MINUTES OF MEETING HELD APRIL 27, 1971
Mayor Gottfried called the meeting to order at 7~32 P.M.
PRESENT: Mayor Jerome Gottfried, Aldermen Robert Burgermeister,
Harold DeBack, Edwin Dumke, Charles Foldy, Frank Narlock, Lois
Sapp and Paul Schaumberg. Also present were City Clerk Bette J.
Bowyer and Assistant City Attorney Joseph Wimmer.
MINUTES - Ald. Narlock moved that the minutes of the meeting held
on April 13, 1971, be accepted and placed on file. Seconded by
Ald. Sapp, motion carried.
Ald. Sapp moved that the minutes of the Organizational Meeting held
on April 20, 1971, be accepted and placed on file. Seconded by Ald.
Foldy, motion carried.
Ald. Sapp presented the report of the Finance Cormnittee meeting
held on April 21, 1971, and moved that the report be accepted and
placed on file. Seconded by Ald. Narlock, motion carried.
Ald. Foldy presented the report of the Public Safety Cormnittee
meeting held on April 15, 1971, and moved that the report be accepted
and placed on file. Seconded by Ald. Sapp, motion carried.
Ald. Foldy presented the report of the Rules, Laws & Ordinance
Committee meeting held on April 15, 1971, and moved that the report
be accepted and placed on file. Seconded by Ald. Narlock, motion
carried.
The minutes of the Plan Commission meeting held on April 20, 1971,
were received and placed on file.
UNFINISHED BUSINESS
The Clerk read the Mayor's Veto Message of Resolution #70-71, entitled
Authorizing the Hiring of Part-time Help for Engineering Department.
Ald. Burgermeister moved to sustain the Mayor's veto of the resolution.
Seconded by Ald. Foldy. Upon a roll call vote to sustain the veto,
the motion carried unanimously.
The Clerk read the Mayor's Veto Message of Ordinance #179-A, entitled,
An Ordinance to Repeal and Recreate Ordinance #179 (Re: Trespassing on
Land or Buildings) Ald. Sapp moved to sustain the Mayor's veto of the
ordinance. Seconded by Ald. Schaumberg. Mayor Gottfried explained that
he vetoed Ordinance #179-A because of informalities at the time of the
previous adoption. Upon a roll call vote, the motion to sustain the
veto carried unanimously.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
At this time Mayor Gottfried announced the following appointments to
the standing committees of the Common Council: Finance Committee,
Robert Burgenneister, Frank Narlock and Lois Sapp. Public Works
Committee, Robert Burgermeister, Harold DeBack and Charles Foldy.
Rules, Laws & Ordinance Committee, Frank Narlock, Edwin Dumke and
Charles Foldy. Public Safet Committee, Lois Sapp, Chairman, Edwin
Dumke and Paui Schaumberg. Public Sewer/Welfare Committee Charles
Foldy, Chairman, Paul Schaumberg and Harold DeBack. Building Committee,

The Clerk read a Proclamation designating May 2 to 8, 1971, as "Be
Kind to Animals Week".
The Clerk read a Proclamation from Mayor Gottfried urging all
citizens to support the VFW Poppy Sale this month as evidence
of their gratitude to the servicemen of this country for their sac- rifices.
NEW BUSINESS
Ordinance #179-A - An Ordinance to Repeal & Recreate Ordinance #179.
(Re: Trespass Ordinance). The Clerk gave the first reading of Ordinance
#179-A. Ald. Narlock moved to suspend the rules in order to halve the
second reading of the ordinance. Seconded by Ald. Burgermeister.
Upon a roll call vote to suspend the rules, the motion carried
unanimously. The Clerk gave the second reading of Ordinance 8179-A.
Ald. Narlock moved for the adoption of same. Seconded by Ald.
Foldy. Upon a roll call vote, the motion to adopt Ordinance #179-A
carried unanimously.
Resolution j/73-71 - The Clerk read same, entitled, Declaring Certain
Weeds to be Noxious Within the Boundaries of the City of Muskego.
Ald. DeBack moved for adoption, seconded by Ald. Burgermeister.
Upon a voice vote, motion carried.
Resolution i/74-71 - The Clerk read same, entitled, Appointment of
Weed Commissioner for the City of Muskego. (Willard Bertram). Ald.
Sapp moved for adoption, seconded by Ald. Foldy. Upon a roll call
vote, the motion carried unanimously.
Resolution #75-71 - The Clerk read same, entitled, Authorizing the
Advertising of Bids for Official Newspaper for the City of Muskego.
Ald. Narlock moved for adoption, seconded by Ald. Burgermeister.
Ald. Sapp moved to amend Resolution $175-71 by changing the wording
"Cormnon Council" to "City Clerk" in the second paragraph. Seconded
by Ald. Narlock. Upon a voice vote, the motion to amend Resolution
#75-71 carried. Upon a roll call vote, the motion to adopt Resolution
i/75-71 carried unanimously.
Resolution 1176-71 - The Clerk read same, entitled, Appointment of
Citizen Member to Police & Fire Commission (William Ahrens). Ald.
Burgenneister moved for adoption, seconded by Ald. DeBack. Upon a
roll call vote, the motion to adopt carried unanimously.
Resolution $177-71 - The Clerk read same, entitled, Appointment
of Alderman to Library Board ( Ald. Narlock) Ald. Foldy moved for
adoption, seconded by Ald. Sapp. Upon a roll call vote, the motion
to adopt cacried unanimously.
Resolution i/78-71 - The Clerk read same, entitled, Appointment of
Alderman to Park & Recreation Board (Burgermeister) Ald. DeBack
moved for adoption, seconded by Ald. Schaumberg. Upon a roll call
vote, the motion to adopt carried unanimously.

e Resolution #79-71 - The Clerk read same entitled, Appointment of
Citizen Member to Plan Commission (William Chase) Ald. Foldy moved
for adoption. Seconded by Ald. Burgermeister. Ald. DeBack requested
a ballot vote. Mayor Gottfried appointed Mrs. Vi Joy as Ballot Clerk.
The result of the ballot vote was four (4)"Yes" votes for William
Chase and three (3) "no" votes for Mr. Chase. The motion to adopt
Resolution 1179-71 carried.
Resolution #80-7l- - The Clerk read same, entitled, Determination of
Legal Lot Status, (Melvin Coe) Ald. DeBack moved for adoption,
seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt
carried unanimously.
Resolution i/81-71 - The Clerk read same, entitled, Denying the
Application of William Kassulke to Rezone Certain Parcels of land
in Section 5 (Gold Drive) Ald. DeBack moved for adoption, seconded
by Ald. Burgermeister. Upon a roll call vote, the motion to adopt
carried unanimously.
l Resolution i/82-71 - The Clerk read same, entitled, Directing Citv
Attorney to Draft Amendment to Zoning Ordinance (Re: B-3 Distict)
Ald. Narlock moved for adoption. Seconded by Ald. Burgermeister.
Upon a roll call vote, the motion to adopt carried unanimously.
Resolution #83-71 - The Clerk read same, entitled, Appointment to
Board of Appeals (Gerald Fohr and John Anderson) Ald. Burgermeister
moved for adoption. Seconded by Ald. Sapp. Upon a roll call vote,
the motion to adopt carried unanimously.
Resolution #84-71 - The Clerk read same, entitled, Appointment to
Watershed Commission (Daniel P. Amann, Ronald Ford and Ald. Edwin
P. Dumke) Ald. Sapp moved for adoption, seconded by Ald. DeBack.
Upon a roll call vote, the motion to adopt carried unanimously.
Resolution f/86-71 - Ald. Narlock moved to suspend the rules in order
that Resolution y/86-71, entitled, Expressing Di.sapproval of,School
Aid Distribution Formula as Provided in Governor's Budget. Seconded
by Ald. Dumke. Upon a roll call vote, the motion to suspend the rules
l carried unanimously. The Clerk read the resolution. Ald. Dumke moved
for adoption. Seconded by Ald. Narlock. Upon a roll call vote, the
motion to adopt carried unanimously.
VOUCHER APPROVAL - Ald. Sapp moved for the approval of payment of
vouchers in the amount of $338,410.49, payable April 27, 1971. Seconded
by Ald. Narlock. Upon a roll call vote, the motion carried unanimously.
Ald. Sapp moved for the payment of sewer vouchers in the amount of
$9,855.93, payable April 27, 1971. Seconded by Ald. Narlock. Upon
a roll call vote, the motion carried unanimously.
LICENSE APPROVAL - Ald. Sapp moved for the approval of Operator's
Licenses for Wilma Kapetanich and Alois J. Dombrowski, subject to
receipt of favorable Fingerprint Reports. Seconded by Ald. Narlock.
Upon a voice vote, motion carried.

l Ald. Narlock moved for the approval of Operator's License for
Bonnie Jean Graczyk subject to receipt of favorable Medical and
Fingerprint Report. Seconded by Ald. Sapp. Upon a voice vote,
motion carried.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
The Clerk read a communication from Lester Fohr, Post Commander
of the American Legion Muskego Post #356, directed to the Mayor
and Common Council, dated April 25, 1971, indicating their offer
to donate an American Flag, Flag Pole, Decorative Stone and a
"Flame of Freedom Torch" for the new City Hall. Communication
referred to the Building Committee Chairman.
The Clerk read a petition dated April 26, 1971, from Alvin Fried,
Richard Zach and Paul Rllrbach, requesting an amendment to the
districting map in Section 3. Ald. Burgermeister moved to set
the public hearing for the petition for May 25, 1971, at 7:00 P.M.
Seconded by Ald. DeBack. Upon a voice vote, motion carried.

ADJOURNMENT - Ald. Narlock moved to adjourn the meeting. Seconded
by Ald. Schaumberg, motion carried. The meeting adjourned at
a:32 P.M.

To the Honorab le A ldermen of the City of Muskego
Gentlemen:'
On April 13, 1971, your Honorable Body adopted Ordinance
#179-A which covered illegal trespassing on land or buildings.
Although I have no objection to the ordinance as adopted by
the Council, the procedure under which it was adopted was contrary
to the Council's Rules of Order and therefore, there is a question
in my mind as to the validity of the ordinance as it was adopted.
As a result, I have chosen to veto Ordinance #179-A in order that
it may be reintroduced and properly adopted pursuant to the
Council's Rules of Procedure.
You will note that Ordinance #179-A, of copy of which you
received several days ago, is now on the agenda for adoption.
If you wish it to be adopted on April 27th, it will be necessary
to suspend the rules which require two readings of all ordinances.
I trust that you will uphold my veto and thus provide for
the proper adoption of Ordinance 8179-A.

To the Honorable Aldermen of the City of Muskego
Gentlemen:
On April 13, 1971, the Common Council of the City of
Muskego adopted Resolution $170-71 which authorized the hiring of
part-time help for the Engineering Department. Because I have
some misgivings of the wisdom of your decision and in the hope
that I will be able to convey to you my concerns in this matter
and thus permit you to take another look at your action, I have
chosen to veto Resolution 1170-71.
There are several reasons why I have chosen to veto
Resolution #70-71, one of which involves proper procedure of
the Council in the hiring of additional personnel, particularly
since it was not budgeted for. As you know, Chapter II of the
Administrative Code establishes the standing committees of the
Council and their areas of responsibility. The Finance Committee
is charged with the responsibility of solving personnel problems
and the normal procedure in the hiring of additional personnel
would be for the Council to receive a recommendation from the
Finance Committee. This recommendation would have to include
suggested salary among other things. Resolution #70-71 was not
reviewed by the Finance Committee and thus no specific salary was
provided.
Another reason why I have chosen to veto Resolution 870-71
was my concern over the creation of the position even of limited
hours when it was not budgeted for. The need for a part-time
person to help out in the Engineering Department was carefully
evaluated at budget time and it was decided that it would be vise
to have the new Engineer work without his own secretarial help
for 1971. It was our feeling at the time of discussion that if
the one office girl who serves the Building Inspector and the
Plumbing Inspector could not handle the additional duties required
by the Engineer, there were certainly sufficient number of girls
at city hall who could be available when needed by the Engineering
Department.
The wisdom of this decision is made very clear by the
willingness of the City Clerk to provide to the Engineer, on a
part-time basis, a girl from her office to file and handle the
necessary correspondence going in and out of the Engineer's Office.
Obviously, the money involved is not of such an amount as
to create a financial problem for the city, however, I think it
behooves all of us to do what we can to, first, live by a budget
which we all accepted, and secondly, not to set any precedent of
hiring personnel not planned for unless absolutely necessary, and
finally, taking advantage of the office personnel presently working
for the city in order that we can be sure that we are using them
to the fullest extent.
I sincerely hope that you will consider the things pointed
out in this message and will sustain my veto of Resolution #70-71.
