ccm19700811CGMMGNCOUNCIL- CITY OF MUSKEGO MINUTES OF MFXTING HELD AUGUST 11, 1970 Mayor Gottfried called the meeting to order at 7:40 P.M. PRESENT: Mayor Jerome J. Gottfried, Aldermen Robert Burgermeister, Harold DeBack, Charles Foldy, Frank Narlock, Lois Sapp and Walter Wollman. Also present were City Clerk Bette Bowyer and City Attorney John P. Buckley. ABSENT: Ald. John Dwyer. As there were no additions or corrections to the minutes of the meeting held on July 28, 1970, they were accepted, as mailed, and will be placed on file. COMMITTBE REPORTS Ald. Sapp presented the report of the Finance Committee meeting held on August 5, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman. Motion carried. Ald. DeBack presented the report of the Public Works Committee meeting held on August 6, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Ald. Burgenaeister presented the report of the Public Welfare Committee meeting held on August 6, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Ald. Narlock presented the report of the Rules, Laws & Ordinance Committee meeting held on July 30, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Foldy. Motion carried. Ald. Burgermeister presented the report of the Public Sewer Committee meeting held on August 5, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Sapp. Motion carried. The minutes of the Plan Commission meeting held on August 4, 1970, were received and placed on file. COMMUNICATIONS FRQM THE MAYOR'S OFFICE The Clerk read a proclamation signed by Mayor Jerome Gottfried, proclaim- ing that August 29 and 30, 1970, shall be recognized as 'Muskego V.F.W. Country Fair Days." UNFINISHED BUSINESS - None NEW BUSINESS Resolution 8163-70 - The Clerk read Resolution 8163-70, entitled, Approving the Rezoning of 13 Acres on the George Schaefer Parcel. Ald. Foldy moved for the adoption of Resolution #163-70. Seconded by Ald. Burgermeister. Ald. Narlock requested permission of his fellow aldermen to have Mr. Gerald Galles, Sunny Hill Drive, speak. As there were no objections, Mr. Galles requested Attorney Dale Arene, representing all of the citizens objecting to the proposed rezoning, to speak in his stead. Attorney Arenz spoke at length in opposition to the request for a change in the Zoning District Map of the City. - ? & Common Council Meeting Clity of,Muskego 8/11/70 Page 2. l l Ald. Wollman requested permission of his fellow aldermen to have Mr. David Cunningham, representing Northland Developers, speak. As there were no objections, Mr. Cunningham explained the townhouse concept of the proposed apartment complex. Attorney John Multhauf, representing George and Alvin Schaefer, explained how it was their hope to liquidate a part of their farm to help pay their sewer assessment. Mayor Gottfried requested permission of the aldermen to have Mr. Frederick Graves, S77 W20606 Hillendale Dr. speak. Mr. Graves indicat- ed that he was in 'favor of apartments, however, he did object to the large number of three bedroom units that have been proposed. Following a lengthy discussion between the Aldermen and the Mayor, Ald. Wollman moved to refer this matter back to the Plan Commission with instructions tos&mit with their reconrmendation, specific conditions relating to the ratio of one, two and three bedrooms and a specific area for commercial development. Motion seconded by Ald. Sw. Upon a voice vote, the motion to refer the matter back to the Plan Commission carried. At 8:55 EM Mayor Gottfried declared a recess and at 9:lO P.M. the meeting reconvened. Resolution #164-70 - The Clerk read the resolution, entitled, Authoriz- ing the Park & Recreation Board to Sell a Parcel of Land to Douglas Franxen. Ald. Burgenneister moved for the adoption of Resolution f/164-70, seconded by Aid. Wollman. In answer to a question from Ald. DeBack, Ald. Burgenueister explained the circumstances as to why the 35' strip of land is being sold. Upon a-roll call.vote, the motion to adopt Resolution #164-70 carried unanimously. Ordinance #179 - The Clerk gave the first reading of Ordinance #179, entitled, An ordinance to Repeal and Recreate Section 9.24 and to Create Section 9.25 of the Municipal Code (Trespass Ordinance) VOUCHER APPROVAL - Ald. Narlock moved to pay sewer vouchers in the amount of $141,798.48, payable August 11, 1970. Seconded by Ald. Saw. Upon a roll call vote, the motion to pay the vouchers carried unanimously. LICENSE APPROVAL - Ald. Sapp moved for the approval of Operator's Licenses for Richard Burns, Robert Kujawski, Judith Buckett and Paul Rathman. Also for Richard Smith and Soren Oliver, subject to the receipt of favorable Medical Reports. Seconded by Ald. Narlock. Upon a voice vote, the motion carried. Ald. Wollman moved for the approval of a Class "B" Fermented Malt . Beverage and Intoxicating Liquor License for Theodore Blattner, subject to the necessary advertising requirements. Seconded by Ald. Narlock. Motion carried. Ald. Sapp moved for the approval of a "Gathering" License for the Muskego Volunteer Fire Dept. for August 16th and also a "Gathering" License for the Muskego Athletic Club for Sunday, August 23, 1970. Seconded by Ald. Wollman, motion carried. Ald. Wollman moved for the approval of a Junk License for James Kohne. Seconded by Ald. Narlock, motion carried. Common Council Meeting City of Muskego - 8/11/70 Page 3. Ald. Sapp moved for the approval of a Junk License for Jack Glockner, 0 subject to the development of the berm along Woods Road. Seconded by Ald. Narlock, motion carried. CITY OFFICIAL'S REPORTS- The Clerk presented the Finance Report showing total assets as of July 31, 1970, in the amount of $453,931.85. Report l placed on file. The Clerk gave the Building Report for the month of July, 1970. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Ald. Narlock moved to set the Public Hearing date for the consideration of &k$Y&ents to the Zoning Ordinance (Re: Trailers and Accessory Buildings) for September 22, 1970, at 7:15 P.M. Seconded by Ald. De- Back. Upon a voice vote, the motion carried. At 9:30 P.M. Mayor Gottfried declared a recess and the meeting reconvened at 9:35 P.M. l At this point in the meeting Mr. John Birch appeared to present to the Aldermen the present status of the development of the Industrial Park and also to present an estimated cost analysis for the development of 44.117 saleable acres. Final Plat referred to plan Commission for approval At 1O:lO P.M. the Council adjourned to a Meeting of the Whole to discuss the future of the present City Ball.
