COMMON COUNCIL CITY OF MUSKEGO
MINUTES OF MEETING HELD NOVEMBER 23, 1965
CITY HALL
The meeting was called to order at 7:35 P.M. by Mayor Gottfried.
Present - Mayor Jerome Gottfried, Aldermen Arthur Bostater, Paul M.
Delis, Henry Hudziak, Myron H. Weaver, Donald E. Wiesehnann
and Henry Wolf.
Absent - Alderman Edmund Budish.
Minutes - Alderman Wolf moved that the minutes of the previous
meeting held November 9, 1965, be accepted as presented and placed
on file. Seconded by Alderman Hudziak, motion carried.
Alderman De Angelis moved that the minutes of the special meeting
of the Common Council on November 8, 1965, be accepted as presented, seconded by Alderman Weaver, motion carried.
COMMITTEE REPORTS
Finance Committee - Alderman Wolf presented the report of the Finance Committee Meeting of November 17, 1965, and moved that
the report be accepted and placed on file. Seconded by Ald~erman Bostater, motion carried.
Safetv Committee - Alderman Wieselmann presented the report of the Safety Committee Meeting of November 11, 1965, and moved that
the report be accepted and placed on file. -Seconded by Alderman
Bostater, motion carried.
Public Works Committee - Alderman Wieselmann presented the report
of the Public Works Committee Meeting held November 18. 1965. and moved that the report be accepted an: placed on file. .Seconded
by Alderman Weaver, motion carried.
Planning Commission - The report of the Planning Commission Meeting
of November 16, 1965, was accepted and placed on file.
UNFINISHED BUSINESS
Charter Ordinance #lO - The Clerk gave the second reading of Charter Ordinance #lo, i. e. Staggering Terms of Aldermen. Alderman Wolf moved for the adoption of the Charter Ordinance #lO. Second~ed by Alderman Wieselman and upon a roll call vote the motion to adopt Charter Ordinance #lO it carried unanimously.
Ordinance #23 - The Clerk gave the second reading of Ordinance #23, 1. e. an Ordinance to amend the Zoning Ordinance to rezone a part
of land in Section 7. Ald~erman Weave? moved that Ordinance #23
be accepted and adopted. Seconded by Alderman Wolf, motion carried.
Ordinance #24 - The Clerk gave the first reading of Ordinance #24,
i. e. an Ordinance to amend the Zoning Ordinance of the City of Muskego (Private Street or Way).
COMMUNICATIONS AND RECOMMENDATIONS FROM THE MAYOR
Mayor Gottfried informed the Aldermen that if they have a person
in mind they would like considered for appointment to the Fire and Police Commission they should contact him and submit the name
of such person.
Mayor Gottfried asked the Council to consider suspending the rules
of the Council in order to expedite the adoption of Ordinance #25 so that the Clerk may begin preparing the tax roll.

NEW BUSINESS
Alderman Weaver moved that we suspend with the rubles of the Common
Council requiring an ordinance to be in the hands of the Alderman
three days prior to presentation in order that Ordinance #25 can
be presented. Seconded by Alderman Hudziak, motion carried.
Mr. Hippenmeyer then informed the Council that this must be done in two separate motions. Mr. Wolf then moved to suspend the rules
that interfere with the adoption of Ordinance #25. Seconded by
Alderman De Angelis, motion carried. Alderman Wolf then moved
for the adoption of Ordinance #25. Seconded by Alderman Weaver,
motion carried.
Alderman Bostater then proposed an amendment to Ordinance #25
deleting the general tax, stating that the difference between the
proposed expenditures and receipts be taken from the surplus fund.
Seconded by Alderman Wieselmann. Upon a roll call vote, Alderman
Bostater and Alderman Wieselmann voted "aye". Aldermen De Angelis, Hudziak, Weaver and Wolf voted 'no". Therefore the motion to
emends Ordinance #25 was defeated.
Upon the roll call vote the motion to adopt Ordinance #25 was carried unanimously.
VOUCHER APPROVAL
Alderman Bostater moved that the Common Council approve for payment
vouchers in the amount of $9,392.78, payable November 23, 1965.
Alderman Wolf seconded the motion and upon roll call it carried
unanimou~sly.
LICENSE APPROVAL
Alderman Bostater moved that the Common Council approve the
Operatorts License for Alvin Bourdo subject to receipt of satis- factory fingerprint and medical reports. Seconded by Alderman
Wieselmann, motion carried.
Ordinance #26 - The Clerk then read Ordinance #26, a Zoning ordinance Amendment. Mayor Gottfried suggested that the Council
review it thoroughly in preparation for its first reading.
CITY OFFICIAL'S REPORTS
City Attorney Hippenmeyer commented on Judge Gramlingls recent decision in regard to the law suit between nine property owners
vs. the Board of Appeals in the City of Muskego. He presented to
the Common Council a Deed to Parcel No. 1, also a Grant of Easement
on two lots which are still owned by Mr. Richdorf, and the Agreement
conveying . Parcel No. 1 to the City of Muskego. He further
stated that the opinion rendered by the Court only relates to
these lots. Attorney Hippermneyer then presented Resolution #106 as follows:
BE IT RESOLVED that the Mayor and City Clerk of the City of Muskego be herein authorized and directed to execute the agreement written
on November 23, 1965, between the City of Muskego and Matt Richdorf
and Betty Richdorf, his wife.
Alderman Wolf moved to suspend the rules that interfere with the
adoption of Resolution #lob, seconded by Alderman Weaver, motion
carried. Alderman Wolf moved to adopt Resolu~tion #106. Alderman
Weaver seconded the motion and it carried.
City Attorney Hippenmeyer stated that Judge Callow had found Adam
Ignaziak guilty of all five counts he had been charged with.in violation of City ordinances. Sentence would be passed when Ju~dge
Callow returns to the bench.

Alderman Weaver asked of Mr. Hippenmeyer whether a Wisconsin Natural Gas request needed Council action. Mr. Hippenmeyer advised that Council action was required. The Clerk then read the request in which the Gas Company wanted permission to install
approximately 280 feet of 2" H.P. steel gas main and one 3/4 H.P. lateral to serve the Harold DeFouw residence on Sherwood Circle. Alderman Weaver moved that the Common Council grant permission as per the Gas Companyts request. Seconded by Alderman Wieselmann, motion carried.
Ald. Wolf then requested that the Gas Company leave things as they found them, particularly on Janesville Road where they had left dirt on the highway after the ditches had been covered up. Mayor Gottfried said that a Gas Company Representative called on him personally and told him that any complaints wou~ld be taken of. Ald. Wolf said he thought the complaints should come from the City Hall. Alderman Wieselmann questioned who from the City determined whether tile, etc. are broken. Would it be the Building Inspector or the Highway? Mayor Gottfried advised that either could do it, most likely the Building Inspector.
County Board Supervisor Myron Weaver read the part of the Minutes of the Park and Planning Commission relative to the Muskego Pond being dug in the County Park. He also reported on the County Budget.
l Alderman Weaver asked of the City Attorney what the limitations of spending of the candidates who are going to run for city office were. Attorney Hippenmeyer quoted from the State Statutes “For any city officer, a sum not exceeding one-third of the salary to which such person would, if elected, be entitled during the first year of his incumbency of such office."
Clerk Bette Bowyer read a communication from the Waukesha Blood Donor Club expressing their thanks for the financial support to their twice-yearly Blood Mobiles in Muskego. Communication was placed in file.
Alderman Wolf moved for adjournment. Alderman Wieselmann seconded the motion and the meeting was adjourned at 9:03 P.M.
