ccm19680709COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD JULY 9, 1968 The meeting was called to order at 8:16 P.M. by Mayor Wieselmann. a PRESENT: Mayor Donald Wieselmann, Aldermen Robert Burgermeister, Kenneth Cooley, Harold DeBack, Edmund Budish, Roland Linck, Frank Narlock and * Walter Wollman. Also present were City Attorney John Buckley and City Clerk Bette Bowyer. APPROVAL OF MINUTES: Alderman Narlock moved to accept the minutes of the previous meeting of June 25, 1968, as mailed. Alderman Linck seconded the motion and the motion carried. COMMITTEE REPORTS FINANCE COMMITTEE - Ald. Narlock presented the report of the Finance Committee meeting held on July 3, 1968, and moved that the report be accepted and placed on file. Ald. Budish seconded the motion and the motion carried. PUBLIC WORKS COMMITTEE - None PUBLIC SAFETY COMMITTEE - Ald. Cooley presented presented the report of the Public Safety Committee meeting held on July 1, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Linck, motion carried. PUBLIC WELFARE COMMITTEE - Ald. Burgermeister presented the report of the Public Welfare Committee meeting held on July 1, 1968, and moved that the report be accepted and placed on file. Ald. Wollman seconded the motion and the motion carried. RULES, LAWS & ORDINANCE COMMITTEE - Ald. Linck presented the report of the Rules, Laws & Ordinance Committee meeting held on July 3, 1968, and moved that the report be accepted and placed on file. Seconded by Ald. Narlock, motion carried. PLAN COMMISSION - The report of the Plan Commission meeting held on July 2, 1968, was received and placed on file. 0 COMMUNICATIONS FROM THE MAYOR% OFFICE The Clerk read Mayor Wieselmann's Veto Message of Resolution 11110-68, entitled, Appointment of all Aldermen to the Sewer Committee and the Sewer Financing and Procedures Committee. Ald. Burgermeister moved for the reconsideration of Resolution #llO-68, seconded by Ald. Cooley. Ald. Narlock raised a Point of Order and upon the legal advice of the City Attorney it was determined that all appointments to special committees shall be made by the Mayor, therefore, Resolution $1110-68 was out of order. UNFINISHED BUSINESS Resolution 8103-68 - The Clerk read Resolution $1103-68, entitled, Approving Supplementary Agreement with Walter and Dorothy Vesbach. Ald. Budish moved for the adoption of Resolution l/103-68, seconded by Ald. DeBack. Upon a roll call vote, the motion to adopt Resolution #103-68 carried unanimously. NEW BUSINESS Ordinance #lo.5 - The Clerk gave the first reading of Ordinance #105, entitled, An Ordinance to Repeal and Recreate Sec. 7.03 of the Municipal Code. Ordinance #106 - The Clerk gave the first reading of Ordinance #106, entitled, An Ordinance to Create 20.09 (15) of the Municipal Code (Re: Scuba Diving). Ald. Burgermeister moved to suspend the rules that would interfere with the adoption of Ordinance #106, seconded by Ald. Linck. Upon a roll call vote to suspend the rules, the motion carried unanimously. Ald. Burgenneister moved for the adoption of Ordinance #106, seconded by Ald. Linck. Upon a voice vote, the motion to adopt Ordinance #lo6 carried unanimously. Resolution #118-68 - The Clerk read Resolution i/118-68, entitled, Resolution Rescinding Resolution No. 17-67 (Re: special assessments for sewers (Racine Ave.). Aid. Linck moved for the adoption of Resolution #118-68. Seconded by Ald. Cooley. Ald. DeBack moved to refer Resolution #118-68 to the Sewer Committee. Seconded by Ald. Narlock. Linck moved for the adoption of Resolution i/119-68, seconded by Ald. Cooley. Ald. DeBack moved to refer Resolution #119-68 to the Municipal Sewer Committee. Seconded by Ald. Narlock. Upon a roll call vote to refer Resolution #119-68 to the Sewer Committee, Aldermen Budish, DeBack and Narlock voted "aye". Aldermen Burgermeister, Cooley, Linck and Wollman voted "no". Resolution i/127-68 - Authorizing Full Time Pay to City Employees While at Military Summer Camp. Ald. Narlock moved for the adoption of Resolution $1127-68. Seconded by Ald. Linck. Upon a roll call vote, Aldermen DeBack, Linck, Narlock and Wollman voted "aye". Aldermen Budish, Burgermeister and Cooley voted "no". The motion to adopt Resolution i/127-68 carried. Resolution f/128-68 - The Clerk read Resolution f/128-68, entitled, Resolution Reaffirming the Established Assessment Policies of the Sewer Projects MSS-l- 67 Thru MSS 3-67 and MSS-l-68 Thru MSS-5-68. Ald. Burgermeister moved for the adoption of Resolution 11128-68, seconded by Ald. Cooley. Ald. Narlock a moved to refer Resolution #128-68 to the Municipal Sewer Committee. Seconded by Ald. DeBack. Following considerable discussion regarding sewer assessment policies, upon a roll call vote to refer Resolution 11128-68 to the Municipal Sewer Committee, Aldermen Budish, DeBack. and Narlock voted "aye". Aldermen Burgermeister, Cooley, Linck and Wollman voted "no". The motion to refer Resolution i/128-68 to the Sewer Committee did not carry. Upon a voice vote, the motion to adopt Resolution l/128-68 carried. Resolution #129-68 - The Clerk read Resolution 11129-68, entitled, Resolution Providing Municipal Sewer Lateral Inspection. Ald. Burgermeister moved for the adoption of Resolution 11129-68, seconded by Ald. Cooley. Ald. Burg- ermeister moved to defer action on Resolution 11129-68 until the Municipal Sewer Committee can consult with the City Building Inspector and make their recommendation to the Finance Committee for action. Seconded by Ald. Budish. Upon a voice vote, the motion to defer action on Resolution j/129-68 carried. Resolution f/130-68 - The Clerk read Resolution l/130-68, entitled, Authoriz- ing the Appraisal of Idle Isle Beach. Ald. Budish moved for the a~doption 0 of Resolution #130-68, seconded by Ald. Narlock. Upon a roll call vote, AldennenBudishj-Cooley, DeBack and Narlock voted "aye". Aldermen Burger- meister, Linck and Wollman voted "no". The motion to adopt Resolution #130-68 carried. Resolution #131-68 - The Clerk read Resolution i/131-68, entitled, Authorizing Approval of Radio Equipment Maintenance Contract with Motorola Co. Ald. Narlock moved for the adoption of Resolution i/131-68, seconded by Ald. De- Back. Wollman moved to refer Resolution i/132-68 back to the City Attorney for redrafting and clarification. Seconded by Ald. DeBack. Upon a voice vote, the motion to refer Resolution #132-68 to the City Attorney carried. LICENSE APPROVAL Ald. Budish moved for the approval of an Operator's License for Virgil Nelson. Seconded by Ald. Narlock. Upon a voice vote, the motion carried. Ald. Narlock moved for the approval of an Operator's License for Wayne Schwartzman. Seconded by Ald. Budish. Upon a voice vote, motion carried. VOUCHER APPROVAL Ald. Budish moved for the approval of the payment of vouchers in the amount of $36,091.28 for period ending July 9, 1968. Seconded by Ald. Narlock. Upon a roll call vote, the motion to pay the vouchers carried unanimously. CITY OFFICIAL'S REPORT The Clerk presented the Financial Report as of June 30, 1968, in the amount of $465,989.61. Report to be placed on file. The Clerk presented the Building Report for the month of June, 1968. Report to be placed on file. With reference to discussion at the previous meeting regarding the installation of holding tanks, the City Attorney reported that a holding tank need not-be'installed unless it is required by the State. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a communication directed to the Mayor and Aldermen from the Adjutant of the VFW thanking them for cooperation received during the Memorial Day celebration. The Clerk read a communication directed to the Mayor from the Post Office Dept. regarding a new Post Office for the City of Muskego. . . . . Ald. Budish moved to set the Public Hearing date as August 27, 1968, 7:00 P.M. at the City Hall to rezone certain land in Sections 9 and 16 from RS-3 to RS-M. - Aid. Wollman announced that the Official City Entrance Signs completion. Ald. Wollman moved to adjourn the meeting. Seconded by Ald. The meeting adjourned at lo:23 P.M. are nearing Burgermeister. Respectfully submitted, /&ii&d Bette J. Bowykr, City Clerk je VETO MESSAGE OF RESOLUTION 8128-68 TO: ALL ALDERMEN I have decided to veto Resolution $1128-68 for these following reasona. The resolution, as presented, does not allow for any changes in policy if there will be any, and there very well may be some that do come to attention. We do not have any cost figures from our engineer as of the latest inquiry on the Northeast and Northwest sewer areas. Further, as you may recall, the advice from our legal counsel on financing was such that there would be changes that may be necessary when the financial facts are available.
