MINUTES OF MEETING HELD MAY 25, 1971
Mayor Gottfried called the meeting to order at 7~47 P.M. l PRESENT: Mayor Jerome Gottfried, Aldermen Robert Burgermeister,
Harold DeBack, Edwin Dumke, Charles Foldy, Frank Narlock, Lois Sapp
and Paul Schaumberg. Also present were City Clerk Bette Bowyer
and City Attorney John Buckley.
Ald. Sapp moved for the approval of the Common Council meeting held
on May 11, 1971, as mailed, and that they be placed on file. Seconded
by Ald. Narlock. Motion carried.
Ald. Sapp presented the reports of the Finance Committee meetings
held on May 19th and May ZSth, 1971, and moved that the reports be
accepted and placed on file. Seconded by Ald. Narlock, motion carried.
Ald. DeBack presented the report of the Public Works Committee meeting
held on May 20, 1971, and moved that the report be accepted and placed
on file. Seconded by Ald. Burgenneister. Motion, carried.
l Ald. Sapp presented the report of the Public Safety Committee meeting
held on May 13, 1971, and moved that the report be accepted and placed
on file. Seconded by Ald. Dumke, motion carried.
Ald. Dumke presented the report of the Rules, Laws & Ordinance Committee
meeting held on May 13, 1971, and moved that the report be accepted and
placed on file. Seconded by Ald. Narlock, motion carried.
Ald. Schaumberg presented the report of the Public Sewer/Welfare
Committee meeting held on May 20, 1971, and moved that the report
be accepted and placed on file. Seconded by Ald. DeBack, motion
carried.

COMMUNICATIONS FROM TBE MAYOR'S OFFICE
Mayor Gottfried advised that on June 3, 1971, at 6:30 P.M. at the
Holiday Inn - Central, Milwaukee, Wis., the Wis. League of Municipalites
a will hold a meeting for the purpose of discussing Governor Lucey's
proposed changed in the redistribution of aids to communities. He
invited all Aldermen to attend.
Mayor Gottfried advised that a bill (#A 889) is pending before the
Legislature which would prohibit governmental bodies from charging
for ambulance service. He suggested that the matter be discussed
at the next Public Safety Committee meeting.
Mayor Gottfried officially declared the Week of May 31st thru June 5th,
1971, to be Muskego's "Clean and Green Week"
NEW BUSINESS
Resolution #99-71 - The Clerk read same, entitled, Authorizing the Public
Works Committee to Seek Quotations for Fuel Oil and Gasoline for City
Departments. Ald. Burgermeister moved for adoption, seconded by Ald.
DeBack. Upon a voice vote, motion carried.

Resolution #lOO-71 - The Clerk read same, entitled, Directing City Attorney
to Draft an Ordinance to Provide for Increase of Fees for Licenses 6
Permits. Ald. Narlock moved for adoption, seconded by Ald. Sapp. Ald.
Burgermeister moved to defer action on Resolution #lOO-71 in order to
give the Aldermen more time to further study the proposed resolution
Seconded by Ald. Sapp. Upon a voice vote, the motion to defer action
on Resolution #lOO-71 for two weeks carried.
Resolution #lOl-71 - The Clerk read same, entitled, Authorizing the
Advertising of Bids for Treatment Plant in the Northeast District.
Aid. DeBack moved for adoption, seconded by Ald. Schaumberg. In
answer to a question from Ald. Narlock, Mayor Gottfried advised that
as soon as the Root River Water Basin Study is approved by the Environ-
mental Protection Agency, Federal Funds to aid in the construction of
the treatment plant would be released to the City. Upon a roll call
vote, the motion to adopt Resolution #lOl-71 carried unanimously.
Resolution #102-71 - The Clerk read same, entitled, Declaring Intent
Not to Participate in the Wisconsin Unemployment Compensation Act.
Ald. Burgenneister moved for adoption, seconded by Ald. Narlock.
Upon a roll call vote, the motion to adopt carried unanimously.
Resolution #103-71 - The Clerk read same, entitled, Authorizing the
Advertising of Bids for Lateral Rook-up in Sewer District "A" (Lakeside
Took Building and Residence) Ald. Foldy moved for adoption. Seconded
by Ald. DeBack. Upon a roll call vote, the motion carried unanimously.
Resolution #104-71 - The Clerk read same, entitled, Directing City Attorney
to Draft Ordinance to Amend the Zoning Ordinance of the City (Former
Checkerway Bus Co. Building on Janesville Rd.) Ald. DeBack moved for
adoption, seconded by Ald. Burgermeister. Mayor Gottfried then turned
the Chair over to Council President Burgermeister in order that he could
voice his objection to the adoption of the proposed resolution. He
suggested that it be referred back to the Plan Commission to consider
enlarging the area of the rezoning and that the City Attorney could
investigate the ramifications of spot zoning. Ald. DeBack spoke in
favor of the adoption of Resolution #104-71. Upon a roll call vote,
the motion to adopt Resolution #104-71 carried unanimously.
At 8:35 P.M. Mayor Gottfried declared a recess of the regular meeting
in order that a Council Meeting of the Whole could be held for the
purpose of discussing possible development of a portionof the Industrial
Park (Resolutions #105-71 and #106-71).
At 9:ll P.M. the regular meeting of the Council reconvened.
Resolution #105-71 - The Clerk read same, entitled, Authorizing the
Preparation of Road and Sewer Specifications for the Development of
a Portion of the Industrial Park. Ald. Burgenneister moved for adoption.
Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt
carried unanimously.
Resolution #106-71 - The Clerk read same, entitled, Authorizing the
Expenditure of Funds for Signs Advertising the City Industrial Park.
Ald. Burgermeister moved for adoption. Seconded by Ald. DeBack. Upon
a roll call vote, the motion to adopt carried unanimously.
Resolution 8107-71 - Ald. Burgermeister moved to suspend the rules in
order that Resolution #107-71 could be brought to the floor. Seconded
by Ald. Foldy. Upon a roll call vote, the motion to suspend the rules
carried unanimously. The Clerk read same, entitled, Authorizing the
Release of the Bond for the Former Joseph Magarich Gravel Pit ($500.00
Restoration Bond) Ald. Foldy moved for adoption of same, seconded by
Ald. Burgermeister. Ald. DeBack requested to abstain from voting on

Resolution #107-71. As there were po objections, permission was
granted. Upon a roll call vote, the motion carried unanimously.
Ordinance #lY3 - The Clerk gave the first reading of Ordinance 8193,
entitled, An Ordinance to Amend Ordinance #161, As Amended, Establish-
ing a Muskego Watershed Commission.
VOUCHER APPROVAL - Ald. Sapp moved for the approval of payment of
general vouchers in the amount of $586,364.98, payable May 25, 1971.
Seconded by Ald. Narlock. Upon a roll tail vote, the motion to
pay the vouchers carried unanimously.
Ald. Sapp moved for the approval of payment of sewer utility vouchers
in the amount of $164.34 and the payment of sewer vouchers in the
amount of $22,526.00, payable May 25, 1971. Seconded by Ald. Narlock.
Upon roll call, the motion carried unanimously.
LICENSE APPROVAL - Ald. Sapp moved for the approval of Operator's
License for Gordon Herda, John Lee Sparks and Norman Bashirian,
subject to approval of favorable Medical and Fingerprint Reports
Seconded by Ald. Narlock. Motion carried.
Ald. Sapp moved for the approval of Operators License for Ross G.
Crow, subject to receipt of favorable Medical and Fingerprint Reports.
Seconded by Ald. Burgermeister. Motion carried.
Ald. Sapp moved for the approval of the list of applications for Class
"A" & "B" Fermented Malt Beverage and Intoxicating Liquor Licenses
as per the list attached to the Finance Committee Minutes.of meeting
held on May 19, 1971. Seconded by Ald. Burgenaeister. Upon a voice
vote, motion car&&d.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
Ald. Narlock moved to initiate a petition and to set the public
hearing date to rezone property in the NE% of Sec. 25 from R-3 to
R-3 with an OIP Overlay to permit construction and operation of
a fire station (Shy Property) for June 22, 1971, at 7:00 P.M.
Seconded by Ald. DeBack, motion carried, Petition referred to Plan
Commission.
The Clerk read a communication directed to the Mayor and Council,
dated 5124171 from Bernard Lindner, requesting legal lot status of
Lots 6, 7 & 8 of the Michi Plat. Communication referred to Plan
Commission for recommendation.
The'Clerk read a petition from Harold R. DeBack and Jean Wallner
requesting rezoning in Section 12 from I-2 and RS-3 to RSA with
Overlay Planned Development. Petition referred to Plan Commission.
The Clerk read an adopted motion by the Watershed Commission at their
meeting of 5/10/71, requesting consideration of the Common Council of
the revised.Land Division Ordinance, as prepared by SEWRPC with the
proposed Sedimentation, Floodland and Shoreland Regulations, with the
recommendation of the Watershed Conrmission that the Sedimentation,
Floodland and Shoreland Regulations, be approved. Motion referred
to the Rules, Laws & Ordinance Committee and the Plan Commission.
ADJOURNMENT - Ald. DeBack moved to adjourn. Seconded by Ald. Narlock.
Motion carried. The meeting adjourned at 9:18 P.M.
