MINUTES OF SPECIAL MEETING HELD ON APRIL 30, 1968
The meeting was called to order at 4:06 P.M. by Mayor Wieselmann.
PRESENT - Mayor Donald Wieselmann, Aldermen Edmund Budish, Robert
Burgermeister, Kenneth Cooley, Roland Linck, Frank Narlock, Harold
DeBack and Walter Wollman. Also present was Clerk Bette J. Bowyer. 0 * RESOLUTION $169-68 - The Clerk read Resolution 1/69-68, entitled,
Recognition of the Muskego Chaplain's Corps.
to suspend the rules that would interfere with the adoption of
Resolution $169-68, seconded by Alderman Linck. Upon a roll call
vote to suspend the rules, the motion carried unanimously. Alderman
Cooley moved for the adoption of Resolution 1/69-68, seconded by
Alderman DeBack. Alderman Cooley requested permission of his fellow
Aldermen to have Police Chief Kraus speak. As there were no objections,
Chief Kraus explained the makeup and functions of the newly organized
Chaplains Corps. He extended an invitation to the Mayor and Aldermen
to attend a press conference to be held at 1O:ClO A.M. May 1, 1968 at
the Muskego Community Church pertaining to the organization. Upon a
voice vote, the motion to adopt Resolution 1/69-68 carried.
City Attorney Bonneville arrived at 4:13 P.M.
Alderman Wollman moved
REZONING OF A PARCEL OF LAND IN SEC. 2
The matter regarding the rezoning of approximately 58 acres of land
in Sec. 2 from B-3 and RS-2 to Industrial 1-1 was brought to the
floor. Mayor Wieselmann explained that it was necessary that the
boundaries of the proposed rezoning be defined by the Common Council
for presentation at the scheduled Public Hearing to be held on May 28,
1968 at 7:15 P.M. Because the subject matter had not appeared on
an agenda, Alderman Narlock moved to suspend the rules to have the
Council request the City Attorney designate the boundary lines of
the proposed industrial area. Seconded by Alderman Linck. Upon a
roll call vote, the motion to suspend the rules carried unanimously.
Clerk Bette Bowyer reviewed the history of the proposed rezoning.
Alderman Narlock moved that the City Attorney be authorized to
implement the rezoning by providing a legal description of the tract
as outlined on the map which had been submitted by the Industrial
Development Committee and endorsed by the City Plan Commission.
Seconded by Alderman DeBack. Upon a voice vote, the motion carried. 0
COMMITTEE APPOINTMENTS
A discussion took place as to the legality of the Common Council
voting on Mayoral appointments by secret ballot. Mayor Wieselmann
indicated that at the Special Meeting of the Common Council held on
April 29, 1968, the Council had acted in a way that is contrary to
the State Statutes and the Municipal Code of the City of Muskego.
Attorney Bonneville advised that both the State Statutes and the
Municipal Code indicate that confirmation of appointments to
commissions must have a roll call vote, i.e. maye or nag and that
to vote by secret ballot is not an authorized means to vote. He
referred to State Statute 62.11(d) and 2.17(5) of the Municipal Code.
Alderman Cooley based his objection on Roberts Rules of Order (Revised)
which indicates that to vote by ballot would be permitted when approved

Mayor Wieselmann declared a recess at 4:30 P.M. and the meeting re- & convened at 4:52 P.M.

Following further discussion, Alderman Cooley moved that action on the
appointments be deferred until he could get a written opinion from
the Attorney General or an opinion from an attorney whom he would
pay. Seconded by Alderman Budish. Alderman Cooley moved to amend
his motion to include the words "by May 14, 1968". Seconded by
the motion. Alderman Cooley, Budish, Burgermeister and Narlock
spoke in favor of the motion. Upon a roll call vote on the amendment
to the motion, Aldermen Budish, Burgermeister, Cooley, Linck, Narlock
and Wollman voted "aye". Alderman DeBack voted "no".

Sewer Financing and Procedures. Alderman Narlock moved for the re-
consideration of Resolution 1/68-68.
Upon a roll call vote to reconsider Resolution #68-68, Aldermen
Budish, DeBack and Narlock voted "aye". Alderman Burgermeister,
Cooley, Linck and Wollman voted "no". The motion to reconsider
Resolution 1/68-68 did not carry.
Alderman Burgermeister moved to adjourn the meeting, seconded by
Alderman. Motion carried. The meeting adjourned at 5:lO P.M.
