ccm19700609COMMON COUNCIL CITY OF MUSREGO MINUTES OF MEETING HELD JUNE 9, 1970 Mayor Gottfried called the meeting to order at 7~35 P.M. PRESENT: Mayor Jerome J. Gottfried, Aldermen Robert Burgermeister, Harold DeBack, John Dwyer, Charles Foldy, Frank Narlock, Lois Sapp and Walter Wollman. Also present were City Clerk Bette Bowyer and City Attorney John P. Buckley. Ald. Wollman moved to approve the minutes of the regular meeting held on May 26, 1970, seconded by Ald. Dwyer. Motion carried. COMMITTEE REPORTS Ald. Sapp presented the report of the Finance Committee meeting held on June 3, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock. Motion carried. Ald. DeBack presented the report of the Public Works Committee meeting held on June 4, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Ald. Dwyer presented the report of the Public Welfare Committee meeting held on June 4, 1970, and moved that the report be accepted and placed . on file. Seconded by Ald. Burgenneister and carried. Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee meeting held on May 28, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Foldy and carried. Ald. Burgenneister presented the reports of the Public Sewer meetings held on June 1 and June 8, 1970, and moved that the reports be accepted and placed.on file. Seconded by Ald. Wollman and carried. The minutes of the Plan Commission meeting held on June 2, 1970, were received and placed on file. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried reported that he has been in contact with HUD continually in an effort to obtain federal funds to help with the purchase of Idle l Isle Beach. UNFINISHED BUSINESS Ordinance #164 - The Clerk read Ordinance #164, entitled, An Ordinance to Repeal and Recreate Section 16.25 of the Municipal Code (Re: Relief Valves; Hot Water Heating/Storage Tanks) Upon a roll call vote, the motion to adopt Ordinance #164 carried unanimously. Ordinance #168 - The Clerk read Ordinance i/168, entitled, An Ordinance Creating Ch. 23 of the Municipal Code Regulating the Use of Flammable * Liquids, Fuel Oil Burners and Equipment. Ald. Narlock moved for the adopti'on of Ordinance #168. Seconded by Ald. Foldy. Upon a roll call vote, the motion to adopt Ordinance 11168 carried unanimously. Ordinance #170 - The Clerk read Ordinance #170, entitled, An Ordinance Repealing and Creating Certain Sections of Ch. 16 of the Municipal Code (Re: Holding Tanks). Ald. Narlock moved for the adoption of Ordinance a #170, seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt Ordinance #170 carried unanimously. Common Council Meeting City of Muskego - 619170 Page 2. t l $ Ordinance #171 - The Clerk read Ordinance i/171, entitled, An Ordinance to Repeal, To Recreate and to Amend Certain Sections of Ch. 16 of the Municipal Code (Re: Plumbing Code) Ald. Narlock moved for the adoption of Ordinance #171. Seconded by Ald. Foldy. Ald. Narlock moved to amend Ordinance #ill, SECTION 3 - 16.19 MATERIALS FOR SEWER PIPE AND LATER&.$ (1) All building sanitary sewer laterals shall be constructed of extra heavy cast iron, vitrified clay concrete or asbestos cement pipe. All sewer joints from main to building shall be of rubber or similar gasket approved for that purpose with the following exceptions; a) Where the location of the well requires the use of cast iron pipe with leaded joints. b) In the absence of any ground water, hot poured tar joint will be allowed for the last joint at the building. Seconded by Ald. Wollman. Ald. Burgermeister moved to further amend Ordinance #171 by adding the words "with a minimum diameter of 4Enches" after the words "cement pipe". Seconded by Ald. Wollman. The motion to amend the amendment carried. Also, upon a voice vote, the motion to amend Ordinance #171 carried. Ald. Narlock moved to amend Ordinance #171 by rephrasing Section 4, Section 16.21 (3) of the last paragraph to read "The Plumbing Inspector shall issue a permit for an absorption system installed in accordance with the Waukesha County Community Health Code. Seconded by Ald. Dwyer. Upon a voice vote, the motion to further amend Ordinance #171 carried. Upon a roll call vote, the motion to adopt Ordinance #171 As Amended, carried unanimously. Ordinance 1~172 - The Clerk read Ordinance #172, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Shy Property - Tess Corners Fire Dept. Substation). Ald. Dwyer presented a petition opposing the proposed location for the firehouse substation and therefore moved to defer action on Ordinance #172 until the next meeting of the Council to be held June 23, 1970. Seconded by Ald. Wollman. Upon a voice vote, the motion to defer action on Ordinance #172 until June 23, 1970, carried. Ordinance #173 - The Clerk read Ordinance #173, entitled, An Ordinance to repeal Ordinances #55 and #68 (Former Salary Ordinances) Ald. Wollman moved for the adoption of Ordinance 1~173. Seconded by Ald. Burgermeister. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #76-70 - The Clerk read Resolution 1176-70, entitled, Appointment to Watershed Commission (R. Burgermeister). Ald. Burgermeister moved to 0 amend Resolution #76-70 by changing the name of the appointment to John Dwyer . Seconded by Ald. Sapp. Upon a roll call vote, the motion to amend Resolution i/76-70 carried unanimously. Upon a roll call vote, the motion to adopt Resolution Y/76-70, As Amended, carried unanimously. l Ald. Burgermeister moved to reconsider the motion that had been set - to holda Public Hearing for the proposed rezoning of the George Schaefer Farm (Sec. 8) for June 23, 1970. Seconded by Ald. Dwyer. Upon a roll call vote, the motion to reconsider carried unanim- ously. On the motion to hold the Public Hearing June 23, 1970, Aldermen Burgermeister, DeBack and Dwyer voted "aye". Aldermen Foldy, Narlock, Sapp and Wollman voted "no". The motion to hold the Public Hearing on June 23, 1970, did not carry. At 8:35 P.M. Mayor Gottfried declared a recess and the meeting reconvened at 8:56 P.M. NEW BUSINESS l Resolution 1~119-70 - The Clerk read Resolution #119-70, entitled, Denial of Petition of Bryan A. Frame to Rezone Certain Parcels of Land in Sec. 10. Ald. Burgermeister moved for the adoption of same. Seconded by Ald. Nar- lock. The Clerk read a communication from the Plan Commission directed to the Council recommending the denial. Upon a voice vote, the motion to adopt Resolution #119-70 carried. Ald. Burgermeister moved for the adoption of same, seconded by Ald. Sapp. b > Upon a voice vote, the motion to adopt carried. Resolution 1~121-70 - The Clerk read Resolution #121-70, entitled, Request- ing Establishment of Proper Speed Zone Location in Lake DeNoon Area. l Ald. Sapp moved for the adoption of same. Seconded by Ald. Sapp. Upon a voice vote, the motion to adopt carried. Resolution 1~122-70 - The Clerk read Resolution #122-70, entitled, Resolution Regarding Sale of Land on Pioneer Drive. Ald. Wollman moved for the adoption of same. Seconded by Ald. Narlock. Upon a voice vote, the motion to adopt carried. Resolution #123-70 - The Clerk read Resolution #123-70, entitled, Resolution accepting Resignation of City Engineer. Ald. Sapp moved for the adoption of same. Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #124-70 - The Clerk read Resolution #124-70, entitled, Declar- Q ing the City's Intent to Retain Title to Certain Lands in Fountainwood SubdivvLsion. Ald. Foldy moved for the adoption of same. Seconded by Ald. Sapp. Upon a roll call vote, the motion to adopt Resolution #124-70 carried unanimously. Resolution #125-70 - The Clerk read Resolution i/125-70, entitled, Re- quiring the Payment of Delinquent Withholding Taxes, State Sales Tax and Income Tax Prior to the Issuance of Class "A" and "B" Liquor Licenses. Ald. Sapp moved for the adoption of same. Seconded by Ald. Narlock. Ald. Dwyer moved to amend Resolution 1~125-70 by deleting the words'income tax" from the title, first and third paragraph of the resolution. Seconded by Ald. Sapp. Upon a voice vote, the motion to amend Resolution #125-70 carried. Upon a voice vote, the motion to adopt Resolution $125-70, As Amended, carried. Ordinance i/l69 - The Clerk gave the first reading of Ordinance #169, entitled, An Ordinance Amending Certain Sections of Ch. 30 (Building Code) of the Municipal Code. 0 Ordinance #174 - The Clerk gave the first reading of Ordinance #174, entitled, An Ordinance to Amend Ch. 3.10 of the Municipal Code by adding Thereto Sec. (3)(e) (Re: Sewer Service Charges - Summer Cottages) Resolution #126-70 - Ald. Burgermeister moved to suspend the rules that would interfere with the adoption of Resolution #126-70. Seconded by Ald. Dwyer. Upon a roll call vote to suspend the rules, the motion carried unanimously. The Clerk read Resolution #126-70, entItled, Approving the Prohibition of Swimming at Idle Isle Beach by the Park and Recreation Board. Ald. Burgenneister moved for the adoption of Resolution i/126-70. Seconded by Ald. Sapp. Upon a roll call vote, e the motion to adopt carried unanimously. VOUCHER APPROVAL - Ald. Wollman moved for the apProva1 of payment of Sewer Voucher in the amount of $13,606.00 payable June 9, 1970. Seconded by Ald. Narlock. Narlock moved for the approval of Operators License for Gregory Longhurst. Seconded by Ald. Sapp. Upon a voice vote the motion carried. Ald. Sapp moved for the approval of Operators Licenses for Cathie A. Matelski and Agnes Pickering pending receipt of favorable Fingerprint Report. Seconded by Ald. Narlock. Ald. Sapp moved to amend the motion to add the words "and Medical" after the word "Fingerprint. Seconded by Ald. Narlock. Upon a voice vote, the motion to amend the motion carried. Upon a voice vote, the motion, as amended, carried. Ald. Sapp moved for the approval of Class "B" Fermented Malt Beverage and Intoxicating Liquor Licenses as per the suhaitted list. Seconded by Ald. Wollman. Upon a voice vote the motion carried. Ald. Narlock moved for the approval of Class "A" and Combination Class "A" Liquor Licenses as per the submitted list. Seconded by Ald. Wollman. Upon a voice vote the motion carried. CIfl OFFICIAL'S REPORTS The Clerk presented the Financial Report showing total assets in the amount of $329,495.09 as of May 31, 1970. Report placed on file. The Clerk presented the Building Report for May, 1970. Report placed on file. City Attorney Buckley reported that legal action has been commenced on all zoning violations th&t.bad been referred to him. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a communication directed to the Council, dated June 3, 1970, from Mildred Schubert, requesting determination of legal lot status for lots 5 and 6 Oak Grove Subdivision.
