MINUTES OF MEETING HELD ON NOVEMBER 24, 1970

Mayor Gottfried called the meeting to order at 7~37 P.M.
- PRESENT: Mayor Jerome Gottfried, Aldermen Robert Burgenneister, John
Dwyer, Charles Foldy, Frank Narlock, lois Sapp, Harold DeBack and
Walter Wollman. Also present were City Clerk Bette Bowyer and City
Attorney John P. Buckley.
w MINUTFS: Ald. Burgermeister moved to approve the minutes of the
meeting held on November 10, 1970, as mailed. Seconded by Ald. Sapp,
motion carried.
COMMITTEE REPORTS
Ald. Sapp presented the reports of the Finance Committee meetings held
on November 18, 1970, and moved that the report be accepted and placed
on file. Seconded by Ald. Narlock, motion carried. Ald. Sapp also
presented the report of the Finance Conunittee meeting held on November 10,
1970, and moved that the report be accepted and placed on file. Seconded
by Ald. Wollman. Motion carried.
l Ald. Foldy presented the report of the Public Safety Committee meeting
held on November 12, 1970, and moved that the report be accepted and
placed on file. Seconded by Ald. Sapp, motion carried.
Ald. Dwyer presented the report of the Public Welfare Committee meeting
held on November 19, 1970, and moved that the report be accepted and
placed on file. Seconded by Ald. Burgermeister, motion carried.
Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee
meeting held on November 12, 1970, and moved that the report be accepted
and placed on file. Seconded by Ald. Foldy. Motion carried.
Ald. Burgermeister presented the report of the Public Sewer Comittee
meeting held on November 16, 1970, and moved that the report be accepted
and placed on file. Seconded by Ald. Sapp. Motion carried.
The minutes of the Plan Commission meeting held on November 17, 1970,
were received and placed on file.
e COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried advised that following the adjournment of this meatit%$
there would be a Meeting of the Whole for the purpose of ilitVitl&~Mr. Sam
Lawent present a proposal for a Civic Center.
UNFINISHED BUSINESS
Resolution f/224-70 - Accepting Low Bid for Installation of Sewer Connection
(Andrews Plumbing). Following discussion, Ald. Wollman moved to defer
action on Resolution i/224-70 for two weeks until the owners of the land
and the building in question can be heard. Upon a voice vote, the motion carried. Seconded by Ald. Sapp. (Ald. Burgenneister requested
that it be noted in the minutes that he voted "no".
Resolution l/229.-70 - The Clerk read Resolution #22Y-70, entitled. Authoriz-
ing the City of Muskego to Pay the Total Cost of its Employees .Contribution
to the Wi,sconsin Retirement Fund.(As Amended) As this resolution was alread:
on the floor, the motion to adopt same carried unanimously upon roll call.

Ordinance #186 - An Ordinance to Rezone Certain Property and to Amend
the Zoning Map of the City of Muskego (Schaefer) This ordinance has had two readings and had been deferred from the previous meeting. Ald.
Foldy moved to again defer action on Ordinance l/l86 until after the
next Plan Commission when further discussions could be held with the
developers. Seconded by Ald. Sapp. Upon a voice vote, the motion carried.
NEW BUSINESS
Resolution l/238-70 - The Clerk read the resolution entitled, Extending
Deadline Date for Partial Payment of 1970 Real Estate Taxes. Ald.
Wollman moved for the adoption of Resolution i/238-70, seconded by Ald.
Dwyer. Upon a voice vote, motion to adopt carried.
Resolution i/239-70 - The Clerk read the resolution, entitled, Authorizing
Deferred Assessment on the Fred Farnsworth Sewer Installation in Dist. F-6.
Ald. Wollman moved for the adoption of Resolution #239-70, seconded by
Ald. DeBack. Ald. Wollman moved to amend the second last paragraph by
changing the rate of interest to 8%. Seconded by Ald. DeBack. Upon
a voice vote, the motion to amend Resolution #239-70 carried. Upon a
roll call vote, the motion to adopt Resolution #239-70, As Amended
carried unanimously.
Resolution i/24&-70 - The Clerk read same, entitled, Establishing Salaries
for Elected Officials and Other Employees of the City of Muskego for 1971.
Ald. Narlock moved for the adoption of Resolution #241-70, seconded by Ald.
Wollman. Ald. Wollman moved to defer action on Resolution $241-70,
seconded by Ald. Narlock. Upon a voice vote, the motion to defer carried.
Resolution #242-70 - The Clerk read same, entitled, Authorizing Rental of
AB Dick Copy Machine. Ald. Sapp moved for adoption, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt carried unanimously.
Resolution i/243-70 - The Clerk read same, entitled, Granting Variance
for Two Lots in Tess Corners Industrial Park. Ald. Foldy moved for
the adoption of same, seconded by Ald. Burgermeister. Upon a voice
vote, motion carried.
Resolution #244-70 - The Clerk read same, entitled, Granting Variance
in Subdivision Control Ordinance (D. Miller) Ald. Burgermeister moved
for the adoption of Resolution f/244-70, seconded by Ald. Foldy. Upon a
voice vote, motion to adopt carried.
Resolution j/245-70 - The Clerk read same, entitled, Declaring Legal Lot
Status (Mary Preston) Ald. Foldy moved for the adoption of same. Sec-
onded by Ald. Burgenneister. Upon a roll call vote, the motion to adopt
carried unanimously.
Resolution #248-70 - The Clerk read same, entitled, Rejection of all Bids
for Kurth Park. Ald. Burgermeister moved for the adoption of same,
seconded by Ald. Wollman. Upon a roll call vote, the motion carried
unanimously.
Resolution #249-70 - The Clerk read same, entitled, Approval of Rental
Agreement on Certain Portions of the Former Bluhm Property. Ald. Wollman
moved for the adoption of same, seconded by Ald. Narlock. Upon a roll
call vote, the motion to adopt carried unanimously.

Ordinance #177 - The Clerk gave the first reading of Ordinance i/177,
e entitled, An Ordinance to Create Sec. 12.15 of the Municipal Code (Re: Storage and Use of Explosives Within City)
Ordinance i/l84 - An Ordinance to Amend Sec. 3.05(5) of the Municipal
Code (Re: Capital Budgeting Committee) Ald. Dwyer moved to suspend the l rules that would interfere with the adoption of Ordinance i/184. Seconded
by Ald. Foldy. Upon a roll call vote, the motion to suspend the rules
carried unanimously. The Clerk gave the second.reading of the ordinance.
Ald. Dwyer moved for the adoption of Ordinance i/184. Seconded by Ald.
Foldy. Upon a voice vote, the motion to adopt Ordinance #184 carried.
Ordinance 11188 - The Clerk gave the first reading of Ordinance #X38,
entitled, Appropriating the Necessary Funds for the Operation of the
Government and Administration of the City of Muskego for the year 1971.
At 8:50 P.M. Mayor Gottfried declared a recess and the meeting recon-
vened at 9:08 P.M.
VOUCHER APPROVAL - Ald. Narlock moved for the approval of payment of
0 vouchers in the amount of $243,224.05, payable 11/24/70. Seconded by
Ald. Wollman. Upton a roll call vote, the motion to pay the vouchers
carried unanimously.
LICENSE APPROVAL - Ald. Sapp moved for the approval of Operator's
Licenses for Fred Giesegh and FrankSzalkowski, subject to receipt of
favorable Fingerprint Report. Seconded by Ald. Narlock. Upon a voice
vote, motion carried.
Ald. Sapp moved for the approval of Class "B" Fermented Malt Beverage
and Intoxicating Liquor License for Richard G. Smith and John Collins.
Seconded by Ald. Wollman. Upon a voice vote, motion carried.
Ald. Wollman moved to transfer the Class "B" Fermented Malt Beverage
and Intoxicating Liquor License held previously by Robert Brinkmeier,
deceased, to Lela Brinkmeier, his widow. Seconded by Ald. Narlock.
Upon a voice vote, motion carried.
CITY OFFICIAL'S REPORT l City Attorney advised that the claims against the City that had been
filed by Mrs. Vera Hoefs and Mike Lange should be denied on the basis
that the claimants failed to file a claim for refund within the time
required by statute.
ADJOURNMENT - Ald. Sapp moved to adjourn the meeting. Seconded by
Ald. Dwyer. Motion carried. The meeting adjourned at 9:14 P.M.
