ccm19700210l 0‘ COMMON COUNCIL CITY OF MUSKEGO MINUTES OF REGULAR MEETING HELD FEBRUARY 10, 1970 Ma~yor Wieselmann called the meeting to order at 7~30 P.M. PRESENT: Mayor Donald Wieselmann, Aldermen Robert Burgenneister, Edmund Budish, Harold DeBack, Frank Narlock, Emmett O'Connell, Lois Sapp and Walter Wollman. Also present were City Clerk Bette J. Bowyer and Attorney John Buckley. APPROVAL OF MINUTES - Ald. Wollman moved to approve the minutes of the Common Council meeting held January 27, 1970, as mailed. Seconded by Aid. Budish. Motion carried. Mayor Wieselmann welcomed Girl Scout Cadet Troop 8410 who were present this evening to help in their study of City Government. COMMITTEE REPORTS Finance Committee - Ald. DeBack presented the report of the meeting held on February 4, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock and the motion carried. Public Works Committee - Ald. DeBa~ck presented the report of the meeting held on February 5, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Public Welfare Committee - Ald. Burgermeister presented the report of the meeting held on February 4, 1970, a~nd moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Public Safety Committee - Aid. Sapp presented the report of the meeting held on February 4, 1970, and moved that the report be accepted and pla~ced on file. Seconded by Ald. O'Connell, motion carried. Rules, Laws & Ordinance Committee - Ald. Sapp presented the report of the meeting held on Februa~ry 5, 1970, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Plan Commission - The Minutes of the meeting held on February 3, 1970, were received and placed on file. UNFINISHED BUSINESS Resolution j/14-70 - Establishing Salaries for Elected Officials and Other Employees of the City of Muskego. Ald. Wollman moved to defer action on Resolution until the next meeting. Seconded by Ald. Burgermeister. Upon a voice vote, motion carried. Resolution i/108-69 - Resolution to Rename Racine Ave. from S.T.H. 24 south to new Highway "Y". Ald. Burgermeister moved to defer action on Resolution #108-69 in order to give the Public Safety Committee time to meet with all interested people. Seconded by Ald. Wollman. Upon a voice vote the motion carried. Resolution #208-68, As-Amended - Authorizing a Service Fee of $25.00 for Persons Served by the Tess Corners Rescue Squad. Ald. Budish moved for the adoption of Resolution j/208-68. Seconded by Ald. Narlock. - Common Council Meeting City of Muskego 2/10/70 Page 2. Ald. Wollman moved to amend Resolution i/208-68, As Amended, by changing the date in Paragraph (l), Line 1, from January 1, 1969, to March 1, 1970. Seconded by Ald. Burgermeister. Upon a voice vote, the motion to further amend Resolution 11208-68, As Amended, carried. Upon a roll call vote, the motion to adopt #208-68, As Amended, carried unanimously. NEW BUSINESS Resolution #18-70 - Approval of 1970 Contract for Rescue Service. The Clerk read Resolution i/18-70. Ald. Wollman moved for the a~doption of Resolution j/18-70. Seconded by Ald. Sapp. Upon a roll call vote, the motion carried unanimously. Resolution i/19-70 - The Clerk read Resolution #19-70, entitled, Denial of Rezoning Petition for John Podgorski. Ald. Narlock moved for the adoption of Resolution #19-70. Seconded by Ald. Sapp. The Clerk read the communication from the Plan Commission, dated February 4, 1970, recommending the denial of the rezoning petition. Upon a voice vote, the motion to adopt Resolution #19-70 carried. Resolution $121-70 - The Clerk read Resolution #21-70, entitled, Authorizing the Advertising of Bids for the Construction of Recreational Building at Kurth Pa,rk. Ald. Burgermeister moved for the adoption of Resolution l/21-70. Seconded by Ald. Wollman. In answer to a question from Ald. Budish as to the availability of recrea~tional lands in the southern part of the City, Aid. Burgenneister assured him that action would be taken by the Park and Recreation Board as soon as possible. He a~lso briefly reviewed the specifications and plains for the proposed recreational building. Upon a roll call vote, the motion to adopt Resolution 1121-70 carried unanimously. Resolution 822-70 - The Clerk read Resolution 1122-70, entitled, Authorizing the Purchase of Land Abutting Jensen Park. Ald. Burger- meister briefly reviewed the circumstances that led to the necessity of purchasing the 35 feet of property from Mr. James Warwick that overlapped the hard surfaced play area, at Jensen Park. Ald. Burger- meister moved for the adoption of Resolution J/22-70, seconded by Ald. Wollman. Upon a roll call vote, the motion to adopt Resolution #22-70 carried unanimously. Resolution 824-70 - The Clerk rea~d Resolution i/24-70, entitled, Authorizing Transfer of Funds from Acct. #292, Unappropriated Surplus, to Muskego Utility Redemption Fund. Ald. Budish moved for the adoption of Resolution 824-70. Seconded by Ald. Wollma~n. Ald. Narlock moved to amend Resolution 824-70 by changing the year 1970 in the first and second paragraph to "1969". Seconded by Ald. DeBack. Upon a voice vote, the motion to amend Resolution i/24-70 carried. Upon a roll call vote, the motion to adopt Resolution #24-70 carried unanimously. Resolution j/25-70 - The Clerk read Resolution i/25-70, entitled, Authorizing the Issuing of Promissory Notes for the Acquisition and Development of Industrial Sites. Ald. Budish moved for the adoption of Resolution #25-70. Seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt Resolution #25-70 carried unanimously. Resolution j/26-70 - The Clerk read Resolution i/26-70, entitled, Resolution Authorizing the Continued Service of Ehlers & Associates Inc. - Part III of Proposal. Ald. Budish moved for the adoption of Resolution #26-70. Seconded by Ald. Narlock. Mr. Seegar Swanson of Ehlers & Associates, Inc. was present to answer several questions of the Aldermen regarding his company's proposal to a~ct as Financial Consultants for the City of Muskego. Following the discussion, Ald. Sapp moved to defer action on Resolution #26-70 in order to have more Common Council Meeting City of Muskego - 2110170 Page 3. time to review the proposal. Seconded by Ald. Burgermeister. Upon a roll call vote.on the motion to defer, Aldermen Sapp, Burgenneister and Wollman voted "aye" and Aldermen Budish, DeBack, Narlock and O'Connell voted "no". The motion to defer did not carry. Upon a, roll call vote to adopt Resolution f/26-70, Aldermen Budish, DeBack, Narlock and O'Connell voted "aye" and Aldermen Burgermeister, Sapp and Wollman voted "no". The motion to adopt Resolution #26-70 carried. Resolution i/27-70 - In order to introduce this resolution, the Clerk needed only to read same, entitled, Initial Resolution Authorizing $1,500,000.00 General Obligation Bonds of the City of Muskego. Resolution 828-70 - The Clerk read Resolution 7128-70, entitled, Resolution Authorizing Publication of Initial Resolution. Ald. Narlock moved for the adoption of Resolution i/28-70. Seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Resolution 828-70 carried unanimously. Resolution i/29-70 - Ald. Budish moved to suspend the rules in order that this resolution could be brought to the floor. Seconded by Ald. Narlock. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read Resolution i/29-70, entitled, Authorizing Disbursements to be made from Account 602.049, Contingency Fund to Reimburse Several Taxpayers Covering Erroneous 1969 Tax Assessments. Ald. Budish moved for the adoption of Resolution #29-70. Seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt Resolution 829-70 carried unanimously. Resolution j/30-70 - Ald. Narlock moved to suspend the rules that would interfere with the adoption of Resolution #30-70. Seconded by Ald. Budish. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read Resolution 830-70, entitled, Resolution Authorizing Necessary Transfer of Funds from Account 8292, Unappropriated Surplus,to Various Departmental Accounts. Ald. Narlock moved for the adoption of Resolution 830-70. Seconded by Ald. DeBack. Upon a~ roll call vote, the motion to adopt Resolution i/30-70 carried unanimously. Ordinance l/162 - The Clerk gave the 1st reading of Ordinance 8162, entitled, An Ordinance to Amend Section 3.08(2) Ch. 17 of the Municipal Code (Re: Bd. of Appeals Membership). Ordinance 8165 - The Clerk gave the first reading of Ordinance #165, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Scholbe-Fofh Property) Ald. Burger- meister moved to suspend the rules in order to have the second reading of the ordinance. The Clerk gave the second reading of Ordinance 8165. Ald. Budish moved for the adoption of Ordinance 8165. Seconded by Ald. Na~rlock. Upon a voice vote, the motion to adopt Ordinance 8165 carried. VOUCHER APPROVAL - Ald. DeBack moved for the approval of the payment of vouchers in the amount of $39,227.22 payable February 10, 1970. Upon a roll call vote, the motion to pay the vouchers carried unanimously. LICENSE APPROVAL - Ald. Budish moved for the approval of an Operator’s License for Daniel Barnhardt pending receipt of favora~ble Fingerprint and Medical Report. Seconded by Ald. DeBack. Motion ca~rried. CITY OFFICIAL'S REPORT The Clerk gave the Financial Report showing total assets in the amount $413,567.57 as of Janua~ry 31, 1970. Report to be placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS l The Clerk read a communication directed to the Mayor and Council from Mr. W.M. Masterson, dated February 9, 1970, requested that action regarding sewer lateral installation to Dandilion Park be expedited as the ballroom will be open for the first event on March 14, 1970 and it will require sanitary sewer connection by that date. City Clerk Bowyer advised the Council that the check protector owned by the City was outmoded and badly in need of repair. Ald. Budish moved tha~t a new check protector be purchased. Seconded by Ald. Wollman. Upon a roll ca~ll vote, the motion carried. Ald. Wollman a,dvised that bids for sewer lateral installation for Dandilion Park had been rejected and new bids would be opened on February 19, 1970, at 4:00 P.M. a Ald. Wollman requested that the secreta~ries of various committees have the minutes of their meetings in the Clerk's Office by Friday in order to have the Aldermen receive them prior to the Common Council meeting.
