ccm19700526COMMON COUNCIL CITY OF MIJSREGO MINUTES OF MEETING HELD MAY 26, 1970 Mayor Gottfried called the meeting to order at 7~57 P.M. PRESENT: Mayor Jerome J. Gottfried, Aldermen Robert Burgermeister, Harold DeBack, John Dwyer, Charles Foldy, Frank Narlock, Lois Sapp l and Walter Wollman. Also present were City Clerk Bette Bowyer and City Attorney John P. Buckley. Ald. DeBack moved to approve the minutes of the regular meeting held on May 12, 1970, seconded by Ald. Narlock and carried. COMMITTEE REPORTS Ald. Sapp presented the report of the Finance Committee meeting held on May 20, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Ald. DeBack presented the report of the Public Works Committee meetings held on May 13 and May 21, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. a Ald. Foldy presented the report of the Safety Committee meeting held on May 21, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Ald. Burgermeister presented the report of the Public Welfare Committee meeting held on May 21, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Dwyer and carried. Ald. Dwyer presented the report of the Rules, Laws & Ordinance Committee meeting held on May 14, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Ald. Burgenaeister presented the reports of the PublKc Sewer Committee meetings held on May 18 and May 20, 1970, for the Aldermen's information. The minutes of the Plan Commission meeting held on May 19, 1970, were received and placed on file. 0 COMMUNICATIONS FROM TEE MAYOR'S OFFICE Mayor Gottfried announced that the Mayor, Aldermen and Office Staff and their families are invited to the opening of the Fbuntainwood Pool on Saturday, May 30, 1970, from 1:00 - 4:00 P.M. Mayor Gottfried announced that the streets in the Industrial Park will be known as Mercury Dr., Gemini Dr. and Apollo Dr. He also reviewed the present status of the development of the park. He further indicated that a proposed Subdivision Control Ordinance for the park will be referred to the Plan Commission and the Rules, Laws & Ordinance Committee. 0 OLD BUSINESS Resolution l/66-70 - Resolution Relating to Final Determination of Special Assessments - Northwest District E-5, Area 1. The Clerk read Resolution #68-70, entitled, Resolution Directing Notice of Final Determination (NW Dist, E-5, Area 1) (Bay Shores: etc.) Ald. Narlock moved for the adoption of Resolution #68-70, seconded by Ald. Saw. Upon a roll call vote, the motion to adoptcarried unanimously. The Clerk read Resolution #97-70., entitled, Resolution Establishing Positions in the Police Dept. Aid. Sapp moved for the adoption of Resolution #97-70, seconded by Ald. Foldy. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution 1198-70, entitled, Recognizing Bargaining Agent for Employees of the Muskego Police Dept. Ald. Narlock moved for the adoption of Resolution 1~98-70, seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution #99-70, entitled, Designating the Muskego- Lakeland Hub As Official Newspaper for a Temporary Period. Ald. DeBack moved for the adoption of Resolution #99-70, seconded by Ald. Foldy. Upon a voice vote, the motion to adopt carried. The Clerk read Resolution I/100-70, entitled, Authorizing the Public Works Dept. to Advertise for bids for New Road Grader. Ald. Wollman moved for adoption of same, seconded by Ald. DeBack. Upon a voice vote, motion to adopt carried. The Clerk read Resolution #lOl-70. entitled, Authorizing the Public Works Dept. to Advertise for Bids for New Truck, Plow and Sander. Ald. Wollman moved for the adoption of same, seconded by Ald. Dwyer. Upon a voice vote, motion carried. The Clerk read Resolution #102-70, entitled, Authorizing the Public Works Committee to Advertise for Bids for Sewer Roder. Ald. Wollman moved for the adoption of same, seconded by Ald. Burgermeister, motion to adopt carried. The Clerk read Resolution i/103-70, entitled, Acceptance of Bid for Municipal Sewer Project MSS-2-70, NW Dist. E-5, Area 1 (Cathlina Construction, Inc.) Ald. Wollman moved for the adoption of same, seconded by Ald. Burgermeister. In answer to a question from Ald. DeBack, Mayor Gottfried advised that this bid includes three inches of blacktop for road restoration upon completion of the sewer project. Upon a roll call vote, the motion to adopt Resolution #103-70 carried unanimously. The Clerk read Resolution i/104-70, entitled, Acceptance of Bid for Municipal Sewer Project MSS-3-70, NW Dist. E-5 Area 1 (Ramplex, Inc. Ald. Wollman moved for the adoption of Resolution #104-70, seconded by Ald. Burgermeister. In answer to a questiontiom Ald. Dwyer, Mayor Gottfried advised that the bids for the proposed sewer projects came in 20% lower than estimates of consulting engineers. Upon a roll call vote, the motion to adopt Resolution #104-70 carried unanimously. The Clerk read Resolution #105-70, entitled, Resolution to Waive Rescue Fees Not Collectible. Ald. Dwyer; Upon a roll call vote, the motion to adopt b carried unanimously. The Clerk read Resolution 8107-70, entitled, Authorizing the Public Works Committee to Advertise for Bids to Install Culvert on S.T.R. 24 l in Tess Corners area. Ald. Wollman moved for the adoption of same, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution #108-70, entitled, Resolution Denying Claim of James Kohne. Ald. Burgermeister moved for the adoption of Resolution #108-70, seconded by Ald. Dwyer. Attorney Buckley expanded on this recommendation to deny the claim. Upon a roll call vote, the motion to adopt Resolution l/108-70 carried unanimously. The Clerk read Resolution 8109-70, entitled, Denying Claim of Joan Kohne. Ald. Wollman moved for the adoption of same, seconded by Ald. Burgenneister. Upon a roll call vote, the motion to adopt carried unanimously. 0 The Clerk Read Reaolution #llO-70, entitled, Approval of the Preparation of a City-Wide Newsletter. Ald. Foldy moved for the adoption of Res- olution #llO-70, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt.carried unanimously. The Clerk read Resolution #ill-70, entitled, Authorizing a Preventive Maintenance Agreement Between City and Addressograph Multigraph Co. for Electric Graphotype Machine. Ald. Narlock moved for the adoption of same, seconded by Ald. Sapp. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution 8112-70, entitled, Resolution Approving the Joining of the Wis. Institute of Municipal and County Employers, Inc. Ald. Sapp moved for the adoption of same, seconded by Ald. Wollman. At 9:28 P.M. Mayor Gottfried declared a recess and the meeting reconvened at 9:38 P.M. Ald. Narlock moved to amend Resolution #112-70 by including the a following paragraph: "Be it Further Resolved that $150.00 be transferred from Acct. 8602.049, Contingency Fund." Seconded by Ald. Sapp. The motion to amend Resolution #112-70 carried. Upon a roll call vote, the motion to adopt Resolution #112-70, As Amended, carried unanimously. At this point in the meeting Ald. Foldy requested pe.rmission of his fellow aldermen to have Mr. Raymond J. Dague, Chairman of the Waukesha County Young Democrats, speak. Mr. Dague urged that the Common Council ban the sale pf Disposable beer and soda bottles.within the city. Mayor Gottfried referred Mr. Dague's request and a communication pertaining to same, to the City Attorney and the Rules, Laws & Ordinance Committee. a The Clerk read Resolution #113-70, entitled, Resolution Waiving the Placement of Interior Boundary Stakes in Muskego Industrial Park. Ald. Wollman moved for the adoption of same, seconded by Ald. DeBack. Upon a voice vote, the motion to adopt carried. The Clerk read Resolution #114-70, entitled, Recommending Appointment of * Gerald P. Lee As Agent for Waukesha Co. Health Dept. Ald. Sapp moved for the adoption of same, seconded by Ald. Foldy. The Clerk read Resolution 8115-70, entitled, Resolution Indicating the Intention of the City to Declare Ownership of Gold Drive. Ald. DeBack moved for the adoption of same, seconded by Ald. Burgermeister. Upon a voice vote, the motion to adopt carried. The Clerk read Resolution i/116-70. entitled, Resolution Offering for Sale the the Foundation of the Scholbe Barn. Ald. Wollman moved for the adoption of same, seconded by Ald. DeBack. Upon a voice vote, the motion to adopt same carried. The Clerk read Resolution #117-70, entitled, Preliminary Resolution Declaring Intent to Levy Special Assessment for Sanitary Sewer Improve- ments in Area Known as NW District, E-5, Area 2. Ald. Burgermeister moved for the adoption of same, seconded by Ald. Dwyer. Upon a roll call vote, the motion to adopt Resolution 11117-70 carried unanimously. Ald Wollman moved to suspend the rules that would interfere with the adoption of Resolution #118-70, entitled, Authorizing the Advertising of Bids for Sanitary Sewer Installation in Northwest Distriat. Seconded by Ald. Sapp. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read Resolution #118-70. Ald. Narlock moved for the adoption of same. Seconded by Ald. Burgermeister. Ald. DeBack moved to amend the 2nd and 3rd paragraph of Resolution j/118-70 by changing the word "or" to "and". Seconded by Ald. Foldy. Upon a roll call vote, the motion to adopt Resolution j/118-70, As Amended, carried unanimously. The Clerk gave the first reading of Ordinance #164, entitled An Ordinance to Repeal and Recreate Sec. 16.25 of the Municipal Code (Plumbing Code) Relief Valves, Hot Water Heating/Storage Tanks. The Clerk gave the first reading of Ordinance i/168, entitled, An Ordinance Creating Ch. 23 of the Municipal Code Regulating the Use of Flammable Liquids, Fuel Oil Burners and Equipment. Ald. Wollman moved that the first reading of the following ordinances on the agenda be referred to by title only. Seconded by Ald. Burgermeister. Ald. DeBack spoke as being opposed to the motion. Upon a roll call vote on the motion to refer to the ordinances by title only at this meeting, Aldermen Burgermeister and Wollman voted "aye". Aldermen DeBack, Dwyer, Foldy, Narlock and Sapp voted "no". The motion to refer to the ordinances by title only did not carry. The Clerk gave the first reading of Ordinance #170, entitled, An Ordinance Repealing and Creating Certain Sections of Ch. 16 of the Municipal Code (Re: Holding Tanks). The Clerk gave the first reading of Ordinance #171, entitled, An Ordinance jto repeal, to recreate and to Amend Certain Sections of Ch. 16 of the Municipal Code (Plumbing Code). The Clerk gave the first reading of Ordinance #172, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Shy Property - Tess Corners Fire Dept. Substation in Sec. 25) The Clerk gave the first reading of Ordinance 11173, entitled, An Ordinance to Repeal Ordinances 855 and #68 (Re: Salaries of Police Dept.) VOUCHER APPROVAL - Aid,. Narlock moved for the approval of the payment of vouchers in the amount of $192,389.86, payable May 26, 1970. Seconded by Ald. Wollman. Ald. Narlock moved to amend the voucher payable list by adding the amount of $132,275.00. Seconded by Ald. Wollman. The motion to amend the list carried. Upon a roll call vote, the motion to pay the voucher list, as amended, total amount being $324,664.86, carried unanimously. Common Council Meeting City of Muskego 5/26/70 Page 5. LICENSE APPROVAL Ald. Sapp moved for the approval of Operator's Licenses for Michael Amann, Thomas Ajack and James Janz. Seconded by Ald. Narlock, motion carried. Ald. Wollman moved for the approval of Operator's Licenses for Robert l Dresen and Fred Giesegh pending receipt of favorable Fingerprfntr- Report. Seconded by Ald. Sapp, motion carried. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a petition from Wauer Gravel requesting renewal of their Extractive Permit which expires June 1, 1970. Same referred to Plan Commission. The Clerk read a communication from Richard J. Anderley, President of the Little Muskego Lalce,Association, directed to the Mayor regarding pollution problems. Communication referred to the Public Welfare Committee. ADJOURNMENT - Ald. Dwyer moved to adjourn the meeting. Seconded by Ald. Foldy, motion carried.
