ccm19681126, .i COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD NOVEMBER 26, 1968 The meeting was called to order at 7~32 P.M. l PRESENT - Mayor Donald Wieselmann, Aldermen Robert Burgermeister, Kenneth Cooley, Harold DeBack, Frank Narlock, Roland Linck and Walter 0 Wollman. Also present were City Attorney John P. Buckley and City Clerk.Bette Bowyer. APPROVAL OF MINUTES - Ald. Narlock moved to accept the Minutes of the meeting held on November 12, 1968, as mailed. Seconded by Ald. DeBack, motion carried. Public Works Committee - Ald. DeBack presented the report of the Public Works Committee meeting held on November 14, 1968, and moved that the reports be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Public Safety Committee - Ald. Wollman presented the report of the Public Safety Committee meeting held on November 16, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Linck, motion carried. Public Welfare Committee - Ald. Burgermeister presented the report of the Public Welfare Committee meeting held on November 13, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. Rules, Laws & Ordinance Committee - Ald. Linck presented the report of the Rules, Laws & Ordinance Committee meeting held on November 21, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. Plan Commission - The report. of the Plan Commission meeting:held on November 19, 1968, was received and will be placed on file. UNFINISHED BUSINESS Ordinance #126-S - The Clerk gave the second reading of Ordinance #126-S, entitled, An Ordinance Establishing Rules and Regulations for the Use of the Muskego Co. Park Within the City of Muskego. Ald. Burgermeister l moved for the adoption of Ordinance #126-S, seconded by Ald. Narlock. Motion carried. Ordinance #127 - An Ordinance to Create Ch. 3.10 of the Municipal Code Relating to the Establishment and Collection of Sewerage Service Charges. Ald. Burgermeister moved to defer action on Ordinance until, as he had previously requested, a meeting with Mr. Brussat and Mr. Hammond can be arranged. Seconded by Ald. Narlock, motion carried. Ordinance #128-A - The Clerk gave the second reading of Ordinance #128-A, a entitled, An Ordinance Creating Ch. 7.18 of the Mun. Code Requiring Registration and Inspection of Bicycles. Ald. Linck moved for the adoption of Ordinance #128-A, seconded by Ald. Cooley, motion carried. Resolution i/193-68 - The Clerk read Resolution j/193-68, entitled, Authorizing the City Engineers to Study the Feasibility of Extending Sewers to the Southeast, Southwest and Northwest Areas of the City. Ald. Cooley withdrew his proposed amendment to Resolution j/193-68, with the consent of his second, indicating that the City Engineer had assured him that the adoption of Resolution i/193-68 would not interfere with the study of the feasibility of installing sewers in the Northeast District. Ald. DeBack moved for the adoption of Resolution j/193-68, seconded by Ald. Cooley. Upon a roll call vote, the motion to adopt Resolution #193-68 carried unanimously. Resolution Y/200-68 - The Clerk read Resolution #200-68, entitled, Author- izing Amendment of Appraisal Contract with Great Lakes Appraisa,l Corp., and the amendment attached thereto. Ald. Wollman moved to suspend the rules that would interfere with the adoption of Resolution l/200-68, second- ed by Ald. Narlock. Upon a roll call vote, the motion to suspend the rules carried unanimously. Ald. Wollman moved for the adoption of Resolution l/200-68, seconded by Ald. Narlock. Ald. Burgenneister moved to amend Paragraph 18 by deleting the words "dog lists". Seconded by Ald. Linck, motion carried. Upon a roll call vote, the motion to adopt Resolution #200-68, As Amended, carried unanimously. Resolution #201-68 - Ald. Burgenneister moved to suspend the rules that would interfere with the a~doption of Resolution f/201-68, seconded by Ald. Narlock. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read Resolution #201-68, entitled, Authorization of Common Council to Transfer Unexpended 1968 Budgeted Funds to Reserve Accounts. Ald. Narlock moved for the adoption of seconded by Aid. Wollman. Upon a roll call vote, Resolution #201-68 carried unanimously. Resolution j/201-68, the motion to adopt the rules that would Resolution #202-68 - Ald. Cooley moved to suspend interfere with the adoption of Resolution 11202-68, seconded by Ald. Burger- meister. Upon a roll call vote to suspend the rules, the motion ca~rried unanimously. The Clerk read Resolution f/202-68, entitled, Authorization of the Common Council to Transfer Monies from Specific Accounts to the 1968 General Fund. Ald. Wollman moved for the adoption of Resolution 202-68, seconded by Ald. Cooley. Upon a roll call vote, the motion to a~dopt Resolution f/202-68 carried unanimously. Ordinance #129 - The Clerk gave the first reading of Ordinance #129, entitled, Appropriating the Necessary Funds for the Operation of the Government and Administration of the City of Muskego for the Year 1969. Ma~yor Wieselmann requested that the Common Council consider reducing the tax levy by $1.65 per thousand. City Attorney Buckley advised that the proposed budget and Ordinance i/l29 could be amended any time before it is adopted. The follow- ing amendments were made to the proposed 1969 Budget. Ald. Burgermeister moved to amend the amount in A/c 320 Income Tax, from $225,000.00 to $250,000.00. Seconded by Ald. Cooley, motion carried. Ald. Burgenneister moved to Include A/c 389, Rescue Fees, under Other Revenues, and insert the amount $8,000.00. Seconded by Ald. Linck, motion carried. Ald. Cooley moved to amend the amount in A/c 521, Tess Corners Fire Dept. by changing the amount of $29,840.00 to $27,840.00 and to amend the amount under Muskego Fire Dept. from $24,456.15 to $23,361.00 ($1,095.15 Sewer Assessment and lateral fees.) Seconded by Ald. Linck, motion carried. Ald. Cooley moved to amend the amount in A/c 550, Engineering, Salaries and Wages, from $12,000.00 to $lO,OOO.OO and to amend the amount under Fees, from $5,000.00 to $3,000.00. Seconded by Ald. Linck, motion carried. Discussion followed regarding the deduction of $2,000.00 from Salaries & Wages, with Ald. Narlock speaking in opposition. Upon a voice vote, motion caqied. Ald. DeBack moved to amend the amount in A/c 553, Roadway of Streets, Contracted Services, Major Road Improvement, from $85,000.00 to $5,000.00. Seconded by Ald. Wollman, motion carried. Ald. DeBack suggested that the Common Council of Muskego appoint a committee to study the feasibility of setting up an assessment policy for roads, committee to investigate what surrounding communities are doing. Ald. Cooley moved to amend A/c 528, City Planning, Fees, Contract Service, from $11,650.00 to $8,650.00. Seconded by Ald. Wollman. Motion carried. - . Wollman moved to amend the amount in A/c 559, Highway Dept., Capital Outlay - Equipment, New & Replacement, from $35,700.00 to $32,200.00. Seconded by Ald. DeBack. Motion ca~rried. a Ald. Burgermeister moved to delete the amount of $6,000.00 of A/c 583, Park & Recreation, Land Acquisition, in its entirety. Seconded by Ald. l Linck, motion carried. Ald. Cooley moved to amend the amount in A/c 552, Roadway of Streets, Maintenance, Salaries & Wages from $72,000.00 to $66,000.00. Seconded by Ald. Burgermeister. Discussion followed as to whether or not the Highway Dept. would be hiring an additional man. Ald. DeBa~ck spoke in opposition of the proposed amendment. Upon a roll call vote, Aldermen Burgenneister, Cooley, Linck and Narlock voted "aye". Aldermen DeBack and Wollman voted "no". The motion to amend A/c 552 carried. Ald. Cooley moved to amend A/c #520, Police Dept., Salaries 6 Wages, by changing the amount from $96,000.00 to $111,000.00, $S,OOO.OO of which would cover the hiring of one additional man and $7,000.00 to cover over time charges for 1969. Seconded by Ald. Linck. Upon a roll call vote to increase the amount, Aldermen Burgermeister, Cooley, Linck and Wollman voted "aye". Ald. DeBack and Narlock voted "no". The motion to increase the amount carried. \ b Ald. Cooley moved that the transfer from Surplus of the 1969 Budget be increased $31,000.00, thus making a total of $108,000.00. Seconded by Ald. Wollman, motion carried. At 8:50 P.M. Mayor Wieselmann declared a recess to give the City Clerk an opportunity to calculate the revised tax levy. The meeting reconvened at 9:12 P.M., and the Clerk revealed that the tax levy would be $2.81 per $l,OOO.OO of assessed valuation. Ald. Cooley moved for the adoption of Ordinance #129, seconded by Ald. Linck. Ald. Cooley moved to suspend the rules that would interfere with ^ the adoption of Ordinance #129, seconded by Ald. Linck. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk gave the second reading of Ordinance #129. Ald. Cooley moved for the adoption of Ordinance $129, As Amended. Seconded by Ald. Linck. Upon a roll call vote, the motion to adopt Ordinance #129, as Amended, carried unanimously. Ordinance #131 - The Clerk gave the first reading of Ordinance 11131, entitled An Ordinance to Rezone Certain Property in the City of Muskego (Wojtczak).-' l Ald. Narlock moved to suspend the rules that would interfere with the adoption of Ordinance #131, seconded by Ald. DeBack. Upon a roll call vote to suspend the rules, the motion carried unanimously. Ald. Narlock moved for the adoption of Ordinance 11131, seconded by Ald. DeBack. Upon a voice vote, motion carried. Resolution i/197-68 - The Clerk read Resolution #197-68, entitled, Transfer of Funds (City Dump and SEWRPAC Assessment & Tax Roll) Ald. Narlock moved for the adoption of Resolution i/197-68, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Resolution #197-68 carried unanimously. a Resolution #198-68 - The Clerk read Resolution #198-68, entitled, Author- izing the Purchase of Chairs for City Hall. Ald. Narlock moved for the adoption of Resolution #198-68, seconded by Ald. DeBack. Upon a roll call l vote, the motion to adopt Resolution #198-68 carried unanimously. Narlock moved for the adoption of Resolution j/199-68, seconded by Ald. Wollman. Upon a roll call vote, the motion to l adopt Resolution i/199-68 carried unanimously. Ordinance #119 - The Clerk gave the first reading of Ordinance #119, e entitled, An Ordinance to Create Sec. 7.11 of the Municipal Code Relating to Snow Emergency. Ald. Burgermeister moved to suspend the rules that would interfere with the adoption of Ordinance i/119, seconded by Ald. Linck. Upon a roll call vote, the motion to suspend the rules carried. unanimously. The Clerk gave the second reading of Ordinance #119. Ald. Wollman moved for the adoption of Ordinance 1'1119, seconded by Ald. Linck. Ald. Linck moved to amend Ordinance i/119, by adding the following words to the end of Sec. 4 "unless with reasonable diligence he could not avoid it." Seconded by Ald. Burgemneister. Upon a voice vote, the motion to amend Ordinance #119 carried. Upon a voice vote, the motion to adopt Ordinance #119, as amended, carried. LICENSE APPROVAL - Ald. Narlock moved for the approval of an Operator's License for Roger Wagner. Seconded by Ald. DeBack. Upon a voice vote, motion carried. b VOUCHER APPROVAL - Ald. DeBack moved for the approval of payment of sewer construction vouchers in the amount of $169,882.65. Seconded by Ald. Narlock. Upon a roll call vote, motion carried. Ald. Narlock moved for the approval of payment of general vouchers, payable November 26, 1968, in the amount of $266,614.47. Seconded by Ald. DeBack. Upon a roll call vote, motion carried. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Ald. Burgenneister moved to change the date of the meeting date of December 24th to December 30, 1968. Seconded by Ald. Linck. Motion carried.
