ccm19680312COMMON COUNCIL CITY OF MUSREGO MINUTES OF MEETING HELD MARCH 12, 1968 Mayor Gottfried called the meeting to order at 7:30 P.M. PRESENT: Mayor Gottfried, Aldermen Edmund Budish, Sivier Joost, Jr., S. Robert Lentini, Roland Linck, Frank Narlock, Donald Wieselmann and Walter Wollman. Also present were Attorney Richard S. Hippenmeyer and City Clerk Bette Bowyer. MINUTES: Alderman Budish moved to accept the Minutes of the Common Council meeting of February 27, 1968, as mailed. Seconded by Alderman Narlock, motion carried. COMMITTEE REPORTS FINANCE COMMITTEE: Alderman Linck presented the report of the Finance Committee meeting held on March 6, 1968, and moved that the report be accepted and placed on file. Seconded by Alderman Joost, motion carried. PUBLIC WORKS COMMITTEE: Alderman Wieselmann presented the report of the Public Works Committee meeting held on March 7, 1968, and moved that the report be accepted and placed on file. Seconded by Alderman Wollman, motion carried. PUBLIC SAFETY COMMITTEE: Alderman Narlock presented the report of the Public Safety Committee meeting held on March 4, 1968, and moved that the report be accepted and placed on file. Seconded by Alderman Linck, motion carried. PUBLIC WELFARE COMMITTEE: No report. RULES, LAWS & ORDINANCE COMMITTEE: Alderman Joost presented the report of the Rules, Laws & Ordinance Committee meeting held on March 7, 1968, and moved that the report be accepted and placed on file. Seconded by Alderman Narlock, motion carried, PLAN COMMISSION: The Minutes of the Plan Commission meeting held on March 4, 1968, were received and placed on file. UNFINISHED BUSINESS Ordinance #95 - The Clerk gave the second reading of Ordinance #95, entitled, An Ordinance to Amend an Ordinance Known as the Zoning Ordinance of the City of Muskego (John Weseljack). Alderman Wollman moved for the adoption of Ordinance #95, seconded by Alderman Lentini. Upon a roll call vote, the motion to adopt Ordinance #95 carried unanimously. Ordinance #97 - The Clerk gave the second reading of Ordinance #97, entitled, An Ordinance to Amend the Municipal Code of the City of Muskego and to Establish a Sign Code for the City of Muskego. Alderman Wollman moved for the adoption of Ordinance #97, seconded by Alderman Narlock. Upon a roll call vote, the motion to adopt Ordinance #97 carried unanimously. NEW BUSINESS Ordinance #96 - The Clerk gave the first reading of Ordinance #96, entitled, An Ordinance to Create Chapter 22 of the Municipal Code of Muskerro (Re: Onen Housing). - . -. Page 2. Resolution #37-68 - The Clerk read Resolution #37-68, entitled, Approval of Rescue Contract. Alderman Linck moved for the adoption of Resolution #37-68, seconded by Alderman Narlock. Upon a roll call vote, the motion to adopt Resolution #37-68 carried unanimously. Resolution #39-68 - The Clerk read resolution j/39-68, entitled, Approving the Purchase of Culverts from Bark River Culvert Co. for Fountainwood Ditch Project. Alderman Budish moved for the adoption of Resolution #39-68, seconded by Alderman Wieselmann. Upon a roll call vote, the motion to adopt Resolution #39-68 carried unanimously. Resolution #40-68 - The Clerk read Resolution #40-68, entitled, Approval of an Amendment to the Woods Road Bridge Contract. Alderman Budish moved for the adoption of Resolution #40-68, seconded by Alderman Wieselmann. Upon a roll call vote, the motion to adopt Resolution #40-68 carried unanimously, Resolution #41-68 - The Clerk read Resolution 1141-68, entitled, Preliminary Resolution for the Northeast Muskego Sewerage Project. Alderman Wollman moved for the adoption of Resolution #41-68, seconded by Alderman Budish. Upon a roll call vote, the motion to adopt Resolution i/41-68 carried unanimously. Mayor Gottfried declared a recess at 8:20 P.M. and the meeting recon- vened at 8:25 P.M. Resolution #42-68 - The Clerk read Resolution i/42-68, entitled, Appointment of a Member to Library Board. Alderman Budish moved for the adoption of Resolution #42-68, seconded by Alderman Lentini. The Clerk read Mr. Kenneth Kapelka's letter of resignation as a Member of the Library Board. The Resolution name Mrs. Elaine Modlinski to fill the unexpired term of Mr. Kapelka. Upon a roll call vote, the motion to adopt Resolution 1142-68 carried unanimously. LICENSE APPROVAL Alderman Budish moved for the approval of Donna Leetch,to receive an Operator's License. Seconded by Alderman Joost. Motion carried. Alderman Linck moved for the approval of an Operator's License for Jean Green. Seconded by Alderman Wieselmann, motion carried. VOUCHER APPROVAL Alderman Budish moved for the approval of the payment of vouchers, payable March 12, 1968, in the amount of $39,345.31. Seconded by Alderman Linck. Upon a roll call vote, the motion to pay the vouchers carried unanimously. The Clerk read the Financial Report for the month of February, 1968, showing a cash balance as of February 29, 1968, of $442,276.63. Report placed on file. The Clerk gave the Building Report for the month of February, same placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Page 3. The Clerk read a communication directed to the Mayor and Council from the Plan Commission recommending denial of the vacation of a 20' alley between Lots 9 and 10 of Point DeNoon. Communication referred to City Attorney. The Clerk read a communication directed to the Common Council from Assessor Wieselmann requesting that the Council take immediate steps in the hiring of additional part-time personnel help in order to eliminate inequities in assessments. Communication referred to Finance Committee. The Clerk read a coannunication from Morton Smith, Sr. directed to the Mayor and Council requesting consideration for a land division. Conrmunication referred to Plan Commission. The Clerk read a communication from Mayor Kathke of the City of New Berlin, directed to Mayor Gottfried regarding sewer assessment policies in the City of New Berlin. Communication referred to Sewer Committee. The Clerk read a communication directed to Mayor Gottfried from Mr. L. C. Hammond regarding sewer assessment policies in the City of Muskego. Communication referred to the Sewer Committee. The Clerk read a communication from Mr. Kenneth Cooley, Chairman of the Muskego Fair Share Tax Committee, directed to the Common Council of the City of Muskego, requesting permission to present a petition to the Common Council, signed by Muskego residents who own more than three million dollars worth of real estate, requesting that a city wide reassessment of property be made, by an outside independent agency. Communication referred to Finance Committee. Alderman Wieselmann moved that the Public Hearing date for vacating the 20' alley between Lots 9 and 10, Point Denoon, be set for May 14, 1968, 7:00 P.M. Alderman Joost requested permission of the Council to have Mr. Kenneth Cooley speak. As there were no objections, Mr. Cooley presented a petition signed Muskego residents who own more than three million dollars worth of real estate and requested the Council to set a public hearing date, after election, and take all of the action necessary to have an independent agency reassess the entire City of Muskego. Alderman Narlock read a communication directed to the Common Council and Mayor Gottfried from Raymond R. WalX%r regarding special assess- ments in the City of New Berlin. Communication referred to the Public Sewer Committee. Alderman Wieselmann indicated that he felt that it was necessary that a public hearing be held regarding Muskego's Sewer Assessment policies in the near future. Alderman Budish requested his fellow Aldermen to review the posting of speed zone signs throughout the city and to make some recommendations to the Safety Committee.in order that speed zone problems can be ironed out more rapidly. He further indicated that most people are unaware of the fact that astreet not posted automatically has a 35 mph limit. Alderman Narlock indicated that he has received several complaints regarding the uncovered waste material at the city dump. He requested that immediate action be taken to eliminate the condition. Alderman Wieselmann moved that the Common Council set a date for a public hearing prior to the next Council meeting for the purpose of clarifying the sewer assessment policies to the people involved. Seconded by Alderman Narlock. Following considerable discussion, upon a roll call vote,to hold a public hearing, Aldermen Lentini, Narlock and Wieselmann voted "aye". Aldermen Budish, Joost, Linck and Wollman voted "no" The motion to hold a public hearing did not carry. Alderman Joost moved to have Mayor Gottfried call a Council Meeting of the Whole on Friday evening, March 15, 1968, 7:00 P.M. for the purpose of discussing sewer assessment policies.
