ccm19671114COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD NOVEMBER 14, 1967 Mayor Gottfried called the meeting to order at 7:35 P.M. PRESENT: Mayor Gottfried, Aldermen Edmund Budish, Sivier Joost, Jr. S. Robert Lentini, Roland Linck, Frank Narlock and Walter Wollman. Also present were City Attorney Richard S. Hippenmeyer and City Clerk Bette Bowyer. ABSENT: Alderman Donald Wieselmann. MINUTES: Alderman Wollman moved to accept the Minutes of the meeting of October 24, 1967, as mailed. Seconded by Alderman Linck, motion carried. COMMITTEE REPORTS FINANCE COMMITTEE: - Alderman Linck presented the reports of the Finance Committee meetings held on October 25th, November 1 and November 8, 1967, and moved that the reports be accepted and placed on file. Seconded by Alderman Budish, motion carried. PUBLIC WORKS COMMITTEE: Alderman Wollrnan presented the reports of the Public Works Committee meeting held on November 9, 1967, and moved that the report be accepted and placed on file. by Alderman Budish, motion carried. PUBLIC SAFETY COMMITTEE: Alderman Narlock presented the report of the Public Safety Committee meeting held on November 6, 1967, and moved that the report be accepted and placed on file. Seconded by Alderman Lentini, motion carried. PUBLIC WELFARE COMMITTEE: Alderman Budish presented the report of the Public Welfare Committee meeting held on November 8, 1967, and moved that the report be accepted and placed on file. Seconded by Alderman Lentini, motion carried. RULES, LAWS IS ORDINANCE COMMITTEE: Alderman Joost presented the report of the meeting of the Rules, Laws & Ordinance Committee held on November 9, 1967, and moved that the report be accepted and placed on file. Seconded by Alderman Narlock, motion carried. Alderman Narlock presented a Minority Report on the meeting of the Rules, Laws & Ordinance Committee meeting held on November 9, 1967, in regard to Ordinance 7/81, An Ordinance to Create Section 1.04 (a) Municipal Code of the City of Muskego (Establishing the Procedure for Hiring a City Engineer). UNFINISHED BUSINESS Ordinance 7/81 - The Clerk gave the second reading of Ordinance #8l, entitled, An Ordinance to Create Section 1.04 (a) Municipal Code of the City of Muskego (Re: City Engineer). Alderman Wollman moved for the adoption of Ordinance 7/81, seconded by Alderman Budish. Alderman Wollman moved to table Ordinance 7/81, seconded by Alderman Narlock. Upon a roll call vote, the motion to table Ordinance 7/81 carried unanimously. Seconded Page 2. NEW BUSINESS Resolution 11144-67 - The Clerk read Resolution 11144-67, entitled, Authorizing the Wisconsin Natural Gas Company to Install Main Along the Right-of-Ways of Streets in the City of Muskego. Alderman Budish moved for the adoption of Resolution 11144-67, seconded by Alderman Wollman, motion carried. Resolution 11145-67 - The Clerk read Resolution 11145-67, entitled, Designating the Name of the new City Park to be Known as "Kurth Park". Alderman Joost moved for the adopting of Resolution 11145-67, seconded by Alderman Narlock, motion carried. Ordinance 1/84 - The Clerk gave the first reading of Ordinance 1/84, entitled, Annexation, (Town of Vernon to City of Muskego). Ordinance 1/84 will be referred to the Rules, Laws & Ordinance Committee. Ordinance 1185 - The Clerk gave the first reading of Ordinance 1/85, entitled, Appropriating the Necessary Funds for the Operation of the Government and Administration of the City of Muskego for the Year 1968. a Ordinance 1186 - The Clerk gave the first reading of Ordinance 1/86, entitled An Ordinance Establishing Personnel and Establishing and Regulating the Salaries and Other Compensations of Elected and Appointed Officers and Employees of the City of Muskego. 1/86 will be referred to the Rules, Laws & Ordinance Committee and Attorney Hippenmeyer. Resolution 11146 - The Clerk read Resolution 11146-67, entitled, Designation of Legal Lot (Myrtle Thode). Alderman Lentini moved for the adoption of Resolution 11146-67, seconded by Alderman Wollman, motion carried. Resolution 11147-67 - The Clerk read Resolution 11147-67, entitled, Suspension of Rifle Range Permit Held by Schultz's Resort. Alderman Linck moved for the adoption of Resolution 11147-67, seconded by Alderman Narlock. Alderman Wollman requested permission of his fellow Aldermen to have Mr. Raymond Schwalbach, W150 S7587 Dorothy Dr., speak. Mr. Schwalbach, representing a group of Bay Lawn Sub- division residents, spoke in favor of the revocation of that portion of Schultz's Trap Shooting and Rifle Range License that permitted rifle shooting. that there should be more investigation into the recent shooting incident before any action be taken by the Council and moved to defer action on Resolution 11147-67. The motion to defer action on Resolution 11147-67 lost for lack of a second. The motion to adopt Resolution 11147-67 carried with Alderman Budish casting a dissenting vote. Ordinance 0 Alderman Budish indicated that it was his feeling Resolution 11148-67 - The Clerk read Resolution #148-67, entitled, Approval of a Claim from Arthur Wieselmann. Alderman Budish moved for the adoption of Resolution 11148-67, seconded by Alderman Linck. Clerk Bette Bowyer read the following report directed to the Finance Committee and Common Council of the City of Muskego: "Gentlemen: a On October 24th, I received a claim from Arthur Wieselmann, Assessor, I do not recommend payment of said claim for the following reasons. for legal services rendered to him in the amount of $150.00. a Page 3. On the 22nd day of November, 1966, the Common Council did adopt Ord. #54, As Amended, which provided that all records and equipment relating to the assessor's position be kept at City Hall, said ordinance becoming effective May 1, 1967. According to Mr. Clayton Cramer, Attorney, these City owned records and equipment were not delivered to City Hall until on or about August 7th, 1967. It is my understanding that the City may or may not pay the claim or any portion of it as the City deems just - to a personal liability growing out of the performance of official duties. By not complying with aforesaid ordinance until August 7, 1967, I do not believe that the Assessor was performing said duties of his office. I, therefore, believe that the taxpayers of the City of Muskego v should not be obligated to pay said claim. (Signed) B. J. Joost moved to suspend the Rules that would interfere with the adoption of Resolution $1150-67. Seconded by Alderman Narlock. Upon a roll 0 call vote, the motion to suspend the Rules carried unanimously. Clerk read Resolution #150-67. of Resolution #150-67. vote, the motion to adopt Resolution #150-67 carried unanimously. Alderman The Alderman Budish moved for the adoption Seconded by Alderman Joost. Upon a roll call LICENSE APPROVAL Alderman Linck moved for the approval of an Operator's License for Dennis Jones. Seconded by Alderman Joost, motion carried. Alderman Budish moved for the approval of an Operator's License for Martena Sterrett. Alderman Joost moved for the approval of a Combination Class "A" Fermented Malt Beverage and Intoxicating Liquor License for Rose J. Wannebo. Seconded by Alderman Linck, motion carried. Seconded by Alderman Linck, motion carried. VOUCHER APPROVAL 0 - Alderman Joost moved for the approval of the payment of vouchers in the amount of $38,434.22 payable November 14, 1967. Seconded by Alderman Linck. carried unanimously. CITY OFFICIAL'S REPORT The Clerk read the Treasurer's Report for the month of October, 1967, showing a cash balance of $507,496.11. The Clerk read the Building Report for the month of October, 1967, Upon a roll call vote, the motion to pay the vouchers Report to be placed on file. a same to be placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a communication directed to the Mayor and Common Council from Mr. Floyd Thompson regarding damage to his camper when it struck Communication and claim referred to Attorney Hippenmeyer and Finance Committee. a low hanging limb on Hillview Drive. Page 4. The Clerk read a copy of a communication from Mr. Freeman Holmer, Administrator of the State of Wis. Dept. of Natural Resources directed to Mr. H. W. Poston, Regional Director of the Federal Water Pollution Control Administration in which it listed a recommended Federal grant-in-aid increase for the construction of waste treatment fac- ilities for the City of Muskego in the amount of $20,900.00. Communication to be placed on file. Alderman Budish indicated his concern over the procedure being used in requiring the compliance of the Zoning Ordinance, particularly the newly adopted amendment relating to the parking of trucks.
