ccm19680827COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD AUGUST 27, 1968 The meeting was called to order at 7:46 P.M. PRESENT: Mayor Donald Wieselmann, Aldermen Edmund Budish, Robert Burgermeister, Kenneth Cooley, Harold DeBack, Frank Narlock, Roland Linck and Walter Wollman. Also present was Assistant City Attorney Joseph Wimmer and City Clerk Bette Bowyer. APPROVAL OF MINUTES - Ald. Budish moved to accept the Minutes of the previous meeting held on August 13, 1968, as mailed. Seconded by Ald. Burgermeister and the motion carried. COMMITTEE REPORTS FINANCE COMMITTEE - Ald. Narlock presented the report of the Finance Committee meeting held on August 21, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Budish, motion carried. PUBLIC WORKS COMMITTEE - Ald. DeBack presented the report of the Public Works Committee meeting held on August 22, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. PUBLIC SAFETY COMMITTEE - None PUBLIC WELFARE COMMITTEE - Ald. Burgermeister presented the report of the Public Welfare Committee held on August 19, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Wollman, motion carried. RULES, LAWS & ORDINANCE COMMITTEE - None PLAN COMMISSION - The report of the Plan Commission meeting held on August 20, 1968, was received and placed on file. COMMUNICATIONS FROM THE MAYOR'S OFFICE - None. UNFINISHED BUSINESS Ordinance #lo7 - The Clerk gave the second reading of Ordinance #107, entitled, An Ordinance to Amend the Zoning Ordinance of the City of Muskego (Dumke) 2nd reading. Ald. Budish moved for the adoption of Ordinance #107, seconded. by Ald. Wollman. Upon a voice vote, the motion to adopt Ordina~nce #107 carried. Ordinance i/108, Amended - The Clerk gave the second reading of Ordinance #108, entitled, An Ordinance to Rezone Certain Property in the City of Muskego (Sec. 29 - Fire Dept. Sub-station) Ald. Wollman moved for the adoption of Ordinance /&OS, As Amended) Seconded by Ald. Budish. Upon a voice vote, the motion to adopt carried. Ordinance #lo9 - The Clerk gave the second reading of Ordinance #109, entitled, Revision of Ch. 7 of the Municipal Code (Traffic Code) Ald. Narlock moved for the adoption of Ordinance 8109, seconded by Ald. Burgermeister. Ald. Wollman moved to defer action on Ordinance #lo9 for two weeks. Seconded by Ald. Budish. Upon a voice vote, the motion to defer action on Ordinance #lo9 for two weeks carried. Common Council Meeting City of Muskego 8/27/68 Page 2. 4 Ordinance #llO - The Clerk gave the second reading of Ordinance #llO, entitled, An Ordinance to Create Ch. 21 of the Municipal Code to be entitled "Regulations of Minors in Public Places. Ald. Burgermeister moved for the adoption of Ordinance #llO, seconded by Ald. Linck. Ald. Narlock moved to defer Ordinance #llO to the Rules, Laws & Ordina~nce Committee. Seconded by Ald. Wollman. Upon a voice vote, the motion to refer Ordinance #llO to the Rules, Laws & Ordinance Committee carried. Ordinance $1111 - The Clerk gave the second reading of Ordinance #ill, entitled, Ordinance for Waterway Marking. Ald. Wollman moved for the adoption of Ordinance 111, seconded by Ald. DeBack. Upon a voice vote, the motion to adopt Ordinance $1111 carried. Ordinance 8112 - The Clerk gave the second reading of Brdinance #112, entitled, Amendment to Salary Ordinance (Dispatcher). Ald. Budish moved for the adoption of Ordinance #112, seconded by Ald. Cooley. Upon a roll call vote, the motion to adopt Ordinance #112 carried unanimously. Ordinance 1170 - The Clerk read Ordinance #70, entitled, An Ordinance to Amend the Zoning Ordinance of the City of Muskego (Sec. 4, John Victor property) which had been referred to the Plan Commission for their recommendation on August 22, 1967. Aldermen Budish and Wollman questioned the change in legal description contained in Ordinance 870 as compared to the recent Certified Survey which had been presented to the Plan Commission at their meeting of August 20, 1968. Attorney Wimmer rendered legal opinion that because of the minor discrepancies contained in the legal description and Ordinance #70 that it could be amended at this time. Ald. Cooley noted that Ord,inance #TO . . . should be corrected to show 50' road dedication instead of 33'. Ald. Budish moved to amend th?t the footage change in the ordinance be changed according to the recent Certified Survey map that had been submitted to the Plan Commission. Seconded by Aid. NEW BUSINESS Resolution i/146-68 - The Clerk read Resolution #146-68 entitled, Appointment of Five Members to an Electrical Licensing Board for the City of Muskego. Members appointed are as follows: Gerald P. Lee, Clarence Beierle, James Dethardt, Werner Bierbach and Blair Dixon. Ald. Narlock moved for the adoption of Resolution #146-68. Seconded by Ald. Budish. Mayor Wieselmann reviewed the qualifications of the new appointees. Upon a roll call vote, the motion to adopt Resolution 11146-68 carried unanimously. Resolution 8154-68 - The Clerk read Resolution i/154-68, entitled, Acceptance of Low Bid for Crowbar Reconstruction. Ald. Budish moved for the adoption of Resolution i/154-68, seconded by Ald. Wollman. Ald. Narlock moved to amend Resolution 8154-68 by changing the amount of $32,209.00 to $32,490.00. Seconded by Ald. DeBack. Resolution 9155-68 - The Clerk read Resolution f/155-68, entitled, Denial of Rezoning in Section 5 (Dale Dawson). Ald. DeBack moved for the adoption of Resolution i/155-68, seconded by Ald. Na~rlock. Mayor Wieselmann vacated the Chair to Council President Budish in o'rder to speak in favor of the adoption of Resolution i/155-68. Ald. Narlock also spoke in favor of the adoption of Resolution #155-68. Upon a roll call vote to adopt Resolution #155-68, Aldermen Budish, Burgermeister, Cooley, DeBack, B&+ak and Narlock voted "aye". Ald. Wollman voted "no". The motion to adopt Resolution l/155-68 carried. Resolution #156-68 - The Clerk read Resolutfon #156-68, entitled, Setting Bid Notice Pursuant to Resolution f/145-68 (Re: Reassessment). Ald. Cooley moved for the adoption of Resolution i/156-68, seconded by Ald. Narlock. Ald. Cooley moved to amend Resolution #156-68 by changing the bid due date from September 18, 1968 to September 23, 1968. Seconded by Ald. Burgermeister. Upon a voice vote to amend Resolution #156-68 the motion carried. Upon a roll call vote to adopt Resolution i/156-68, As Amended, the motion carried unanimously. Resolution $1157-68 - The Clerk read Resolution j/157-68, entitled, Establishing Traffic Regulations ("No Parking" on Ladwig Drive) Ald. Narlock moved for the adoption of Resolution 8157-68, seconded by Ald. Linck. Ald. Burgermeister moved that Resolution #157-68 be referred back to the Safety Committee, seconded by Ald. Budish. Upon a voice vote, the motion to refer Resolution i/157-68 back to the Safety Committee carried. Resolution 8158-68 - The Clerk read Resolution j/158-68, entitled, Establishing Traffic Regulations (Speed Limits Eatablished) Ald. Burgermeister moved for the adoption of Resolution #158-68, seconded by Ald. Linck. Ald. Budish moved to defer action ,on Resolution i/158-68 until the next Council meeting. Seconded by Ald. Wollman. Upon a voice vote, the motion to defer action on Resolution #158-68 carried. Resolution j/159-68 - The Clerk read Resolution #159-68, entitled, Establishing Traffic Regulations (Arterial Streets) Ald. Burgermeister moved for the adoption of Resolution $1159-68, seconded by Ald. Linck. Aid. Budish moved to defer action on Resolution #159-68 until the next Council meeting, seconded by Ald. Wollman. Upon a voice vote, the motion to defer action on Resolution #159-68 carried. Resolution #160-68 - The Clerk read Resolution 8160-68, entitled, Approval of Contract for Continued Engineering Services for Little Muskego Lake. Ald. Burgermeister moved for the adoption of Resolution #169-68, seconded by Ald. Narlock. Ald. Narlock requested permission of Mr. Ronald P. Slattery, S71 W19803 Simandl Dr. to speak. As there were no objections, Mr. Slattery questioned as to whether or not the adoption of this resolution would allow the City to buy a dredge or just a continuation of engineering services. Also whether or not the financing of this project would be a general assessment or an assessment against lake property owners. Mayor Wieselmann indicated that the City's application to the Federal Government had not been denied, therefore we cannot concern ourselves with this at this time. Attorney Wimer rendered legal opinion that travel expenses allowed do not include loss of salary. Upon a roll call vote, the motion to adopt Resolution f/160-68 carried unanimously. Common Council Meeting City of Muskego - 8127168 Page 4. Resolution 8161-68 - The Clerk read Resolution #161-68, entitled, Establish- ing Permit Fee for Waterway Markers. Ald. Linck moved for the adoption of Resolution j/161-68, seconded by Ald. Wollman. Upon a voice vote, the motion l to adopt Resolution #161-68 carried. * Resolution i/162-68 - The Clerk read Resolution #162-68, entitled, Authorizing Execution of Rosecky Easement. Ald. Burgermeister requested permission of his fellow Aldermen to have Mr. Anthony Rosecky speak. As there were no objections, Mr. Rosecky indicated that it was his hope that three large maple trees in his front yard could be preserved during the reconstruction of College Agenue. Ald. Cooley moved to amend Resolution i/162-68 by de- leting the entire last paragraph and substitute the words "that the Common Council will establish what the monetary loss might be if the trees do actually come down". Seconded by Ald. Narlock. Upon a voice vote, the motion to amend Resolution i/162-68 carried. Ald. Cooley moved to further amend Resolution 11162-68 by adding the words "and that the City pay at the rate of $5.00 per inch of diameter for the total loss of the trees during the construction period." Seconded by Ald. Narlock. Upon a voice vote, the motion to further amend, Resolution #162-68 carried. Ald. Burg- ermeister moved to amend the second paragraph of Resolution l/162-68 and the Rosecky ea~sement by changing the number of trees from two to "three". Seconded by Ald. Linck. Upon a voice vote, the motion to further amend Resolution l/162-68, As Amended, carried. Upon a voice vote, the motion to adopt Resolution l/162-68, As Amended, carried. Ordinance 8113 - The Clerk gave the first reading of Ordinance #113, entitled, An Ordinance to Rezone Certain Property in the City of Muskego (Re: Sec. 9 and 16 - Kelly Property) Ordinance #114 -The Clerk gave the first reading of Ordinance i/114, entitled An Ordinance to Create Sec. 7.10 of the Mun. Code Relating to the Storage of Junked Automobiles. Ordinance #115 - The Clerk gave the first reading of Ordinance 8115, entitled An Ordinance to Repeal and Recreate Sec. 9.22 and 9.23 of the Municipal Code of the City of Muskego Relating to Open Fires. Resolution i/163-68 - Ald. Budish moved to suspend the Rules that would interfere with the adoption of Resolution 8163-68, entitled, Authorizing the Wis. Natural Gas Co. to Install Main. Upon a roll call vote, the motion to suspend the Rules carried unanimously. Ald. Budish moved for the adoption of Resolution $1163-68, seconded by Ald. Wollman. Upon a voice vote, the motion to adopt Resolution 8163-68 carried. LICENSE APPROVAL - None VOUCHER APPROVAL - Ald. Narlock moved for the approval of payment of vouchers in the amount of $58,268.70 as of August 27, 1968. Seconded by Ald. DeBack. Upon a roll call vote, the motion to approve payment of vouchers carried unanimously. l CITY OFFICIAL'S REPORT - None COMMUNICATIONS AND MISCELLANEOUS BUSINESS l The Clerk read a communication from the Plan Commission directed to the Common Council and Mayor Wieselmann, dated Aug. 26, 1968, recommending that the proposed rezoning be held in abeyance for further study concerning a reduction in lot size in areas which will be sewered. The Clerk read a communication from the Plan Commission directed to the Common Council and Mayor recommending denial of a Petition from l Dale Dawson to rezone property in Sec. 5. Communication placed on file. * The Clerk read a communication from Congressman Glenn Davis thanking the City for the use of the City Hall on August 17, 1968. Communication placed on file. The Clerk read a communication from the State Dept. of Natural Resources which granted the City a Permit to dredge Little Muskego Lake. Communication placed on file. The Clerk introduced a resolution regarding the closing of the west end of Simandl Dr. in Hi-Y Ranches Subdivision. Ald. Narlock moved to set the Public Hearing date regarding same for October 8, 1968, at 7:15 P.M. Seconded by Ald. DeBack. Upon a voice vote, the motion carried. Ald. Burgermeister moved to change the date of the next Common Council meeting from September 10, 1968, to Monday, September 9, 1968, due to the fact that the Primary Election will be held on September 10th.
