ccm19700714COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD JULY 14, 1970 Mayor Gottfried called the meeting to order at 7~36 P.M. PRESENT: Mayor Jerome J. Gottfried, Aldermen Robert Burgenneister, Harold DeBack, John Dwyer, Charles Foldy, Frank Narlock, Lois Sapp l and Walter Wollman. Also present were City Clerk Bette Bowyer and City Attorney John P. Buckley. Ald. Sapp moved to approve the minutes of the regular meeting held on June 23, 1970. Seconded by Ald. Narlock. Motion carried. COMMITTEE REPORTS Ald. Sapp presented the report of the Finance Committee meeting held on July 8, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Ald. DeBack presented the report of the Public Works Committee meetings held on June 30th and July 9th, 1970, and moved that the report be 0 accepted and placed on file. Seconded by Ald. Wollman, motion carried. Ald. Dwyer presented the report of the Public Welfare Committee meeting held on July 9, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Burgermeister, motion carried. Ald. Foldy presented the report of the Public Safety Committee meeting held on July 9, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Sapp. Motion carried. Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee meeting held on June 25, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Ald. Burgermeister presented the reports of the Public Sewer Committee meetings held on June 30, 1970 and July 6, 1970, and moved that the reports be accepted and placed on file. Seconded by Ald. Wollman, motion carried. l The Minutes of the Plan Commission meeting held on July 7, 1970, were received and placed on file. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried reviewed the procedures that he hoped could be used for the selection of a City Engineer for the City of Muskego. UNFINISHED BUSINESS Ordinance 11172 - An Ordinance to Rezone Certain Property and to Amend * the Zoning Map of the City of Muskego (Shy Property- Tess Corners Fire Dept. Substation) Ald. Dwyer moved to defer action on Ordinance #172 until the Council meeting to be held on July 28, 1970. Seconded by Ald. Foldy. Upon a roll call vote, the motion to defer carried unanimously. Ordinance 7~175 - The Clerk gave the second reading of Ordinance $1175, entitled, An Ordinance to Amend Ch. 7 of the Municipal Code (Traffic a Code). Ald. Narlock moved for the adoption of Ordinance #175. Seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt Ordinance #175 carried unanimously. Ordinance #176 - The Clerk gave the second reading of Ordinance #176, entitled, An Ordinance to Amend Ch. 1 of the Municipal Code (Re: Municipal Justice). Ald. Narlock moved for the adoption of Ordinance i/176. Sec- onded by Ala. Foldy. Upon a roll call vote, the motion to adopt Ordinance #176 carried unanimously. NEW BUSINESS Resolution i/138-70 - The Clerk read Resolution 11138-70, entitled, Refund of Personal Property Tax to Robert Brinkmeier. Ald. Wollman moved for the adoption of same, seconded by Ald. DeBack. Upon a voice vote, the motion to adopt Resolution i/138-70 carried. Q 0 Share Cost-of-Surveying S. Denoon Rd. Ald. Wollman moved for adoption of same, seconded by Ald. DeBack. Resolution #139-70 - The Clerk read Resolution f/139-70, entitled, Authorizing Agreement Between Town of Norway and City of Muskego to the , the Resolution #140-70 - The Clerk read Resolution #140-70, entit Approving the Easement for the Wisconsin Telephone Co. Across led, the Muskego Industrial Park. Ald. Dwyer moved for the adoption of same, seconded by Ald. Foldy. In answer to a question from Ald. Foldy, City Attorney Buckley advised that the new easement would be permanent. Upon a voice vote, the motion to adopt Resolution 8140-70 carried. Resolution #141-70 - The Clerk read Resolution l/141-70, entitled, Relinquishing Certain Right-of-Ways Owned by the City Along S.T.H. 24 Adjacent to Industrial Park. Ald. Wollman moved for the adopt same, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Resolution $1141-70 carried unanimously. Resolution 8142-70 - The Clerk read Resolution 8142-70, entitled, Approval of Sewer Lateral Easement for John Laurich in Oak Grove Subdivision. Ald. Sapp moved for the adoption of same, seconded by Ald. Narlock. Upon a roll call vote, the.motion to adopt Resolution $1142-70 carried unanimously. Resolution j/143-70 - The Clerk read Resolution Y/143-70, entitled, Approval of Waterway Marker and Swimming Beach for Daniel Amann and Lake Denoon Beach, Inc. Ald. Sapp moved for the adoption of same, seconded by Ald. Narlock. Upon a voice vote, the motion to adopt Resolution $1143-70 carried. Resolution #144-70 - The Clerk read Resolution f/144-70, entitled, Authorizing the Advertising for Sale of City Owned Lands on Pioneer Drive. Ald. Wollman moved for the adoption of same, seconded by Ald. Sapp. Upon a roll call vote, the motion to adopt carried unanimously. Resolution $1145-70 - Resolution Adopting Rules and Regulations for Muskego Business/Industrial Park. Ald. Narlock moved for the adoption of same. Seconded by Ald. Foldy. Ald. Narlock moved to amend Res- olution #145-70 a last paragraph to read as follows: "Be it Further Resolved, that a copy of these Rules and Regulations, together with a copy of the legal description of the lands involved, be placed in recordable form and recorded in the office of the Register of Deeds". Seconded by Ald. Foldy. Upon a voice vote, the motion to amend Res- olution f/145-70 carried. Ald. Wollman moved to defer action on Res- olution #145-70 until the meeting of July 28, 1970. Ald. DeBack moved for the adoption of same. Seconded by Ald. Wollman. Upon a roll call vote, the motion to adopt carried unanimously. Resolution $1148-70 - The Clerk read Resolution i/148-70, entitled, Approval of Change of Procedures Regarding Sewer Lateral Waivers. Ald. Burgermeister moved for the adoption of same. Resolution #150-70 - The Clerk read Resolution #150-70, entitled, Acceptance of Bid for Hydraulic Sewer Rodder. (O'Brien Mfg. Co.) Ald. Wollman moved for the adoption of same. Seconded by Ald. Burger- meister. Upon a roll call vote, the motion to adopt Resolution #150-70 carried unanimously. Resolution i/151-70 - The Clerk read Resolution j/151-70, entitled, Acceptance of Bid for New Highway Truck, Snow Plow and Material Spreader. (International Hamster Co.) Ald. Wollman moved for the adoption of Resolution j/151-70. Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Resolution i/151-70 carried unanimously. At 9:05 Mayor Gottfried declared a recess and the meeting reconvened at 9:15 P.M. I) Resolution #152-70 - The Clerk read Resolution #152-70, entitled, Awarding the Contract for Reconstruction of Drainage Culvert in Tess Corners Area (Brookfield Culvert Co.) Ald. Wollman moved for the adoption of same. Seconded by Ald. Burgenneister. Upon a roll call vote, the motion to adopt Resolution 11152-70 carried unanimously. Resolution 11153-70 - The Clerk read Resolution #153-70, entitled, Authorizing the Advertising for Position of City Engineer for the City of Muskego. Ald. Wollman moved for the adoption of same. Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. l Ordinance I~178 - The Clerk gave the first reading of Ordinance #178, entitled, An Ordinance to Amend Sec. 3.05 Establishing a Capital Expenditure Budget, Five-Year Capital Improvement Program and Capital Budgeting Committee. Sapp. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read Resolution 11154-70, entitled, Accepting the 1970 and 1971 Contract With Teamsters Union Local #695. Ald. Sapp moved for the adoption of Resolution i/154-70. Seconded by Ald. DeBack. Ald. Sapp reviewed the contents of the 1970 and 1971 contract for certain l members of the Police Department. Upon a roll call vote, the motion to adopt Resolution #154-70 carried unanimously. LICENSE APPROVAL Ald Narlock moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Lake Denoon Beach, Inc. Seconded by Ald. Sapp. Upon a voice vote, the motion carried. Ald. Sapp moved for a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Mary Jane Doss. Seconded by Ald. Narlock. Upon a voice vote, the motion carried. Ald. Sapp moved for the approval of an Operator's License for Robert Kwasigroch, subject to the receipt of favorable Fingerprint and Medical Reports. Seconded by Ald. Wollman. Upon a voice vote, motion carried. Ald. Wollman moved for the approval of a "Gathering" License for St. Paul's Lutheran Church to be held on August 2, 1970. Seconded by Ald. Narlock. Upon a voice vote, motion carried. Aid. Narlock moved for a Swimming Beach License for Daniel Amann and Lake Denoon Beach, Inc. Seconded by Ald. Wollman. Upon a voice vote, motion carried. Ald. Sapp moved for the denial of Operator's Licenses for James Harsch and Charles Rathsack. Seconded by Ald. Wollman. Upon a voice vote, motion carried. VOUCHER APPROVAL - Ald. Narlock moved for the approval of payment of sewer voucher , payable July 14, 1970, in the amount of $286,123.41 Seconded by Ald. Wollman. Upon a roll call vote, the motion to pay the sewer vouchers carried unanimously. i) CITY OFFICIAL'S REPORTS - The Clerk gave the Financial Report for the month of June, 1970, indicating total assets in the amount of $526,311.76. Report placed on file. The Clerk presented the Building Report for the month of June, 1970. Report placed on file. City Attorney Buckley reported that he had received advice from the Wisconsin League of Municipalities regarding a proposed ordinance restricting the sale of disposable bottles. The matter was referred to the Rules, Laws & Ordinance Committee. l COMMUNICATIONS AND MISCELLANEOUS BUSINESS. The Clerk read a communication; dated July 8, 1970, from Mr. and Mrs. Robert Smart directed to the Council, requesting variance for two lots on School Drive. Same referred to Plan Commission. The Clerk read a communication directed to the Council from the Plan Comm. regarding a proposed amendment to the Zoning Ordinance regarding parking l , of trailers within the city.
