ccm19691223COMMON COUNCIL CITY OF MUSKEGO MINUTES OF REGULAR MEETING HELD DECEMBER 23, 1969 Mayor Wieselmann called the meeting to order at 7:45 P.M. l PRESENT: Mayor Donald Wieselmann, Aldermen Robert Burgermeister, Edmund Budish, Harold DeBack, Frank Narlock, Emmett O'Connell, Lois Sapp and Walter Wollman. Also present were City Attorney John Buckley and City Clerk Bette J. Bowyer. APPROVAL OF MINUTES - Ald. Narlock moved to approve the minutes of the Council meeting held December 9, 1969, as mailed. Ald. DeBack. Seconded by Motion carried. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Wieselmann advised that the tax bills have been received and that the rate is $26.34 per one thousand dollars of assessed valuation. Mayor Wieselma~nn appointed a committee to report to the Council on the new reassessment. He advised that the Committee is to submit a detailed report as to how the reassessment came about and the results of it and that the report is to be mailed to the Supervisor of Assessments and to be available to all citizens of Muskego. He appointed Alderman Narlock, Chairman, Alderman DeBack, Secretary and Alderman Sapp, member. Mayor Wieselmann encouraged the adoption of Resolutions #143-69 and #144-69, pointing out the City's need for an industrial park and the necessity for all to work toward its success. COMMITTEE REPORTS Finance Committee - Ald. Narlock presented the report of the meeting held on December 17, 1969, and moved that the report be accepted and placed on file. Seconded by Ald. Budish, motion carried. Public Works Committee - Ald. DeBa~ck presented the report of the meeting held on December 18, and placed on file. 1969, and moved that the report be accepted Seconded by Ald. Wollman, motion carried. Public Welfare Committee - Ald. Burgermeister presented the report a of the meeting held on December 12, 1969, and moved tha~t the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Rules, Laws & Ordinance Committee - Ald. Sapp presented the report of the meeting held on December 18, 1969, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Public Safety Committee - Ald. Sapp presented the report of the meeting a held on December 17, 1969, and moved that the report be a~ccepted,and placed on file. Seconded by Ald. O'Connell, motion carried. Plan Commission - The minutes of the meeting held on December 16, 1969 were accepted and placed on file. UNFINISHED BUSINESS Resolution j/129-69 - The Clerk read Resolution $1129-69, entitled, Reso- lution Authorizing Exercise of Option for Purchase of Idle Isle Beach. Ald. Burgermeister read a commun ,. .icat .ion from the president of the Little Muskego Lake Association, Ron Ford, encouraging the purchase of Idle Isle. As Resolution i/129-69 was already on the floor, upon a roll call vote, a Aldermen Budish, Burgermeister, DeBack, Narlock,?O'Connell and Wollman voted "aye" and Ald. Sapp voted "no". Ald. Narlock moved to direct the Clerk to make payment from the general fund. Ald. DeBack seconded the Common Council - 12/23/69 City of Muskego Page 2. - u motion and upon a roll call vote, carried unanimously. the motion to adopt Resolutionti#129-69 Resolution $1131-69 - This resolution, entitled, Approval of Easement by Wisconsin Electric Power Company for Muskego Lakes Country Club was already on the floor. The Clerk read the Indemnity Agreement between the City of Muskego and the Muskego Lakes Country Club. Ald. Budish expressed concern at the language used in the agreement referring- to "a public street opening" pointing out that the Public Works Dept. would not be responsible for building a road(~to access to the country club. Ald. Burgermeister moved to defer action on Resolution i/131-69 until representatives of the Muskego Lakes Country Club can meet with the Public Works Committee. Ald. Budish seconded the motion and the motion carried, Resolution 8141-69 - Resolution f/141-69, entitled, Authorizing Installation of Manholes and Sewer Laterals to Serve Parcels A and B 0 of Certified Survey Map 8734617 was already on the floor. Attorney Buckley advised that the resolution was not necessary as it had been drawn up through a misinterpretation of the Plumbing Code. Upon a voice vote, the motion to adopt Resolution #141-69 did not carry. Ordinance 8157 - The Clerk gave the second reading of Ordinance $1157 entitled, An Ordinance to Amend Sec. 25.01 (1) (a). Ald. Na~rlock moved for the adoption of Ordinance i/157. Ald. Burgermeister seconded the motion and the motion carried. NEW BUSINESS Resolution j/142-69 - The Clerk read Resolution 11142-69, entitled, Acceptance of Low Bid of Schroeder Plumbing Co., Inc., to Install Sewer Lateral to Serve the Samuel Jones property. Ald. Wollman moved for the adoption of Resolution 8142-69. Ald. Budish seconded the motion and upon a roll call vote the motion carried unanimously. l Resolution i/143-69 - The Clerk read Resolution #143-69, entitled, Resolution Authorizing the Exercise of an Option to Purchase Certain Real Estate in the City of Muskego (Foth). Ald. Narlock moved for the adoption of Resolution i/143-69. Aid. DeBack seconded the motion. Ald. Narlock cited the city's need for an industrial park. Mayor Wieselmann advised that the purchase and ultimate use of this property will fall within the plan outlined by Mr. James Barry. Ald. DeBack spoke in fa~vor of the adoption of this resolution. Ald. Sapp expressed concern at the marketability of Assessment "B" Bonds for the Sewer a Program. Mr. Louis Ludwig, spokesman for the Industrial Committee, advised that at their last meeting they had unanimously voted to exercise these options (Foth and Scholbe). Attorney Buckley reviewed the option on the Foth property. Mr. Seegar Swanson advised that the 5.6% was a very acceptable interest rate. Upon a roll call vote to adopt Resolution f/143-69, Aldermen Burgenneister, Budish, DeBack, Narlock, O'Connell and Wollman voted "aye". Alderman Sapp voted "no". Resolution 8144-69 - The Clerk read Resolution j/143-69, entitled, Resolution Authorizing the Exercise of an Option to Purchase Certain Real Estate in the City of Muskego (Scholbe). Ald. Narlock moved to adopt Resolution 8144-69. Ald. Burgermeister seconded the motion. Upon a roll call vote, Aldermen Burgermeister, Budish, DeBack, Narlock, O'Connell and Wollman voted "aye". Alderman Sapp voted "no". Resolution i/145-69 - The Clerk read Resolution i/145-69 entitled, *Approval of Radar Maintenance Contract with Stark Electronic Service, Inc. Ald. DeBack moved to adopt Resolution i/145-69. Ald. Budish seconded the motion and upon a roll call vote, the motion carried unanimously. Resolution 11146-69 - The Clerk read Resolution 8146-69, entitled, Defining Fringe Benefits for Public Works Employees for the year 1970. Ald. Wollman moved to adopt Resolution 11146-69. Seconded by Ald. Budish. Ald. Budish moved amend Resolution f/146-69 by deleting the words “at the discretion of Department Head!'. Seconded by Ald. Burgenneister and the motion carried. Discussion followed regarding the work week, work day and overtime pay. Upon a roll call vote to adopt Resolution i/146-69, As Amended, the motion carried unanimously. Mayor Wieselmann declared a recess at 9:32 P.M. and the meeting re- convened at 9147 P.M. Ordinance #159 - The Clerk gave the first reading of Ordinance #159 entitled, An Ordinance to Amend Section 12.01(7) of the Municipal. Ordinance #160 The Clerk ga~ve the first reading of Ordinance 8160, entitled, An Ordinance to Amend Sec. 2.02, Sec. 8.11 (7) A 2 c. a~nd Sec. 9.06 (7) A 2. b. a~nd f. of Chapter 17 of the Municipal Code. Ordinance #161 - The Clerk gave the first reading of Ordinance #161, entitled, Establishing a Muskego Water Shed Commission. LICENSE ACTION - Ald. Budish moved to deny a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Clifford Weber. Ald. DeBack seconded the motion and the motion carried. VOUCHER APPROVAL - Ald. Narlock moved to approve the payment of vouchers in the amount of $167,332.40, payable December 23, 1969. Ald. Budish seconded the motion and upon a~ roll call vote, the motion carried unanimously. Ald. DeBack moved for the payment of sewer vouchers in the amount of $40,472.25. Ald. Narlock seconded the motion and upon a roll call, vote the motion carried unanimously. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Ald. Narlock moved to schedule a public hearing for January 27, 1970, 7:15 P.M. to consider the petition of John Podgorski to rezone a pa~rcel of land in Section 9 from RS-3 to B-l. Ald. Burgermeister seconded the motion and the motion carried. Mayor Wieselmann advised that the uniform a,llowance for the dispatchers had been deleted by Council action when Resolution 888-69 had been adopted. Following discussion, Alderman Burgermeister moved to direct the Clerk to pay the dispatchers uniform allowance for 1969. Ald. Narlock seconded the motion and upon a roll call vote, the motion carried unanimously. Common Council - 12123169 City of Muskego Page 4. Mayor Wieselmann advised that Police Chief Kraus had requested that the Council authorize the appointment of two Patrol Sergeants. Ald. Burgermeister moved to authorize the appointment of two Patrol Sergeants. Ald. Wollman seconded the motion and the motion carried. Attorney Michael Schober appeared regarding a sewer engineering problem on the George Schaefer property. It was the Council's decision to refer this problem to the consulting engineers and legal advisors. City Clerk Bette Bowyer advised that a~ primary election will be held the first Tuesda~y in March and that the regular election will be held the first Tuesday in April. Ald. Budish moved that the City Clerk put a notice in the paper con- cerning the use of snowmobiles. Ald. Wollman seconded the motion and the motion carried. Mr. Seegar Swanson, representative of Ehlers and Associates, Inc., presented a final Finance Plan for the City of Muskego dated December 23, 1969. He reviewed the revisions in the Assessment B Bonds which had recently been passed by the state legislature. Mayor Wieselmann advised that he would like to introduce a resolution thanking Senator James Devitt and Assemblyman John Shabaz for their assistance in making this legislature pass.
