ccm19670228l l COMMON COUNCIL CITY OF MUSREGO MINUTES OF MEETING HELD FEBRUARY 28, 1967 Mayor Gottfried called the meeting to order at 7:49 P.M. PRESENT - Mayor Gottfried, Aldermen Edmund A. Budish, Sivier L. Joost, Jr., S. Robert Lentini, Roland Linck, Myron Weaver, Donald E. Wieselmann and Walter Wollman. Also present were City Clerk Bette Bowyer and Atty. Hippen- meyer. MINUTES - Alderman Weaver moved to accept the Minutes of the meeting held on February 14, 1967. Seconded by Alderman Linck, motion carried. COMMITTEE REPORTS Finance Committee - Alderman Linck presented the report of the Finance Committee meeting held on February 22, 1967, and moved that the report be accepted and placed on file. Seconded by Alderman Budish, motion carried. Public Safety Committee - Alderman Weaver presented the report of the Public Safety Committee meeting held on February 21, 1967, and on February 24, 1967, and moved that the reports be accepted and placed on file. Seconded by Alderman Lentini, motion carried. Public Works Committee - Alderman Budish presented the report of the Public Works Committee meeting held on February 23, 1967, and moved that the report be accepted and placed on file. Seconded by Alderman Wollman, motion carried. Public Welfare Committee - Alderman Budish presented the report of the Public Welfare Committee meeting held on February 22, 1967, and moved that the report be accepted and placed on file. Seconded by Alderman Wieselmann, motion carried. Rules, Laws & Ordinance Committee - Alderman Joost presented the report of the Rules, Laws & Ordinance Committee meeting held on February 27, 1967, and moved that the report be accepted and placed on file. Seconded by Alderman Wollman, motion carried. Plan Commission - The report of the Plan Commission meeting held on February 21, 1967, will be accepted at the Council meeting of March 14, 1967. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried announced that there will be a meeting of the Waukesha County Fire Fighters Association to be held at the Muskego Fire House on March 22, 8:00 P.M. and the Aldermen have been invited to attend. UNFINISHED BUSINESS Ordinance #61 - The Clerk gave the second reading of Ordinance l/61, entitled, An Ordinance Amending Ordinance #55 Entitled, An Ordinance Establishing Personnel and Establishing and Regulating the Salaries and Other Compensations of Elected and Appointed Officers and Employes of the City of Muskego. Alderman Wieselmann moved for the adoption of l Ordinance V61, seconded by Alderman Joost. A discussion was held re- lating to the creation of the two newly created Library positions and upon a roll call vote the motion to adopt Ordinance #61 carried unanimously. Page 2. Ordinance #62 - The Clerk gave the second reading of Ordinance i/62, entitled, An Ordinance Creating a Minimum Housing Code for the City of Muskego, Waukesha County, Wisconsin. No action was taken on this Ordinance, however, as the Public Hearing will be held on March 14, 1967, 7:QQ P.M. Attorney Hippenmeyer stated that a provision providing for 0 the creation of a Boa~rd of Appeals needed to be inserted into the ordinance. He made the following suggestion: Page 1, Chapter 2, under Definitions, after the subsection Bedroon, subsection "Board" should be inserted and it shall mean Board of Appeals as hereinafter created. * Also, on page 4 at the top of the page the following shall be inserted: Creation of Board of Appeals; There is hereby created a Board of Appeals to act as provided in this ordinance. (Sec. 62.23 (7) (e) 2. shall be quoted) NEW BUSINESS Resolution $115-67 - The Clerk read Resolution l/15-67, entitled, Authorizing the State Department of Taxation to Release the 1963, 1964, 1965 Income Cash Rolls to the City of Muskego. Alderman Budish moved for the adoption of Resolution i/15-67, seconded by Alderman Joost, motion carried. Resolution 1116-67 - The Clerk read Resolution i/16-67, entitled, Correcting l Erroneous Assessment. Alderman Linck moved for the adoption of Resolution #16-67, seconded by Alderman Wieselmann. Upon a roll call vote the motion to adopt Resolution $116-67 carried unanimously. Resolution f/17-67 - The Clerk read Resolution 1117-67, entitled, Final Resolution for Installment of Sanitary Sewer Pipes. Alderman Weaver moved for the adoption of Resolution i/17-67, seconded by Alderman Wollman. Alderman Lentini moved to defer action on Resolution #17-67 until more facts relating to the reconstruction of Highway "Y" and the proposed sewer project are available. Seconded by Alderman Wieselmann. A discussion was held with Aldermen Joost, Weaver and Budish speaking in oppostion to the deferment. Aldermen Lentini and Wieselmann spoke in favor of deferring Resolution #17-67. Upon a roll call vote to defer action on Resolution j/17-67, Aldermen Budish, Joost, Linck, Weaver and Wollman voted "no" and Aldermen Lentini and Wieselmann voted "x&'. The motion to defer action on Resolution #17-67 did not carry. Upon a roll call vote to adopt Resolution #17-67, Aldermen Budish, Joost, Linck, Weaver and Wollman voted "aye". Aldermen Lentini and Wieselmann voted "no" The motion to adopt Resolution i/17-67 carried. l Resolution #18-67 - The Clerk read Resolution i/18-67, entitled, Final Resolution on Special Assessments for Installation of Sidewalks, Driveway Approaches, Concrete Curb and Gutter and Storm Sewer. Alderman Budish moved for the adoption of Resolution f/18-67, seconded by Alderman Wollman. Upon a roll call vote the motion to adopt Resolution #X3-67 carried unanimously. At 9:43 P.M. Alderman Weaver asked to be excused from the meeting. Resolution #19-67 - The Clerk read Resolution #19-67, entitled, Allowing Claim for Erroneous Weed Cutting Charge Against the City of Muskego. e ldennan Linck moved for the adoption of Resolution 819-67, seconded by Alderman Wieselmann. Alderman Wieselmann moved to amend Resolution M19-67 as follows: Fourth paragraph to read, BE IT FURTHER RESOLVED that the City Clerk is authorized to refund to Mr. Petzold the amount of $25.00. Seconded by Alderman Joost, motion carried. Upon a roll call vote to adopt Resolution #19-67, As Amended, the motion carried unanimously. a Page 3. Resolution f/20-67 - The Clerk read Resolution #2Q-67, entitled, Approval of Contract for Rescue Service. Alderman Linck moved for the adoption of Resolution $120-67, seconded by Alderman Lentini. Upon a roll call vote the motion to adopt Resolution i/20-67 carried unanimously. 0 Resolution #21-67 - The Clerk read Resolution j/21-67, entitled Denying Claims for Erroneous Weed Cutting Charges. Alderman Budish moved for the adoption of Resolution i/21-67, seconded by Alderman Linck. Alder- man Wollman moved to defer action on Resolution 821-67 until the Weed l Commissioner has a chance to explain the charges, seconded by Alderman Lentini. The motion to defer action carried. LICENSE APPROVAL - Alderman Budish moved that the Council approve Operator's Licenses for Barry Colbert, Patricia Mitsch and Anthony Zawalich. Seconded by Alderman Linck, motion carried. VOUCHER APPROVAL - Alderman Linck moved for the approval of payment of vouchers in the amount of $4,801.84, payable to February 28, 1967. Seconded by Alderman Budish. Upon a roll call vote to pay the vouchers the motion carried unanimously. CITY OFFICIAL'S REPORT l Attorney Hippenmeyer reported on the assessment of property owned by Muskego-Norway School Dist. #9. He indicated that as a rule school property is tax exempt, however, the State Statutes indicate that as long as an income is derived from the property the assessment should stand as it. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a cormnunication directed to Mayor Gottfried and the Council from the Plan Commission approving the relocation of a portion of Woods Road. Communication referred to the Public Works Committee. The Clerk read a communication directed to Mayor Gottfried from Mr. John E. Kane of ,the Department of Housing and Urban Development, acknowledging receipt of the document "Workable Program for Community Improvement." Communication to be placed on file. l The Clerk announced that to date approximately 40 applications have been distributed for the position of Police Chief, twelve of which have been returned. The deadline date for returning applications is March 31, 1967. Alderman Joost moved to adjourn the meeting, seconded by Alderman Wollman. The meeting adjourned at lo:09 P.M.
