MINUTES OF MEETING HELD SEPTEMBER 9, 1968
The meeting was called to order at 7:34 P.M.
0 PRESENT: Mayor Donald Wieselmann, Aldermen Edmund Budish, Robert

Burgermeister, Kenneth Cooley, Harold DeBack, Frank Narlock and
Roland Linck. Also present was City Attorney Buckley and City Clerk
Bette J. Bowyer.
ABSENT: Ald. Walter Wollman
APPROVAL OF MINUTES: Ald. Burgerrneister moved to accept the Minutes of
the previous meeting held on August 27, 1968, as mailed. Seconded by
Ald. Narlock, motion carried.
COMMITTEE REPORTS
Finance Committee - Ald. Narlock presented the report of the Finance
Committee meeting held on September 4, 1968, and moved that the report
be accepted and placed on file. Seconded by Ald. Budish, motion carried.
Public Works Committee - Ald. DeBack presented the report of the Public
l Works Committee meeting held on September 5, 1968, and moved that the
report be accepted and placed on file. Seconded by Ald. Budish, motion
carried.
Public Safety Committee - Ald. Cooley presented the report of the Public
Safety meeting held on September 3, 1968, and moved that the report be
accepted and placed on file. Seconded by Ald. Linck, motion carried.
Public Welfare Committee - Ald. Burgenneister presented the report of
the Public Welfare Committee held on September 3, 1968, and moved that
the report be accepted and placed on file. Seconded by Ald. Cooley,
motion carried.
Rules, Laws & Ordinance Committee - Ald. Linck presented the report of
the Rules, Laws & Ordinance Committee meeting held on September 5, 1968,
and moved that the report be accepted and placed on file. Seconded by
Ald. Narlock, motion carried.
l Plan Commission - The report of the Plan Commission meeting held on
September 3, 1968, was received and placed on file.
COMMUNICATIONS FROM THE MAYOR'S OFFICE - None
UNFINISHED BUSINESS
Ordinance 8109 - The Clerk gave the second reading of Ordinance #109,
entitled, Revision of Ch. 7 of the Mun. Code. Ald. Narlock moved for the
adoption of Ordinance 8109 seconded by Ald. Burgermeister.

entitled, Regulations of Minors in Public Places. Ald. Burgenneister
moved for the adoption of Ordinance #llO, seconded by Ald. Narlock. Upon

4) Regulations for Burning Trash:
l
a) Burning must be done in a trash burner container made of
metal, masonry or concrete with a cover of fine metal screen.
c) Burning shall be done only when wind velocity does not
exceed fifteen (15) miles per hour as recorded by the U.S.
Weather Bureau, Milwaukee, Wisconsin and when etc.
5) Emergencies: Whenever, because of extreme dryness or drought,
the'Mayor shall deem it necessary to prohibit the setting of
fires upon any land within the city, he shall by proclamation, declare
an emergency and cause to be published in the official newspaper a
notice forbidding the setting of fires within the city or any part
thereof and or have broadcast on radio or T.V. such notice, and
after publishing or broadcasting of such notice, no person shall
set any fire upon lands in such area except for warming the person
or cooking food until the expiration of such emergency."
Seconded by Ald. Linck. Upon a voice vote, the motion to adopt
Ordinance #115, As Amended, carried.
NEW BUSINESS
Ordinance #117 - The Clerk read Ordinance l/117, entitled, An Ordinance
to Create Sec. 6.10 (16) of Ch. 17 of the Mun. Code (Non-Conforming
Signs to be Removed) Ald. Burgermeister moved to suspend the rules
that would interfere with the adoption of Ordinance #117, seconded by
Ald. Cooley. Upon a roll call vote, the motion to suspend the rules
carried unanimously. The Clerk gave the second reading of Ordinance
#117. Ald. Narlock moved for the adoption of Ordinance i/117, seconded
by Ald. Burgermeister. Upon a voice vote, the motion to adopt Ordinance
11117 carried.
Ordinance 11118 - The Clerk read Ordinance i/118, entitled, An Ordinance
to Rezone Certain Property in the City of Muskego (Mary Mayer Property)
Ald. Narlock moved to suspend the rules that would interfere with the
adoption of Ordinance #118, seconded by Ald. Linck. Upon a roll call
vote to suspend the rules, the motion carried unanimously. The Clerk
gave the second reading of Ordinance i/118. Ald. Narlock moved for the
adoption of Ordinance 11118, seconded by Ald. DeBack. Upon a voice
vote, the motion to adopt Ordinance #118 carried.
Ordinance #120 - The Clerk gave the first reading of Ordinance #120,
entitled, An Ordinance Correcting Sec. 3 of the Municipal Code (Ch. 17)
Ald. Narlock moved to suspend the rules that would interfere with the
adoption of Ordinance i/120, seconded by Ald. Burgermeister. Mayor
Wieselmann vacated the Chair to Council President Budish to speak in
favor of the immediate adoption of Ordinance #120. Upon a roll call vote
to suspend the rules, Aldermen Budish, Cooley and Linck voted "no".
Aldermen Burgenneister, DeBack and Narlock voted "aye". The vote being
a tie, Mayor Wieselmann vote "aye". The motion to suspend the rules
carried. The Clerk gave the second.reading of Ordinance i/120. Ald.
Narlock moved for the adoption of Crdinance #120, seconded by Ald.
DeBack. Upon a voice vote, the motion to adopt Ordinance #120 carried.
Ordinance #121 - The Clerk gave the first reading of Ordinance i/121,
entitled, An Ord. to Create Sec. 12.01(8) of the Municipal Code Regulat-
ing Sale and Possession of Fermented Malt Beverages and Intoxicating
Liquors by Minors. Ald. Burgermeister moved to suspend the rules that
would interfere with the adoption of Ordinance i/121, seconded by Aid.
Linck. Upon a roll call vote, the motion to suspend the rules carried
unanimously. The Clerk gave the second reading of Ordinance #121. Ald.
Burgermeister moved for the adoption of Ordinance #121, seconded by
Ald. Narlock. Upon a voice vote, the motion to adopt Ordinance #121 carried.

Resolution #164-68 - The Clerk read Resolution f/164-68, entitled, Authoriz-
ing the Wis. Natural Gas Co. to Install Main. Ald. Budish moved for the
adoption of Resolution i/164-68, seconded by Ald. DeBack. Upon a voice vote,
l the motion to adopt Resolution 11164-68 carried.
Resolution i/165-68 - The Clerk read Resolution $1165-68, entitled, Extension
w of Dump Contract. Ald. DeBack moved for the adoption of Resolution #165-68,
seconded by Ald. Budish. Upon a roll call vote, the motion to adopt
Resolution #165-68 carried unanimously.
Resolution #166-68 - The Clerk read Resolution #166-68, entitled, Authoriz-
ing the Public Works Committee to Advertise for Bids for the Purchase of
a New Truck. Ald. Budish moved for the adoption of Resolution j/166-68,
seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt
Resolution #166-68 carried unanimously.
Resolution i/167-68 - The Clerk read Resolution $1167-68, entitled, Authoriz-
ing the Public Works Committee to Advertise for Bids for the Purchase of a
Front End Loader. Ald. Budish moved for the adoption of Resolution l/167-68,
seconded by Ald. DeBack.. Upon a~ roll call vote, the motion to adopt
Resolution 11167-68 carried unanimously.
0 Resolution i/168-68 - The Clerk read Resolution $1168-68, entitled, Transfer
of Funds from Surplus Unappropriated to Rescue Service, Acct. #523-012.
Ald. Linck moved for the adoption of Resolution i/168-68, seconded by Ald.
Narlock. Upon a roll call vote, the motion to adopt Resolution #168-68
carried unanimously.
LICENSE APPROVAL - None.
VOUCHER APPROVAL - Ald. Narlock moved for the approval of payment of
vouchers in the amount of $124,272.72 as of September 9, 1968. Seconded by
Ald. DeBack. Ald. Burgermeister questioned several disbursements and Ald.
Cooley questioned authorized payment covering Voucher i/646, Bayshore Signs.
The Clerk reviewed the procedure used prior to final approval of Council.
Ald. Cooley asked that each alderman receive prepared voucher list at the
same time it is presented to the Finance Committee so the Council has
ample time to review same before payment approval. Upon a roll call vote,
the motion to approve payment of voucher list carried.
CITY OFFICIAL'S REPORT -
l The Clerk presented the Building Report for the month of August, 1968.
Report to be placed on file.
The Clerk presented the Financial Report as of August 30, 1968, in the
amount of $452,087.30. Report to be placed on file.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
The Clerk read a communication directed to the Common Council from the Plan
Commission recommending the closing of Simandl Dr. on the west end at the
entrance to new Highway "Y". l The Clerk announced that two of the firms that are bidding on the reassess-
ment of the City would like to meetwith the Cormnon Council some time in
the near future in order to clarify the way bids are to be presented.
l Mayor Wieselmann announced that due to the fact that many members of the
Community Improvement Program Committees have resigned or moved, it is
his intention reorganize the committees. Letters of thanks will be mailed
to all who served on the many committees.thanking them for their services.
Ald. Cooley thanked Ald. Budish, Chairman of the Public Works Dept. for the
fine job being done in the Fountainwood area regarding the cleaning of ditches
