TO THE HONORABLE ALDERMEN - CITY OF MUSKEGC
Gentlemen:
I am writing to apprise you of my feelings regarding
Resolution #190, i.e. the Rezoning of Certain Parcels of Land in Section 4 from B-l and RS-2 to B-2. This land could be more specifically identified as the John Victor property and

the land on the southwest corner of Martin Drive and College Ave.
If you recall, several weeks ago Mr. John Victor, through
Mr. Forrest Perkins, requested that the land owned by him be rezoned to RS-2 and Multiple-family. The Plan Commission recommended denial of this request which was upheld by the
Council. Following this action, the Plan Commission recommended to the Council that the entire area owned by Mr. Victor, approx-
imately 10 acres and approximately 4s acres on the southwest
corner of Martin Drive and College Avenue, be rezoned to B-2.
It is my feeling that if this recommendation is upheld by the
Council it would not be in the best interest of the City.
No one can deny that the land in question has some
potential for commercial development, however, up to this time
no specific proposal for the commercial development of the area has been submitted other than to locate a DX filling station on
the corner of the John Victor property. The argument that a filling station should be permitted to add to the City's tax
base is easily refuted by examining the assessment on the eight
existing service stations we have in the City of Muskego. The valuation of these stations, that is the improvements, ranges
from approximately $4,900.00 to $32,OOO.OO, with an average of
$16,000.00. Most any commercial building or office building would produce considerably more tax base as can easily be seen
by examining the assessments on similar buildings recently
erected in the City.
It is no secret that the major oil companies would like
to see a filling station on every business corner of all conmun-
ities as can be evidenced by their willingness to pay premium
prices for lands of this kind. However, I feel that by reserv- ing this-land for more desirable commercial development we will
be able to add substantially to our tax base in the future.

There is no reason to rezone this land at this time on speculation, particularly, since it might not be the proper
zoning. Once our Zoning Ordinance is amended by the adoption of Ordinance #SO, the time required for zoning changes will be reduced considerably. We will, therefore, be able to quickly rezone this area should a commercial development more advantag-
eous to the City and property owner be proposed.
It is for‘this reason that I ask you to defeat Resolution #190 in order that it may be returned to the Plan Commission for
further study.

Mayor Gottfried called the meeting to order at 8:50 P.M.

PRES@ - Mayor Gottfried, Alderman Edmund Budish, Sivier Joost, Jr.,

Walter Wollman. Also present were Clerk Bette Bowyer and Attorney

MINUTES - Alderman Wieselmann corrected the minutes of the meeting held on August 23, 1966, to add the sentence on Page 2, Para. 4,
7th Line, after the word "person" as follows: "Mr. Hippenmeyer
stated that it would be possible to limit the use of 22 cal. rifles
to farmers." Alderman Budish moved to accept the minutes of the
Common Council meeting of August 23, 1966, as corrected. Seconded
by Alderman Wieselmann, motion carried.

Rules, Laws & Ordinance Committee - Alderman Joost presented the report of the meeting held on September 8, 1966, and moved that the
report be accepted and placed on file. Seconded by Alderman Weaver,

UNFINISHED BUSINESS
Resolution #183 - The Clerk read Resolution #183, i.e. Accepting
Certain Lands in the Jew Crest Subdivision. Alderman Wieselmann
moved for the adoption of Resolution #183, seconded by Alderman
Lentini, motion carried.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried announced that on October 3, 1966, at 7~30 ,P.M.
Mr. Alfred Howe of the Wisconsin Department of Taxation, Members of the Council, the Board of Review, the City Assessor and other
interested people will meet regarding the re-assessment of the City
of Muskego.
Mayor Gottfried announced that on Thursday, September l.#, 1966, 8:15 P.M., City Hall, the United Fund Chairman, Mr. Mitch Rosinski,
c and the wolunteer workers of the United Fund Campaign will hold a
meeting. All interested people are urged to attend.

The Clerk read a &mmunication from Mayor Gottfried addressed to
the Alderman stated his reasons for being opposed to the rezoning
of the John Victor property and the land on the southwest corner
of Martin Drive and College Ave.
The Clerk read a communication from the Public Administration
- Service, 1313 East Sixtieth St., Chicago, Illinois, addressed to
Mayor Gottfried explaining their proposal to assist the City of
4 Muskego in planning for a municipal police department, cost not
to exceed $1600.00.
NEW BUSINESS -
Resolution #189 - The Clerk read Resolution #189, entitled, Author- izing a Study for a Municipal Police Department. Alderman Linck
moved for the adoption of Resolution #189, seconded by Alderman
Weaver. In discussion, Alderman Wieselmann spoke in opposition
of Resolution #189. Aldermen Joost, Weaver, Lentini and Budish
spoke in favor of adopting Resolution #189. Upon roll call,
Aldermen Budish, Joost, Lentini, Linck and Weaver voted "aye.
Aldermen Wieselmann and Wollman voted 'no'.
Resolution #190 - The Clerk read Resolution #190, entitled, Affirming the Recommendation of the 'Plan Commission to Rezone
Certain Parcels of Land in 'Section 4. Alderman Lentini moved for
the adoption of Resolution #190, seconded by Alderman Wieseimann.
Alderman Lentini requested that the Aldermen understand that
Resolution #190 was a resolution to rezone this property and not
to locate a filling station here. He felt that this is an ideal
piece of commercial property. Alderman Budish indicated that once
property is zoned for this type of business there is no way to
rezone it. It was his feeling that the Council should not rezone
a parcel of land for approximately the one-half acre that a filling
station would take. Mayor Gottfried turned the Chair over to Council President Wieselmann and spoke in opposition of the rezoning.
It was his feeling that once the property is rezoned, the Plan
Commission would not turn down the petitioner as was evidenced in
the Tess Corners area. Upon a roll call vote to adopt Resolution
#190, Aldermen Lentini, Linck, Weaver, Wieselmann and Wollman
voted "aye". Alderman Joost and Budish voted "no". The motion to
adopt Resolution #190 carried.
Resolution #191 - The Clerk read Resolution #191, entitled,
Authorizina the Wisconsin Natural Gas Company to Install Gas Mains
Along the Eight of Ways of Streets in the-City of Muskego. Alderman
Budish moved to suspend the rules that would interfere with the
adoption of Resolution #191, seconded by Alderman Linck. Upon
roll call, motion carried unanimously. Alderman Wieselmann moved
for the adoption of Resolution #191, seconded by Alderman Wollman.
Alderman Budish moved to amend Resolution #191 to add #4 as follows:
"ZOO' of 3" H.P. main and one 3/4 H.P. service to serve George
Janssen at Wl72 S'f'645 Lannon Drive." Seconded by Alderman Wiesel-
mann, motion carried. The motion to adopt Resolution #191, as
Amended, carried.
Mayor Gottfried declared a recess at 1O:lO P.M. and the meeting reconvened at lo:15 P.M.
Resolution #192 - The Clerk read Resolution #192, entitled,
Acceptance of Relocated Crowbar Road and Authorization for Payment
of Construction Costs. Alderman Budish moved to suspend the rules
that would interfere with the adoption of Resolution #192, seconded
by Alderman Wollman. Upon roll call, motion carried unanimously.
Alderman Budish moved for the adoption of Resolution #192, seconded
by Alderman Wollman. Alderman Wieselmann questioned the City
Attorney as to whether or not the City would be bound to pay the
amount of $1,378.50 which was over the amount of $11,500.00 agreed

to pay Payne & Dolan for work on Crowbar Road. Attorney Hippenmeyer read the agreement between the City of Muskego
and Payne & Dolan and stated the City would not be required
to pay the $1,378.50 and the added expenditure should have
been authorized by the Finance Committee and the Common Council.
Mayor Gottfried explained how the added expenditure and)
indicated that it will save the City money in the futre. Ald- erman Budish urged the payment of the two claims and quoted
from the minutes of the Public Works Committee of the meeting
a of September 8, 1966, which showed the payment of the bills
approved. Upon roll call, the motion to adopt Resolution #192
carried unanimously.
Resolution #193 - The Clerk read Resolution #193, entitled Street Lighting Districts. Alderman Linck moved to suspend the
rules that would interfere with the adoption of Resolution #193,
seconded by Alderman Weaver. Upon roll call, unanimously carried. Alderman Linck moved for the adoption of Resolution #193, seconded by Alderman Lentini, motion carried. The Public Hearing date was set for October 2.5, 1966, at 7:00 P.M.
Ordinance #51 and #52. The Clerk read Ordinances 51 and 52,
entitled, Ordinance to amend the Zoning Ordinance of the City of
Muskego. Alderman Weaver moved to set Public Hearing for
Ordinances #SO, #51 and #5Z for October 11, 1966, 7~00 P.M.
Seconded by Alderman Lentini, motion carried.
VOUCHER APPROVAL - Alderman Budish moved that the Common Council
approve payment of vouchers in the amount of $26,341.84 payable
to September 13, 1966. Seconded by Alderman Linck. Upon a roll
call vote the motion carried unanimously.
Mayor Gottfried declared a recess at lo:44 and the meeting re-
convened at lo:46 P.M.
LICENSE APPROVAL - Alderman Budish moved that a Bartender's
License for Edna Marzu be approved. Seconded by Alderman Linck, motion carried.
Alderman Joost moved that a Trap Shoot License be approved for
Mr. Lloyd Erno, seconded by Alderman Budish, motion carried.
LICENSE DENIAL - Alderman Budish moved that a Class "B" Fermented
Malt Beverage and Intoxicating Liquor License for Mr. Joseph
Feypel be denied, seconded by Alderman Joost. In answer to a question from Alderman Wieselmann as to whether or not Mr. Feypel
could re-apply for this type of License or if his wife could apply,
a
Mayor Gottfried indicated that this would be possible. The motion '
to deny the license for Joseph Feypel carried.
CITY OFFICIAL'S REPORT
The Clerk read the Building Report for the month of August, same
to be placed on file.
The Clerk read the Treasurer's Report showing a cash balance as
of August 31, 1966, of $395,123.76. Report to be placed on file.
COMMUNECATIONS A~+IISCELLANEOUS BUSINESS
The Clerk read a communication from Attorney Hippenmeyer directed
to Mayor Gottfried regarding the City Council's power over the
Board of Appeals. Communication referred to Public Welfare Committee.
The Clerk read a communication from Payne & Dolan directed to the
Common Council thanking them for a permit to place',a temporary
asphalt plant on Crowbar Road. Communication placed on file.

The Clerk read a communication from Dr. Glenn Riess, President of
the Park and Recreation Board, Directed
approval to acquire 6.351 acres of land
to the,Council requesting
in the Belmont Greens
Subdivision. Communication referred to Public Welfare Committee.
The Clerk read a communication from James and Kathleen Juel
directed to the City of Muskego offering to purchase city owned
land between Lots #20 and #21 in Kingston's Subdivision.

The Clerk read a petition from Mr. David Bierle requesting that a
parcel of land located in Sec. 9 on Highway 24, presently zoned
RS-3 be amended by the overlaying of an 00s - Office and Special Service. Alderman Budish moved that a Public Hearing for Mr. Bierle
be set for October 11, 1966, 7:15 P.M. Seconded by Alderman Wieselmann, motion carried.
Alderman Wieselmann suggested that individuals connected with
Parkland ~P1az.a appear before the Plan Commission to give a
progress report. Mayor Gottfried stated that he would mention
Alderman Wieselmannis suggestion to the Plan Commission.
Alderman Weaver expressed a desire to have the Municipal Site Committee and the Industrial Site Committee reactivated.
Alderman Linck moved to adjourn the meeting, seconded by Alderman
Wieselmann, motion carried. The meeting adjourned at 11:05 P.M.
