ccm19700428COMMON COUNCIL CITY OF MUSREGO MINUTES OF MEETING RBLD APRIL 28, 1970 Mayor Gottfried called the meeting to order at 7~45 P.M. -. a PRESENT: Mayor Jerome J. Gottfried, Aldermen Robert Burgermeister, Edmund Budish, Harold DeBack, Frank Narlock, Charles Foldy, Lois Sapp and Walter Wollman. Also present were City Clerk Bette Bowyer .* and City Attorney John P. Buckley. Ald. Budish moved to approve the minutes of the regular meeting held on April 14, 1970, and the Organizational meeting held on April 21, 1970. Seconded by Ald. Narlock, motion carried. COMMITTEE REPORTS Ald. Sapp presented the report of the Finance Committee meeting held on April 22, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Ald. DeBack presented the report of the Public Works Committee meeting held on April 23, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. (I, Ald. Burgermeister presented the report of the Public Welfare Committee meeting held on April 22, 1970, and moved that report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. The minutes of the Plan Commission meetings held on April 9th and April 21st, 1970, were received and will be placed on file. CQMMUNICATION FROM l'l.lg MAYOR'S OFFICE Mayor Gottfried delivered a State of the City message in which he re- vealed his philosophies and goals for the City of Muskego for the newt two years. UNFINISHED BUSINESS The Clerk read Resolution #58-70, entitled, Resolution Designating Public Depos\toy and Authorizing Withdrawal of the City of Muskego Monies. 0 Ald.‘&?ved to amend the first paragraph of Resolution #58-70 to include the First National Bank of Waukesha, the Brookfield National Bank and the Hales Corners State-Bank as Public Depositories for the City of Muskego monies. Seconded by Ald. Foldy. In answer to a question from Ald. Budish, City Clerk Bowyer advised that the Marine Banks had no objections to the City using the local banking services for some of the City of Muskego accounts. Upon a roll call vote, the motion to amend Resolution 858-70 carried unanimously. Ald. Wollman moved to further amend Resolution #58-70 to change the name of Donald E. Wieselmann to Jerome J. Gottfried, Mayor. Seconded by Ald. Sapp. Upon a voice vote, the motion to further amend Resolution #58-70 carried. Upon a roll call vote, the motion to adopt Resolution 858-70, As Amended, * carried unanimously. The Clerk read Resolution #60-70, entitled, Resolution Accepting Offer of S. Robert Lentini. Ald. Wollman moved to table Resolution 1~60-70. Seconded by Ald. DeBack. Upon a roll call vote to table Resolution #60-70, the motion carried unanimously. Narlock moved to defer action on Resolution #66-70, entitled, Resolution Relating to Final Determination of Special Assessments. Seconded by Ald. Foldy. Upon a voice vote, motion carried. The Clerk gave the second reading of Ordinance #167, entitled, An Ordinance Amending Ch. 20 of the Municipal Code (Boating Ordinance) Ald. Burgermeister moved for the adoption of Ordinance #167. Seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt Ordinance 8167 carried unanimously. NEW BUSINESS The Clerk read Resolution #63-70, entitled, A Resolution Authorizing and Providing for the Borrowing of $305,000.00 by the City of Muskego, Wis. from the Marine National Exchange Bank of Milwaukee for Various Purposes Specified Therein and for the Issuance of Promissory Notes to Evidence said Borrowing. Ald. Burgermeister moved for the adopting of Resolution Lr #63-70. Seconded by Ald. Wollman. Ald. Burgermeister moved to amend the first paragraph by changing the following figures: $162,000.00 to $188,000.00, $80,000.00 to $50,000.00 and $63,000.00 to $67,000.00. Seconded by Ald. Wollman. Upon a roll call vote to amend Resolution 863-70, the motion carried unanimously. Upon a roll call vote to adopt Resolution #63-70, As Amended, the motion carried unanimously. The Clerk read Resolution #64-70, entitled, A Resolution Authorizing and Providing for the Borrowing of $1,050,000.00 by the City of Muskego, Wis. from Marine National Exchange Bank of Milwaukee for the purpose 'of paying general and current municipal expenses and for the Issuance of Promissory Notes to Evidence Said Borrowing. Ald. Wollman moved for the adoption of Resolution 864-70. Seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt Resolution #64-70 carried unanimously, The Clerk read Resolution #69-70, entitled, Appointment of City Attorney for City of Muskego (John P. Buckley). Ald. Burgenseister moved for the adoption of Resolution #69-70, seconded by Ald. Budish. Mr. Buckley indicated that he would consider it an honor and privilege to serve as City Attorney for the City of Muskego under the new administration. Upon a roll call vote, the motion to adopt Resolution #69-70 carried unanimously. The Clerk read Resolution #70-70, entitled, Appointment of Member to Plan Commission (Alvin Basse). Ald. DeBack moved for the adoption of Resolution 070-70, seconded by Ald. Foldy. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution #71-70, entitled, Appointment of Members to Board of Appeals (John Fonaas and Rarry Smet) Ald. Foldy moved for the adoption of Resolution #71-70, seconded by Ald. Burgermeister. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution 872-70, entitled, Appointment of Member to Police and Fire Commission (Walter Bohrer) Aid. Wollman moved for the adoption of Resolution #72-70, seconded by Ald. Sapp. Upon a roll call vote, Aldermen Budish, Burgermeister, Foldy, Narlock, Sapp and Wollman voted "aye". Ald. Budish moved for the adoption of Resolution #74-70. Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution #75-70, entitled, Establishing "No Parking" Restrictions on the East Side of Garnet Drive) Ald. Burgermeister moved for the adoption of Resolution #75-70. Seconded by Ald. Foldy. Upon the advice of Attorney Buckley, Ald. Budish moved to defer action on Resolution #75-70 until the next meeting, seconded by Ald. Burger- meister. Upon a voice vote, the motion to defer carried. The Clerk read Resolution 876-70, entitled, Appointment of Alderman to Watershed Commission (Burgermeister) Ald. Sapp moved for the adoption of Resolution #76-70, seconded by Ald. Foldy. Ald. DeBack moved to defer action on Resolution #76-70 until after the appointment of the Alderman of Ward VII who will succeed Edmund Budish. Seconded by Ald. Budish. Upon a roll call vote to defer action on Resolution #76-70, Aldermen Budish, DeBack, Foldy, Narlock and Wollman voted "aye". Aldermen Burgermeister and Sapp voted "no". The motion to defer carried. The Clerk read Resolution 877-70, entitled, Appointment of Alderman to Park and Recreation Board (Burgenneister). Ald. Budish moved for the adoption of Resolution #77-70, seconded by Ald. DeBack. Ald. Wollman moved for the adoption of Resolution #79-70, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. The dlerk read Resolution #80-70, entitled, Declaring Certain Weeds to be Noxious Within the Boundaries of the City of Muskego. Ald. Budish moved for the adoption of Resolution #80-70, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution #81-70, entitled, Designation of Legal Lot (Prusinski) Ald. Wollman moved for the adoption of Resolution #81-70, a seconded by Ald. Foldy. The Clerk read a conxwnication from the Plan Commission directed to the Council and Mayor, dated April 22, 1970, recommending that Lot 826, Bay Shore Estates, be granted Legal Lot Status. The Clerk read Resolution #SC70 entitled, Accepting Low Bid for the Use of Liquid Asphalt for City Street Purposes (Wolf Construction) Ald. Wollman moved for the adoption of Resolution 884-70, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution #85-70, entitled, Accepting the Low Bid for Q Bituminois Asphalt to be used by the City of Muskego for 1970. (Payne & Dolan) Ald. Wollman moved for the adoption of Resolution #85-70, seconded by Ald. Burgermeister. Upon a roll call vote, the motion to adopt carried unanimously. The Clerk read Resolution #86-70, entitled, Resolution Authorizing the Advertising of Bids for Sandseal. Ald. DeBack moved for the adoption of Resolution #86.-70, seconded by Ald. Burgermeister. Wollman moved to suspend the rules that would interfere with the adoption of Resolution #89-70, entitled, Resolution Extending Appreciation to Edmund A. Budish. Seconded by Ald. Narlock. Upon a roll call vote to suspend the rules, the motion carried unanimously. The Clerk read Resolution #89-70. Ald. Wollman moved for the adoption of Resolution #89,70. Seconded by Ald. Narlock. Several of the Aldermen and Clerk Bowyer expressed their regrets at Alderman Budish's resignation and all wished him success with his new venture in Canada. Upon a roll call vote, the motion to adopt Resolution #89-70 carried unanimously. VOUCHER APPRDVAL Ald. Narlock moved for the approval of payment of vouchers as of April 28, 1970, in the amount of $776,501.48. Seconded by Ald. Wollman. COMMUNICATIOWS AND MISCELLAWEOUS BUSINESS m The Clerk read a communication directed to-Mayor Gottfried and the Common Council directed to the City Plan Commission, dated April 28, requesting an extension of time before making their recommendation a on the rezoning petitions of the Bryan Ardis Frame and the Les Abel properties in Section 10. Ald. Sapp moved to grant the extension of time until June 1, 1970, seconded by Ald. Burgenneister. Upon a voice vote, the motion carried. The Clerk read a communication directed to the Mayor and Council, dated April 28, 1970, from the Board of Appeals, requesting that the Council expend all efforts to make a decision on stand-by sewer charge and hook-up for summer cottages. Communication referred back to the Sewer Committee. The Clerk read a communication directed to Mayor Gottfried, dated April 27, 1970, from Mr. I.L. Tipple, President, West Allis Savings and Loan, requesting that he contact Mr. Raymond Wallner, an agent for his firm, regarding property'located at S76 W18149 Janesville Rd., Muskego. Communication referred to Sewer Committee, Public Works Committee and Plan Commission. Mayor Gottfried requested that the entire Council be present at the City Hall on Thursday, May 7, 7:OO P.M. for the purpose of interviewing the candidates for the position of Alderman of Ward VII. . . Ald. Wollman suggested that a meeting be arranged between the School Board and the Common Council in the near future. ADJOURNMENT - Ald. Budish moved to adjourn the meeting. Seconded by Ald.
