MINUTES OF REGULAR MEETING HELD SEPTEMBER 23, 1969

Mayor Wieselmann called the meeting to order at 7~38 P.M.
PRESENT: Mayor Wieselmann, Robert Burgermeister, Harold DeBack, Frank
Narlock, Lois Sapp, Emmett O'Connell, Walter Wollman. Also present

were City Clerk Bette Bowyer and City Attorney John Buckley.
ABSENT: Ald. Edmund Budish.
APPROVAL OF MINUTES: Ald. Narlock moved to approve the minutes of the
previous meeting held on September 9, 1969, as mailed. Seconded by Ald.
Burgermeister, motion carried.
COMMITTEE REPORTS
Ald. Narlock presented the report of the Finance Committee meeting held
on September 17, 1969 and moved that the report be accepted and placed
on file. Seconded by Ald. DeBack, motion carried.
Ald. DeBack presented the report of the Public Works Committee meeting
r-. held on September 18, 1969 and moved that the report be accepted and
0 placed on file. Seconded by Ald. Wollman, motion carried.
Ald. Burgenneister presented the report of the Public Welfare Committee
meeting held on September 17, 1969, and moved that the report be accepted
and placed on file. Seconded by Ald. Wollman, motion carried.
Ald. Sapp presented the report of the Rules, Laws & Ordinance Committee
meeting held on September 18, 1969, and moved that the report be accepted
and placed on file. Seconded by Ald. Narlo c k, motion carried.
Ald. Sapp presented the report of the Public Safety Committee meeting
held on September 17, 1969, and moved that the report be accepted and
placed on file. Seconded by Ald. O'Connell, motion carried.
UNFINISHED BUSINESS
Ordinance #147 - An Ordinance to Repeal and Recreate Sec. 8.04 of the
Municipal Code (Street Excavations) City Attorney Buckley reported that he
_ had reviewed Ordinance 1~147 with representatives of the utility companies
and he had redrafted the ordinance. Ald. Burgenneister moved to defer
action on Ordinance #147 until the new ordinance could be re.ti~ev%~ by
the City Engineer, the Public Works Committee and the Rules, Laws &
Ordinance Committee. Seconded by Ald. Wollman. Upon a voice vote, the
motion carried.
NEW BUSINESS
u Resolution #llO-69 - The Clerk read Resolution #llO-69, entitled, Denying
the Claims of Fred & Diane Ceballos. Ald. Wollman moved for the adoption
of Resolution J/110-69, seconded by Ald. Narlock. Upon a voice vote the
motion to adopt Resolution #llO-69 carried.
Resolution #ill-69 - The Clerk read Resolution #ill-69, entitled, Resolution
to Approve Renewal of Insurance Policies with Sentry Insurance Company.
Ald. Narlock moved for the adoption of Resolution Y/111-69, seconded by
Ald. DeBack. l Upon a roll call vote the motion carried unanimously.

Resolution #112-69 - The Clerk read Resolution i/112-69, entitled, Denial
of Legal Lot Status(Jerome Strobel) Ald. Burgenneister moved for the
adoption of Resolution 11112-69, seconded by Ald. Narlock. Upon a voice
vote, the motion to adopt Resolution 11112-69 carried.
* Resolution i/113-69 - The Clerk read Resolution #113-69, entitled,
Appointment of Member to Park & Recreation Board (Paul J. Ussel). Ald.
Wollman moved for the adoption of Resolution #113-69, seconded by Ald.

Resolution i/114-69 - The Clerk read Resolution 11114-69, entitled, Renewal
of Extractive Permit for Wauer Gravel. Ald. DeBack moved for the adoption
of Resolution #114-69, seconded by Ald. Narlock. Upon a roll call vote,
the motion to adopt Resolution #114-69 carried unanimously.
Resolution #115-69 - Resolution Levying Special Assessment on Property in
Assessment Dist. #3 (Dobrowski). Ald. Wollman moved to suspend the rules
that would interfere with the adoption of Resolution #115-69, seconded
by Ald. Burgermeister. Upon a roll call vote, the motion to suspend the
rules carried unanimously. The Clerk read Resolution #115-69 and the
attached Waiver. Ald. Burgermeister moved for the adoption of Resolution
#115-69, seconded by Ald. Wollman. Ald. Narlock moved to amend Paragraph
(3) by inserting the date November 1, 1969 into the second and third
lines of the paragraph. Upon a voice vote, the motion to amend Resolution
#115-69 carried. Upon a roll call vote, the motion to adopt Resolution
i/115-69, As Amended, carried unanimously.
Resolution f/116-69 - Ald. Burgermeister moved to suspend the rules that
would interfere with the adoption of Resolution i/116-69, seconded by Aid.
Saw. Upon a roll call vote, the motion to suspend the rules carried
unanimously. The Clerk read Resolution I/116-69, entitled, Resolution
Requesting Distribution List for Taxable Year 1966. Ald. Narlock moved
for the adoption of Resolution #116-69, seconded by Ald. Wollman. Upon
a voice vote, the motion carried.
Resolution j/117-69 - Resolution Requesting Distribution List for Taxable
Year 1967. Ald. Burgermeister moved to suspend the rules that would
interfere with the adoption of Resolution #117-69, seconded by Ald.
Wollman. Upon a roll call vote, the motion to suspend the rules carried
unanimously. The Clerk read Resolution #117-69. Ald. Narlock moved for
the adoption of Resolution #117-69, seconded by Ald. DeBack. Upon a
a voice vote, the motion to adopt Resolution f/117-69 carried.
Resolution i/118-69 - Resolution Requesting Distribution List for Taxable
Year 1968. Ald. Burgermeister moved to suspend the rules that would
interfere with the adoption of Resolution #118-69, seconded by Ald. Sapp.
Upon a roll call vote, the motion to suspend the rules carried unanimouslgp-.

entitled, An Ordinance to Amend Ch. 17, Sec. 8.01(7)(C) of the Municipal
Code (Re: Mother-in-law Houses) Ald. Narlock moved to suspend the rules
in order to have the second reading of the ordinance. Seconded by Ald.
Burgermeister. Upon a roll call vote, the motion to suspend the rules
carried unanimously. The Clerk gave the second reading of Ordinance #149.

Ordinance #154 - An Ordinance to Amend Ch. 7 of the Municipal Code by
.Creating Sec. 7.19 of the Municipal Code (Excessive Acceleration of
XAutomobiles.) The Clerk gave the first reading of the ordinance. Ald.
Narlock moved to suspend the rules in order to have the second reading

motion to suspend the rules carried unanimously. The Clerk gave the
second reading of Ordinance #154. Ald. Narlock moved for the adoption

Ordinance #155 - The Clerk gave the first reading of Ordinance #155,
entitled, An Ordinance to Amend Ordinance i/127 Being Chapter 3.10 of
the Municipal Code (Re: Sewer Service Charges). Ald. Wollman moved to
suspend the rules in order to have the second reading of Ordinance #155.
Seconded by Ald. DeBack. Upon a roll call vote, the motion to suspend
the rules carried unanimously. The Clerk gave the second reading of
the ordinance. Ald. Wollman moved for the adoption of Ordinance #155.
Seconded by Ald. DeBack. Following discussion regarding the buildings
in the Sewer District (business and residential) upon a voice vote, the
motion to adopt Ordinance #155 carried.
LICENSE APPROVAL - Ald. Narlock moved for the approval of an Operator's
License for Mildred Wolf. Seconded by Ald. DeBack. Unon a voice vote.

Ald. DeBack moved for the approval of an Operator's License for Billy
Joe Leighton subject to the receipt of a favorable Fingerprint Report.
Seconded by Ald. Narlock. Upon a voice vote the motion carried.
VOUCHER APPROVAL - Ald. Narlock moved for the approval of payment of
vouchers as of September 23, 1969 in the amount of $240,780.04. Seconded
by Ald. DeBack. Upon a roll call vote, the motion to pay the vouchers
carried unanimously.
Ald. DeBack moved for the approval of payment of Sewer Vouchers as of
September 23, 1969, in the amount of $26,370.30. Seconded by Ald. Narlock.
Upon a roll call vote, the motion to pay the vouchers carried unanimously.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
Ald. Narlock moved to set the Public Hearing Dante for the rezoning of Valley-

wood Fairways, Sec. 24, from R-3 to B-4 for October 28, 1969 at 7:00 P.M.
Seconded by Ald. Wollman, motion carried.
Ald. Narlock moved to set the Public Hearing date for the rezoning for
Les Abel (Sec. 10) from WF and RSA to RSM for October 28, 1969 at 7:15 P.M.
Seconded by Ald. Wollman. Upon a voice vote, motion carried.
A discussion took place regarding the proposed Beltline Freeway through
the City of Muskego. Aldermen Sapp and Wollman spoke in favor of the
Freeway. Ald. Wollman moved that the Common Council of the City of
* Muskego recommends that the Belt Freeway run through the City of Muskego
as was originally proposed and that there be off-on ramps on Highway 24
and Highway "00". Seconded by Ald. Sapp. Upon a voice vote, the.,motion
carried.
Mayor Wieselmann requested permission of the Aldermen to have Mr. John
Couture speak and as there were no objections, Mr. Couture appeared as
a representative of the Garbalizer Corporation of America, Salt Lake City,

Utah, and explained a new waste disposal process system and questioned as
to whether or not there would be a possibility that the end product could
be deposited in Muskego. Attorney Buckley offered to confer with the
Dept. of Natural Resources in Madison regarding this matter.
