ccm19661213COMMON COUNCIL CITY OF MUSREGO MINUTES OF MEETING HELD DECEMBER 13, 1966 a Mayor Gottfried called the meeting to order at 8:30 P.M. PRESENT - Mayor Gottfried, Aldermen Edmund Budish, Sivier Joost, Jr., S. Robert Lentini, Roland Linck, Myron Weaver, Donald Wieselmann 0 and Walter Wollman. Also present were Clerk Bette Bowyer and Attorney Hippenmeyer, City-Engineer John Mielke and Mr. Max Ander- son of Max Anderson Associates. MINUTES - Alderman Budish moved to accept the minutes of the meeting held on November 22, 1966, seconded by Alderman Weaver, motion carried. COMMITTEE REPOBTS Finance Committee - Alderman Linck presented the report of the meeting ofthe?F-inance Committee held on December 7, 1966, and moved that the-report be accepted and placed on file. Seconded by Alderman Joost, motion carried. Public Works Committee - Alderman Wieselmann presented the report of the Public Works Committee meeting held on December 8, 1966, and moved that the report be accepted and placed on file. Seconded by Alderman Budish, motion carried. Public Safety Committee - Alderman Lentini presented the report of joint meeting of the Public Safety Committee and the Police and Fire Commission held on December 8, 1966, and moved that the report be accepted and placed on file. Seconded by Alderman Linck and the motion carried. Public Welfare Committee - No report. Rules, Laws 6 Ordinance Committee - Alderman Joost presented the report of the meeting held on December 12, 1966, and moved that the report be accepted and placed on file. Seconded by Alderman Wollman, motion carried. Plan Commission - The report of the Plan Commission meeting held on December 6, 1966, was accepted and placed on file. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried announced that on Monday, December 20, 1966, at 7:00 P.M., the Common Council will meet with the Plan Commission for the presentation of the Industrial Study Report prepared by City Engineers Ruekert& Mielke and Planning Consultants Nelson & Associates. OLD BUSINESS * None NEW BUSINESS Resolution #215 - The Clerk read Resolution #215, entitled, Pre- liminary Resolution Declaring Intent to Exercise Special Assessment l Powers under Section 66.60, Wisconsin Statutes of 1965. Alderman Budish moved for the adoption of Resolution l/215, seconded by Page 2. Alderman Joost. Considerable discussion took place as to whether or not this resolution should be adopted before a public hearing is held. Attorney Hippenmeyer advised that a preliminary resolution indicating the intent of the City to exercise special assessment powers according to the State Statutes is necessary before a public l hearing is held. Alderman Wieselmann moved to defer action on Resolution #215 for two weeks, seconded by Alderman Lentini.. Upon roll call to defer action on Resolution #215, Alderman Budish, Lentini and Wieselmann voted "aye" and Alderman Joost, Linck, Weaver a and Wollman voted "no". The motion to defer action on Resolution 11215 for two weeks did not carry. Upon a roll call vote to adopt Resolution f/215, Aldermen Budish, Lentini and Wieselmann voted "no" and Aldermen Joost, Linck, Weaver and Wollman voted "aye". The motion to adopt Resolution #215 carried. During the roll call vote Alderman Wieselmann indicated that he wanted to continue the discussion of the resolution. Alderman Weaver raised a point of order indicating that once a vote is begun no further discussion is permitted. Mayor Gottfried ruled that a roll call vote can be interrupted only for clarifying the vote. Alderman Wieselmann requested that the records show that he voted "no" on the adoption of Resolution #215 because he felt he did not have all the facts pertaining to the Resolution. 0 Resolution #219 - The Clerk read Resolution $1219, entitled, Prelim- inary Resolution Declaring Intent to Exercise Special Assessment Powers Under Section 66.60, Wisconsin Statutes of 1965. Alderman Wollman moved to suspend the rules that would interfere with the adoption of Resolution #219, seconded by Alderman Budish. Upon a roll call vote to suspend the rules that would interfere with the adoption of Resolution 1~219, the motion carried unanimously. Alderman Wollman moved for the adoption of Resolution #219, seconded by Alderman Weaver. Upon a roll call vote to adopt Resolution #219, the motion carried unanimously. At 9:28 P.M. Mayor Gottfried declared a recess in order to introduce Mr. Max Anderson of Max Anderson Associates to explain to the Council his. recent study which had been authorized by the Plan Commission, entitled, Workable Program for Community Improvement. At lo:50 P.M. the regular meeting reconvened. Resolution #216 - The Clerk read Resolution #216, entitled, Author- izing the Finance Committee to Negotiate for the Purchase of the Schwefel property in Sec. 9. Alderman Lentini moved for the adoption of Resolution #216, seconded by Alderman Wieselmann. After discussion, Alderman Weaver moved that Resolution #216 be referred to the Welfare Committee, seconded by Alderman Wollman, motion carried. Resolution #217 - The Clerk read Resolution #217, entitled, Approval of Submittal of Workable Program to Establish Eligibility for Federal Renewal Aid. Alderman Wieselmann moved for the adoption of Resolution 1,217, seconded by Alderman Budish. Upon a roll call vote the motion to adopt Resolution #217 carried unanimously. Resolution #218 - The Deputy Clerk read Resolution #218, entitled, Transferring $23,000.00 from Acct. #600 Constable, to Reserve Account for Police Department Equipment. Alderman Linck moved for the adoption of Resolution #218, seconded by Alderman Lentini. Alderman Weaver moved to amend Resolution #218 by deleting the word "equipment" in the third and fifth paragraph. Seconded by Alderman Wieselmann. The motion to amend Resolution #218 carried. Upon a roll call vote the motion to adopt Resolution #21%, As Amended, carried unanimously. Page 3. LICENSE APPROVAL - Alderman Budish moved that the Common Council approve Operator Licenses for Christine Erno and Douglas Erno,- seconded by Alderman Linck, motion carried. a VOUCHER APPROVAL - Alderman Linck moved that the Common Council approve payment of vouchers in the amount of $10,085.87, payable to December 13, 1966. Seconded by Alderman Budish. Upon a roll call vote the motion carried unanimously. w CITY OFFICIAL'S REPORT Attorney Hippenmeyer reported that the long pending court case of the City of Muskego vs. Gille had been dismissed. The Clerk read the Building Report for the month of November, 1966, same to be placed on file. The Clerk read the Financial Report showing a cash balance as of November 30, 1966, of $365,453.71. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a communication from Ruekert & Mielke directed to l the City of Muskego regarding an outlet road from Lazynski's pro- posed subdivision. Mayor Gottfried urged that all Aldermen read a copy of cormnunication from the Southeastern Wisconsin Regional Planning Commission directed to Nelson & Associates, Inc. regarding water supply proposals for the City of Muskego. The Clerk announced that nomination papers for the offices of Clerk- Comptroller, Treasurer, Assessor and Constable are now available in the Clerk's office.
