ccm19700324COMMON COUNCIL CITY OF MUSREGO MINUTES OF MEETING HELD MARCH 24, 1970 Mayor Wieselmann called the meeting to order at 8:06 P.M. ,.. -. a PRESENT: Mayor Donald Wieselmann, Aldermen Robert Burgermeister, Edmund Budish, Harold DeBack, Frank Narlock, Emmett O'Connell, Lois Sapp and Walter Wollman. Also present were City Clerk Bette J. Bowyer and City * Attorney John P. Buckley. APPROVAL OF MINUTES - Ald. Narlock moved to approve the minlltes of the regular meeting held on March 10, 1970. Seconded by Ald. Burgenaeister, motion carried. COMMITTEE REPORTS Finance Committee - Ald. Narlock presented the report of the meeting held on March 18, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. DeBack, motion carried. Public Works Committee - Ald. Wollman presented the report of the meeting held on March 19, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Budish, motion carried. $ Public Welfare Committee - Ald. Burgermeister presented the report of the meeting held on March 18, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Public Safety Committee - Ald. Sapp presented the report of the meeting held on March 18, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. O'Connell, motion carried. Rules, Laws & Ordinance Committee - Ald. Sapp presented the report of the meeting held on March 19, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Plan Commission - The minutes of the meeting held on March 18, 1970, were-received and placed on file. At this time Ald. DeBack requested permission of of his fellow Aldermen and the Mayor to have Mr. Richard Arrington, W203 S10630 N. Shore Dr., speak. As there were no objections, Mr. Arrington, representing the Lake DeNoon Association, requested that the City take whatever steps are necessary to have the property in question, which is now owned by the City of Muskego, revert back to the ownership of the property owners involved or the ownership of the previous owner. City Attorney Buckley reviewed the State Statutes applicable to the situation and Mayor Wieselmann suggested that because of the prevailing statutes the matter be referred to the Plan Commission. Mr. James T. Barry appeared at the meeting to discuss the present status of the Muskego Business/Industrial Park. He displayed a proposed brochure advertising the Park. Ald. Budish moved to suspend the rules in order that the Council could act on this matter at this time. Seconded by Ald. Burgenneister. Upon a roll call vote, motion carried. Ald. Budish moved that the City accept the-.proposal ef the James T. Barry Co. for the brochure and layout of an outdoor sign in an amount not to exceed $2,200.00. Seconded by Ald. DeBack. Upon a roll call vote, the motion carried unanimously. Ald. Narlock moved for the acceptance of the sign proposal in an amount not to exceed $800.00. Seconded by Ald. Budish. City Attorney Buckley advised that this matter would need Plan Commission approval and will be referred to said Commission. Upon a roll call vote, the motion carried unanimously. 0 0. Common Council Meeting City of Muskego 3124170 Page 2. UNFINISHED BUSINESS Resolution f/14-70 - Establishing Salaries for Elected Officials and Other Employees of the City of Muskego. Mr. John Sculley, representing Associated Hospital Service, appeared at the meeting and advised that an opinion will be received by him from his firm's legal counsel re- garding the employees of the City who have duplicity of insurance coverage and he would report back to the Council upon receipt of same. Ald. Budish moved to defer action on this matter until the next meeting. Seconded by Ald. Wollman. Upon a voice vote, the motion carried. NEW BUSINESS Resolution #50-70 - The Clerk read Resolution f/50-70, entitled, Author- izing the acceptance of Low Bid for Kurth Park Recreational Building. Ald. Narlock moved for the adoption of Resolution #50-70. Seconded by Ald. DeBack. Upon a roll call vote, the motion carried unanimously. Resolution $151-70 - The Clerk read Resolution f/51-70, entitled, Waiving of Building Permit Fees for Kurth Park Building. Ald. Wollman moved for the adoption of Resolution i/51-70. Seconded by Ald. Burgenneister. Upona roll call vote, the motion carried unanimously. Resolution #53-70 - The Clerk read Resolution 853-70, entitled, Author- izing the Public Works Dept. to Dispose of Junked Truck. Ald. DeBack moved for the adoption of Resolution #53-70. Seconded by Ald. Budish. Upon a roll call vote, the motion carried unanimously. Resolution #54-70 - The Clerk read Resolution 854-70, entitled, Author- izing Disbursement to be made from Acct. #602.049, Contingency Fund. to Reimburse Taxpayer for Erroneous 1969 Personal Property Tax Assess- ment (John Lang) Ald. Narlock moved for the Resolution #54-70. Seconded by Ald. Budish. Upon a roll call vote, the motion carried unanimously. Resolution #55-70 - Resolution Authorizing the Issuance of Promissory Notes of the City of Muskego, Waukesha County, Wisconsin, Providing Details Thereof and Levying Taxes Therefor (Foth-Scholbe Purchases). Ald. Burgenneister moved to suspend the rules that would interfere with the adoption of Resolution 855-70. Seconded by Ald. Wollman. Upon a roll call vote, the motion to suspend the rules carried unanim- ously. The Clerk read Resolution #55-70. Ald. Wollman moved for the adoption of Resolution 855-70. Seconded by Ald. DeBack. Ald. DeBack moved to insert April 1, 1970, into Section 5 and Section 7 of Resolution #55-70. Secondeded by Wollman. Upon a voice vote, motion carried. Upon a roll call vote, the motion to adopt Resolution #55-70 carried unanimously. Ordinance #166 - The Clerk gave the first reading of Ordinance #166, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego. Ald. Narlock moved to suspend the rules that would allow the second reading of the ordinance. Seconded by Ald. DeBack. Upon a roll call vote, Aldermen Budish, DeBack and Narlock voted "aye". Aldermen Burgermeister, O'Connell. Sapp and Wollman voted "no". The motion to suspend the rules did not carry. VOUCHER APPROVAL - Ald. Budish moved for the approval of payment of vouchers in the amount of $136,600.64. Seconded by Ald. Narlock. Budish moved for the approval of an Operator's License for Ann Moser. Seconded by Ald. Narlock. Motion carried. Ald. DeBack moved for the approval of an Operator's License for Terry Bartelt pending receipt of favorable Fingerprint Report. Seconded by Ald. Narlock. Motion carried. Ald, Narlock moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for. Suzanne E. Kondell. Seconded by Ald. Budish, motion carried. Ald. Budish moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Guenther Christ. Seconded by Ald. DeBack, motion carried. Ald. DeBack moved for the Leonard's Home and School motion carried. approval of a "Gathering" License" for St. for April 4, 1970. Seconded by Ald. Narlock, Ald. Budish moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Frank Pancratz. Seconded by Ald. Narlock, motion carried. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The matter of an easement and a parcel of land in Hi-Y Ranches, owned by S. Robert Lentini and offered for sale to the City, was discussed. Ald. Budish moved to refer this matter to the Plan Commission. Sec- onded by Ald. Burgermeister. Upon a voice vote, motion carried. City Attorney Buckley advised that those sections of the Zoning Ordinance that were in dispute, subject to the recent Lawsuit involving Parkland Plaza, should be readopted through the regular zoning procedures. and the Common Council should initiate the proceedings. The matter of Lot 62, Jewel Crest Subdivision (owned by the City of Muskego) is being considered for the possible use of a life station. and was referred to the Plan Commission. The Clerk read a communication from Chief Utpatel of the Tess Corners Fire Dept., dated March 18, 1970, directed to the Mayor, requesting that the Common Council initiate the for the zoning change. The Clerk read a communication from Lloyd E. Taylor and Joan Taylor, Gurnee, Illinois, dated March 19, 1970, directed to the Mayor, objecting to the proposed establishment of a conservation area near the land formerly owned by Adam Ignasiak. The Clerk read claims from James and Joan Kohne, W200 S7203 Hi-Y Drive, Muskego, regarding 1969 real estate ass,essment. Cla~ims referred to City Attorney Buckley. The Clerk read a cormnunication from Ald. Edmund Budish informing the Mayor and Council of his resignation as Alderman of Ward VII effective May 1, 1970. Mayor Wieselmann stated that on behalf of the City he wished to express his thanks to Ald. Budish for the many years he has served the City. Common Council Meeting City of Muskego 3124170 Page 4. Ald. Wollman moved to set the Public Hearing date for the rezoning of the land for the newly proposed location of the Tess Corners Fire Department (Sec. 25) for April 28, 1970, at 7:15 P.M. Seconded by Ald. Budish, motion carried. Ald. Wollman moved to reconsider Resolution #48-70, entitled, Appoint- ment of Alternate Member to Board of Appeals (Estel Ellery). Seconded by Ald. Burgermeister. Upon a roll call vote to reconsider Resolution $148-70, Aldermen Burgenneister, Sapp and Wollman voted "aye". Aldermen Budish, DeBack, Narlock and O'Connell voted "no". The motion to re- consider #48-70 did not carry. Mr. Seegar Swanson, representing Ehlers & Associates, reviewed the bids that had been submitted for proposals for various banking services for the City of Muskego. Following discussion, Ald. Budish moved that the two bids received from local branch banks be tabled at this time. Seconded by Ald. Narlock. Motion carried. ADJOURNMENT - Ald. Budish moved to adjourn the meeting.
