ccm19690408COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD APRIL 8, 1969 CITY HALL 0 Mayor Wieselmann called the meeting to order at 7:45 P. M. PRESENT - Mayor Donald Wieselmann, Aldermen Edmund Budish, Robert Burgermeister, Kenneth Cooley, Harold DeBack, Roland Linck, Frank l Narlock and Walter Wollman. Also present were Deputy Clerk June Elger and Asst. City Attorney Joseph Wimmer. MINUTES - Ald. Budish moved that the minutes of the previous meeting of March 25, ,1969, and the minutes of the special meeting of April 1, 1969, be accepted and placed on file. Ald. Narlock seconded the motion and the motion carried. COMMITTEE REPORTS _----__-- Finance Committee - Ald. Narlock presented the report of the Finance Committee mzing held on April 2, 1969, and moved that the report be accepte'd and placed on file. Ald. Budish seconded the motion and the motion carried. Public Works Committee - Ald. DeBack presented the report of the Public Works Committee meeting held on April 3, 1969, and moved that the report be accepted and placed on file. Ald. Wollman seconded the motion and the motion carried. Public Safety Committee - Ald. Wollman presented the report of the Public Satety Committeemeeting held on April 2, 1969, and moved that the report be accepted and placed on file. Ald. Linck seconded the motion and the motion carried. Public Welfare Committee - Ald. Burgermeister presented the re- port of the Public Welfare Committee meeting held on April 2, 1969, and moved that the report be accepted and placed on file. Ald. Wollman seconded the motion and the motion carried. Rules, Laws 81 Ordinances Committee - Ald. Linck presented the report of the meeting ot the Rules, Laws & Ordinances Committee held on April 3, 1969, and moved that the report be accepted and placed on file. Ald. Narlock seconded the motion and the motion carried. Plan Commission - The report of the Plan Commission meeting held on April 2, 1969, was received and placed on file. 0 COMMUNICATIONS FROM THE MAYOR'S OFFICE _--_--__-------m-e- The Deputy Clerk read a Proclamation declaring the dates of April 17th through April 20th as AFS days in the City of Muskego. UNFINISHED BUSINESS _---m----s Ordinance #139 - An Ordinance to Amend Ch. 3-10 of the Municipal Code Relating to Sewer Service Charges. The Deputy Clerk read Ordinance #139. Alderman Burgermeister moved for the adoption of Ordinance #139. Ald. Budish seconded the motion. Ald. Budish recommended that action be deferred on Ordinance #139 as the sewerage service charges for churches has not as yet been determined. Alderman Wollman moved for deferment. Ald. DeBack seconded the motion and the motion carried. Ordinance #140 - An Ordinance to amend Sec. 12.03 of the Municipal Code Relating to Transient Merchants. The Deputy Clerk read Ord. #140. Alderman Burgermeister moved to adopt Ord. #140. Ald. Narlock seconded the motion and the motion carried. Page 2 - Common Council April 8, 1969 a brdinance #Id- - An Ordinance to Create Chapter 13 of the Municipal Code Relating to Regulations of Animals. In accordance with a reqiest from Ald. Burgermeister, the Deputy Clerk read only that portion of Ordinance #14I relating to horseback riding. Ald. DeBack moved for the adoption of Ordinance #141. Aid. Burgermeister seconded the motion. Ald. Burgermeister moved to amend Sec. 13.02 (1) Areas of Riding Restricted, to read as follows: "No person shall engage in horseback riding in the City, except on the private property of the rider. the orouertv of another with his consent. on the shoulders of public'roads'only between the hours of sunrise and sunset or on designated bridal trails on public or private property." And to amend the last sentence of Sec. 13.02 (6) Neglected or Abandoned: Police Power. to read as follows: police officer, "Whenever in-the ooinion of a an animal is hopelessly injured or diseased so as to be beyond the probability of recovery, a veterinarian shall be consulted, after such consultation, unless the officer has the owner's prior consent, it shall be lawful for such police officer to kill such animal." Aid. Linck seconded the motion. Alderman DeBack requested permission of his fellow aldermen to allow a citizen to speak. Mr. Robert Bierbower, S92 W20084 Henneberry Dr., and Mr. Milton Leichtfuss, S81 W12511 Hi View Dr., expressed concern that the ordinance is too stringent. Mr. Leo Friemoth, Troy Center, questioned if the city can regulate the use of highways and Attorney Wimmer advised that the city has this power. Following a lengthy discussion, Alderman Budish moved to defer action on Ordinance #141 until the following meeting, April 22nd. Ald. Burgermeister seconded the motion and upon a roll call vote the motion carried unanimously. Mayor Wieselmann advised concerned citizens to contact their aldermen. NEW BUSINESS ------ Resolution #40-69 - Acceptance of Bid for Mun. Sewer Project MSS-l-69. The Dewetv Clerk read Resolution #40-69. Aid. DeBack'moved for the adoption of Res. #41-69. Aid. Narlock seconded the motion. In answer to a question from Ald. Burgermeister, ,Mayor Weiselmann advised that there are sufficient funds from pre-payments to cover these sewer projects. Upon a roll call vote the motion to adopt carried unanimously. Resolution #41-69 - Acceptance of Bid for Municipal Sewer Pro- ject MSS-2-69. The Deputy Clerk read Resolution #41-69. Ald. DeBack moved for the adoption of Resolution #41-69. Ald. Narlock seconded the motion and upon a roll call vote the motion carried unanimously. Resolution #42-69 - Acceptance of Bid for Municipal Sewer Project MSS-3-69. Ald. Budish moved for the adoption of Res. #42-69. Ald. Wollman seconded the motion and upon a roll call vote the motion carried unanimously. Resolution #43-69 - Approval of Maintenance Agreement for Burroughs Bookkeeping Machine. Ald.N;arlockmoved for the adoption of #43-69. Ald. Budish seconded the motion. Ald. Wollman moved to amend the second line, fourth paragraph of Res. #43-69 to read I'.... Upon a roll call vote, the motion to adopt Res. $43-69 As Amended carried UnanimouslY- Page 3 - Common Council April 8, 1969 Resolution #45-69 - Designation of Legal Lot (Wallner) The Deputy Clerk read-Res. #4.5-69. Aid. Narlock moved for the adoption of Res. #45-69. Ald. DeBack seconded the motion. Ald. Burgermeister requested permission of his fellow aldermen to allow Raymond Wallner to speak. In answer to questions from the Common Council, Mr. Wallner advised that the lot does border the new Highway "Y", that he has no plans at this time to build and that he has agreed to allow the storage of machinery on this lot during the construction of the new "Y". The Deputy Clerk read a communication from the City Plan Commission recommending approval of Mr. Wallner's request for legal status for this lot. Upon a roll call vote the motion to adopt Res. #4.5-69 carried unanimously. LICENSE APPROVAL -------- Ald. Narlock moved for the approval of a Transient Merchant's License for Roy Henrichs, <Jr. Ald. DeBack seconded the motion and the motion carried. VOUCHER APPROVAL -------- Ald. Burgermeister moved for the approval of vouchers in the amount of $355.00 payable April 8, 1969. Ald. Narlock seconded the motion and the motion carried unanimously upon a roll call vote. CITY-.OFFICIAL'S REPORTS ---------__- Financial Report - The Deputy Clerk read the Financial Statement for the month of March, 1969, same placed on file. for t&%G%Z%Gch The Deputy Clerk read the Building Report , 1969, same placed on file. COMMUNICATIONS & MISCELLANEOUS BUSINESS -------------------- The Deputy Clerk read a communication dated April 7, 1969, frqm the City Plan Commission recommending that the city accept Melford Foth's offer to dedicate approximately 16 acres of property in the NW% of Sec. 16 to the city. Mayor Wieselmann advised the aldermen that the sewer assessment on this property is approximately $11,000 and encouraged them to view the site prior to the next meeting. Mayor Wieselmann expressed his appreciation to Alderman Linck for his service as alderman. Alderman Linck thanked the aldermen and city employees for their cooperation during his term. Mayor Wieselmann announced that a send-off dinner for Miss Christine Flasch, Wisconsin's Jr. Miss, will be held at Clifford's Supper Club in Muskego on Friday, April 18, 1969, at 6:30 P. M. He urged that the aldermen and their wives attend. Ald. Cooley and Mayor Wieselmann advised that they had been contacted by students from the intermediate school indicating their desire for a project to clean-up and beautify the city. The aldermen were requested to submit suggestions. ADJOURNMENT - Alderman Budish moved for adjournment, Ald. Linck seconded the motion and the meeting adjourned at 9:12 P. M. bjs 4-11-69
