Gottfried, Aldermen Robert Burgermeister, Harold DeBack, John Dwyer, Cha~rles Foldy, Frank Narlock, Lois Sapp and Walter Wollman. Also present were City Clerk Bette Bowyer and ; l City Attorney John P. Buckley. Ald. Narlock moved to approve the minutes of the regular meeting held on June 9, 1970, Seconded by Ald. Dwyer. Motion carried. COMMITTEE REPORTS Ald. Sapp presented the report of the Finance Committee meeting held on June 17, file. 1970, and moved that the report be accepted and placed on Seconded by Ald. Wollman, motion carried. Ald. DeBack presented the report of the Public Works Committee meeting ! held on June 18, on file. 1970, and moved that the report be accepted and placed Seconded by Ald. Burgermeister, motion carried. 0 Ald. Foldy presented the report of the Public Safety Committee meeting held on June 18, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Sapp. Motion carried. Ald. Dwyer presented the report of the Public Welfare Committee meeting held on June 18, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Burgermeister, motion carried. Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee meeting held on June 14, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Ald. Burgermeister presented the report of the Public Sewer Committee meeting held on June 15, 1970, and moved that the reports be accepted and placed on file. Seconded by Ald. Sapp, motion carried. The minutes of,,the Plan Commission meeting held on June 16, 1970, were received and placed on file. 0 UNFINISHED BUSINESS Ordinance #172 - An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Shy Property - Tess Corners Fire Dept. Substation). Ald. Dwyer moved to defer action on Ordinance #172 until the next meeting of the Common Council (July 14, 1970). Seconded by Ald. Wollman. Upon a voice vote, the motion to defer carried. Ordinance 1069 - The Deputy Clerk read Ordinance #169, entitled, An Ordinance Amending Certain Sections of Ch. 30 of the Municipal Code(2nd) Ald. Narlock moved for the adoption of Ordinance #169, seconded by Ald. l Foldy. Ald. Dwyer moved to amend Ordinance #169, Section 11, by changing the Sec. No. from 30.38 to 30.36. Seconded by Ald. Foldy. Upon a voice vote, the motion to amend Ordinance #169 carried. Upon a roll call vote, the motion to adopt Ordinance l/169, As Amended, carried unanimously. Ordinance #174 - The Clerk gave the second reading of Ordinance j/174, entitled, An Ordinance to Amend Ch. 3.10 of the Municipal Code by Adding * Thereto Section (3)(e). Ald. Sapp moved for the adoption of Ordinance #174. Seconded by Ald. Narlock. Ald. Narlock moved to amend Ord. 11174 by changing the 2nd sentence of Sec. (l)(e) t o read "A summer cottage shall be a building which is not structurally designed or built for year-round occupancy." Sec- onded by Ald. Foldy. Upon a voice note, the motion to amend carried. Wollman moved for the adoption of Resolution #127-70, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt Resolution #127-70 carried unanimously. Resolution Y/138-70 - The Clerk read Resolution l/138-70, entitled, Appoint- ment to Board of Review (William Sapp). Ald. Foldy moved for the adoption of Resolution #138-70, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt carried unanimously.with Ald. Sapp abstaining from the voting. Ordinance #175 ~- The Clerk gave the first reading of Ordinance l/175, entitled, An Ordinance to Amend Chapter 7 of the Municipal Code (Traffic Code). l Ordinance #176 - The Clerk gave the first reading of Ordinance #176, entitled, An Ordinance to Amend Chapter 1 of the Municipal Code (Municipal Justice). Resolution 11128-70 - The Clerk read Resolution #128-70, entitled, Denial of Legal Lot Status (Mildred Schubert). Ald. Foldy moved for the adoption of Resolution #128-70. Seconded, by Ald. Narlock. The Clerk read a letter from the Plan Commission directed to the Cormnon Council recommending same. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #129-70 - The Clerk read Resolution #129-70, entitled, Denial of Legal Lot Status (Pollock Realty) Ald. Foldy moved for the adoption of Resolution #129-70. Seconded by Ald. Burgenneister. The Clerk read a communication from the Plan Commission directed to the Council recommending same. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #130-70 - The Clerk read Resolution #130-70, entitled, Approval of Extractive Permit for State Sand and Gravel. Ald. Burgermeister moved for the adoption of Resolution #130-70, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #131-70 - The Clerk read Resolution #131-70, entitled, Approval of Extractive Permit for Gravel, Inc. Ald. Burgermeister moved for the adoption of same, seconded by Ald. Foldy. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #132-70 - The Clerk read Resolution j/132-70, entitled, Accepting Road Constructed by Harold DeBack. Ald. Wollman moved for the adoption of Resolution #132-70, seconded by Ald. Burgermeister. Upon a roll call vote, the motion to adopt carried unanimously with Ald. DeBack abstaining l from the voting. Resolution #133-70 - The Clerk read Resolution j/133-70, entitled, Author- izine. to Advertise for Bids to Paint Citv Hall and Garage. Ald. Narlock moved for the adoption of Resolution 11133-70, seconded by Ald. Wollman. Ald. DeBack urged that the Finance Committee receive bids on each building separately. Upon a roll call vote to adopt Resolution f/133-70, Aldermen DeBack, Dwyer, Foldy, Narlock, Sapp and Wollman voted "aye". Alderman & Burgenneister voted "no". Narlock moved for the adoption of Resolution #134-70, 4 seconded by Ald. Sapp. Upon a roll call vote, the motion to adopt same carried unanimously. l Resolution #135-70 - The Clerk read Resolution #135-70, entitled, Trans- ferring Funds from Acct. i/525-014 Dues to Acct. #525-016 Convention Expense. Ald. Narlock moved for the adoption of Resolution #135-70, seconded by Ald. Sapp. Upon a roll call vote, the motion to adopt same carried unanimously. Resolution 11136-70 - The Clerk read Resolution #136-70, entitled, Determin- ing the Sewer Usage Charge under Sec. 5K of Ordinance #155. Ald. Wollman moved for the adoption of Resolution #136-70. Seconded by Ald. Sapp. Upon a roll call vote, the motion to adopt same carried unanimously. Resolution #137-70 - The Clerk read Resolution $1137-70, entitled, Designating Kipling and Longfellow a 4-Way Stop. Ald. Foldy moved for the adoption of Resolution i/137-70, seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt Resolution j/137-70 carried unanimously. 0 At 9:02 Mayor Gottfried declared a recess and the meeting reconvened at 9:16 P.M. VOUCHER APPROVAL - Ald. Sapp moved for the approval of payment of vouchers in the amount of $176,445.36, payable June 23, 1970. Seconded by Ald. Wollman. Upon a roll call vote, the motion to pay the vouchers carried unanimously. LICENSE APPROVAL - Ald. Sapp moved for the approval of an Operator's License for Kenneth Dorow, seconded by Ald. Narlock. Motion carried. Ald. Sapp moved for the approval of Operator's License for Ed Subel and Paul M. DeAngelis subject to the receipt of favorable Fingerprint and Medical Reports. Seconded by Ald. Foldy. Upon a voice vote, the motion carried. Ald. Wollman moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Dale Van Ooyen, subject to the expir- ation of the 15-day waiting period after advertising, as required by State V Law. Seconded by Ald. Narlock. Upon a voice vote, the motion carried. CITY OFFICIAL'S REPORT Attorney Buckley advised that of the four zoning violations upon which legal action had been commenced, one case was satisfactorily disposed of and the other three would be settled in the near future. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a petition from David Cunningham requesting the rezoning 'L of 13 acres of the George Schaefer property in Sec. 8 from RS-2 to RSM. Ald. Wollman moved to set the Public Hearing date for said request for July 28, 1970, 7:00 P.M. in the city hall. Seconded by Ald. Burgenneister. Upon a voice vote, the motion carried. Ald. Wollman moved to sell the mown hay on a portion of the Industrial Park to Harold Scholbe for $60.00. Seconded by Ald. Narlock. Upon a roll call 4 vote, the motion carried unanimously. Sapp moved that the Common Council accept the Wage and Fringe -_ Benefit Contract between the Dispatchers and the City of Muskego as I) indicated with a few minor changes. Seconded by Ald. DeBack. Upon a roll call vote, the motion to accept the contract carried unanimously. l The Clerk read a communication from Attorney E.E. Iushewitz dated June 19, 1970, directed to the Council requesting the vacation of an alley adjoining Lots 34 and 35, Oak Grove Subdivision. Communication referred to Plan Commission and City Attorney. The Clerk read correspondence between Mr. Frank Grisa and the Dept. of Local Affairs & Development regarding the Muskego Industrial Park. Correspondence referred to Mr. Grisa and Plan Commission. The Clerk read a communication from the Wis. Telephone Co., directed to the Mayor regarding the relocation of the telephone cable in the Industrial Park. Communication referred to City Attorney Buckley. City Clerk Bette Bowyer briefly reviewed the proceedings of the 1970 Wisconsin Clerks and Finance Officers Conference held June 17, 18 & 19th, 1970, at Eagle River, Wisconsin. ADJOURNMENT - Ald.
