ccm19680924COMMON COUNCIL CITY OF MUSKEGO MINUTFS OF MEETING HELD SEPTEMBER 24, 1968 The meeting was called to order at 7:35 P.M. l PRESENT: Mayor Donald Wieselmann, Aldermen Robert Burgermeister, Kenneth Cooley, Harold DeBack, Frank Narlock, Roland Linck and Walter Wollman. l Also present was City Attorney John P. Buckley and City Clerk Bette Bowyer. ABSENT: Alderman Edmund Budish APPROVAL OF MINUTES - Ald. Linck moved to accept the Minutes of the previous meeting held on September 9, 1968, as mailed. Seconded by Ald. Narlock, motion carried. COMMITTEE REPORTS FINANCE COMMITTEE; Ald. Narlock presented the report of the Finance Committee meeting held on September 18, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. DeBack, motion carried. PUBLIC WORKS COMMITTEE: Ald. DeBack presented the report of the Public Works Committee meeting held on September 19, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. PUBLIC SAFETY COMMITTEE - Ald. Cooley presented the report of the Public Safety Committee meeting held on September 16, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Burgermeister, motion carried. RULES. LAWS & ORDINANCE COMMITTEE - Ald. Burgermeister presented the report of the Rules; Laws & Ordinance Committee meeting held on September 19, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. PUBLIC WELFARE COMMITTEE - Ald. Burgermeister presented the report of the Public Welfare Committee meeting held on September 16, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. PLAN COMMISSION - The report of the Plan Commission meeting held on September 17, 1968, was received and placed on file. UNFINISHED BUSINESS Ordinance #llc - The Clerk gave the second:' reading of Ordinance #114. Ald. Wollman moved for the adoption of Ordinance 11114, seconded by Ald. Cooley. Ald. Burgermeister moved to amend Sec. 7.10, Paragraph 2, last sentence by changing the word "shall" to "may". Seconded by Ald. Wollman. Upon a voice vote, the motion to amend Ordinance #114 carried. Upon a voice vote, the motion to adopt Ordinance 8114 carried. NEW BUSINESS Resolution #169-68 - The Clerk read Resolution i/169-68, entitled, Resolution Relating to Final Determination of Special Assessments in Dist. 112 (Re: Curb, Gutter, etc.) Ald. Narlock moved for the adoption of Resolution #169-68, seconded by Ald. Linck. Ald. Cooley moved to amend Paragraph #6, last line, by deleting the word "additional". Seconded by Ald. Common Council Meeting City of Muskego g/24/68 - Page 2. Narlock. Upon a roll call vote, the motion to amend Resolution #169-68, Aldermen Cooley, Linck,and Narlock voted "aye". Aldermen Burgermeister, DeBack and Wollman voted "no". There being a tie vote, Mayor Wiesel- mann voted "aye" thus breaking the tie. The motion to amend Resolution #169-68 carried. Upon a voice vote, the motion to adopt Resolution j/169-68, As'Amended, carried. Resolution #170-68 - The Clerk read Resolution #170-68, entitled, Transfer of Funds from Surplus Unappropriated to Acct. $528.0121, City Planning. Ald. Narlock moved for the adoption of Resolution 11170-68, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Resolution #170-68 carried unanimously. Resolution #171-68 - The Clerk read Resolution #171-68, entitled, Designation of Legal Lot (Clayton Leverance) Ald. Linck moved for the adoption of Resolution i/171-68. Seconded by Ald. Wollman. Upon a voice vote, the motion to adopt Resolution $1171-68 carried. Resolution #172-68 - The Clerk read Resolution #172-68, entitled, Authorizing Purchase of Land (John Victor Property) Ald. DeBack moved for the adoption of Resolution $1172-68, seconded by Ald. Wollman. Upon a roll call vote, the motion to adopt Resolution Y/172-68 carried unanimously. Resolution i/173-68 - The Clerk read Resolution #173-68, entitled Acceptance of Bids for Reassessment of City of Muskego. Ald. Cooley moved for the adoption of Resolution $1173-68, seconded by Ald. Burg- ermeister. Ald. Cooley moved to defer action on Resolution 11173-68 until the next Council meeting. Seconded by Ald. Linck. Upon a roll call vote, the motion to defer action on Resolution #173-68 for two weeks carried unanimously. Resolution #174-68 - The Clerk read Resolution #174-68, entitled, Authorizing Public Works to Rule on Waiver of Sewer Lateral Install- ations. The Clerk also read the Request For-Waiver of Sewer Lateral Installation. Ald. Wollman moved for the adoption of Resolution $1174-68, seconded by Aid. DeBack.<.Upon a voice vote, the motion to adopt Resolution #174-68 carried. Resolution #175-68 - The Clerk read Resolution #175-68, entitled, Transfer of Funds. Ald. Narlock moved for the adoption of Resolution' i/175-68, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Resolution 11175-68 carried unanimously. Resolution #176-68 - The Clerk read Resolution #176-68, entitled, Setting the Sale Price of Muskego Building Code ($3.00). Ald. DeBack moved for the adoption of Resolution $1176-68, seconded by Ald. Narlock. Upon a roll call vote, the motion to adopt Resolution j/176-68 carried unanimously. Ordinance 11122 - The Clerk gave the first reading of Ordinance 11122, entitled, An Ordinance to Amend Sec. 12.04(8)(b) of the Municipal Code Relating to Live Music in Public Places. Ald. Burgermeister moved to suspend the rules that would interfere with the adoption of Ordinance #122, seconded by Ald. Wollman. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk gave the second reading of Ordinance #122. Ald. Wollman moved for the adoption of Ordinance #122, seconded by Ald. Burgenneister. Ordinance #123 - The Clerk read Ordinance #123, entitled, An Ordinance to Repeal and Recreate Sec. 12.01 (4)(i) of the Municipal Code (Obstruct- ion of View Prohibited). Ald._Wollman moved to suspend the rules that would interfere with the adoption of Ordinance #123, seconded by Ald. Burgermeister. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk gave the second reading of Resolution i#l23. Ald. Wollman moved for the adoption of Resolution #123, seconded by AId. Burgermeister. Upon a voice vote, the motion to adopt Resolution #123 carried. Ordinance #124 - The Clerk read Ordinance #124, entitled, An Ordinance to,Amend Sec. 12.01(4)(h) of the Municipal Code Relating to Gambling. Ald. Burgermeister moved to suspend the rules that would interfere with the adoption of Ordinance #124, seconded by Ald. Narlock. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk gave the second reading of Ordinance #124. Ald. Narlock moved for the adoption of Ordinance l/124, seconded by Ald. Wollman. Upon a voice vote, the motion to adopt Ordinance #124 carried. Resolution i/177-68 - Resolution Authorizing Public Works Committee to Authorize Utility Installations in Public Streets. Ald. Cooley moved to suspend the rules that would interfere with the adoption of Resolution 11177-68, seconded by Ald. Wollman. Upon a roll call vote to suspend the rules, the motion carried unanimously. The Clerk read Resolution #177. Ald. Cooley moved for the adoptionof Resolution 11177-68, seconded by Ald. DeBack. It was requested by Ald. Burgermeister that the Public Works Committee follow up on a utility such as the Wis. Natural Gas Co. to make sure that property is left in the same condition that it had been found in prior to the installation of the main. Upon a voice vote, the motion to adopt Resolution f/177-68 carried. Resolution #178-68 - Ald. Narlock moved to suspend the rules that would interfere with the adoption of Resolution j/178-68. Seconded by Ald. Cooley. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read Resolution #178;68, entitled, Transfer of Funds from Unappropriated Surplus to Acct. 1E~53.0615, College Avenue. Ald. Narlock moved for the adoption of Resolution f/178-68, seconded by Ald. Burgenneister. Upon a roll call vote, the motion to suspend the rules carried unanimously. LICENSE APPROVAL - Ald. DeBack moved for the approval of an Operator's License for Duane Lindhorst. Seconded by Ald. Narlock. Upon a voice vote the motion carried. VOUCHER APPROVAL - Ald. Narlock moved for the approval of payment of vouchers in the amount of $248,730.60 (sewer payment and regular vouchers) Seconded by Ald. DeBack. Upon a roll call vote to pay the vouchers as of g/24/68, the motion carried unanimously. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Mayor Wieselmann reminded the Aldermen of the joint meeting of the Common Council and the Plan Commission on Tuesday, October 1, 1968, 8:00 P.M. Mayor Wieselmann asked that the Aldermen plan to attend the street opening ceremonies of new Racine Avenue on Sat., Sept. 28, 1968, 5:00 P.M. The Clerk announced that she was in receipt of a petition from Roland Linck to rezone 1.33 Acres from RS-A to B-4. Ald. Burgermeister moved to set the Public Hearing date for the proposed rezoning for November 12, 1968, 7~15 P.M. Aid. Cooley moved to adjourn the meeting, seconded by Ald. Wollman, motion carried. The meeting adjourned at 9:00 P.M.
