that
the committee had met once again with Mr. Norb Theine of SEWRPC and had
completed its review of the Subdivision Control Ordinance. The motion
to accept the minutes carried.
Ald. Schaumberg presented the report of the Public Sewer/Welfare
Committee meeting held on February 3, 1972, and moved that the report
be accepted and placed on file. Seconded by Ald. Foldy, motion carried.
The minutes of the Plan Commission meeting held on 2/l/72 were received
and placed on file.
UNFINISHED BUSINESS
Ordinance f/209 - An Ordinance to Amend Cb 17 (Zoning Ordinance) of the
a Municipal Code. As this ordinance had had its second reading, upon a
roll call vote the motion to adopt carried (Re: Floor area requirement)
Ordinance #212 - An Ordinance to Amend Certain Provisions of Chapter 17
(Zoning Ordinance) of the Muniqipal Code (Re: Gasoline Servica Stations)
The, Clerk, gave the second reading-of,Grdinanize :#2121:...A$d. DeBack-.maved.for
adoption, seconded by Ald. Foldy, motion carried. Ald. Burgermeister
moved to reconsider Ordinance #212, seconded by Ald. DeBack, motion
carried. The Clerk read the corrected draft of Ordinance #212. Upon
a roll call vote, the motion to adopt Ordinance 8212 carried unanimously.
COMMUNICATIONS FROM TRE MAYOR'S OFFICE
* The Clerk read the Mayor's proclamation of "MUSKEGO VOTER REGISTRATION
WEEK" (February 13 - 19, 1972).
Mayor Gottfried advised that City Clerk Bowyer has arranged to have a
clerk spend the morning of February 16th at Muskego High School to
a
register those eligible to vote in the March and April elections.

Ald. Burgermeister moved for the reconsideration of Resolution #6-72
entitled, Establishing Salaries for Elected Officials in the City of
Muskego. $econded by Ald. Schaumberg. Ald. Burgermeister stated his
reason for reconsideration being based on past policy that non-policy
making city officials were paid from January 1st of any given year.
Upon a roll call vote the motion to reconsider Resolution &i-72 carried
unanimously. Ald. Burgermeister moved to amend the second paragraph
of the resolution by changing the date May 1, 1972, to January 1, 1972.
Seconded by Ald. &Back. Upon a roll call vote, the motion to amend
carried unanimously. Upon a roll call vote, the motion to adopt
Resolution #6-72, As Amended, carried unanimously.
NEW BUSINESS
Resolution #16-72 - The Clerk read same, entitled, Establishing
Traffic Regulations (No Parking on College Ave. from Hillendale Dr.
to Small Rd. at any time) Ald. Foldy moved for adoption, seconded
by Ald. Dumke. Upon a voice vote the motion carried.
Resolution i/17-72 - The Clerk read same, entitled, Approval of Rescue
Contract. Ald. Sapp moved for adoption, seconded by Ald. Burgermeister.
l Upon a roll call vote, the motion to adopt carried unanimously.
Resolution #la-72 - The Clerk read same, entitled, Approval of Radar
Maintenance Contract with Stark Electronic Service, Inc. Ald. Sapp
moved for adoption, seconded by Ald. Burgermeister. Upon a roll call
vote, the motion to adopt carried unanimously.
Resolution #19-72 - The Clerk read same, entitled, Initiating Action
to Rezone Certain Land in Sec. 25 from R-3 to R-3 with OIP overlay.
Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Ald.
DeBack spoke in opposition of the motion indicating that he felt the
possibility of other sites should be investigated. Ald. Dumke question-
ed whether or not the fire department had tried to dispose of the
property in question. Ald. Schaumberg stated that the fire department
had searched for other locations at a reasonable price but to no avail.
Mayor Gottfried stated that former Ald. Wollman and himself had spent
several days with Chief Utpatel looking for an alternate site and that
the one alternate site that wasqreed upon and the necessary zoning
accomplished, the final cost to the department became prohibitive.
Ald. DeBack moved to defer action on Resolution #19-72 and that mem-
bers of the Safety Committee and the Tess Corners Fire Dept. again try
to locate a suitable site. Seconded by Ald. Sapp. Upon a roll call
vote on the motion to defer, Aldermen Burgermeister, Dumke, Sapp, Foldy
and DeBack voted "aye". Ald. Schaumberg voted "nay". The motion to
defer carried.
Resolution #20-72 - The Clerk read same, entitled, Accepting Recommenda-
tion of Plan Commission to Schedule Public Hearing for DeBack-Wallner
Property. In accordance with the recommendation of the Plan Commission
Ald. Burgermeister moved for adoption. Seconded by Ald. Foldy. Mayor
Gottfried turned the Chair over to Council President Burgermeister
* and spoke in opposition to the resolution on the basis of what he felt
was improper zoning and inadequate sewage treatment facilities. Ald.
DeBack vacated his chair at the Council table and spoke in favor of
the proposed development. Upon a roll call vote to adopt Resolution
#20-72 which would set the public hearing date for the rezoning of
the DeBack-Wallner property, (March 14, 1972, 7:30 P.M.), Aldermen
l Burgermeister, Foldy and Schaumberg voted "aye". Aldermen Dumke and
Sapp voted "nay". Ald. DeBack requested to abstain from voting. The
motion to adopt Resolution #20-72 carried.

Ordinance 8213 - The Clerk gave the first reading of Ordinance #213,
entitled, An Ordinance to Rezone Certain Property and to Amend the
Zoning Map of the City of Muskego (Kirkwood Manor and Kirkwood Add. 111)
Ordinance #214 - The Clerk gave the first read of same, entitled, An
Ordinance to Amend,.Ordinance #211, As~Amended,-Establishing Sewer
Senrice Charges. Ald. Burgermeister moved to suspend the rules in
order to permit the second reading of Ordinance #214. Seconded by
Ald. Foldy. Upon a roll call vote to suspend the rules, the motion
carried unanimously. The Clerk gave the second reading of Ordinance
#214. Ald. Bureermeister moved for adootion. seconded by Ald. Foldy.

Licenses for James Woznicki and Eugene Gutho. Seconded by Ald.

Ald. Sapp moved for the approval of an Operator's License for Jon
Erik Kingstad subject to the receipt of favorable Fingerprint Report.
Seconded by Ald. Burgermeister, motion carried.
CITY OFFICIAL'S REPORTS
The Clerk presented the Financial Report for month ending January 31,
1972, showing total assets in the amount of $944,438.20. Same placed
on file.
The Clerk presented the Building Report showing total construction
for the month of January, 1972, being $675,222.00. Same placed on
file.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
The Clerk submitted a claim to the City of Muskego from Gregory
Koeferl, same referred to City Attorney.
The Clerk read a communication from the Little Muskego Yacht Club
directed to the Council, dated l/29/72, expressing its opposition
to maintaining the current low water level for a period of time
longer than the minimum required for the reconstruction of the dam.
Same placed on file.
ADJOURNMENT - Ald. Burgermeister moved to adjourn, seconded by
Ald. DeBack, motion carried. The meeting adjourned at 9:13 P.M.
