ccm19710928COMMON COUNCIL CITY Or MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 28, 1971 Ma~yor Gottfried called the meeting to order at 7~30 P.M. * PRESENT: Mayor Jerome Gottfried, Aldermen Burgermeister, DeBack, Dumke, Foldy, Narlock, Sapp and Schaumberg. Also present were City Clerk Bette Bowyer and City Attorney John Buckley. APPROVAL OF MINUTES - Ald. Narlock moved for the approval of the Common Council minutes of meetings held on September 14th and the adjourned meeting of September 21, 1971, as mailed and that they be placed on file. Seconded by Ald. Dumke. Motion carried. COMMITTEE REPORTS Ald. Burgenneister presented the report of the Finance Committee meeting held on September 22, 1971, and moved that the report be accepted and placed on file. Seconded by Ald. Sapp, motion carried. Ald. DeBack presented the report of the Public Works Committee meeting held on September 23, 1971, and moved that the report be accepted and placed on file. Seconded by Ald. Burgermeister. Ald. Burgermeister a reported that as of this date all street and drainage problems in the Parkland Plaza Development are up to date. The motion to accept the report carried. Ald. Schaumberg presented the report of the Public Safety Committee meetingsheld on Sept. 16 &20;,1971, and moved that the reporis be accepted and placed on file. Seconded by Ald. Sapp, motion carried. Ald. Schaumberg presented the report of the Public Sewer/Welfare Committee meeting held on September 23, 1971, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Ald. Dumke presented the report of the Rules, Laws & Ordinance Committee meeting held on September;16, 1971, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. The minutes of the Plan Commission meeting held on September 21, 1971, were received and placed on file. UNFINISHED BUSINESS Resolution #ll-71 - Authorizing Conveyance of Land to Frank DeAngelis. Ald. DeBack moved that same be deferred until the next meeting of the Council. Seconded by Ald. Burgermeister, motion carried. NEW BUSINESS Resolution #189-71 - The Clerk read same, entitled, Rejection of Bids for City-owned Land (Fountainwood Lots and 5.5 Acres on Durham Dr.) Ald. Narlock moved for adoption, seconded by Ald. Sapp. Following discussion of the various bidding methods used, upon a roll call vote, the motion to adopt Resolution $1189-71 carried unanimously. Resolution #190-71 - The Clerk read same, entitled, Granting Variances and Approval of Legal Lot Status (A. Spirer) Ald. DeBack moved for adoption, seconded by Ald. DeBack moved for l adoption, seconded by Ald. Burgenneister. Upon a roll call vote, Aldermen Burgermeister, DeBack, Dumke, Foldy, Narlock and Schaumberg voted vaye". Ald. Sapp voted "nay". The motion to adopt Resolution #191-71 carried. Resolution i/192-71 - The Clerk read same, entitled, Granting Variances and Approval of Legal Lot Status (Zangerle) Ald. DeBack moved for adoption, seconded by Ald. Burgermeister. At 8:20 P.M. Mayor Gottfried declared a recess and the meeting reconvened at 8~24 P.M. Upon a roll call vote, the motion to adopt Resolution #192-71 carried unanimously. Resolution j/193-71 - The Clerk read same, entitled, Directing City Attorney to Draft an Ordinance to Amend the City of Muskego Zoning Ordinance (Honeck - Sec. 34) Ald. DeBack moved for adoption, seconded by Ald. Burgermeister. Upon a roll call vote, the motion carried l unanimously. Resolution f/194-71 - The Clerk read same, entitled, Authorizing Necessary Transfer of Funds. Ald. Sapp moved for adoption, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #195-71 - Ald. Sapp moved to suspend the rules that would interfere with the adoption of Resolution #195-71, seconded by Ald. Dumke. Upon a roll call vote to suspend the rules, the motion carried unanimously. The Clerk read same, entitled, Recommendation to County Board Redistricting of Supervisory Districts. Ald. Sapp moved for adoption, seconded by Ald. Dumke. Upon a roll call vote, the motion to adopt carried unanimously. Resolution f/196-71 - Directing the City Attorney to Draft Ordinance for Rezoning in Sec. 17. (Rudolph & Moore) Ald. DeBack moved to suspend the rules that would interfere with the adoption of Resolution f/196-71. Seconded by Ald. Burgermeister. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read the resolution. Ald. Narlock moved for adoption, seconded by Ald. Burgenneister. Ald. Sapp moved to amend the 2nd paragraph of the resolution by adding the words "for future consideration by the Council". Seconded by Ald. Foldy. After discussing the need for positive action by the Council to permit the consummation of the land sales, Ald. Sapp, with the consent of her second, withdrew her amendment. Upon a roll call vote, the motion to adopt Resolution #196-71 carried unanimously. VOUCHER APPROVAL - Ald. Burgermeister moved to approve the payment of general vouchers in the amount of $93,502.70, seconded by Ald. Narlock. Upon a roll call vote, the motion to pay the vouchers carried unanimously. Ald. Narlock moved for the approval of payment of sewer utility vouchers in the amount of $16,268.67. Seconded by Ald. Sapp,and upon a roll call vote, the motion to pay the sewer utility vouchers carried unanimously. LICENSE APPROVAL - Ald. Narlock moved for the approval of Class "B" e Fermented Malt Beverage & Intoxicating Liquor License for William Hackett. Seconded by Ald. Burgermeister. Sapp moved for the approval of Operators License for Rosalie Graikowski and Ronald Millious pending receipt of favorable Fingerprint Report. Seconded by Ald. Burgermeister. Motion carried. for Donald Dalzell Ald. Burgermeister moved for the approval of Operators License/pending receipt of favorable Medical and Fingerprint Reports. Seconded by Ald. Narlock, motion carried. Ald. Burgermeister moved for the approval of a Garbage Refuse Permit for Thomas Disposal. Seconded by Ald. Narlock, motion carried. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Mayor Gottfried advised that he has received official notice from the Dept. of Natural Resources that a carp removal program will take place during the winter and until such time all fishing restrictions on Little Muskego Lake have been removed. Mayor Gottfried reported on the city's application to the Emergency l Employment Act of 1971. The Clerk read a communication from Marcella Larsen and Leona Wollman, dated Sept. 24, 1971, directed to the Common Council concerning the 9% acre tract of land on Pioneer Drive.
