MINUTES OF MEETING HELD NOVEMBER 9, 1971
Mayor Gottfried called the meeting to order at 7~52 P.M.
a PRESENT: Mayor Gottfried, Aldermen Burgermeister, DeBack, Dumke, Foldy,
Narlock, Sapp and Schaumberg. Also present were City Clerk Bette Bowyer
and City Attorney John P. Buckley.
APPROVAL OF MINUTES - Ald. Sapp moved for the approval of the minutes of
the previous meeting held on October 26, 1971, as mailed, and that they be
placed on file. Seconded by Ald. Narlock, motion carried.
COMMITTEE REPORTS
Ald. Burgerrneister presented the reports of the Finance Committee meetings
held on October 27th and November 3rd, 1971, and moved that the report be
accepted and placed on file. Seconded by Ald. Narlock, motion carried.
Ald. DeBack presented the report of the Public Works Committee meeting
held on November 4, 1971, and moved that the report be accepted and
placed on file. Seconded by Ald. Burgenneister, motion carried.

Ald. Schaumberg presented the report of the Public Sewer/Welfare Committee
meeting held on November 4, 1971, and moved that the report be accepted and
placed on file. Seconded by Ald. Foldy, motion carried.
The minutes of the Plan Commission meeting held on November 2, 1971, were
received and placed on file.
UNFINISHED BUSINESS
Resolution i/199-71 - Ald. Burgermeister moved to defer action on same
in order to give Kohne's Attorney an opportunity to meet with the Finance
Committee - resolution to again be considered in two weeks. Seconded by
Ald. Narlock. Upon a voice vote, motion carried.
COMMUNICATIONS FROM THE MAYOR'S OFFICE - Mayor Gottfried advisedthat Ald.
Narlock and himself were unable to attend the seminar in Milwaukee regarding
the re-distribution of State Aids and he will therefore seek information
regarding same from the League of Municipalities.
l NEW BUSINESS
Resolution #180-71 - The Clerk read same, entitled, Proceedings by the
Common Council of the City of Muskego to Discontinue and Vacate a Part of
Emerald Drive. Ald. Burgermeister moved for adoption, seconded by Ald.
DeBack. Upon a roll call vote, the motion to adopt carried unanimously.
Resolution #181-71 - The Clerk read same, entitled, Proceedings by the
Common Council of the City of Muskego to Discontinue and Vacate a Part of
Pearl Drive. Ald. Burgermeister moved for adoption, seconded by Ald. Foldy.
Ald. Burgermeister advised that due to the response of the persons who were
present at the public hearing earlier this evening, he would urge that this
resolution be defeated. Upon a roll call vote to adopt Resolution #181-71,
unanimously did not carry.
Resolution 11208-71 - The Clerk read same, entitled, Approval of Agreement
Between Wisconsin Electric Power Co. and City of Muskego for Access to Horn
Field. Ald. Burgenaeister moved for adoption, seconded by Ald. DeBack.
Upon a roll call vote,

Resolution #209-71 - The Clerk read same, entitled, Resolution Proposing
Growth Rate for New Developments in the City of Muskego. A lengthy dis-
cussion took place between several of the Aldermen and the Mayor. Ald.
8 Dumke spoke in favor of the 65% development and Ald. DeBack indicated
that he would also be agreeable, however, both opposed the $250.00 per
dwelling assessment for sewer purposes. Ald. DeBack moved to amend
Resolution #209-71, by deleting the words in the first paragraph "and
that where any division of lands are made each dwelling unit be assessed
$250.00 for the cost of expanding the sewer treatment facilities.".
Motion seconded by Ald. Narlock. More discussion followed and upon a
roll call vote to amend Resolution 11209-71, Aldermen Burgermeister,
DeBack, Dumke, Narlock, Sapp and Schaumberg voted Ilayeu. Ald. Foldy
voted "nay" The motion to amend carried. Ald. Sapp moved to further
amend Resolution #209-71 by re-wording it as follows: "BE IT RESOLVED
that the City of Muskego is receptive to allowing development by any
subdivision developer in the northeast assessment district who would
be willing to agree to the limitation of 65% of the permitted density.
BE IT FURTHER RESOLVED that at such time as 95% of the northeast sewer
district treatment plant capacity is reached no further development will
take place until the City of Muskego can expand the existing facilities
until Milwaukee Metropolitan sewers are extended to serve the City of

Muskego." Seconded by Ald. Dumke. Following further discussion regarding
the pros and cons of having separate requirements of the northeast and
northwest districts, the motion to further amend lost with Aldermen
Burgermeister DeBack, Foldy, Narlock and Schaumberg voted "nay". Alder-
men Dumke and Sapp voted "aye". Upon a roll call vote to adopt Resolution
#209-71, as amended, Aldermen Burgermeister, DeBack, Foldy, Narlock and
Schaumberg voted "aye". Aldermen Dumke and Sapp voted "nay". The motion
carried.
Resolution #214-71 - At this time of the meeting, Mayor Gottfried re-
quested Mr. Don Kangas, Coach of the Muskego Warrior Football Team, to
introduce Team Captains Howie Fischer, Guy Robb and Jeff Coe to the
Aldermen. The Clerk read Resolution #214-71, entitled, Commending the
Muskego Warriors for Winning the 1971 Parkland Conference Football
Championship. Ald. Burgermeister moved for adoption, seconded by Ald.
Narlock. Upon a voice vote the motion carried. Mayor Gottfried presented
Coach Kangas a copy of said resolution.
Resolution 8210-71 - The Clerk read same, entitled, Authorizing a Service
0 Agreement for Police Department Copy Machine (Savin Sales Corp.) Ald.
Narlock moved for adoption, seconded by Ald. Sapp. Upon a roll call vote,
the motion to adopt carried unanimously.
Resolution j/211-71 - The Clerk read same, entitled, Denying Petition of
Melford Foth to Rezone Parcel of Land in Section 16. Ald. DeBack moved
for adoption, seconded by Ald. Burgermeister. Upon a voice vote, the
motion to adopt carried.
Resolution #212-71 - The Clerk read same, entitled, Initiating Action to
Rezone Certain Lands in Section 1 from RS-2 to RS-2 with an 00s overlay.
Ald. DeBack moved for adoption, seconded by Ald. Burgermeister. Upon a
roll call vote, Aldermen Burgermeister, DeBack, Narlock, Sapp, Schaumberg
and Dumke voted "aye". Ald. Foldy voted "nay". The motion to adopt
carried.
Resolution #213-71 - The Clerk read same, entitled, Initiating Action to
Rezone Certain Lands in Sections 16 and 17 from RS-2 to RS-2 with an 00s
8 overlay. Ald. DeBack moved for adoption, seconded by Ald. Burgermeister.
Upon a voice vote, motion carried.

Resolution #215-71 - The Clerk read same, entitled, Authorizing Ruekert
& Mielke to Develop Plans and Specifications for the Purpose of Providing
Sewers to Hillendale Heights and Hi-Y Ranches Subdivisions. Ald. Foldy
w moved for adoption, seconded by Ald. Schaumberg. Upon a voice vote
the motion to adopt carried.
Ordinance #205 - The Clerk gave the first reading of Ordinance #205,
entitled, An Ordinance to Amend Certain Provisions of Ch. 17 of the
Municipal Code (Re: Duplexes).
VOUCHER APPROVAL - Ald. Burgermeister moved for the approval of payment
of vouchers in the amount of $591,050.74. Seconded by Ald. Narlock.
Upon a roll call vote, the motion carried.
Ald. Burgermeister moved for the approval of payment of sewer vouchers
in the amount of $383,541.72. Seconded by Ald. Narlock. Upon a roll
call vote, the motion carried.
LICENSE APPROVAL - Ald. Burgermeister moved for the approval of Operators
Licenses for Sylvester Ksobiech, Rene Stickel III and Ronald Clark subject
to the receipt of favorable Fingerprint and Medical Reports. Seconded
0
by Ald. Narlock. Upon a voice vote the motion carried.
CITY OFFICIAL'S REPORTS - The Clerk presented the Financial Report for
the month ending October 31, 1971, showing total assets in the amount
of $210,424.38. Report placed on file.
The Clerk presented the Building Report for the month of October, 1971,
showing building permits for 13 new dwellings during that month. Report
placed on file.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
The Clerk read a communication from the City Plan Commission directed
to the Common Council, dated November 8, 1971, regarding proposed
amendments to the Zoning Ordinance, Communication referred to the
Rules, Laws & Ordinance Committee.
Ald. Foldy moved for the reconsideration of Resolution #209-71, As
Amended, for the purpose of again discussing the $250.00 assessment per l dwelling. The .motion lost for lack of a second.
ADJOURNMENT
Ald. Burgermeister moved to adjourn. Seconded by Ald. DeBack, motion
carried. The meeting adjourned at 9:53 P.M.
