ccm19681022COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD OCTOBER 22, 1968 The meeting was called to order at 7~35 P.M. by Mayor Wieselmann. a PRESENT - Mayor Donald Wieselmann, Aldermen Edmund Budish, Robert Burgermeister, Kenneth Cooley, Harold DeBack, Frank Narlock, Roland Linck and Walter Wollman. l Also present were City Attorney John P. Buckley and City Clerk Bette Bowyer. APPROVAL OF MINUTES - Ald. Narlock moved to accept the Minutes of the previous meeting held on October 8, 1968, as mailed. Seconded by Ald. Burgenneister, motion carried. .-. b COMMITTEE REPORTS FINANCE COMMITTEE - Ald. Narlock presented the reports of the Finance Committee meetings held on October 9th and October 16th, 1968, and moved that the reports be accepted and placed on file. Seconded by Ald. Budish. A discussion took place regarding the Schultz Rifle Range. Alderman Wollman moved that the City Clerk direct a letter to Mr. Schultz advising him that he may now operate his Rifle Range with the condition that there be supervision on the range whenever it is in use. Seconded by Ald. Linck. Upon a voice vote, motion carried. Upon a voice vote, the motion to accept the Minutes carried. PUBLIC WORKS COMMITTEE - Ald. DeBack presented the reports of the Public Works Committee meetings held on October 15 and October 17, 1968, and moved that the reports be accept and placed on file. Seconded by Ald. Wollman, motion carried. PUBLIC SAFETY COMMITTEE - Ald. Wollman presented the report of the Public Safety Committee meeting held on October 14, and moved that the report be accepted and placed on file. Seconded by Ald. Linck, motion carried. PUBLIC WELFARE COMMITTEE - Ald. Burgermeister presented the report of the Public Welfare Committee meeting held on October 10, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. RULES, LAWS & ORDINANCE COMMITTEE - Ald. Linck presented the report a of the Rules, Laws & 0rdinanc.e Committee meeting held on October 17, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. PLAN COMMISSION - The report of the Plan Commission meeting held on October 15, 1968, was received and will be placed on file. COMMUNICATIONS FROM THE MAYOR'S OFFICE The Clerk read the Mayor's Proclamation which designated November 10th a thru November 16th, 1968, as American Education Week. UNFINISHED BUSINESS l Resolution j/173-68 - Acceptance of Bids for Reassessment of City of Muskego. Mayor Wieselmann introduced Mr. Henry and Hugh Trilling of the Great Lakes Appraisal Company to the Aldermen. Mr. Henry Trilling explained the purpose and benefits of a reassessment to a municipality. Common Council Meeting City of Muskego 10/24/68 Page 2. He displayed various materials and data sheets used by his firm in their work. Mr. Trilling answered several questions by the Aldermen and following further discussion, Ald. Cooley moved that the City accept the low bid of Great Lakes Appraisal Company in the amount of $31,000.00. Seconded by Ald. Wollman. Upon a roll call vote, the motion to accept the bid of $31,000.00 from Great Lakes Appraisal Co. to reassess-theCity of Muskego carried unanimously. Ordinance #113 - As Ordinance #113, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego, Wisconsin, was already on the floor, the Clerk read a recommendation from the City Plan Comm- ission directed to Mayor Wieselmann and the Common Council, dated October 22, 1968, recommending the proposed rezoning of properties in Sections 9 and 16. Upon a voice vote, #113 carried. the motion to adopt Ordinance Ordinance #125 - An Ordinance to Renumber the Municipal Code Sections as Numbered in Ordinance No. 114. Ald. Cooley moved to suspend the rules that would interfere with the adoption of Ordinance #125, seconded by Ald. Wollman. Upon a roll call vote, the motion to suspend the rules carried unanimously. Ordinance #125. The Clerk gave the second reading of Ald. Budish moved for the adoption of Ordinance #125, seconded by Ald. Cooley. Upon a voice vote, Ordinance #125 carried. the motion to adopt NEW BUSINESS Resolution #180-i8 The Clerk read Resolution i/180, entitled, Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate a Part of Simandl Drive in the City of Muskego, Wisconsin. (West Side of Simandl Drive) Ald. Narlock moved for the adoption of Resolution 11180, seconded by Aid. DeBack. Upon a voice vote, the motion to adopt Resolution #180-68 carried. Resolution y/181-68 - The Clerk read Resolution Y&81-68, entitled, Accepting Offer of the Milwaukee Company to Purchase ~JG;.--Y - Sewer System Mortgage Revenue Bonds of the City of Muskego. Ald. Cooley moved for the adoption of Resolution 11181-68, seconded by Ald. Burger- meister. Mr. Robert C. Brussat, representative of The Milwaukee Company appeared before the Council and read the proposal offered to the City of Muskego by The Milwaukee Company for the financing necessary for the first phase of its Sewerage System Construction Project. Ald. Cooley moved to amend Resolution #181-68 by inserting the figure $320,000.00 into the resolution. Seconded by Ald. Budish. Upon a voice vote, the motion to amend Resolution #181-68 by using the figure $320,000.00 as the amount of Mortgage Revenue Bonds to be purchased by the City. carried. Upon a roll call vote, the motion to adopt Resolution i/181-68, As Amended, carried unanimously. Resolution 11182-68 - The Clerk read Resolution 11182-68, entitled, Authorizing Grading and Graveling of Muskego-Norway District Middle School Road. Ald. Budish moved for the adoption of Resolution #182-68, seconded by Ald. Narlock. Considerable discussion took place as to how much land is involved, what benefits would be afforded to the citizens and abutting landowners, the cost to the City for the building of the road, etc. Ald. Budish and Ald. Narlock spoke in favor of the City building the new road. of Resolution #182-68. Aid. DeBack spoke in opposition to the adoption Following considerable more discussion, upon a roll call vote, Aldermen Budish and Narlock voted "aye". Aldermen Burgermeister, Cooley, DeBack, Linck and Wollman voted "no". The motion to adopt Resolution j/182-68 did not carry. 1 Common Council Meeting City of Muskego 10122168 Page 3. l a l Resolution i/183-68 - The Clerk read Resolution i/183-68, entitled, Eliminating all Sewer Assessment Interest in Districts No. 1 and 3 to November 1, 1968. Ald. Burgermeister moved for the adoption of Resolution i/183-68, seconded by Ald. Wollman. Ald. Burgermeister spoke in favor of the adoption of Resolution i/183-68. Upon a roll call vote, the motion to adopt Resolution j/183-68 carried unanimously. Resolution i/184-68 - The Clerk read Resolution 11184-68, entitled, Authorizing the Purchase of a New Highway Truck. Ald. Budish moved for the adoption of Resolution l/184-68, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Resolution l/184-68 carried unanimously. Resolution #185-68 - Ald. Wollman moved to suspend the rules that would interfere with the adoption of Resolution i/185-68. Seconded by Ald. Linck. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read Resolution i/185-68, entitled, Urging that Halloween Handout Activities Be Held on Sunday Afternoon October 27th, 1968, from 2:00 - 5:00 P.M. Ald. Linck moved for the adoption of Resolution #185-68, seconded by Ald. Wollman. Upon a voice vote, the motion to adopt Resolution i/185-68 carried. Ordinance 11127 - Ald. Burgermeister moved to suspend the rules that would allow Ordinance #127 to be placed on the agenda. Seconded by Ald. Wollman. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk gave the first reading of Ordinance #127. Ald. Wollman moved to suspend the rules that would interfere with the adoption of Ordinance $1127-68, seconded by Ald. Burgermeister. Upon a roll call vote, the motion to suspend the rules carried unanim- ously. The Clerk gave the second reading of Ordinance 11127. Ald. Wollman moved for the adoption of Ordinance #127, seconded by Ald. DeBack. Ald. Burgenneister referred to Sec. (3) Connection to the System: Following discussion, Ald. Narlock moved to amend Sec. 3 by changing the words "30 days" to "six months". Seconded by Aid. Budish. Ald. Cooley moved to amend the amendment by changing the time of "six months" to "nine months". to amend Ordinance #127 carried. Narlock moved for the approval of an Operator's License for James White. Seconded by Ald. DeBack. Upon a vuice vote, motion carried. VOUCHER APPROVAL - Ald. DeBack moved for the approval of the payment of vouchers in the amount of $65,116.90 and sewer payment vouchers in the amount of $152,353.80, payable October 22 1968. Seconded by Ald. Narlock. Upon a roll call vote, the motion to pay the vouchers carried unanimously. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Ald. Cooley moved to set a Public Hearing date for Rezoning in Sec. 4 (RSE with an.OIP Overlay to I-l - Industrial Park (former Nike Site) for 7:OO P.M. November 26, 1968, and a Public Hearing date for rezoning in Sec. 17 from RS-2 to RS-2 with an 00s Overlay (Wojtczak) for 7:15 PM on November 26, 1968. Seconded by Ald. Wollman. Upon a voice vote, motion carried. Common Council Meeting City of Muskego 10/22/68 Page 4. Attorney Clayton Cramer appeared at the meeting with his clients Lydia and Carl Wauer regarding the proposed Dump Contract. Ald. Narlock spoke in opposition of the proposed contract. Following a lengthy discussion, Ald. Cooley moved that the Mayor and City Clerk be author- ized to execute the proposed contract between the City of Muskego and Lydia and Carl Wauer. Seconded by Ald. Linck. Upon a roll call vote to accept the proposed contract, Aldermen Budish, Burgermeister, Cooley, Linck and Wollman voted "aye". Ald. Narlock and DeBack voted "no". The motion to accept the proposal, as presented by Attorney Cramer, carried. The matter was referred to City Attorney Buckley directing him to draft a contract suitable to all parties concerned. Ald. Wollman moved to adjourn the meeting until Tuesday, October 29, 1968, at 7~30 P.M. Seconded by Ald. Burgermeister. Motion carried. The meeting ended at 11:08 P.M.
