MINUTES OF MEETING HELD FEBRUARY 14, 1967
Mayor Gottfried called the meeting to order at 7~38 P.M.
a PRESENT - Mayor Gottfried, Aldermen Edmund A. Budish, Sivier Joost, Jr.,
S. Robert Lentini, Roland Linck, Myron Weaver and Walter Wollman. Also
present were Clerk Bette Bowyer and Attorney William Hippenmeyer.
l ABSENT - Alderman Donald E. Wieselmann.
MINUTES - Alderman Budish moved to accept the Minutes of the meeting
held on January 24, 1967, and the Special Meeting of the Common Council
held on January 30, 1967. Seconded by Alderman Linck, motion carried.
COMMITTEE REPORTS
Finance Committee - Alderman Linck presented the report of the Finance
Committee meeting held on February 8, 1967, and moved that the report
be accepted and placed on file. Seconded by Alderman Joost, motion
carried.
Public Works Committee - Alderman Budish presented the report of the
a Public Works Committee meeting held on February 9, 1967, and moved that
the report be accepted and placed on file. Seconded by Alderman
Wollman, motion carried.
Public Safety Committee - Alderman Weaver presented the report of the
Public Safety Committee meeting held on February 7, 1967, and moved
that the report be accepted and placed on file. Seconded by Alderman
Linck, motion carried.
Public Welfare Committee - Alderman Budish presented the report of the
Public Welfare Committee meeting held on February 8, 1967, and moved
tha,t the report be accepted and placed on file. Seconded by Alderman
Lentini, motion carried.
Rules, Laws & Ordinance Committee - Alderman Joost presented the report
of the Rules, Laws & Ordinance Committee meeting held on February 9, 1967,
and moved that the report be accepted and placed on file. Seconded by
Alderman Wollman, motion carried.
l Plan Commission - The report of the Plan Commission meeting held on
February 7, 1967, was accepted and placed on file.
UNFINISHED BUSINESS
Ordinance #59 - The Clerk read Ordinance #59, entitled, An Ordinance to
Amend the Zoning Ordinance of the City of Muskego. Alderman Weaver
moved for the adoption of Ordinance #59, seconded by Alderman Wollman.
Upon a roll call vote to adopt Ordinance #59, Aldermen Budish, Joost,
Linck, Weaver and Wollman voted "aye". Alderman Lentini voted "no".
The motion to adopt Ord. #59 carried.
0 Ordinance J/60 - The Clerk read Ordinance l/60, entitled, An Ordinance
Repealing and Recreating an Ordinance Entitled, Plumbing Code of the
City of Muskego. Alderman Weaver moved for the adoption of Ordinance $160,
seconded by Alderman Wollman. Alderman Linck moved to amend Ordinance
860, Sec. 9.2, the first sentence to read, "All sewer laterals shall be
constructed with extra heavy cast iron or glazed clay tile with State
approved joints." Seconded by Alderman Wollman, motion carried. Alder-

Ordinance Committee to re-evaluate the need for a maximum fee charged
in regard to the number of fixtures in a building. The motion lost for
lack of a second. Upon a roll ca,ll vote to adopt Ordinance i/60, As
Amended, Aldermen Budish, Joost, Linck, Wea~ver and Wollman voted "aye"
and Alderman Lentini voted "no". The motion to adopt Ordinance #60,
As Amended, carried.
Resolution #216 - The Clerk read Resolution l/216, entitled, "Authorizing
the Finance Committee to Negotiate for the Purchase of Schwefel Property
in Section 9. Alderman Lentini moved for the adoption of Resolution
8216, seconded by Alderman Budish. Alderman Lentini moved to amend
Resolution #216 as follows: Paragraph 84 to read as follows:
WHEREAS the Little Muskego Lake Committee and the Public Welfa~re
Committee has suggested that all of this land be purchased under
the Open Space Act whereby the city could receive fifty per cent
aid from the Federal Government.
Paragraph #5 to read as follows:
THEREFORE BE IT RESOLVED that the Common Council of the City of
Muskego does hereby authorize the Finance Committee to investigate
availability and price with Mrs. Evelyn Schwefel or her authorized
agent.
Paragraph #6 to be deleted entirely.
Upon a roll call vote to amend Resolution 8216, the motion carried
unanimously. Upon a roll call vote to adopt Resolution #216, As Amended,
the motion carried unanimously.
COMMUNICATIONS FROM THE MAYOR'S OFFICE - None.
At this point in the meeting, Alderman Budish requested permission of
his fellow Aldermen to have Mr. Melvin Wright speak< Atty. Norman Schatz
spoke in lieu of Mr. Wright, explaining Mr. Wright's position in the
forthcoming snowmobile derby to be held on February 18 and 19, 1967,
on Big Muskego Lake. A discussion was held regarding the policing of
the area,, the protection of the specta~tors, the required insura~nce,
the cleaning up of the area, etc. In answer to a question from Mayor
Gottfried as to whether or not the Common Council could legally permit
a license to be issued to Mr. Wright to allow a snowmobile derby to be
held on these particular days, Attorney Hippenmeyer replied that if the
Council chose to waive the Rules of Order, it would be possible to
conduct the derby with stipulated provisions.
At 9:15 P.M. Mayor Gottfried declared a recess in order to give Attorney
Hippenmeyer and Mr. Wright's attorneys time to discuss a mutual agreement.
At 9:45 P.M. the Council meeting reconvened. Alderman Budish moved that
the request of Mr. Melvin Wright begranted. Seconded by Alderman Joost.
Alderman Joost moved to amend Alderman Budish's motion by adding the
following words, "and to authorize the City Attorney to draw up an
agreement that would be acceptable to both parties." Seconded by Alder-
man Budish, motion carried. Upon a roll call vote to adopt the motion
as presented by Alderman Budish and amended by Alderman Joost, Aldermen
Budish, Joost, Lentini and Wollman voted "aye". Alderman Linck and
Weaver voted "no". l NEW BUSINESS
Resolution #7-67 - The Clerk read Resolution #7-67, entitled, Approving
Pitney-Bowes Postage Meter Machine Quarterly Inspection Agreement. Alder-
man Joost moved for the adopting of Resolution #7-67, seconded by Alder-
man Linck. Upon a roll call vote to adopt Resolution 117-67, the motion l carried unanimously.

Resolution #g-67 - The Clerk read Resolution #S-67, entitled, A,pproving
Friden Adding Machine Maintenance Agreement. Alderman Linck moved for
the adoption of Resolution 88-67, seconded by Alderman Budish. Upon a
roll call vote to adopt Resolution 88-67, the motion carried unanimously.
l Resolution #9-67 - The Clerk read Resolution 89-67, entitled, Authorizing
the Purchase of Quarter Section Maps. Alderman Linck moved for the
adoption of Resolution 89-67, seconded by Alderman Joost. Upon a roll
call vote to adopt Resolution J/9-67, the motion carried unanimously.
0 Resolution #lo-67 - The Clerk read Resolution i/10-67, entitled, Author-
izing the Finance Committee to Purchase Additional Chairs for the City
Hall. Alderman Budish moved for the adoption of Resolution #lo-67,
seconded by Alderman Joost. Upon a roll call vote, the motion to adopt
Resolution l/10-67 carried unanimously.
Resolution iill-67 - The Clerk read Resolution i/11-67, entitled, Approval
of Contract for Muskego and Tess Comers Fire Departments. Alderman
Linck moved for the adoption of Resolution f/11-67, seconded by Alderman
Budish. Upon a roll call vote the motion to adopt Resolution $&l-67
carried unanimously.
Resolution 812-67 - The Clerk read Resolution #12-67, entitled, Author-

izing the Wisconsin Natural Gas Company to Install Gas Mains Along the
Right-of-Ways of Streets in the City of Muskego. Alderman Budish moved
for the adoption of Resolution 812-67, seconded by Alderman Wollman,
motion carried.
Ordinance 861 - The Clerk gave the first reading of Ordinance Q61,
entitled, An Ordinance Amending Ordinance #55 entitled, An Ordinance
Establishing Personnel and Establishing and Regulating the Salaries
and Other Compensations of Elected and Appointed Officers and Employes
of the City of Muskego. Ordinance #61 will be referred back to the
Finance Committee and the Rules, Laws & Ordinance Committee.
Ordinance #62, entitled, An Ordinance Creating a Minimum Housing Code
for the City of Muskego, Waukesha County, Wisconsin. Alderman Weaver
moved to suspend the Rules of Order in order to waive the first reading
of Ordinance 862. Seconded by Alderman Wollman. Upon a roll call vote
to suspend the Rules of Order, the motion carried unanimously.

Resolution #13-67 - Authorizing the Public Sewer Committee to Investigate
Land Purchases for Sewers. Alderman Weaver moved to suspend the Rules
that would interfere with the adoption of Resolution #13-67, seconded
by Alderman Budish. Upon a roll call vote to suspend the Rules, the
motion carried unanimously. The Clerk read Resolution f/13-67. Alderman
Weaver moved for the adoption of Resolution f/13-67, seconded by Alderman
Wollman. Alderman Weaver moved to amend Resolution 1113-67 by adding
the following sentence at the end of Paragraph #5, "and authorize the
Public Sewer Committee and the Finance Committee to investigate the
possible purchase of lands necessary for the development of the sewer
treatment plant." Seconded by Alderman Wollman, motion carried. Upon
a roll call vote to adopt Resolution 813-67, As Amended, the motion
carried unanimously.
LICENSE APPROVAL - Alderman Linck moved that the Common Council approve
a Class "A" Fermented Malt Beverage and Intoxicating Liquor License for
Evelyn Beaupre. Seconded by Alderman Budish, motion carried.
Alderman Budish moved for the approval of an Operator's License for
John F. Jensen.

Alderman Joost moved for the approval of a Class "B" Fermented Malt
Beverage and Intoxicating Liquor License for Donald Kneser. Seconded
by Alderman Linck, motion ca~rried.
Alderman Joost moved for the approval of a Class "C" Dance Hall
8 License for the Jewel Crest Advancement Association, Donna Belair,
Agent. Seconded by Alderman Lentini, motion carried.
VOUCHER APPROVAL - Alderman Budish moved for the approval of payment
8 of vouchers in the amount of $21,432.33, payable to February 14, 1967.
Seconded by Alderman Linck, motion carried.
Resolution 814-67 - The City Attorney read Resolution #14-67, entitled,
Granting Permission to Melvin Wright to Conduct a Snowmobile Derby.
Alderman Budish moved that the rules that would interfere with the
adoption of Resolution #14-67 be suspended. Seconded by Alderman
Joost. Upon a roll call vote to suspend the rules, Aldermen Joost,
Budish, Lentini and Wollman voted "aye". Aldermen Weaver and Linck
voted "no". The motion to suspend the rules carried. Alderman Budish
moved for the adoption of Resolution #14-67, seconded by Alderman
Joost. Alderman Weaver spoke in opposition to the adoption of
Resolution 1114-67. Upon a roll call vote to adopt Resolution 814-67,
Aldermen Budish, Joost, Lentini and Wollman voted "aye'. Aldermen
Linck and Weaver voted "no". The motion to adopt Resolution #14-67
carried.
CITY OFFICIAL'S REPORT
The Clerk presented the Financial Report showing a cash balance
as of January 31, 1967, of $430,868.81. Same to be placed on file.
The Clerk read the Building Report for the month of January, 1967,
same to be placed on file.
City Attorney's Report - None
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
Alderman Budish moved to set March 14, 1967, 7:00 P.M. as the Public
Hearing date for Ordinance #62, (Minimum Housing Code). Seconded
by Alderman Weaver, motion carried.
Alderman Joost moved to set March 14, 1967, 7~25 P.M. as the Public
Hearing date for the proposed amendment to the Zoning Ordinance.
l Seconded by Alderman Wollman, motion carried.
The Clerk announced that the Common Council was in receipt of a
petition for renewal of conditional use status for extractive purposes
in behalf of Hales Comers Sand and Gravel Company. Petition to be
referred to the Plan Commission.
The Clerk read a communication directed to Mayor Gottfried from
U. S. Senator Gaylord Nelson in regard to improved postal services. Communication placed on file.
ADJOURNMENT
