PRESENT: Mayor Donald Wieselmann, Aldermen Robert Burgermeister, Kenneth 0 Cooley, Harold DeBack, Roland Linck, Frank Narlock and Walter Wollman. Also present were Attorney Albert Beck and City Clerk Bette Bowyer. ABSENT: Alderman Edmund Budish APPROVAL OF MINUTES: Alderman Narlock moved to accept the minutes the previous meeting of June 11, 1968, as mailed. Alderman Linck seconded the motion and the motion carried. COMMITTEE REPORTS --------- of FINANCE COMMITTEE - Alderman Narlock presented the report of the Finance Committee meeting held on June 19, 1968, and moved that the report be accepted and placed on file. Alderman DeBack seconded the motionand the motion carried. PUBLIC WORKS COMMITTEE - Alderman DeBack presented the report of the Public Works Committee meeting held on June 20, 1968, and moved that the report be accepted and placed on file. Alderman Wollman seconded the motion and the motion carried. PUBLIC SAFETY COMMITTEE - Alderman Cooley presented the report of the Public Safety Committee meeting held on June 19, 1968, and moved that the report be accepted and placed on file. Alderman Wollman seconded the motion and the motion carried. PUBLIC WELFARE COMMITTEE - Alderman Burgermeister presented the report ot the Public Welfare Committee meeting held on June 19, 1968, and moved that the report be accepted and placed on file. Alderman Cooley seconded the motion and the motion carried. UNFINISHED BUSINESS --m-m----- RESOLUTION #103-68 - The Clerk read Resolution #103-68 - Approving Supplementary Agreement with Walter and Dorothy Vesbach. Alderman Wollman moved to defer action on Resolution #103-68 pending results of a Sewer Committee meeting. Alderman Burgermeister seconded the motion and the motion carried. (II, NEW BUSINESS -----__ RESOLUTION #107-68 - The Clerk read Resolution #107-68 - Accepting " 0 the "Tri- own Hub as the Official Newspaper for the City of Muskego. Alderman Wollman moved for the adoption of Resolution #107-68. Alderman Cooley seconded the motion and upon a roll call vote the motion carried unanimously. RESOLUTION #108-68 - The Clerk read Resolution #108-68 - Granting and Extractive Permit to Hales Corners Sand & Gravel. Alderman Narlock moved for the adoption of Resolution #108-68. Alderman Wollman seconded the motion. RESOLUTION #109-68 - The Clerk read Resolution #109-68 - Authorizing the City Attorney to Draft an Amendment to Chapter 17 of the Municipal Code. Alderman Narlock moved to adopt Resolution #lU9-68. Alderman DeBack seconded the motion and the motion carried. RESOLUTION #llO-68 - The Clerk read Resolution #llO-68 - Appointment Of all Aldermen to the Sewer Committee and the Sewer Financing and Procedures Committee; Alderman Burgermeister moved for the adoption of Resolution #llO-68. Alderman Cooley seconded the motion. Alderman Narlock spoke in opposition to Resolution #llO-68 and suggested that information could be obtained if the Common Council would request official reports on the sewer project from the Comptroller and Treasurer. Mayor Wieselmann and Alderman DeBack also spoke in opposition to the Resolution. Upon a roll call vote for the adoption of Resolution #llO-68, Aldermen Burgermeister, Cooley, Linck and Wollman voted "aye" and Aldermen DeBack and Narlock voted "no" and the motion carried. RESOLUTION #ill-68 - The Clerk read Resolution #ill-68 - Approving Rules and Regulations Governing City Parks as well as the Rules and Regulations of the Park & Recreation Board. Alderman Wollman moved for the adoption of Resolution #ill-68. Alderman Burgermeister seconded the motion and the motion carried. ‘?, RESOLUTION #112-68 - The Clerk read Resolution #112-68 - Setting Public Hearing Date and Waiving of Notice Requirements for Rezoning of Land in Sections 3 and 4. Alderman Narlock moved for the adoption of Resolution #112-68. Alderman DeBack seconded the motion. Alderman Burgermeister moved to amend Resolution #112-68 by the removal of paragraph 4 and that portion of paragraph 5 waiving notice requirements. Alderman Cooley seconded the motion. Alderman Narlock pointed out the excessive administration which would be required to notify the many property owners who would be involved in this rezoning. The motion to amend did not carry. The motion to adopt Resolution #112-68 carried. RESOLUTION #113-68 - The Clerk read Resolution #113-68 - Requiring the Payment ot Delinquent Taxes prior to issuance of Class "A" and Class "B" Intoxicating Liquor and Fermented Malt Beverage Licenses. Alderman DeBack moved for the adoption of Resolution #113-68. Alderman Wollman seconded the motion and the motion carried. RESOLUTION #114-68 - The Clerk read Resolution #114-68 - Authorizing the Wis. Natural Gas Company to Install Mains Along the Right-of-Ways of Streets in the City of Muskego. Alderman Wollman moved for the adoption of Resolution #114-68. Alder- man DeBack seconded the motion and the motion carried. RESOLUTION #115-68 - The Clerk read Resolution #115-68 - Regarding Holdine Tank Bond Aereement with Texaco. Aiderman Wollman moved for the adoption of Resolution #115-68. Alderman Narlock seconded the motion and the motion carried. RESOLUTION #116-68 - The Clerk read Resolution #116-68 - Establishing a Holding Tank Proeram for the Citv of Muskeeo. Alderman Wollman moved for the adoption-of Resolution #116-68: Alderman Linck seconded the motion. Mayor Wieselmann advised that a question had been raised as to whether or not private individuals would be required to post $1000 bond. Alderman Wollman moved for deferment of Resolution #116-68 pending clarification. Alderman Cooley seconded the motion. However, it was determined that the holding tank program is established by the State Board of Health, thus Alderman Wollman withdrew his motion with the consent of Alderman Cooley. The motion to adopt Resolution #116-68 carried. Page 3 --Common Council Minutes June 25, 1968 RESOLUTION #117-68 - Alderman Burgermeister moved for suspension of the rules in order that Resolution #117-68 could be introduced. Alderman Cooley seconded the motion and upon a roll call vote the motion carried unanimously. The Clerk read Resolution #117-68 - Establishing Sinking Fund for Promissary Note dated June 1, 1968, and Sewer System Construction Fund with the First National Bank of Waukesha. AldermanNarlock moved for the adoption of Resolution #117-68. Alderman DeBack seconded the motion and upon a roll call vote the motion carried unanimously. ORDINANCE #104 - Alderman Wollman moved for suspension of the rules in order that Ordinance #104 could be introduced. Alderman Linck seconded the motion and upon a roll call vote, the motion carried unanimously. The Clerk gave the first reading of Ordinance #104 - An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego. Alderman Narlock moved for suspension of the rules in order to waive the second reading of Ordinance #104. Alderman Wollman seconded the motion and upon a roll call vote, the motion carried unanimously. Alderman Wollman moved for the adoption of Ordinance #104. Alderman DeBack seconded the motion and the motion carried. VOUCHER APPROVAL -------- None LICENSE APPROVAL -------- Alderman Narlock moved for approval of a Class 'tBtt Fermented Malt Beverage and Intoxicating Liquor License for Kenneth Brach, S86 W21693 Janesville Road. Alderman DeBack seconded the motion and the motion carried. Alderman Narlock moved for approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Harold and Ruth T. Harris (Partnership), S86 W13988 Priegel Dr. Alderman DeBack seconded the mo- tion and the motion carried. Alderman Narlock moved that the Class "B" licenses of John Blasius and Susan Lewandowski be held in abeyance for one year. Alderman Burgermeister seconded the motion and the motion carried. Alderman DeBack moved for approval of Operator's Licenses for Shirley Berg, Daniel Sydlewski, Joan Schiltz and Erwin F. Koehn pending favorable fingerprint reports. Alderman Narlock seconded the motion and the motion carried. COMMITTEE REPORTS --------- None COMMUNICATIONS AND MISCELLANEOUS BUSINESS --------------------- Alderman Burgermeister moved to schedule a public hearing for July 23, 1968, 7:00 P. M., to consider rezoning a 2 acre parcel of land on Racine Ave. near Parker Drive from R-l to R-l with an OIP Overlay for the purpose of the Muskego Vol. Fire Dept. Sub-station. Alderman Linck seconded the motion and the motion carried unanimously. It was the decision of the Common Council to reserve a room at the Muskego Grade School in which to hold the public hearing indicated in Resolution #112-68. There are several reasons for this action, one being that to have the entire Council serve as a Committee for, or on, the matter of sewers makes a very cumbersome situation. The purpose of a Committee is defeated. The Committee should act as a laison between the Council and engineer, contractor or other professional person involved. The importance of the sewer program and its impact on the City may at times require that the entire Council be present for a meeting in order that details may be secured first hand; however, to require that every Councilman be present at every Sewer Committee meeting would be totally unfair to the man that may have to be working at his job. There will be times when a Committee meeting may have to be held during the day because of other professional people who are in- volved in our program and I do not feel that all the Councilmen should be obligated to be present. It would be my wish that all Councilmen would be present for these important meetings, however, each one should have the discretion of deciding whether he would be there if not a member of the Committee. There will be occasions when a meeting will have to be called hastily because of some unforeseen problem, again making Resolution #llO-68 a cumbersome situation. I agree that the meetings should be posted well enough in advance whenever possible, however, with our past problems with the program this hasn't been possible because of the time factor. Then there is the problem of scheduling evening meetings and trying to coordinate these schedules with those of the City Attorney, City Engineer, legal advisor on investments and the representatives of the investment companies or banks.
