ccm19660322COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD MARCH 22, 1966 The meeting was called to order at 7~35 P.M. by Mayor Gottfried. Present - Mayor Gottfried, Aldermen Arthur Bostater, Paul DeAngelis, Henry Hudziak, Myron Weaver, Donald Wieselmann, Henry Wolf and Edmund Budish. Also present were Clerk Bette Bowyer and Attorney Hippenmeyer. Minutes - Alderman Wolf moved that the minutes of the previous w meeting held on March 7, 1966, be accepted as presented and placed on file. Seconded by Alderman Weaver, motion carried. COMMITTEE REPORTS Finance Committee - Alderman Wolf presented the report of the Finance Committee meeting held on March 16, 1966, and moved that the report be accepted and placed on file. Seconded by Alderman Budish. The motion to accept the report carried. Public Safety Committee - No report. Public Welfare Committee - Alderman DeAngelis presented the report n of the =Welfare Committee meeting held on March 16, 1966, and moved that the report be accepted and placed on file. Seconded by Alderman Hudziak and the motion carried. Public Works Committee - Alderman Wieselmann presented the report of the Public Works Committee meeting held on March 17, 1966, and moved that the report be accepted and placed on file. Seconded by Alderman Weaver, motion carried. Rules. Laws & Ordinance Committee -- - Alderman Weaver presented the report of the Rules, Laws & Ordinance Committee meeting held on March 17, 1966, and moved that the report be accepted and placed on file. Seconded by Alderman DeAngelis, motion carried. Planning Commission - The report of the Plan Commission meeting of March 15, 1966, was accepted and placed on file. UNFINISHED BUSINESS Ordinance #33 - The Clerk gave the second reading of Ordinance #33, i.e. An Ordinance to Amend an Ordinance Known as the Building Code of the City of Muskego, Waukesha County, Wisconsin. Alderman l Wieselmann moved for the adoption of Ordinance #33, seconded by Alderman Hudziak. Alderman Wieselmann moved to amend Ordinance #33 as follows: Under Rate of Category "Wrecking and Razing", the last sentence to read "Farm out-buildings less than 400 sq. ft. are exempt from this requirement." Alderman Weaver seconded the motion to amend Ordinance #33 and the motion carried. Alderman Wolf corrected the first item under Category to read "Heating or Heating and Air Conditioning including duct work". The motion to adopt Ordinance #33 as corrected and amended carried. COMMUNICATION FROM THE MAYORIS OFFICE -- Mayor Gottfried reported briefly on the Public Service Commission Public Hearing at Madison on March 16, 1966, relative to the proposed a@ transmission line of Wisconsin Electric Power Company. He advised that Attorney Reilly, Planner Knetzger and several of the land owners involved also attended the Hearing and spoke in opposition to the proposed route of the line. He further stated that as a result of the Hearing, Electric Company officials met with him, Planner Knetzger and Attorney Reilly on March 22 at the City Hall and expressed a willingness to a compromise route and therefore l a - m - l a - 0 - l Page 2. submitting a counter proposal which will be submitted to the Plan Commission for their consideration. Mayor Gottfried thanked the Aldermen for their cooperation during the past 15 months. NEW BUSINESS Resolution #131 - The Clerk read Resolution #131, i.e. Acceptance of the Federal Grant-in-Aid for Waste Treatment Facilities. The Clerk then read a communication from the Committee on WaterPollution directed to the Mayor relative to the Acceptance of the Federal Grant-in-Aid. Alderman Wolf moved for the adoption of Resolution #131, seconded by Alderman Wieselmann and upon a roll call vote the motion to adopt Resolution #131 carried unanimously. Ordinance #34 - The Clerk read Ordinance #34, i.e. An Ordinance to Amend the Zoning Ordinance and then Official Zoning Map of the City of Muskego. Attorney Hippenmeyer recommended that due to the fact that there will be new members on the Council at the next meeting that the Common Council suspend the Rules of Order and act on Ordinance #34 at this time. There were no objections raised by any of the Aldermen. Alderman Wolf then moved to suspend the Rules of Order in order that Ordinance #34 might be acted upon immediately. Seconded by Alderman Wieselmann and the motion carried. Alderman Wolf then moved for the adoption of Ordinance #34, seconded by Alderman DeAngelis. At this point Mr. John Couture expressed a desire to be heard and Alderman Wieselmann requested permission of the other Aldermen for Mr. Couture to speak and there were no objections. Mr. Couture ex- pressed his apologies for not being present at the Public Hearing in regard to the matter referred to in Ordinance #34. He spoke in opposition to the proposed Zoning change in this particular area. Alderman Wolf requested the Councills permission for Mrs. Eileen Baseler to speak and as there were no objections from any of the Aldermen, she spoke in favor of the rezoning. The motion to adopt Ordinance #34 carried. VOUCHER APPROVAL Alderman Wolf moved that the Common Council approve payment of vouchers in the amount of $9,318.76 payable to March 22, 1966. Seconded by Alderman Budish. Upon a roll call vote the motion to approve payment of vouchers carried unanimously. LICENSE APPROVAL Inasmuch as the &day waiting period, after publication, has not passed, Attorney Hippenmeyer suggested that this license approval by the Council be held over until the next Council meeting. Mayor Gottfried then called a recess at 8:31 P.M. in order that Attorney Hippenmeyer could check the Wisconsin State States in regard to this matter. At 8:45 P.M. the Council meeting reconvened and Attorney Hippenmeyer read State State 176.09 relative to the &day, after publication, wafting period before a Class B. Fermented Malt Liquor License can be issued. The matter was deferred to the next Common Council meeting. CITY OFFICIALS REPORT - None COMMUNICATIONS AND MISCELLANEOUS BUSINESS Mayor Gottfried read a communication from Wolf Construction Co., Inc. advising that they have a floating barge weed cutter available for rent. Communication referred to Public Work8 Committee. Mayor Gottfried read a communication from Ludwig C. Schroeder regarding a claim of $12.00 against the City of Muskego. Communication referred to the Finance Committee. Page 3. In answer to a question from Alderman Wieselmann as to whether or not the referendum on the forthcoming election ballot would be one or two questions, City Clerk Bette Bowyer answered that the referendum would be one separate question as it had been presented upon petition. Alderman Weaver expressed his best wishes to the Mayor and fellow Councilmen. He thanked Mayor Gottfried for gu%danoe and understanding and helpfulness given to him and the other Aldermen when they first took offics. Alderman Budish reminded the Aldermen of the Dedication Ceremonies of Luther Parker Cemetery on Saturday, March 26, at 2:00 P.M. and invited them all to attend. Alderman Budish then expressed his gratitude to the Aldermen and Mayor for consideration given him during the past 15 months. Alderman Bostater, who was attending his last Common Council Meeting, stated that he had enjoyed working with all of gentlemen at the Council table and wished all of them the best of luck.
