ccm19701027COMMON COUNCIL CITY OF MUSREGO MINUTES OF ADJOURNED MEETING OF OCTOBER 13, 1970, HELD ON OCTOBER 27, 1970 Mayor Gottfried called the meeting to order at 7:39 P.M. PRESENT: Mayor Jerome Gottfried, Aldermen Robert Burgermeister, Harold DeBack, John Dwyer, Charles Foldy, Frank Narlock, Lois Sapp and Walter Wollman. Also present were City Attorney John Buckley and City Clerk Bette J. Bowyer. m MINUTES: Ald. DeBack moved to approve the minutes of the meeting held October 13, 1970, as mailed. Ald. Dwyer seconded the motion a~nd the motion carried. COMMITTEE REPORTS Ald. Sapp presented the reports of the Finance Committee meetings held on October 13th, October 14th and October 21st, 1970, and moved that the 'reports be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Ald. DeBack presented the report of the Public Works Committee meeting held on October 22, 1970, and moved that the report be accepted and l placed on file. Seconded by Ald. Burgenneister. Motion carried. Ald. Dwyer presented the report of the Public Welfare Committee meeting held on October 22, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Burgermeister. Motion carried. Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee meeting held on October 15, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock. Motion carried. Ald. Burgenneister presented the report of the Public Sewer Committee meeting held on October 19, 1970, a~nd moved that the report be accepted and placed on file. Seconded by Ald. Wollman. Motion carried. The minutes of the Plan Commission meeting held on October 20, 1970, were received and placed on file. COMMUNICATIONS FROM THE MAYOR'S OFFICE 4 Mayor Gottfried informed the Aldermen that later on in the evening the problem of financing the Industrial Park would be discussed during a Meeting of the Whole. Mayor Gottfried announced that he had been in receipt of a gift of $200.00 from the MNEA, thus bringing the total to date from this . organization $632.25 to be earmarked for the Library in the New Civic Center. Mayor Gottfried announced the formation of a Muskego High School Booster Club. He urged everyone present to attend Muskego's Homecoming game on Oct. 30, 1970, with New Berlin. UNFINISHED BUSINESS The Clerk gave the second reading of-Ordinance #183, entitled, An Ordinance to Amend Sec. 9.01 (l)(c) of the Municipal Code (Re: Prohibiting the firing of 22 cal. guns using a rim fired cartridge anywhere within the a Muskego City Limits except as provided for in the Code) Ald. Narlock moved for the adoption of Ordinance 11183. Seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt carried unanimously. Narlock spoke in favor of the motion to override Mayor Gottfried's vetoof Resolution $163-70, As Amended, Upon a roll call vote to override the veto, Aldermen Burgermeister, DeBack, Dwyer, Narlock, Foldy and Wollman voted "aye". Ald. Sapp voted “IiO”. The motion to override the veto carried. e NEW BUSINESS The Clerk read Resolution i/16<-70, As Amended, entitled, Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate Certain Alleys Located in Oak Grove, a Recorded Subdivision in the City of Muskego. Ald. Sapp moved for the adoption of same, seconded by Ald. Burgermeister. Upon a roll call vote, the motion to adopt Resolution #163-70, As Amended, carried unanimously. The Clerk read Resolution #221-70, entitled, Directing the City Attorney to Draft Ordinance for Rezoning in Sec. 25 (Re: Tess Corners Fire Dept. Substation) Ald. Foldy moved for the adoption of same, seconded by l Ald. Burgermeister. Upon a voice vote, the motion to adopt Resolution #221-70 carried. The Clerk read Resolution #222-70, entitled, Granting Extension for Purchase Agreement for Land in Industrial Park to James A. Blake. Ald. Wollman moved for adoption, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution #223-70, entitled, Accepting Low Bid for Installation of Sewer Connections (P. Kowalkowski) Ald. Wollman moved for adoption of same, seconded by Ald. DeBack. Ald. Burgermeister re- quested permission of his fellow aldermen to have Mr. John Couture speak. Mr. Couture advised that due to the fact that one of the buildings listed in the resolution would be removed very shortly, it was his opinion that to accept the bid would be in error. Aid. Wollman moved to defer action on Resolution #223-70 and Resolution $1224-70 until representatives of Parkland Plaza Shopping Center, Inc. arrived at the meeting later in the evening. Seconded by Ald. Burgenneister. Upon a voice vote, the motion to defer action carried. The Clerk read Resolution #225-70, entitled, Accepting Low Bid for Installation of Sewer Connections (Schroeder Plbg.) Ald. Wollman moved for the adoption of same. Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution #226-70, entitled, Requesting Permission to Provide Residence Inspection for Sewer Construction. Ald. Sapp moved for the adoption of same, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt Resolution i/226-70 carried unanimously. a Resolution #227-70 - Ald. Sapp moved to suspend the rules that would interfere with the adoption of Resolution l/227-70, entitled, Accepting State Grant Offer Under Sec. 144.21, Wisconsin ($898,000.00) Seconded by Ald. Foldy. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read the resolution. Ald. Sapp moved for the adoption of Resolution #227-70, seconded by Ald. Dwyer. M.,Alderman Wollman moved to adjourn this into a Meeting of the Whole, for the purpose of an informal dis- cussion of the problem of financing the development of the Industrial Park. At 9~57 P.M. the regular meeting reconvened. The Clerk read Resolution #220-70, entitled, Approval of Final Plat of Phase I of Parkland Plaza Shopping. Ald. Foldy moved for adoption m Seconded by Ald. Burgermeister. At this time, Messrs. Sam Lawent, Gordon Schroeder, William Paschke and Clarence Piepenberg, represent- ing Parkland Plaza, appeared to review the final plat of Phase I of the development. Upon a roll call vote, the-motion to adopt Res- olution #220-70 carried unanimously. Resolution j/223-70 - Accepting the Low Bid for Instellation of Sewer Connections (P. Kowalkowski) As this resolution was already on the floor, Ald. Wollman moved to amend Resolution #223-70 by deleting Item 113 from the resolution (Muskego Shopping Center Property to be removed in the very near future). Seconded by Ald. DeBack. Upon a voice vote, the motion to amend carried. Upon a roll call vote, the motion to adopt Resolution #223-70, As Amended, carried unanimously. l Resolution #224-70 - The Clerk read Resolution #224-70, entitled, Accepting Low Bid for Installation of Sewer Connections (Andrews Plbg. Co) Aid* Burgermeister moved for the adoption of same, seconded by Ald. Wollman. Ald. Burgermeister moved to defer action on Resolution i/224-70 until the next Council meeting. Seconded by Ald. Wollman. Upon a voice vote, motion carried. LICENSE APPROVAL - Ald. Sapp moved for the approval of Operator's Licenses for Quinn Kearney and Jeffrey Behrs. Seconded by Ald. Narlock. Upon a voice vote, motion carried. Ald. Sapp moved for the approval of Operator's Licenses for Hattie Van Remmen and Dorothy Kraemer subject to receipt of favorable Fingerprint Reports. Seconded by Ald. Wollman. Upon a voice vote, motion carried. VOUCHER APPRCVAL - Ald. Narlock moved for a total payment of vouchers in the amount of $202,563.71, payable October 27, 1970. Seconded by Ald. Wollman. Upon a roll call vote, the motion carried unanimously, COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a Petition from David Beierle to amend Sec. 9.02 C.4 of the Zoning Ordinance and to rezone approximately six acres of the Harold DeBack property in Sec. 29 from R-l to R-l with an OIP Overlay to permit a Public Service Yard. Ald. Wollman moved to set the Public Hearing date for the Petition for December 8, 1970, 7:OO P.M. Sec- onded by Ald. Sapp. Upon a voice vote, motion carried. Petition re- ferred to Plan Commission. Ald. Foldy moved to set the Public Hearing Date for the installation of sanitary sewers in the Northeast District for Monday, November 23, 1970, 8:OO P.M. in the High School. Seconded by Ald. Wollman. Upon a voice vote, motion carried. City Clerk Bette Bowyer advised that Consulting Engineers Ruekert and Mielke will set up office hours on four different occasions in 0 the City Hall to answer questions regarding the sewer installation in the Northeast District and that as soon as the dates are available they will be published in the newspapers.
