MINUTES OF MEETING HELD APRIL 22, 1969 - CITY HALL
Mayor Wieselmann called the meeting to order at 7~45 P.M.
/ PRESENT: Mayor Donald Wieselmann, Aldermen Edmund Budish, Robert Burger-
meister, Kenneth Cooley, Harold DeBack, Frank Narlock, Lois Sapp and
Walter Wollman. Also present were City Clerk Bette Bowyer and Asst.

City Attorney Joseph Wimmer.
MINUTES: - Ald. Budish moved that the minutes of the previous meeting
held on April 8, 1969 and the minutes of the Organizational meeting
held on April 15, 1969, be accepted and placed on file. Seconded by
Ald. Sapp, motion carried.

CCPlMITTEE REPORTS
Finance Committee: Aid. Narlock presented the report of the Finance
Committee meeting held on April 16, 1969, and moved that the report
be accepted and placed on file. Seconded by Ald. DeBack, motion carried.
Public Works Committee: Ald. DeBack presented the report of the Public
Works Committee meeting held on April 17, 1969, and moved that the
report be accepted and placed on file. Seconded by Ald. Wollman, motion
carried.
Public Safety Committee: Ald. Cooley presented the report of the Public
Safety Committee meeting held on April 16, 1969, and moved that the
report be accepted and placed on file. Seconded by Ald. Wollman, motion
carried.
Public Welfare Committee: Ald. Burgermeister presented the report of
the Public Welfare Committee meeting held on April 16, 1969 and moved
that the report be accepted and placed on file. Ald. Cooley seconded
the motion and the motion carried.
Rules, Laws & Ordinance Committee: Ald. Burgermeister presented the
report of the Rules, Laws & Ordinance Committee held on April 17, 1969,
and moved that the report be accepted and placed on file. Ald. Narlock
seconded the motion and the motion carried.
Plan Commission:

April 15, 1969, was received and placed on file.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Wieselmann accounted the appointments to Council Committees as
follows: Finance - Frank Narlock, Sec., Edmund Budish and Harold DeBack.

UNFINISHED BUSINESS
Ordinance #139 - The Clerk gave the second reading of Ordinance #139
l entitled, An Ordinance to Amend Ch. 3.10 of the Municipal Code Relating
to Sewer Service Charges. Ald. Wollman moved for the adoption of Ordinance
%/139, seconded by Ald. Budish. ,* Ald. Wollman moved to amend Ordinance
y/139 by having (j) of Sec. I to read as follows: "The Sewerage Service
charges for churches shall be $10.00 per calendar quarter". Seconded by

Alderman DeBack. Upon a roll call vote to amend Ordinance 11139, the
motion carried unanimously. Upon a roll'call vote, the motion to adopt
Ordinance 11139, As Amended, carried unanimously.
Ordinance if141 - The Clerk gave the second reading of Ordinance #141,
entitled, An Ordinance to Create Ch. 13 of the Municipal Code Relating
to Regulations of Animals. Ald. DeBack requested permission of his
fellow aldermen to have Mr. Leo Friemoth, Troy Center, Wisconsin to
speak. As there were no objections, Mr. Friemoth spoke in opposition
to Ordinance #141. Ald. Burgenneister, on behalf of the Rules, Laws
& Ordinance Committee, spoke in favor of the ordinance and moved to
amend Ordinance #141 as follows: "13.02 REGULATIONS OF HORSE AND HORSEBACK
RIDING (1) AREAS OF RIDING RESTRICTED. No person shall engage in horse-
back riding in the City, except on the private property of the rider,
the property of another with his consent, or on designated bridle trails
on public or private property. (2) RIDING ON PUBLIC PROPERTY RESTRICTED.
No person shall engage in horseback riding upon a traveled portion of any
public highway, except to cross the same, or where no shoulders exist
riding in the right hand lane will be permitted only between the hours
of sunrise and sunset, nor in school yeards, public parks or on other
public property, except when the same is done as a participant in
connection with a public event such as a parade or fair." Motion second-
ed by Ald. Narlock. Upon a voice vote, the motion to amend Ordinance
11141 carried. Upon a voice vote, the motion to adopt Ordinance #141,
As Amended, carried.
NEW BUSINESS
Ordinance l/142. The Clerk gave the first reading of Ordinance #142,
entitled, An Ordinance to Create and to Amend Certain Sections of Ch. 30
of the Municipal Code (Re: Building Code)
Ordinance #143 - The Clerk gave the first reading of Ordinance #143,
entitled, An Ordinance to Amend the Zoning Ordinance of the City of
Muskego (Re: Holz - Rambo).
Resolution i/47-69 - The Clerk read Resolution #47-69, entitled, Resolution
Accepting Dedication of Lands to City of Muskego (Foth Property) Ald. Narlock moved for the adoption of Resolution #47-69, seconded by Aid.
DeBack. Ald. Narlock spoke in favor of adopting Resolution l/47-69,
indicating that because of the proximity of thelproperty in question
to the Civic Center Site and a City Park, the land to be dedicated
to the City has great potential. Ald. Sapp questioned as to whether
or not the monies had been budgeted for this purpose. Mayor Wieselmann
answered that the City does have funds to assume this obligation. Ald.
Burgenneister moved to defer action on Resolution i/47-69 until the next
meeting. Seconded by Ald. Sapp. Ald. DeBack and Ald. Narlock again
spoke in favor of the adoption of Resolution #47-69. Ald. Sapp indicated
that due to the fact that there will be two Council meetings scheduled
before the offer expires she would like to have more time to consider
the matter further. Upon a roll call vote, the motion to defer action
on Resolution i/47-69 carried unanimously.
Resolution $148-69 - The Clerk read Resolution j/48-69, entitled, Appoint-
ment of.Weed Commissioner. Ald. Budish moved for the adoption of
Resolution i/48-69, seconded by Ald. Sapp. Upon a roll call vote, the
motion to adopt Resolution 1148-69 carried unanimously.
Resolution #49-69 - The Clerk read Resolution 1149-69, entitled, Declaring
-* ertain Weeds to be Noxious Within the Boundaries of the City of Muskego.
Ald. DeBack moved for the adoption of Resolution j/49-69, seconded by
Ald. Wollman. Upon a voice vote, the motion to adopt Resolution f/49-69
carried.

Resolution #50-69 - Appointment of Citizen Member to Plan Commission
(Ed. Raimann) Ald. Budish moved for the adoption of Resolution #50-69,
seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt
Resolution l/50-69 carried unanimously.
Resolution #51-69 - Appointment of Citizen Member to Board of Appeals.

Resolution 1152-69 - The Clerk read Resolution i/52-69, entitled, Appoint-
ment of Citizen Member to Park and Recreation Board (Louis W. Stanley)
Ald. Burgermeister moved for the adoption of Resolution f/52-69, seconded
by Ald. Cooley. Upon a roll call vote, the motion to adopt Resolution
#52-69 carried unanimously.
Resolution #53-69 - The Clerk read Resolution #53-69, entitled, Appoint-
ment of Member to Police and Fire Commission (Richard Horn) Ald. Wollman
moved for the adoption of Resolution 1153-69, seconded by Ald. Narlock.
Upon a roll call vote, the motion to adopt Resolution #53-69 carried
unanimously.
a Resolution #54-69 - The Clerk read Resolution f/54-69, entitled, Appointment
to Member of Board of Review (Raymond Schwalbach). Ald. Narlock moved
for the adoption of Resolution #54-69, seconded by Ald. DeBack. Upon's
roll call vote, the motion to adopt Resolution #54-69 carried unanimously.
Resolution 1156-69 - Ald. Burgermeister moved to suspend the rules that
would interfere with the adoption of Resolution y/56-69, seconded by Ald.
Wollman. Upon a roll call vote, the motion to suspend the rules carried
unanimously. The Clerk read Resolution i/56-69, entitled, Designation
of Legal Lot (Raymond Smith) Ald. Wollman moved for the adoption of
Resolution $156-69, seconded by Ald. Narlock. Ald. Budish questioned
whether or not it is possible to create two substandard lots and upon
the legal advice of Attorney Wimmer Ald. Wollman moved to amend Resolution
i/56-69, Paragraph 111 as follows: Whereas, Raymond Smith, owner of Lot 1
Block A, Southern Heights Subdivision, has petitioned the Common Council
of the City of Muskego to create two lots from an existing lot and in
accordance with the Plat of Survey dated April 15, 1969 which is on file
with the City of Muskego Plan Commission". Motion seconded by Ald.
Narlock. Upon a voice vote, the motion to amend Resolution 1156-69
carried. Upon a voice vote, the motion to adopt Resolution f/56-69,
as Amended, carried.
Resolution i/58-69 - Resolution Expressing Appreciation from the City of
Muskego Honoring Miss Christine Flasch. Ald. Burgermeister moved to
suspend the rules that would interfere with the adoption of Resolution
#58-69, seconded by Ald. Narlock. Upon a roll call vote to suspend the
rules, the motion carried unanimously. The Clerk read Resolution i/58-69.
Ald. Narlock moved for the adoption of Resolution #58-69, seconded by
Ald. Cooley. Upon a roll call vote, the motion to adopt Resolution i/58-69
carried unanimously.
Considerable discussion took place regarding the specifications of the
three squad cars for the Police Dept. that are to be advertised for.

At 9:20 P.M. Mayor Wieselmann declared a recess and the meeting reconvened
at 9~27 P.M. Ald. Budish moved that the Council tentatively pass on the
-- proposed specifications to allow the City Clerk to advertise for bids on

until the Safety Committee and Finance Committee have conferred with
Chief Kraus to go over the specifications once more and give their
approval to this advertisement" Seconded by Ald. Wollman. Upon a
, roll call vote, the motion carried unanimously.
LICENSE APPROVAL - Ald. DeBack moved for the approval of a Class "B"

Fermented Malt Beverage and Intoxicating Liquor License for Wayne Hansen
subject to the time required after publication. Seconded by Ald. Narlock.
Upon a voice vote, motion carried.
Ald. Narlock moved for the approval of an Operator's License for Janice
Knapp (subject to a favorable fingerprint and medical report) and for
Paul Horn and Robert Hegerty. Seconded by Ald. Budish. Upon a voice
vote, motion carried.
VOUCHER APPROVAL - Ald. Narlock moved for the approval of payment of
vouchers in the amount of $310,305.45 payable April 22, 1969. Seconded
by Ald. Burgermeister. Upon a roll call vote, the motion to pay the
vouchers carried unanimously. Ald. Narlock moved for the approval of payment of Sewer Voucher in the
amount of $12,051.00 payable April 22, 1969. Seconded by Ald. DeBack.
Upon a roll call vote the motion carried unanimously. l COMMUNICATIONS AND MISCELLANEOUS BUSINESS
Ald. Narlock moved to set a public hearing for rezoning in Sec. 16 for
David Bierele for May 27, 1969, at 7:15 P.M.
ELECTION OF ALDERMAN TO PLAN COMMISSION
Mayor Wieselmann asked the two reporters present to act as ballot clerks.
On the Nominating Ballot Ald. Narlock received 4 votes, Ald. Burgenneister
received 2 votes and Ald. Sapp received 1 vote.
On the first and second election ballot, Ald. Burgermeister received 4
votes and Ald. Narlock received 3 votes.
On the third.and-fourth election ballots, Ald. Narlock received 4 votes
and Ald. Burgenneister received 3 votes.
On the fifth, sixth and seventh ballots, Ald. Burgermeister received 4

votes and Ald. Narlock received 3 votes.
On the ninth thru the twentieth ballots, Ald. Narlock received 4 votes
and Ald. Burgenneister received 3 votes.
On the 21st and 22nd ballots, Ald. Burgermeister received 4 votes and
Ald. Narlock received 3 votes.
Ald. Wollman moved to resume the balloting to an adjourned meeting to
be held on Thursday, April 24, 1969 at 9:00 P.M. Seconded by Ald. Sapp.
Upon a voice vote, motion carried.
'* Mayor Wieselmann announced that on April 30, 1969, 7~30 P.M. a joint
meeting of the Muskego-Norway School Board, the Plan Commission and
the Common Council will be held at the new Middle School.
Mayor Wieselmann announced the plans for a ceremony in honor of Christine
l Flasch, Wisconsin's Jr. Miss, to be held at the City Hall on Thursday,
April 24, 1969 at 8:00 A.M. on the City Hall steps. .
Mayor Wieselmann announced that the week of May 3 thru lOth, 1969, will
be proclaimed as "Beautification and Clean Up Week in the City of Muskego."

Ald. Wollman announced that Mr. Ben Shira, Chairman of the Memorial
Day Parade, has invited the Mayor and Aldermen to again participate
in the Annual Parade.
Ald. Sapp requested that a meeting of the Municipal Sewer Committee

be held in the very near future.
Ald. Narlock requested that the Council take some action on the TARR
Task Force Committee's recommendations as to the distribution of taxes
by the State.
Ald. Budish reviewed the history of the proposed Symbolic Seal for
the City of Muskego and Ald. Wollman moved that the Finance Committee
investigate the expenses that would be incurred regarding the proposed
Symbolic Seal. Seconded by Ald. Burgermeister. Upon a voice vote,
motion carried.
Ald. Burgermeister moved to adjourn the meeting until 9:00 P.M. on
Thursday, April 24, 1969. Seconded by Ald. Narlock, motion carried.
The meeting adjourned at lo:18 P.M.
