ccm19700909COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 9, 1970 0 Mayor Gottfried called the meeting to order at 7~37 P.M. PRESENT: Mayor Jerome J. Gottfried, Aldermen Robert Burgermeister, Harold DeBack, John Dwyer, Charles Foldy, Frank Narlock and Walter e Wollman. Also present were City Clerk Bette Bowyer and City Attorney John P. Buckley. ABSENT: Ald. Lois Sapp. Ald. John Dwyer requested that it be noted that he was present at the Council meeting held on August 25, 1970. Ald. Burgermeister moved for the approval of the minutes of the meeting held on August 25, 1970, as mailed. Seconded by Ald. Dwyer. Motion carried. COMMITTEE REPORTS Ald. Wollman presented the report of the Finance Committee meeting held on September 2, 1970, and,moved that the report be accepted and placed a on file. Seconded by Ald. Narlock. Considerable discussion todcplace between the aldermen and Mayor regarding the inadequacy of the present city hall and the possibility of arranging less expensive alternate plans with the Architectural Finn of Gazinski - Schulze - Zemanovic. The motion to accept the minutes carried. Ald. DeBack presented the report of the Public Works Committee meeting held on September 30, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman. Motion carried. Ald. Foldy presented the minutes of the Public Safety Committee meeting held on August 27, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. DeBack. Motion carried. Ald. Dwyer presented the report of the Public Welfare Committee meeting held on September 3, 1970, and moved that same be accepted and placed on file. Seconded by Ald. Burgermeister, motion carried. Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee \ 4 meeting held on August 27, 1970, and moved that same be accepted and placed on file. Seconded by Ald. Narlock. Ald. Burgermeister requested that the committee take no further action on Ordinance #177 (Regulation of Snowmobiles) until the Park and Recreation Board makes their recommend- ation. The motion to accept Ald. Burgermeister presented meeting held on September 2, placed on file. Seconded by the minutes carried. the report of the Public Sewer Canrmittee 1970, and moved that same be accepted and Ald. Wollman. Motionsarried. The minutes of the Plan Commission meeting held on September 1, 1970, were received and vlaced on file. ,a COMMDNICA'lIONS FROM TRE MAYOR'S OFFICE Mayor Gottfried invited all of the aldermen to the dedication of Lions Park to the City of Muskego on September 12, 1970, at 3:30 P.M. Mayor Gottfried proclaimed the month between September 15th and October 15th as "Muskego Health Month". He praised the Muskego Health Council for health services rendered to the citizens of Muskego since 1956. Common Council Meeting City of Muskego - 9/9/70 Page 2. UNFINISHED BUSINESS Resolution l/172-70 - Accepting Low Bid for Painting of City Hall and City Garage. (Had been referred back to Finance Committee) Ald. Narlock moved to amend Resolution #172-70 by changing the last paragraph to read "Therefore, be it resolved that the Common Council of the City of Muskego does hereby accept the bid of Josten & Co., Inc. in the amount of $1,230.00 for the painting and window replacement of the city garage". Seconded by Ald. Burgermeister. Upon a roll call vote, the motion to amend Resolution #172-70 carried unanimously. Upon a roll call vote to adopt Resolution Y/172-70, As Amended, carried unanimously. Resolution #174-70 - Authorizing Development of Sewer Assessment Defer- ment for the George Schaefer Property. (Deferred from meeting of 8125170) Discussion took place between the Aldermen and Mayor as to what type of deferred assessment policy could possibly be established for this partic- ular piece of property and for future deferment requests. Upon a roll call vote, the motion to adopt Resolution #174-70 carried unanimously. Resolution #175-70 - Authorizing Advertising of Bids of Grading of Muskego Industrial Part (Deferred from meeting of 8/25/70). Ald. Wollman spoke in favor of the adoption of Resolution #175-70 and moved to amend same by adding the following sentence to the last paragraph, "with an alternate bid for grading 44 acres and the rough grading of Apollo Drive only." Seconded by Ald. Narlock. Upon a voice vote, the motion to amend Resolution 8175-70 carried. Upon a roll call vote, the motion to adopt Resolution #175-70, As Amended, carried unanimously. NEW BUSINESS Resolution 8165-70 - Appointment to Electrical Licensing Board (Werner Bierbach and Blair Dixon) The Clerk read Resolution f/165-70. Ald. Wollman moved for the adoption of Resolution #165-70. Seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt same carried unanimously. Resolution 1~181-70 - The Clerk read Resolution #181-70, entitled, A Res- olution Relating to Final Determination of Special Assessments (NW Dist. F-6). Ald. Wollman moved for the adoption of same. Seconded by Ald. Burgenneister. Upon a roll calllvote, the motion to adopt Resolution #181-70 carried unanimously. Resolution #182-70 - The Clerk read Resolution #182-70, entitled, Resolution Levying Special Assessments (NW Dist. F-6). Ald. Wollman moved for the adoption of same, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Resolution #182-70 carried unanimously. Resolution #183-z' The Clerk read Resolution #183-70, entitled, Resolution Directing Notice of Final Determination (NW Dist. F-6) Ald. Wollman moved for the adoption of ssme, seconded by Ald. Resolution #184-70 - The Clerk read Resolution #184-70, entitled, Accesptance of Bid for Municipal Sewer Project MSS-7-70. Ald. DeBack moved for the adoption of Resolution #184-70, seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt carried Unanimously (Cathlina Construction, Inc.) Resolution 11185-70 - The Clerk read Resolution #185-70, entitled, Acceptance of Bid for Municipal Sewer Project MSS-8-70 (L & R Const., Co.) Ald. Burgermeister moved for the adoption of same. Upon a voice vote, the motion to adoption Resolution #186-70 carried. Resolution #L87-70 - The Clerk read Resolution 8187-70, entitled, l Rejection of Previous Bids for Kurth Park Building. Ald. Burgenaeister moved for the adoption of same. Seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt Resolution 11187-70 carried unanimously. Resolution #188-70 - The Clerk read Resolution j/188-70, entitled, Authorization to Join the State Insurance Fund. Ald. Narlock moved for the adoption of same. Seconded by Ald. Wollman. Mayor Gottfried advised that because of the possibility that members of the Insurance Fund could possibly be assessed for extensive damage claims that it might be wise to defer action on this particular resolution until a definite decision is made regarding the payment of large claims. Ald. Wollman moved to defer action on Resolution #188-70,until the meeting of September 22nd, 1970. Seconded by Ald. Narlock. Upon a roll call vote, the motion to.defer action on Resolution #188-70 carried unanimously. l Resolution 8189-70 - The Clerk read Resolution #189-70, entitled, Authorizing the Sale of Outbuildings on the Former Bluhm Property. Ald. Narlock moved for the adoption of same. Seconded by Ald. Wollman. Upon a roll call vote, the motion to adopt Resolution #189-70 carried unan- imously. Resolution 8190-70 - The Clerk read Resolution #190-70, entitled, Author- izing the Sale of Residence and One Acre of the Former Bluhm Residence. Ald. Narlock moved for the adoption of same. Seconded by Ald. Wollman. Upon a roll call vote, the motion to adopt Resolution a190-70 carried unanimously. At 8~58 P.M. Mayor Gottfried declared a recess and the meeting reconvened at 9:09 P.M. Resolution #191-70 - Authorizing Inspection of Muskego City Hall. Ald. DeBack moved to suspend the rules that would interfere with the adoption of Resolution j/191-70. Seconded by Ald. Burgenaeister. Upon a roll call d vote to suspend the rules, the motion carried unanimously. The Clerk read the resolution and Ald. DeBack moved for the adoption of same. Seconded by Ald. Burgermeister. Upon a roll call vote, the motion to adopt Resolution #191-70 carried unanimously. Re: Vacating Alleys in Oak Grove Subdivision Resolution #162-70, As Amendedj- Ald. Wollman moved to bring Res. #162-70 back to the floor. Seconded by Ald. DeBack. Upon a roll call vote, the motion to bring bacb Resolution 11162, As Amended, carried unanimously. Ald. Burgermeister moved to further amend Resolution #162-70, As Amended, by deleting Section (F). Seconded by Ald. Dwyer. Upon a voice vote, the motion to further amend the resolution carried. Ald. Burgermeister moved to re-set the Public Hearing date for October 27, 1970, at 7:OO P.M. l Seconded by Ald. Wollman. Upon a voice vote the motion carried. LICENSE APPROVAL - Ald. Narlock moved for the approval of Operator's Licenses for Harriet Hollencamp, Lester Chapin and Ray Kaczmarek subject to receipt of favorable Fingerprint Reports. Seconded by Ald. Wollman. Upon a voice vote, motion carried. Ald. Narlock moved for the approval of an Operators License for Thomas Grzechowiak, subject to receipt of favorable Fingerprint and Medical Report. Seconded by Ald. Wollman, motion carried. Common Council Meeting City of Muskego 919170 Page 4. - l VOUCHER APPROVAL - Ald. Burgermeister moved for the approval of payment of Sewer Vouchers in the amount of $78,949.53, payable September 9, Seconded by Ald. Narlock. Upon a roll-call vote, the motion to pay voucher carried unanimously. 1970. the CITY OFFICIAL'S REPORTS The Clerk gave the Financkal Report showing total assets as of August 30, 1970, in the amount of $311,203.02. Report placed on file. The Clerk gave the Building Report for the month of August, 1970. Report placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a communication directed to the Common Council, dated September 2, 1970, from Viola L. Frey, requesting a legal lot status for Lot 10, Oak Ridge Unrecorded. Communication referred to Plan Commission. Ald. Dwyer presented a petition directed to the Mayor and Common Council of the City of Muskego, signed by 54 citizens of Muskego, requesting that all steps as may be essential be taken by them to prohibit a dump or "land fill" site in the City of Franklin adjacent to the City of Muskego. Petition placed on file. Ald. Narlock requested the City Clerk to read the contract between the City of Muskego and Lydia and Carl Wauer for the City Dump Site. Discussion followed regarding the land fill operation at the dump site with Ald. Narlock requesting legal opinion as to whether or not the City can control the dumping operations at this dump site and also whether or not the lessor can take in other haulers on that site without coming to the city. Ald. Dwyer moved that a parcel of land belonging to the Muskego Lakes Country Club, on Loomis Drive, be rezoned from B4 to B4 with an OIP Overlay for the purpose of a fire department sub-station. Seconded by Ald. Burger- meister. Upon a voice vote, motion carried. Ald. Dwyer moved to set the Public Hearing for the rezoning for October 27, 1970, at 7:15 P.M. Seconded by Ald. Wollman. Upon a voice vote, motion carried. ADJOURNMENT - Ald. Wollman moved to adjourn the meeting. Seconded by Ald. DeBack. Motion carried. The meeting adjourned at 9:38 P.M.
