ccm19701110COMMON COUNCIL CITY OF MUSREGO MINUTES OF MEETING HELD ON NOVEMBER 10, 1970 Mayor Gottfried called the meeting to order at 7~32 P.M. PRESENT: Mayor Jerome Gottfried, Aldermen Robert Burgermeister, John Dwyer, Charles Foldy, Lois Sapp and Walter Wollman. Harold DeBack arrived at 7:34.PM. a ABSENT: Ald. Frank Narlock. MINUTES : Ald. Wollman moved to approve the minutes of the meeting held on October 27, 1970, as mailed. Seconded by Ald. Burgermeister and carried. COMMITTEE REPORTS Ald. Sapp presented the reports of the Finance Committee meetings held on October 28 and November 4, 1970, and moved that the reports be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Ald. DeBack presented the report of the Public Works Committee meeting a held on November 5, 1970, and moved that the report be accepted and placed on file. Seconded by Wollman, motion carried. Ald. Foldy presented the report of the Public Safety Committee meeting held on November 2, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Sapp. Motion carried. Ald. Dwyer presented the report of the Public Welfare Committee meeting held on November 5, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Burgermeister, motion carried. Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee meeting held on October 29, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Burgenneister. Motion carried. Ald. Burgermeister presented the report of the Public Sewer Committee meeting held on November 4, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Sapp. Motion carried. 6 COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried announced that following the adjournment of this meeting, an executive session would be held with the Union Representative of the Police Dispatchers. Mayor Gottfried advised that within the next week and one half, he would call for a Special Meeting of the Council for the purpose of meeting with Mr. James T. Barry, Jr., Industrial Park Consultant and Mr. Seegar Swanson of Ehlers & Associates, Financial Consultant. a Mayor Gottfried advised that to date a substantial number of applications for the position of City Engineer had been received. He appointed Aldermen Wollman, DeBack and Dwyer to aid him in screening the applicants. At 8:lO P.M. Mayor Gottfried declared a recess and the meeting reconvened at 8:16 P.M. Common Council - City of Muskego - 11/10/70 Page 2. 9 l a UNFINISHED BUSINESS Resolution #224-70 - The Clerk read the resolution entitled, Accepting Low Bid for Installation of Sewer Connections (Andrews Plumbing) As this resolution was already on the floor, a discussion took place as to whether or not the city had received a written notice from the developers of Parkland Plaza as to their intent for the removal of the office building on the land owned by them. Ald. Sapp moved to defer action on Resolution #224-70 for two weeks, seconded by Ald. DeBack. Upon a voice vote, the motion carried. NEW BUSINESS Resolution 1~228-70 - Establishing 1970 Salary for Chief of Police. The Clerk read the resolution. Ald. Sapp moved for the adoption of same, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Res- olution f/228-70 carried unanimously. Resolution #229-70 - Authorizing the City of Muskego to Pay the Total Cost of its Employees Contribution to the Wis. Retirement Fund. The Clerk read the resolution. Ald. Sapp moved for adoption, seconded by Ald. Dwyer. Discussion took place as to the wording of the resolution and City Clerk Bowyer advised that a representative of the Wis. Retirement Fund would be at the city hall during the following week. Ald. Wollman then moved to defer action on Resolution i/229-70 until the next Council meeting. Seconded by Ald. Sapp. Upon a voice vote, motion to defer carried, Resolution $1230-70 - The Clerk read the resolution, entitled, Authorizing the Hiring of Additional Sewer Inspectors. Ald. SaDD moved for the a roll adoption of Resolution #230-70, seconded by Ald. Woiiman. Upon call vote, the motion carried unanimously. Resolution #231-70 - Authorizing the Refund of a Lateral Charge to Alvin Gibson. The Clerk read the resolution. Ald. Sapp moved for 'the adoption of Resolution 11231-70, seconded by Ald. Wollman. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #232-70 - Granting Deferred Assessment to Mr. Fred Farnsworth. xe.Clerk read the res'olution. Ald. Wollman moved for the adoption of same, seconded by Ald. Burgermeister. Upon a roll call vote, the motion to adopt Resolution #232-70 carried unanimously. Resolution #233-70 - Authorizing the Establishment of a Street Light at the Corner of Pioneer Dr. and Racine Ave. The Clerk read the resolution. Ald. DeBack moved for adoption, seconded by Ald. Foldy. Upon a voice vote, the motion to adopt Resolution 1'1233-70 carried unanimously. Resolution #234-70 - Requesting the Waukesha Co. Highway Dept. to Construct a Shadow Lane at Pioneer Dr. and Racine Ave. The Clerk read the res- olution. Ald. DeBack moved for the adoption of same. Seconded by Ald. Foldy. Upon a voice vote, the motion carried. Resolution i/235-70 - Authorizing a Holding Tank Agreement Between City of Muskego and Walter G. Koenig. The Clerk read the resolution. Ald. Wollman moved for the adoption of same. Seconded by Ald. Burgermeister. Upon a roll call vote, the motion to adopt Resolution #235-70 carried unanimously. Wollman moved for the adoption of Resolution #236-70. Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. Y Ordinance #185 - The Clerk gave the first reading of Ordinance f/185, entitl- ed, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Re: Tess Comers Fire Dept. Sub-station) Ald. Burger- meister moved to suspend the rules in order that the second reading of the ordinance could be given. Seconded by Ald. Foldy. Upon a roll call vote to suspend the rules, the motion carried unanimously. The Clerk gave the second reading of the ordinance. Ald. Burgermeister moved for the adoption of Ordinance j/185. Seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt carried unanimously. l Ordinance i/l86 - The Clerk gave the first reading of Ordinance J/186, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (13 acres of the Geo. Schaefer property.) Ald. Burgermeister moved to suspend the rules in order that the second reading could be given. Seconded by Ald. Wollman. Upon a roll call vote to suspend the rules, Aldermen Burgermeister, DeBack, Dwyer and Wollman voted "aye". Aldermen Sapp and Foldy voted "no". The motion to suspend the rules carried. The Clerk gave the second reading of Ordinance lf186. Ald. Burgermeister moved for the adoption of Ordinance j/186, seconded by Ald. Wollman. Aldermen Sapp and Foldy and Mayor Gottfried spoke in favor of deferring action on Ordinance 11186 until after the next Plan Commission meeting when further discussions would be held with the developers. Ald. Wollman moved to defer action on Ordinance #186 until the next Council meeting. Seconded by Ald. Dwyer. Upon a roll ca~ll vote the motion to defer action carried unanimously. LICENSE APPROVAL - Ald. Sapp moved to approve and Operator's License for Gerard Marchese, Jr. subject to receipt of a favorable Fingerprint Report. Seconded by Ald. Wollman, motion carried. VOUCHER APPROVAL - Ald. Sapp moved for the approval of payment of sewer vouchers in the amount of $246,568.82, payable November 10, 1970. Seconded by Ald. Wollman. Upon a roll call vote the motion carried unanimously. CITY OFFICIAL'S REPORTS - The Clerk gave the Building Inspector's Report for the month of October, 1970. Same placed on file. The Clerk gave the Financial Report as of October 31, 1970, showing total assets in the amount of $354,337.92. Report placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read communications fromMr. Mike Lang, Parker Drive and Mrs. Clara Hoefs, RR113 Mukwonago, Wis., directed to the City Treasurer and the a Board of Review, dated November 5, 1970, regarding their 1969 real estate assessment. Communications referred to the City Attorney and Finance Committee. The Clerk read a communication from Mrs. Ada Butcher, dated Nov. 9, 1970, directed to the Muskego Plan Commission regarding property on Tess Comers Dr. in the Industrial Park District. Bame referred to Plan Commission. l The Clerk read a communication directed to the Common Council from Raymond Bellows, RR//2 Waterford, Wis., dated Nov. 7, 1970, requesting variance of property located on Martin Drive. Same referred to Plan Commission. In answer to a question from Ald. DeBack, Mayor Gottfried advised that he would invite Mr. John Baumann of the Marine National Exchange Bank to be present at the aforementioned forthcoming Special Meeting of the Council for the purpose of discussing the city's finances.
