MINUTES OF MEETING HELD DECEMBER 22, 1970
Mayor Gottfried called the meeting to order at 7~30 P.M.
PRESENT: Mayor Jerome Gottfried, Aldermen Robert Burgenneister, John
Dwyer, Charles Foldy, Frank Narlock, Harold DeBack, Lois Sapp and Walter
Wollman. Also present were City Clerk Bette Bowyer and City Attorney
John P. Buckley.
MINUTES: Ald. Sapp moved to approve the minutes of meeting held on
December 8, 1970, as mailed. Seconded by Ald. Dwyer. Motion carried.
COMMITTEE REPORTS
Ald. Sapp presented the report of the Finance Committee meeting held on
December 16, 1970, and moved that the report be accepted and placed on
file. Seconded by Ald. Narlock, motion carried.
Ald. DeBack presented the report of the Public Works Committee meeting
held December 17, 1970, and moved that the report be accepted and placed
on file. Seconded by Ald. Wollman, motion carried.
Ald. Foldy presented the report of the Safety Committee meeting held on
December 12, 1970, and moved that the report be accepted and placed on
file. Seconded by Ald. Sapp, motion carried.
Ald. Dwyer presented the report of the Public Welfare Committee meeting
held on December 17, 1970, and moved that the report be accepted and
placed on file. Seconded by Ald. Burgenaeister, motion carried.
Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee
meeting held on December 10, 1970, and moved that the report be accepted
and placed on file. Seconded by Ald. Narlock, motion carried.
Ald. Burgermeister presented the report of the Public Sewer Committee
meeting held on December 16, 1970, and moved that the report be accepted
and placed on file. Seconded by Ald. Sapp, motion carried.
UNFINISHED BUSINESS
l Resolution #255-70 - The Clerk read the resolution, entitled, Accepting
the recommendation of the Plan Commission to Deny a Petition to Amend
the Zoning Ordinance and to Rezone Property in Sec. 29 (Beierle) Ald.
DeBack requested permission to abstain from voting and oermission was
granted. Upon roll callto-adopt, the Ald'n unanimously voted "no".Ihe motion
to adopt Resolution #255-70 did not carry. Ald. Dwyer moved to reconsider
Resolution f/255-70. Seconded by Ald. Narlock. Upon a roll call vote
to reconsider, Aldermen Burgermeister, Dwyer, Narlock, Sapp and Wollman
voted "aye". Aldermen Foldy and Wollman voted "no". Ald. DeBack abstained
from voting. The motion to reconsider carried. Upon a roll call vote to
adopt Resolution #255-70, Aldermen Burgermeister, Dwyer, Narlock and Sapp
voted "aye". Aldermen Foldy and Wollman voted "no". Ald. DeBack abstained

Resolution #260-70 - The Clerk read Resolution #260-70, entitled,
Establishing Traffic Regulations (Oak Grove Drive a One-Way Street).
Ald. Wollman moved to amend Resolution #260-70 by adding the words,
"Oak Grove Drive - Northerly from Lots 5 Through 16 Westerly on the

alley and southerly from Lots 24 through 35. The motion to amend
Resolution #260-70 carried. Upon a roll call vote, the motion to
adopt Resolution #260-70, As Amended, carried unanimously.
Resolution #224-70 - Accepting the Low Bid for Installation of Sewer
Connection (Andrews Plumbing) Ald. Wollman moved to reconsider this
resolution. Seconded by Ald. Dwyer. Upon a roll call vote, the motion

to reconsider Resolution i/224-70 carried unanimously. Upon a roll call vote, the aldermen unanimously voted "no". The motion to adopt did not

Ordinance #186 - An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City ,of Muskego, Wisconsin (Schaefer) In answer to a

question from Ald. Dwyer, Mayor Gottfried advised that the City had had
no further word as to the intentions of Northland Developers for the
development of the property in question. Unon a roll call vote, the
motion to adopt Ordinance #186 was unanimously defeated.
Ordinance #187 - The Clerk gave the second reading of Ordinance #187 (First
reading had been given on November 24, 1970), entitled, An Ordinance to
Rezone Certain Property and to Amend the Zoning Map of the City of Muskego.
(Southern Hts. & Meadowdale Subdivisions). Ald. Wollman moved for adoption.
Seconded by Ald. Sapp. Upon a roll call vote, the motion to adopt Ordinance
#187 carried unanimously.
Resolution #262-70 - The Clerk read Resolution i/262-70, entitled, Author-
izing Lease Agreement With Brookfield National Bank for Safe Deposit
Box. Ald. Narlock moved to adopt, seconded by Ald. DeBack. Discussion
followed as to the wording of the resolution and Ald. Wollman moved to
amend the first paragraph by adding the following words "jointly but not
severally at any one time." Seconded by Ald. Sapp. Upon a voice vote,
the motion to amend carried. Upon a roll call vote, the motion to adopt
Resolution #262, As Amended, carried unanimously.
Resolution f/263-70 - The Clerk read Resolution #263-70, entitled,
Resolution Authorizing Tax Researchers, Inc. to Investigate Income Tax .
Allocations. Ald. Narlock moved to adopt, seconded by Ald. Dwyer.
Upon a roll call vote, the motion to adopt carried unanimously.
Resolution l/264-70 - The Clerk read same, entitled, Requesting Distribution
List for Taxable Years 1968 and 1969. Ald. Narlock moved for adoption,
seconded by Ald. Dwyer. Upon a voice vote, motion carried.
Resolution #265-70 - The Clerk read the resolution, entitled, Approval
of Fire Protection Contract with Tess Corners Fire Dept. Ald. Sapp moved
to adopt, seconded by Ald. Wollman. Ald. Dwyer moved to defer action

on this resolution until the next Council meeting to be held on January 12,
1971. Seconded by Ald. Sapp. Upon a voice vote, the motion to defer
lost. Upon a roll call vote, the motion to adopt Resolution i/265-70
carried unanimously.
Resolution i/266-70 - The Clerk read Resolution i/266-70, entitled, Approval
of Fire'Protection Contract with Muskego Fire Co. Ald. Wollman movedto
adopt, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt
carried unanimously.

Resolution #271-70 - The Clerk read same entitled, Authorizing
Advertising of Bids for Lateral Hook-Up in Sewer District D. Ald.
l Burgermeister moved for the adoption of Resolution #271-70. Seconded
by Ald. Sapp. Upon a roll call vote, the motion to adopt carried
unanimously.
Resolution #272-70 - The Clerk read same, entitled, Establishing Wages and
Insurance Benefits for Sewer Inspectors. Ald. Sapp moved for the
adoption of Resolution #272-70, seconded by Ald. Burgermeister. Ald.
Sapp spoke in favor of the adoption of this resolution. Ald. Wollman
spoke in opposition to the resolution and he moved to amend Resolution
i/272-70 by deleting the third and last paragraph of -the resolution and
the fourth paragraph by changing the words "25 cent per hour increase"
to "35 cent per hour increase". Seconded by Ald. Burgermeister.
Ald. DeBack spoke in favor of the amendment. Upon a roll call vote,
the motion to amend Resolution i/272-70 carried unanimously.

Resolution i/273-70 - The Clerk read same, entitled, Approval to Raymond Otto for Future Sewer Installation. Ald. Burgenneister moved for the
l adoption of Resolution #273-79, seconded by Ald. Wollman. Ald. Wollman
moved to defer action on this resolution until the next meeting of the
Council. Upon a voice vote, the motion to defer carried.
Resolution #274-70 - The Clerk read same, entitled, Accepting Low Bid of
Installation of Sewer Connection. Ald. Burgermeister moved for the
adoption of same. Seconded by Ald. Wollman. The Clerk read a communi-
cation from John M. Couture, directed to the Mayor and Council, dated
December 22, 1970, declaring his intent to move the building in question
on or before June 1, 1971. Ald. DeBack moved to table Resolution
#274-70. Seconded by Ald. Wollman. Upon a roll call vote to table
Resolution i/274-70, Aldermen DeBack, Foldy, Sapp and Wollman voted
"aye". Aldermen Burgenneister, Dwyer, and Narlock voted "no". The
motion to table Resolution #274-70 carried.
At 8:55 P.M. Mayor Gottfried declared a recess and the meeting re-
convened at 9:12 P.M.
0 Resolution 11267-70 - Providing for the Authorization and Issuance of
$715,000.00 Special Assessment B Bonds of the City of Muskego, Wisconsin,
Providing Details for Said Bonds and Providing for the Security and
Payment Thereof. At this time Mr. Jack Baumann, Vice-President of the
Bonding Dept. of the Marine National Exchange Bank, appeared at the
meeting to explain Resolution #267-70 and to answer questions from the
aldermen relating to same. Ald. Burgermeister moved for the adoption
of Resolution 8267-70, seconded by Ald. Wollman. Upon a roll call
vote, the motion to adopt Resolution #267-70 carried unanimously.
At 1O:OO P.M. Mayor Gottfried declared a recess and the meeting re-
convened at lo:09 P.M.
e At this time members of the Public Works Dept. appeared at the meeting
to discuss their 1971 wages and fringe benefits.
LICENSE APPROVAL
Ald. Narlock moved for the approval of Operator's License for Robert
l Layman, subject to receipt of favorable Medical Report. Seconded by
Ald. Sapp. Upon a voice vote, the motion carried.

e- Ald. Wollman moved for the approval of an Operator's License for
Daniel Sullivan. Seconded by Ald. Narlock, motion carried.
Ald. Sapp moved for the approval of an Operator's License for John
w Stachowski, Dolores Deja and Susan Robl, subject to receipt of
favorable Medical and Fingerprint Reports. Seconded by Ald. Wollman,
motion carried.
Ald. Sapp moved for the approval of a Class "B" Fermented Malt Beverage
and Intoxicating Liquor License for Patrycia Wilson. Seconded by Ald.
Narlock, motion carried.
VOUCHER APPROVAL - Ald. Sapp moved for the approval of payment of
general and sewer vouchers in the amount of $328,010.01. Seconded
by Ald. Narlock. Upon a roll call vote, the motion carried unanim-
ously.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
* The Clerk read a communication from the Plan Commission directed to
the Mayor and Council, dated December 8, 1970, regarding the change
of procedure for Planned Development in the Zoning Ordinance. Ald.
Foldy moved that the Common Council initiate the petition and set the
Public Hearing date for the above for January 26, 1971, at 7~15 P.M.
Seconded by Ald. Dwyer, motion carried.
ADJOURNMENT - Ald. Dwyer moved to adjourn the regular meeting and go
into executive session for the purpose of discussing questions that had
been raised by the Public Works Dept. earlier in the evening. Seconded
by Ald. Wollman. Motion carried. The meeting adjourned at lo:41 P.M.
