ccm19710126COMM0N.COUNCI.L CITY OF MUSKEGO MINUTES OF MEETING HELD JANUARY 26, 1971 * Mayor Gottfried called the meeting to order at 7~35 P.M. PRESENT: Mayor Jerome Gottfried, Aldermen Robert Burgermeister, John Dwyer, Charles Foldy, Frank Narlock, Harold DeBack, Lois Sapp and Walter Wollman. Also present were City Clerk Bette Bowyer and City Attorney John P. Buckley. MINUTES: - Ald. Dwyer moved to approve the minutes of the meeting held on January 12, 1971, as mailed. Seconded by Ald. Narlock. Motion carried. Ald. Sapp presented the report of the Finance Committee meetings held on January 12 and January 20, 1971, and moved that the reports be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Ald. DeBack presented the report of the Public Works Committee meeting held January 21, 1971, and moved that the report be accepted and placed on file. Ald. Narlock questioned the City's policies on the plowing a of private driveways. Ald. Wollman explained the concern of the Public Works Committee and indicated that the Committee would attempt to establish a firm policy in the near future. The motion to accept the report had been seconded by Ald. Wollman and the motion carried. Ald. Foldy presented the report of the Public Safety Cormnittee of l/14/7and moved that the report be accepted and placed on file. Seconded by Ald. Sapp and the motion carried. Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee meeting held January 14, 1971, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock. Motion carried. Ald. Burgermeister presented the reports of the Public Sewer Committee meeting held on January 13 and January 20, 1971, and moved that the reports be accepted and placed on file. The minutes of the Plan Commission meeting held on January 19, 1971, 0‘ were received and placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Mayor Gottfried advised that there will be a Joint Meeting of the Plan Commission and the Common Council on February 15, 1971, at 7:30 P.M. for the purpose of discussing the status of Muskego's planning. UNFINISHED BUSINESS Ordinance #189 - The Clerk gave the second reading of Ordinance #189, entitled, An Ordinance Providing for Payment of Compensation to Assistant City Attorney. Ald. Sapp moved for the adoption of same, seconded by Ald. Dwyer. Upon a roll call vote the motion to adopt Ordinance #189 carried unanimously. Resolution #6-71 - Accepting Quit Claim Deed for the Extension ofEast Drive from Raymond Wallner (Deferred from meeting of l/12/71) Upon the advice of the City Attorney, Ald. Sapp moved to again defer action on e this resolution for two weeks. Seconded by Ald. Foldy. Upon a voice vote, the motion to defer carried. COMMON COUNCIL - l/26/71 City of Muskego Page 2. l l c NEW BUSINESS Ordinance #190 - The Clerk gave the first reading of Ordinance l/190, entitled, An Ordinance to Amend the Zoning Ordinance of the City (Re: Procedure for Planned Development) Resolution i/11-71 - The Clerk read the resolution, entitled, Renewing Maintenance Agreement for Savin Copier for Police Dept. Ald. Narlock moved for adoption, seconded by Ald. Sapp. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #12-71 - The Clerk read same, entitled, Granting a Permit to Payne & Dolan to Operate a Portable Asphalt Plant on Crowbar Dr. Ald. Foldy moved to adopt Resolution j/12-71, seconded by Ald. Burger- meister. Upon a voice vote, motion carried. Resolution #13-71 - The Clerk read the resolution, entitled, Authorizing the Preperation of an Operating Manual for the Sewer System. Ald. Wollman moved for adoption, seconded by Ald. Sapp. In answer to questions from Ald. Dwyer, Mayor Gottfried explained that the adoption of this resolution and the following one are a requirement of the Federal Government in order that the City would be eligible for additional available funds. Upon a voice vote, the motion to adopt Resolution i/13-71 carried. Resolution 1114-71 - The Clerk read same, entitled, Confirming the Existance of a Separate Construction Account for Project WPC-WIS-511. Ald. Wollman moved for adoption, seconded by Aid. Sapp. Upon a voice vote, the motion to adopt carried carried. Resolution j/15-71 - Advertising ob Bids moved for adoption, carried. The Clerk read same, entitled, Authorizing the for New Highway Truck and Pickup Truck. Ald. Wollman seconded by Ald. DeBack. Upon a voice vote, motion Resolution 1116-71 - for the Purchase of The Clerk read same, entitled, Accepting the Bid Three Squad Cars. Ald. Sapp moved for adoption, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt Resolution #16-71 carried unanimously. Resolution #17-71 - The Clerk read same, entitled, Providing for an Advisory Referendum for the Construction of a Municipal Building. Ald. Foldy moved for adoption, seconded by Ald. Sapp. Following considerable discussion and a suggestion from Alderman Wollman that a special Inform- ational Committee of members of the Council be a,ppointed, Ald. Dwyer moved to defer action on Resolution 1117-71 for two weeks. Seconded by Ald. Foldy. Upon a voice vote, the motion to defer carried. (Mayor Gottfried appointed Aldermen Burgermeister, Wollman and Dwyer to serve on the Informational Committee) Resolution #18-71 - The Clerk read same, entitled, Confirmation of Appoint- ment of Engineer for the City of Muskego (Clark Barry). Ald. Wollman moved for the adoption of Resolution $118-71. Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. Resolution i/19-71 - The Clerk read same, entitled, Establishing Deferred Assessment Policies. Ald. Burgermeister moved for adoption, seconded by Ald. Narlock. Ald. Burgenneister moved to defer action on Resolution #19-71 and to refer same to the City Attorney and Sewer Committee. Seconded by Ald. Wollman. Upon a voice vote, the motion carried. At 8:40 P.M. Mayor Gottfried declared a recess and the meeting reconvened at 8:55 P.M. Resolution #20-71 - The Clerk read same, entitled, Approval of Agreement _ Between City of Muskego and Police Dept. Dispatchers. Aid. Dwyer moved for adoption, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. Wollman moved to suspend the rules that would interfere with the adoption of Resolution #21-71. Seconded by Ald. Burgermeister. Upon a roll call vote to suspend the rules, the motion carried unanimously. The Clerk read the resolution. Ald. Wollman moved for the adoption of Resolution #21-71. Seconded by Ald. Burgermeister. Upon a roll call vote, the motion to adopt carried unanimously. VOUCHER APPROVAL - Ald. Sapp moved for the approval of payment of vouchers in the amount of $97,439.39, payable January 26, 1971. Seconded by Ald. Narlock. Upon a roll call vote, the motion to pay the vouchers carried una~nimously. LICENSE APPROVAL- Ald. Sapp moved for the approval of an Operato License for Randolph Anderson, subject to receipt of favorable Medical Report. Seconded by Ald. Narlock. Motion carried. Ald. Narlock moved for the approval of an Operator's License for James Budish and Emmet Mather. Seconded by Ald. Wollman. Motion carried. a Ald. Wollman moved for the approval of an Operator's License for Thomas C. Kramer, subject to receipt of favorable Medical and Fingerprint Reports. Seconded by Ald. Sapp. Motion carried. Ald. Sapp moved for the approval of an Operator's License for Thomas F. Grzechowiak, subject to receipt of favorable Medical and Fingerprint Report. Seconded by Ald. Narlock. Motion carried. Ald. Sapp moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Emmett Mather and Steve Hall, subject to the necessary ~advertising. Seconded by Ald. Narlock. Motion carried. CITY OFFICIAL'S REPORTS - The Annual Building Report for 1970 was received and placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS 0 The Clerk read a petition from William Kassulke requesting a zoning change in Sec. 5 from RS-3~ to RS-A. Ald. Wollman moved to set the Public Hearing date for the proposed rezoning for February 23, 1971, at 7:00 P.M. Seconded by Ald. Sapp. Motion carried. Petition referred to Plan Commission. The Clerk read a communication directed to the Mayor, the Common Council and the Public Sewer Committee, dated January 25, 1971, from Jean B. Wallner, Harold DeBack, owners of land in Sec. 12, and Raymond Wallner, their Agent, requesting that the lands owned by them adjacent to McShane Road, be serviced by the Northeast District Sewer System.
