MINUTES OF MEETING HELD AUGUST 25, 1970 .

Mayor Gottfried called the meeting to order at 7~38 P.M.
PRESENT: Mayor Jerome J. Gottfried, Aldermen Robert Burgermeister,
Harold DeBack, Charles Foldy, Frank Narlock and Lois Sapp. Also
l present were City Clerk Bette Bowyer and City Attorney John P. Buckley.
ABSENT: Ald. Walter Wollman
Ald. Burgermeister moved for the approval of the minutes of the meeting
held on August 11, 1970, as mailed, Seconded by Ald. Narlock,motion
carried.
COMMITTEE REPORTS
Ald. Sapp presented the report of the Finance Committee meeting held
on August 19, 1970, and moved that the report be accepted and placed
on file. Seconded by Ald. Narlock, motion carried.
Ald. DeBack presented the report of the Public Works Committee meeting
0 held on August 20, 1970, and moved that the report be accepted and
placed on file. Seconded by Ald. Burgermeister, motion carried.
Ald. Foldy presented the minutes of the Public Safety Committee meeting
held on August 13, 1970, and moved that the report be accepted and placed
on file. Seconded by Ald. Sapp. Motion carried.
Ald. Burgermeister presented the report of the Public Welfare Committee
meeting held on August 20, 1970, and moved that same be accepted and
Placed on file. Seconded by Ald. Sapp. Motion carried.
Ald. Burgermeister presented the report of the Public Sewer Committee
meeting held on August 18, 1970, and moved that same be accepted and
placed on file. Seconded by Ald. Sapp. Motion carried.
The minutes of the Plan Commission meeting held on August 18, 1970,
were received and placed on file.
__ COMMUNICATIONS FROM TRE MAYOR'S OFFICE
Mayor Gottfried presented statistics to the aldermen which related
to sewer project costs and anticipated revenue for the proposed
districts.

Ordinance #172 - An Ordinance to Rezone Certain Property and to Amend the
Zoning Map of the City (Tess Corners Fire Dept. - Shy Property) In
answer to a question from Ald. DeBack, Ald. Dwyer indicated that the new
proposective location of the fire department sub-station needed approval
by the State Rig&lay Commission for an access unto S.T.H. "36" and
therefore, he moved to defer action on Ordinance 8172 until the Council
meeting of September 22, 1970. Seconded by Ald. Narlock. Upon a voice
vote, the motion to defer carried.
Ordinance Fl79 - The Clerk gave the second reading of Ordinance 8179,
entitled, An Ordinance to Repeal and Recreate Sec. 9.24 and to Create
* Sec. 9.25 of the Municipal Code (Trespass Ordinance). Ald. Narlock
moved for the adoption of Ordinance #179. Seconded by Ald. Foldy. Upon
a roll call vote, the motion to adopt carried unanimously.

l Resolution #166-70 - The Clerk read Resolution 8166-70, entitled,
Authorizing the Installation of Intersection Street Lighting (Tans Dr.
and new Racine Ave. Ald. Sapp moved for the adoption of same. Seconded
by Ald. Foldy. Upon a voice vote, the motion to adopt Resolution 8166-70
carried. l Resolution #167-70 - The Clerk read Resolution #167-70, entitled, Transfer
of Funds to cover Cost of Fire Dept. Well. Ald. Narlock moved for the
adoption of same. Seconded by Alh. Sapp. Upon a roll call vote, motion
carried.
Resolution #168-70 - The Clerk read Resolution #168-70, entitled, Approval
of Final Plat of Muskego Industrial Plat. Ald. DeBack moved for the
adoption of same. Seconded by Ald. Foldy. Upon a roll call vote, the
motion to adopt carried unanimously.
Resolution #169-70 - The Clerk read Resolution 8169-70, entitled,
Acceptance of Bid for Sewer Project MSS-4-70 (Rock Contractors) Ald.
Burgermeister moved for the adoption of same. Seconded by Ald. DeBack. l Upon a roll call vote, the motion to adopt Resolution #169-70 carried
unanimously.
Resolution #170-70 - The Clerk read Resolution #170-70, entitled,
Acceptance of Bid for Sewer Project MSS-5-70. Ald. Burgermeister moved
for the adoption of same. Seconded by Ald. DeBack. Upon a roll call
vote, the motion to adopt Resolution #170-70 carried unanimously. (Bid
was awarded to James Cape & Sons)
Resolution 11171-70 - The Clerk read Resolution 8171-70, entitled,
Acceptance of Bid for Sewer Project MSS-6-70. (Ramplex, Inc.) Ald.
DeBack moved for the adoption of same. Seconded by Ald. Burgermeister.
Upon a roll call vote, the motion to adopt Resolution #171-70 carried
unanimously.
Resolution #172-70 - The Clerk read Resolution #172-70, entitled, Accept-
ing Low Bid for Painting of City Hall and City Garage. Ald. Narlock
moved for the adoption of same. Seconded by Ald. Sapp. In view of the

fact that several of the Aldermen spoke as being opposed to the adoption
of Resolution #172-70, Alderman Sapp moved to refer the resolution back
to the Finance Committee. Seconded by Ald. Narlock. Upon a voice vote,
the motion carried.
Resolution #173-70 - The Clerk read Resolution #173-70, entitled,
Authorizing the Sewer Committee to Advertise for Bids for Installation
of Sewer Connections. Ald. Sapp moved for the adoption of same, second-
ed by Ald. Burgenxeister. Ald. Burgermeister moved to amend Resolution
11173-70, 2nd line of 1st paragraph by adding "A-l and C-3" after the
word "district". Also by adding "District A-l and C-3" after the
word "system" at the end of the 4th paragraph. Seconded by Ald. Dwyer.
Upon a voice vote, the motion to amend Resolution 11173-70 carried.
Upon a roll call vote, the motion to adopt Resolution #173-70, As Amended,
carried unanimously.
Resolution #174-70 - The Clerk read Resolution #174-70, entitled,
Authorizing Development of Sewer Assessment Deferment for the George
Schaefer Property. Ald. Sapp moved for the adoption of same. Seconded
by Ald. Burgermeister. Following discussion regarding the various methods
of deferring sewer assessments, Ald. Burgermeister moved to defer action
on Resolution #174-70 until the next Council meeting in order to give
the Public Sewer Committee an opportunity to make a recommendation on
same. Seconded by Ald. DeBack. Upon a roll call vote to defer action on
Resolution 8174-70, Aldermen Burgermeister, DeBack, Dwyer and Narlock
voted "aye". Aldermen Foldy and Sapp voted "no". The motion to defer
carried.

Resolution 1~175-70 - The Clerk read Resolution 8175-70, entitled, Authoriz-
ing Advertising of Bids of Grading of Muskego Industrial Park, Ald. DeBack
moved for the adoption of same. Seconded by Ald. Burgermeister. Ald.
Sapp moved to defer action on Resolution #175-70,in order to give the
Finance Committee an opportunity to further study the matter, until the
next meeting of the Common Council. Seconded by Ald. Foldy. Ald.

1~176-70, Aldermen Dwyer, Foldy, Narlock and Sapp voted "aye". Aldermen
Burgermeister and DeBack voted "no". The motion to amend Resolution

Resolution 8178-70 - The Clerk read Resolution #178-70, entitled, Authoriz-
ing Advertising of Bids for Additional Culvert Pipe for Tess Corners
Culvert Project. Ald. Burgeameister moved for the adoption of same.
Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt
Resolution 8178-70 carried unanimously.
At 9:15 P.M. Mayor Gottfried declared a recess and the meeting reconvened
at 9:28 P.M.
Ald. Burgenneister moved to suspend the rules that would interfere with
the adoption of Resolution #179-70 and #HO-70. Seconded by Ald. Foldy.
Upon a roll call vote, the motion to suspend the rules carried unanimously.
Resolution #179-70 - The Clerk read Resolution 8179-70, entitled, Authorix-
ing Request for State Funds for Sewage Treatment Plant Expansion Project.
Ald. Narlock moved for the adoption of same. Seconded by Ald. Dwyer. Upon
a voice vote, motion carried.
Resolution #180-70 - The Clerk read Resolution #180-70, entitled, Authoriz-
ing Request for Federal Funds for Sewage Treatment Plant Expansion
Project. Ald. Foldy moved for the adoption of same. Seconded by Ald.
Saw. Upon a voice vote, the motion to adopt Resolution #180-70 carried.

Lions Club for 9/12/70. Seconded by Ald. Foldy, motion carried.

COMMUNICATIONS AND MISCELLANEOUS BUSINESS
* The Clerk read communication dated August 18, 1970, directed to herself
from Mr. Walter J. Wiedemeier, W190 S7635 Circle Drive, requesting that
his name be removed from the petition against multiple family dwellings
as it pertains to the George Schaefer property. Communication placed on

The Clerk read a communication from F. D. Spaight, dated August 25, 1970,
directed to the Common Council requesting legal lot status of Lots 46 and
49, Kingston's-On-Muskego, Subdivision #2. Communication referred to
Plan Commission.
The Clerk read a commtinication from Calvary Church, dated August 14, 1970,
directed to Mayor Gottfried, offering proposals to the city for church
property located on Janesville Rd. Communication referred to Finance
Committee.
The Clerk read a communication dated August 19, 1970, directed to the
Common Council from John A. Shroble, President of the Muskego Lions Club
l inviting them to attend the dedication of the Muskego Lions Club Park
to the City of Muskego on September 12, 1970. Communication placed on
file.
The Clerk read a communication dated August 10, 1970, from Architects
Gaxinski - Schulxe - Zemanovic, directed to the Mayor and Council
regarding services rendered by them pertaining to the Civic Center
Complex. Communication referred to the Finance Committee.
Ald. Narlock moved to reconsider Resolution 8176-70, As Amended, entitled,
Authorizing Appraisals of Land Owned by City (Pioneer Dr.). Seconded by
Ald. Burgermeister. Upon a roll call vote, the motion to reconsider Res-
olution #176-70, As Amended, carried unanimously. Discussion followed
and upon a roll call vote to adopt Resolution 1~176-70, As Amended, Aldermen
Foldy and Sapp voted "aye" and Aldermen Burgermeister, DeBack, Dwyer and
Narlock voted "no". The motion to adopt Resolution #176-70, As Amended,
did not carry.
ADJOURNMENT - Ald. Sapp moved to adjourn the meeting. Seconded by Ald.
