MINUTES OF MEETING HELD JULY 14, 1966
Mayor Gottfried called the meeting to order at 7:34 P.M.
PRESENT: Mayor Gottfried, Aldermen Sivier Joost, Jr., S. Robert Lentini, Roland Linck, Myron Weaver, Donald E. Wieselmann and Walter Wollman. Alderman Budish arrived at 7:38 P.M. Also present were City Clerk Bette J. Bowyer and City Attorney Hippenmeyer.
MINUTES - Alderman Joost moved to accept the Minutes of the previous meeting held on June 28, 1966. Seconded by Alderman Linck and the motion carried.
COMMITTEE REPORTS
Finance Committee: Alderman Linck presented the report of the Finance Committee meeting held on July 6, 1966, and moved that the report be accepted and placed on file. Alderman Lentini seconded the motion and the motion carried.
'Public Works Committee - None.
Public Safety Committee - None.
Public Welfare Committee - Alderman Budish presented the report of -Pub-fare Committee meeting held on July 6, 1966, and moved that the report be accepted and placed on file. Seconded by Alderman Wieselmann and the motion carried.
Rules, Laws & Ordinance Committee - m- Alderman Joost presented the report of the Rules, Laws & Ordinance Committee meeting held on July 7, 1966, and moved that the report be accepted and placed on file. Seconded by Alderman Wollman and the motion carried.
Plan Commission --The report of the Plan Commission meeting held duly 5, 1966, was received and placed on file.
UNFINISHED BUSINESS
Charter Ordinance #ll - The Clerk read Charter Ordinance #ll, i.e. -Charter Ordinance Setting Terms of Office for Certain City Officials. Charter Ordinance #ll was brought back to the floor after being de- ferred at the previous meeting held June 28, 1966. Upon a roll call vote to adopt Charter Ordinance #ll, Aldermen Budish, Joost, Lentini, Linck, Weaver and Wollman voted "aye". Alderman Wieselmann voted "no".
Resolution #170 - The Clerk read Resolution #170, i.e. Denying the Request of Gravel, Inc. to Onerate an Asnhalt Plant. The Clerk then read a communication directed to the City Hall from Mr. Dale Dawson indicating that in order to avoid greater financial loss he would need two seasons, not including this one, to move the asphalt plant from its present location. The Clerk read another communication directed to the Muskego Plan Commission from Mr. Clyde E. Sheets, Attorney representing the Muskego Asphalt Corporation,stating that
a grant of the requested extension would be appreciated as a necessity to protect the interests of his clients as well as Dale Dawson. Alderman Joost then asked permission of the Aldermen for Mr. Walter Schultz, Vice President of the Sherwin Corporation,to speak. Mr. Schultz spoke in favor of the asphalt plant's continued operation in the City of Muskego. Mr. Schultz then attempted to answer questions submitted to him by several of the Aldermen. Alderman Weaver moved for the reconsideration of Resolution #169, i.e. Approval of an Extractive Operation Permit to Gravel, Inc. Seconded by Alderman Joost. Upon a roll call vote the motion to reconsider #169 carried unanimously. Alderman Weaver then moved to amend Resolution #169, the fourth paragraph to read as follows: "THEREFORE BE IT RESOLVED that the Common Council of the City of Muskego does hereby grant an

Extractive Permit to Gravel, Inc. upon receipt of a bond in the amount of $@,OOO and the restoration plan executed,effectlve July 30, 1966." Seconded by Alderman Lentlni and the motion carried. Upon a roll call vote to adopt Resolution #169, As Amended, the motion carried unanimously. Alderman Wieselmann then moved that Resolution #170 be referred back to the Plan Commission to determine the feasibility of relocating the asphalt plant, seconded by Alderman Wollman and the motion carried.
- The Clerk gave the second reading of Ordinance #44, Amendlnn Ordinance #27 entitled "An Ordinance Establishing Salaries of Employees and Cfficers of the City of Muskego, Wisconsin." (Water Patrolmen) Alderman Wiesohnann moved for the adoption of Ordinance #44, seconded by Alderman Lentinl. Upon a roll call vote the motion to adopt Ordinance #44 carried unanimously.
- - The Clerk gave the second reading of Ordinance #45, .e. An Ord nance to Regulate the Demolition of Buildings and Removal of Debris". Alderman Weaver moved for the adoption of Ordinance #45, seconded by Alderman Wollman. Alderman Lentlni moved to amend Ordinance #4.5 as follows: Section V, first sentence, the word "municipal" be inserted before the words sewer pipes shall be protected....etc. Seconded by Alderman Weaver and the motion carried. Alderman Wieselmann moved to amend Ordinance #45 as follows: Section III, after the word "space" the following sentence be inserted: "In those cases where the building is located in an open area or farm yard, the Building Inspector." this requirement may be waived by Seconded by Alderman Lentlnl. The motion to amend Ordinance #45 carried. Alderman Joost moved to amend Ordinance #& as follows: Section VI, last sentence to read "one" additional 30 day extension may be granted. Seconded by Alderman Weaver. Upon a roll call vote to Alderman Joost*s Amendment, Aldermen Joost, Lentini and Weaver voted "aye" and Aldermen Budish, Llnck, Wieselmann and Wollman voted "no". Upon a roll call vote to adopt Ordinance #&, As Amended, the motion carried unanimously.
NEW BUSINESS
Ordinance #47 - The Clerk gave the first reading of Ordinance #47, i.e. An Ordinance 'Prohibiting the Discharge of Firearms and Guns In the City of Muskego.
- - The Clerk gave the first reading of Ordinance #48, i.e. An rdinance Amending an Ordinance Regulating Boating and Related Water Activities on Waters Located Within the City of Muskego, Waukesha County, Wisconsin.
Ordinance #35 - The Clerk gave the first reading of Ordinance #35, .e. An Ordinance Providing for the Regulation Control and Licensing of ~Public Dance Halls.
Resolution #173 - The Clerk read Ordinance #173, i.e. Authorizing City Attorney to Take Action Anainst Adam Ianasiak. Alderman Wieselmann moved for the adoption of Resoluxion #173, seconded by Alderman Lentini and the motion carried.
VOUCHER APPROVAL - Alderman Linck moved that tbe Common Council approve payment of vouchers in the amount of $8,725.60. Upon a roll call vote the motion to approve the payment of vouchers carried unanimously.
LICENSE APPROVAL - Alderman Budish moved that Operator's Licenses for Becker, Henry Klein, Sr. and Jan Strode be approved. Seconded by Alderman Linck and the motion carried.

CITY OFFICIAL'S REPORT
The Clerk read the Building Report for the month of June, 1966, same to be placed on file.
The Clerk presented the Treasurerts Report showing a cash balance as of June 30, 1966, of $3'73,542.11. Same to be placed on file.
City Attorney Hippenmeyer advised the Council that the Public l Service Commission has authorized the Wisconsin Electric Power Company to build lines and they will not approve or disapprove the routes chosen by them. He indicated further that any injunction that might be brought against the Electric Company might prove to be very costly to the City. He also stated that, in his opinion, very little could be done by the City to prevent the utility company from choosing the right-of-way they desire.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS -
Alderman Lentini moved that a Public Hearing be held for the rezoning of the John Victor and adjacent property from B-l to B-2 on August 9, 1966, at 7:15 P.M. Seconded by Alderman Wieselmann and the motion carried.
The Clerk read a petition directed to the City Council signed by several residents on Field Drive requesting a 35 mph speed limit on Field Dr. Petition to be referred to the Safety Committee.
The Clerk read a communication directed to the Mayor and Council from Mrs. Jean Sanders, City Treasurer, announcing the appointment of Mrs. Barbara Sands as Deputy Treasurer.
The Clerk announced the appointment of Mrs. June Elger as Deputy Clerk.
Alderman Joost requested that a letter be written from the proper authority to the Sheriff's Department or State Highway Patrol regarding the speeding of trucks on Highway 24 through the City. Request referred to the Safety Committee.
Alderman Weaver asked the City Attorney for clarification of the agreement between the City of Muskego and Alfred Wauer for the use of the dump site.
ADJOURNMENT - Alderman Wieselmann moved to adjourn the meeting, seconded by Alderman Budish. The meeting adjourned at 9:50 P.M.
