MINUTES OF MEETING HELD AUGUST 13,1968
a The meeting was called to order at 7:45 P.M. by Mayor Wieselmann.

At this point Mayor Wieselmann introduced Assemblyman James Devitt,
23rd District. Assemblyman Devitt indicated that he will be running
for a seat in the State Senate (vacated by Taylor Benson) this fall.
He offered assistance to the Council and School Board in any problems
that might arise for them in the future.
Attorney John Buckley introduced his Assistant Attorney Joseph Wimmer.
Attorney Wimmer has acted as Assistant District Attorney for the past
three years and will be representing the City in our Traffic Court.
ROLL CALL
PRESENT - Mayor Donald Wieselmann, Aldermen Edmund Budish, Robert
Burgermeister, Harold DeBack, Frank Narlock, Roland Linck and Walter
Wollman. Also present were City Attorney John Buckley and City Clerk
Bette Bowyer.
ABSENT - Alderman Kenneth Cooley.
APPROVAL OF MINUTES - Ald. Narlock moved to accept the Minutes of the
previous meeting of July 23, 1968, as mailed. Ald. Wollman seconded the
motion and the motion carried.
COMMITTEE REPORTS
FINANCE COMMITTEE - Ald. Narlock presented the report of the Finance
Committee meeting held on August 7, 1968, and moved that the report
be accepted and placed on file. Seconded by Ald. Budish. Motion carried.
PUBLIC WORKS COMMITTEE - Ald. Wollman presented the report of the Public
Works Committee meeting held on August 8, 1968, and moved that the report
be accepted and placed on file. Seconded by Ald. Budish, motion carried.
PUBLIC SAFETY COMMITTEE - Ald. Burgermeister presented the report of

the Public Safety Committee meeting held on August 5, 1968, and moved
that the report be accepted and placed on file. Seconded by Ald. Linck.
Motion carried.
PUBLIC WELFARE COMMITTEE: Ald. Burgermeister presented the report of
the Public Welfare Committee meeting held on August 5, 1968, and moved
that the report be accepted and placed on file. Seconded by Ald. Wollman,
motion carried.
RULES, LAWS & ORDINANCE COMMITTEE - Ald. Linck presented the report of
the Rules, Laws & Ordinance Committee meeting held on August 6, 1968,
0 and moved that the report be accepted and placed on file. Seconded
by Ald. Narlock, motion carried.
PLAN COMMISSION - The report of the Plan Commission meeting held on
l August 8, 1968 was received and placed on file.

l Resolution i/95 - The Clerk read Resolution #95, entitled, Proceedings
by the Common Council of the City of Muskego to Discontinue and Vacate
l a Part of Hi-Y Drive in the City of Muskego, Wisconsin (East side of
Racine Avenue). Ald. Narlock moved to suspend the rules in order that
Resolution #95 could be considered. Seconded by Ald. Burgermeister.
Upon a roll call vote, the motion to suspend the rules carried
unanimously. Ald. Narlock moved for the adoption of Resolution #95-68.
Seconded by Ald. DeBack.

Resolution f/105-68 - The Clerk read Resolution #105-68, entitled,
Proceedings by the Common Council of the City of Muskego to Discontinue
and Vacate A Part of Simandl Drive in the City of Muskego, Wisconsin
(east side of Simandl) Ald. Narlock moved to suspend the rules that
would interfere with the adoption of Resolution i/105-68. Seconded by
Ald. Wollman. Upon a roll call vote to suspend the rules, the motion
carried unanimously. Ald. Narlock moved for the adoption of Resolution
8105-68, seconded by Ald. Wollman. Upon a voice vote, the motion carried.
6 Resolution 8138-68 - The Clerk read Resolution 8138-68, entitled,
Authorizing the Finance Committee to Take Option on Idle Isle. Ald.
Narlock moved for the adoption of Resolution i/138-68, seconded by Ald.
Burgermeister. .Upon a roll call vote to adopt Resolution #138-68,
Aldermen Budish, DeBack, Burgermeister, Narlock and Linck voted "aye".
Aldermen Cooley and Wollman voted "no".

would interfere with the adoption of Resolution i/145-68, seconded by
Ald. Narlock. Upon a roll call vote, the motion to suspend the rules
carried unanimously. Ald. Narlock moved for the adoption of Resolution
#145-68, seconded by Ald. Cooley. Upon a roll call vote, the motion to

Resolution $1147-68 - The Clerk read Resolution i/147-68, entitled,
Resolution to Reconsider and Amend Resolution #18-67 Levying Special
Assessments for Sidewalks, Driveway Approaches, Curb, Gutter & Storm
Sewer. Ald. Budish moved for the adoption of Resolution i/147-68,

Resolution 8148-68 - Directing Notice of Reconsideration of Special
Assessments in Special Assessment Dist. $12. Ald. Budish moved for

a voice vote, the motion to adopt Resolution i/148-68 ca,rried.
l Resolution #149-68 - The Clerk read Resolution f/149-68, entitled,
Approving of Rezoning in Sections 3 & 4 (Kirkwood) Ald. Wollman moved
for the adoption of Resolution 8149-68, seconded by Ald. Budish. Ald.
Narlock indicated that as a result of the Public Hearing that had been ,
held he would move to refer Resolution #149-68 back to the Plan Commission
for reconsideration and further study. Seconded by Ald. Wollman. Upon
a voice vote, motion to refer Resolution 8149-68 back to the Plan
Commission carried.
Resolution f/150-68 - The Clerk read Resolution f/150-68, entitled, Transfer
of Funds of General Fund Surplus-Unappropriated to Acct. #520-0112, Other
Salaries. Ald. Linck moved for the adoption of Resolution #150-68,
seconded by Ald. Cooley.

Ordinance 8107 - The Clerk gave the first reading ef Ordinance $1107,
entitled, An Ordinance to Rezone Certain Property and to Amend the
Zoning Map of Muskego (Dumke property).
Resolution #152-68 - The Clerk read Resolution #152-68, entitled,
Authorizing Conveyance of Land With Reservation of Sight Easement (Preston-
College Avenue) Ald. Wollman moved to suspend the rules that would inter-
fere with the adoption of Resolution l/152-68, seconded by Ald. Budish.
A,ttorney Buckley explained that in order for the City to retain a visual
sight easement on the Mary Presfnn property abutting Racine Ave. and
College Ave. the passage of Resolution #152-68 wars necessary. Upon a
roll call vote, the motion to suspend the rules carried unanimously.
Ald. Budish moved for the adoption of Resolution #152-68, seconded by
Ald. Wollman. Upon a voice vote, the motion to adopt Resolution #152-68
carried.
Resolution 8153-68 - Authorizing Purchase of Land (Preston-College Avenue)
Ald. Budish moved to suspend the rules that would interfere with the
adoption of Resolution #153-68, seconded by Ald. Burgermeister. Upon a
roll call vote to suspend the rules, the motion carried unanimously.

Ordinance i/l08 - The Clerk gave the first reading of Ordinance #108,

Ordinance #lo9 - Revision of Chapter 7 of Municipal Code. Ald. Burger-
l meister moved to suspend the rules that would waive the first reading
of Ordinance #109. Seconded by Ald. Cooley. Upon a voice vote, the
motion to waive the reading of Ordinance #lo9 carried.

Ordinance #llO - The Clerk gave the first reading of Ordinance #llO,
entitled, An Ordinance to CreatPChapter 21 of the Municipal Code to
be Entitled "Regulations of Minors in Public Places"

moved to suspend the rules that would waive the first reading of
a Ordinance j/111. Seconded by Ald. Cooley. Upon a voice vote, the
motion to waive the first reading of Ordinance i/l11 carried.
Ordinance #112 - The Clerk gave the first reading of Ordinance 8112,
entitled, Amendment to Salary Ordinance (Police Dispatcher)
LICENSE APPROVAL
Ald. Budish moved for the approval of a Class "B" Fermented Malt Beverage
and Intoxicating Liquor License for Mario Calero. Seconded by Alderman
Narlock. Upon a voice vote, the motion carried.
Ald. Narlock moved for the approval of an Operator's License for Donald
Karl. Seconded by Ald. DeBack. Upon a voice vote, the motion carried.
VOUCHER APPROVAL
6 Ald. Budish moved for the approval of payment of vouchers, payable
August 13, 1968, in the amount of $135,460.82. Seconded by Alderman
Narlock. Upon a roll call vote, the motion to pay the vouchers carried
una,nimously.
Ald. Budish moved for the approval of Payment #l to Ruekert & Mielke
for engineering services for Sewer Projects MSS-1-68 thru MSS-5-68
in the amount of $38,004.00. Seconded by Ald. Wollman. Upon a roll call
vote, the motion carried.
Ald. Budish moved to approve payment of $100.00, final payment to Herman
Schoenherr, for the installation of City entrance signs. Seconded by
Ald. Burgermeister. Upon a roll call vote, the motion carried.
CITY OFFICIAL% REPORT
The Clerk read a communication from herself directed to the Common
Council and Mayor Wieselmann in which she disallowed a bill in the amount l of $500.00 from Mr. Robert A. Congdon of Manufacturers Life Ins. Co.
for extraordinary professional services.
The Clerk presented the Financial Report as of July 31, 1968, in the
amount of $425,310.34. Report to be placed on file.
The Clerk presented the Building Report for the month of July, 1968.
Report to be placed on file.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
l Discussion regarding the proposed rezoning by Dale Dawson in Section 5
took place. City Attorney Buckley advised that the Attorney for the
petitioner had indicated at the Public Hearing held on August 8 1968,
l that they would amend the proposed rezoning, therefore Mr. Dawson
should be required to file another petition. Upon Mr. Buckley's
recommendation, Alderman Narlock moved as follows:

WHEREAS, Dale Dawson has petitioned for the rezoning of 105
acres of land and a Public Hearing commenced August 8, 1968,
has been adjourned to August 20, 1968, and
WHEREAS, the petitioner has advised the City that he wishes
to amend his petition for rezoning to substantially reduce
the area involved,
NOW, THEREFORE, BE IT RESOLVED that the petitioner be advised
that the Common Council will take no action on the original
petition unless the petitioner affirms that if the petitioner
does not tish the rezoning of the entire 105 acres that he
be instructed to file a new petition with appropriate procedures
to be had therein.
Motion seconded by Alderman DeBack. Upon a voice vote, the motion
carried.
Alderman Wollman moved that a Public Hearing be held on September 9,
1968, 7:15 P.M. to reconsider special assessments in Assessment Dist. i/2
(curb, gutter, sidewalk and storm sewer - Racine Ave.). Seconded by
Alderman Narlock. Upon a voice vote, the motion carried.
Ald. Burgermeister, speaking for the Chamber of Commerce, indicated
that a celebration for the opening of the new section of Racine
Avenue from Highway 24 south will be held on September 28, 1968. The
Chamber of Commerce is requesting cooperation of the City regarding
traffic control, parking of cars and the supporting of a fireworks
display.
Alderman Narlock moved that the Common Council authorize the City
Attorney to prepare a resolution that would allow the vacating of
the west end of Simandl Drive approaching the new Highway "Y".
Seconded by Ald. Burgermeister. Upon a voice vote, the motion
carried. Recommendation on the proposed closing to come from the
Plan Commission.
ADJOURNMENT
Ald. Budish moved to adjourn the meeting, seconded by Ald. Wollman,
motion carried. The meeting adjourned at 9:38 P.M.
