MINUTES OF MEETING HEILD JULY 28, 1970
Mayor Gottfried called the meeting to order at 8:16 P.M.
(I) PRESENT: Mayor Jerome J. Gottfried, Aldermen Robert Burgenneister,
Harold DeBack, John Dwyer, Charles Foldy, Frank Narlock, Lois Sapp
and Walter Wollman. l Also present were City Clerk Bette Bowyer and
City Attorney Buckley.
Ald. DeBack moved to approve the minutes of the regular meeting held
on July 14, 1970. Seconded by Ald. Dwyer. Motion carried.
COMMITTEE REPORTS
Ald. Narlock presented the report of the Finance Committee meeting
held on July 22, 1970, and moved that the report be accepted and
placed on file. Seconded by Ald. Wollman, motion carried.
Ald. DeBack presented the report of the Public Works Committee
meetings held on July 23, 1970, and moved that the report be accepted
and placed on file. Seconded by Aid. Wollman, motion carried.
l Ald. Foldy presented the report of the Public Safety Committee meeting
held on July 23, 1970, and moved that the report be accepted and
placed on file. Seconded by Ald. DeBack, motion carried.
Ald. Dwyer presented the report of the Public Welfare Committee meeting
held on July 23, 1970, and moved that the report be accepted a~nd
placed on file. Seconded by Ald. Burgermeister. Motion carried.
Aid. Dwyer presented the report of the Rules, Laws & Ordinance Committee
meeting held on July 16, 1970, and moved that the report be accepted
and placed on file. Ald. Wollman requested that the committee give
serious consideration to the permitting of snowmobiling in city parks.
The motion to adopt the report carried.
Ald. Burgermeister presented the report of the Public Sewer Committee
meeting held on July 20, 1970, and moved that the report be accepted
and placed on file. Seconded by Ald. Wollman. Motion carried:

The minutes of the Plan Commission meeting held on July 21, 1970, were
received and placed on file.
UNFINISHED BUSINESS
Ordinance i/l72 - An Ordinance to Rezone Certain Property and to Amend
the Zoning Map of the City of Muskego (Shy Property-Tess Corners Fire
Dept. Substation) Ald. Dwyer moved to defer action on Ordinance #172
until the Council meeting to be held on August 25, 1970. Seconded by
Ald. Wollman. Upon a voice vote, the motion to defer action on
Ordinance #172 until August 25, 1970, carried.
l Resolution #145-70 - Resolution Adopting the Rules and Regulations of the
Muskego Business/Industrial Park. fiis resolution had been deferred
from the previous meeting. Ald. Wollman questioned Paragraph 2 regarding
inability to pour concrete, landscape, etc. during the winter months.
Ald. DeBack moved to amend Paragraph 2, Page 1, of the Rules and Reg-
ulations for Muskego Business/Industrial Park to read as follows: “All

such landscaping, drive, and walks shall be completed at the time of
construction on the building if weather conditions permit." Seconded
by Ald. Narlock. Upon a voice vote, the motion to amend carried. Upon
a roll call vote, the motion to adopt Resolution #145-70, As Amended,
carried unanimously.

Ordinance #178 - The Clerk gave the second reading of Ordinance #178.
Ald. Narlock moved for the adoption of Ordinance #178. Seconded by
Ald. Dwyer. Upon a roll call vote, the motion to adopt Ordinance #178
carried unanimously.
NEW BUSINESS
Resolution #155-70 - The Clerk read Resolution 8155-70, entitled,
Approval of Waterway Marker and Swimming Beach Permit for L. Martin
Oschmann. Ald. Sapp moved for the adoption of Resolution f/155-70,
seconded by Ald. Narlock. Ald. Sapp moved to amend Resolution #155-70
by adding the name of Henry Czarnecki to the resolution. Seconded
by Ald. Narlock. Upon a voice vote, the motion to amend Resolution #155-70
carried. Upon a voice vote, the motion to adopt Resolution #155-70,
As Amended, carried.
Resolution 8156-70 - The Clerk read Resolution j/156-70, entitled,
Resolution Appointing Members to Capital Improvement Committee.
Ald. Burgenneister moved for the adoption of Resolution 11156-70,
seconded by Ald. Foldy. Ald. Sapp pointed out that Ordinance 11178,
As Amended, called for one more appointee.
At 8:55 P.M. Mayor Gottfried declared a recess and the meeting re-
convened at 9:05 P.M.
Ald. Wollman moved to amend Resolution #156-70, by adding Lois Sapp
as the member of the committee to represent the Finance Committee.
Seconded by Aid. Foldy. Upon a voice vote, the motion to amend
Resolution #156-70 carried. Upon a voice vote, the motion to adopt
Resolution f/156-70, As Amended, carried.
Resolution #157-70 - The Clerk read Resolution #157-70, entitled,
Declaring the City's Intent to Reconstruct Main Spillway at the South
End of Little Muskego Lake. Ald Wollman moved for the adoption of
same. Seconded by Ald. Dwyer. Upon a roll call vote, the motion to
adopt Resolution f/157-70 carried unanimously.
Resolution j/158-70 - The Clerk read Resolution $1158-70, entitled,
Directing the City Engineers to Design the Flood Gate for Little
Muskego Lake. Ald. Burgenneister moved for the adoption of same.
Seconded by Ald. Wollman. Upon a roll call vote, the motion to adopt
Resolution $1158-70 carried unanimously.
Resolution #159-70 - The Clerk read Resolution #159-70, entitled,
Authorizing the Park and Recreation Board to Advertise for Bids for
Building at Kurth Park. Ald. Burgermeister moved for the adoption of
same. Seconded by Ald. Sapp. Upon a roll call voted the motion to
adopt carried unanimously.
Resolution 8160-70 - The Clerk read Resolution #160-70, entitled,
Authorizing the Public Works Committee to Asphalt Certain Streets
in Sewer Areas of the City. Ald. Wollman moved for the adoption of
same. Seconded by Ald. Burgenneister. Ald. DeBack urged that his
fellow aldermen investigate road assessment policies in other munici-
palities. Ald. Sapp spoke as being opposed to a special assessment
policy for road construction. Upon a roll call vote to adopt Resolution
#160-70, Aldermen Burgermeister, Dwyer, Foldy, Narlock, Sapp and
Wollman voted "aye". Ald. DeBack voted "no". The motion to adopt
Resolution i/160-70 carried.

Resolution #161-70 - The Clerk read Resolution 8161-70, entitled,
Authorizing Refunds as Required from the Final Accounting of Sanitary
Sewer Dist. #C-3. Ald. Narlock moved for the adoption of same. Sec-
onded by Ald. Wollman. Upon a roll call vote, the motion to adopt
Resolution 11161-70 carried unanimously.
Resolution 8162-70 - The Clerk introduced and read Resolution 8162-70,
entitled, Vacating the Alleys in Oak Grove Subdivision. No action
to be taken on the resolution until after publication and public
hearing. Ald. Wollman moved to set the Public Hearing date as
September 8, 1970, 7:00 P.M. Seconded by Ald. Foldy. Upon a voice
vote, motion carried.
VOUCHER APPROVAL - Ald. Narlock moved for the approval of payment of
vouchers in the amount of $108,160.06, payable July 28, 1970. Seconded
by Ald. Wollman. Upon a roll call vote, the motion to pay the vouchers
carried unanimously.
LICENSE APPROVAL - Ald. Wollman moved for the approval of Operator's
Licenses for Eugene Lien, Kenneth Schwarz and Joseph Rickun. Seconded
by Ald. Narlock. Upon a voice vote, motion carried.
Ald. Narlock moved for the approval of Operator's Licenses for John
Hrica and Robert Gustafson subject to favorable Fingerprint Reports.
Seconded by Ald. Wollman, motion carried.
Ald. Sapp moved for a Class "B" Fermented Malt Beverage and Intoxicating
Liquor License for Donald Kneser, subject to favorable Fingerprint
Report and advertising requirements. Seconded by Ald. Wollman. Upon
a voice vote, motion carried.
Ald. Wollman moved to grant a Swimming Beach Permit for Martin
Oscbmann and Henry Czarnecki. Seconded by Ald. Sapp. Upon a voice
vote, motion carried.
At this point in the meeting Ald. Foldy moved for the reconsideration
of Ordinance #178. Seconded by Ald. Narlock. Upon a roll call vote,
the motion to reconsider Ordinance I\178 carried unanimously.
At 9:41 Mayor Gottfried declared a recess and the meeting reconvened
9:4s!m.
As Ald. Foldy had expressed concern that Ordinance #178, entitled,
An Ordinance to Amend Sec. 3.05 of the Municipal Code, Establishing
a Capital Improvement Program and Capital Budgeting Committee, did
not specify a term of office for the appointees of the committee, he
moved to amend Ordinance $1178 by adding the following sentence to
Paragraph 305(5): The term shall be for one year commencing May 1.
Seconded by Ald. Sapp. Upon a voice vote, the motion to amend
Ordinance #178 carried. Upon a roll call vote, the motion to adopt
Ordinance #178, As Amended, carried unanimously.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
Ald. Narlock read a communication directed to himself from Mr. George
Vogel regarding a land fill operation at the Wauer Dump.
The Clerk read a communication from the Plan Commission directed to
the Mayor and Council, dated 7123170, regarding a Zoning Ordinance
Amendment (Accessory Buildings).

dated July 21, 1970, from Police Dispatcher Mrs. Barbara Polce
regarding insurance coverage.

0 Ald. Foldy moved to adjourn the meeting. Seconded by Ald. Narlock.
