The meeting was called to order at 7:35 P. M. by Mayor Gottfried.
PRESENT: Mayor Jerome Gottfried, Aldermen Arthur Bostater, Edmund
-a- m Paul M. DeAngelis, Henry Hudxiak, Myron H. Weaver, Donald E.

MINUTES: Alderman Wieselmazu~ moved that the minutes of the previous m, July 27, 1965, be approved as mailed. Aldermsn Hudeiak seconded the motion. Alderman Wolf brought the following correctiona to the attention of the Chair: under Ordinance #16, Page 2, first sentence, remove the word "with", that portion of sentence to read "suspend the rules"; and under Voucher Approval, Page 3, add the word "to", that portion of sentence to read payable to July 27, 1965". There being no ob- jections, the Mayor direated the Recording Secretary to make these corrections. The minutes as aorrected were approved.

Alderman DeAngelis seconded the motion. Alderman Wieselmann advised the Council that this was a combined meeting of the Finanoe, Publia Welfare and Publlo Safety Committees and the report should be so corrected. The report, as correated by unanimous agreement, was aooepted and placed on file.
FINANCE COMMITTEE - Alderman Wolf presented the report of the Flnanoe Committee meeting of August 4, 1965, and moved that the report be acoepted and placed on file. Alderman Bostater seconded the motion and it oarried.
PUBLIC WELFARE COMMITTEE - Alderman DeAngelis presented the report of %he Public Welfare Committee meeting of August 4, 1965, and Alderman Hudziak moved that the report be accepted and placed on file. Alderman Budish seconded the motion. Mayor Gottfried advised the Council that in accepting this report, Attorney Hippenmeyer would be authorieed to proceed with action pursuant to Episcopal Church on Ruby Drive. Alderman Hudelak advised that this property would be of little value to the City. The motion to accept the report of the Public Welfare Committee was carried.
RULES, LAWS & ORDINANCE COMMITTEE - Alderman Weaver presented the re-
port of the Rules, Laws & Ordinances Committee meeting of August 5,

1965, and moved that the report be accepted and placed on file. Alder- man Wolf seconded the motion. It was noted by the Council that Supervisory District #l had approximately 800 less In population than Dlstriot #2. Alderman
Weaver explained that the Committee felt that District #l would in- crease rapidly in population and equalize the number of people and each district encompasses all types of land use - residential,

agriculture and business. Alderman Wolf suggested that for the purpose of clarification, this portion of the Rules, Laws & Ordinances report be labeled County supervisory Districts. The motion carried to acoept the report of the Rules, Laws & Ordinances Committee.

PLANNING COMMISSION - The Planning Commission reports of July 29, 1965,
and August 3, 1965, were accepted and placed on Pile.
UNFINISHED BUSINESS
RESOLUTION #64 - The Deputy Clerk read Resolution #64, i. e. acoeptlng offer of the Jewel Crest Advancement Association to donate their
building and grounds to the City. City Attorney Eippenmeyer advised that in lieu of receipt of
abstract and deeds Prom Attorney Jack Radtke, he had prepared the
necessary deed for the Advancement Assooiation signatures.
Attorney Hippenmeyer suggested a change in the text of Resolution
#64 in the third paragraph bi omitting the words “authorize the
Park and Recreation Board to . Alderman Budish moved to adopt Resolution #64 as corrected by
mutual agreement. Alderman DeAngelis seconded the motion and it ’ carried.
COMMUNICATIONS AND RECOMMENDATIONS FROM ‘IHI MAYOR ^
Mayor Gottfried introduced Margrit Croonen Prom Essen, Germany, who
is presently visiting in our City. Alderman Hudelak explained that
because of her interest in government, he had invited her to attend
the Common Counoil meeting. Mayor Gottfried advised that he will
send a letter of greeting to the Burgermeister of her city Prom the City of Muskego.
Alderman Hudeiak moved to suspend the rules in order
to have its first reading. Alderman Wolf seconded the motion and it carried. .~
The Deputy Clerk read Ordinance #17, ii e. an Ordinanoe’ to smend that Ordinance of the City of Muskego known as the Building Code
adopted May 17, 1965, and as emended.
Ordinance #17 was referred to the Rules, Laws & Ordinances
Committee and will be brought before the Council for action August
24, 1965.
The Deputy Clerk read Resolution #83, i. e.
Districts. Alderman Wolf moved that Resolution #83 be adopted. Alderman
Weaver seconded the motion and it oarried. .’
The Deputy Clerk read Resolution #81, i. e. granting to Muskego Asphalt Inc.
Mayor Gottfried called for recess at 8:35 P. M. so that Attorney
Blppersneyer could draft an addition to Resolution X81. The meeting was reconvened at 8:36 P. M.
The Recording Secretary read the amendment to Resolution #81.,
1. e. “Be it further resolved that by the aocepstanoe of such temporary permit, the permittee agrees that this action does not release it of
any obligations under its original restoration agreement or the bond
securing the same.”
Alderman Budish moved to emend Resolution #81. Alderman DeAngelia seconded the motion. Alderman Budish withdrew the motion with the
consent of his second.
Alderman Budlsh moved to adopt Resolution #81 as oorrected by
mutual agreement. Alderman Wieselmann seconded the motion.
Alderman Weaver expressed his opinion that he was against
Resolution #81 because the Asphalt Plant has been a nuisance for
5 years and property values in the adjacent area have deolined. Alderman Budish expressed the view that anyone in violation of
creating a nuisance should be given a Pair chance to correct the vielatien or nuisanae. He further suggested that as the City grows
there will be additional need for asphalt and it would oost the tax-
payers a considerable amount of money if it had to be brought in Prom a distance.

Resolution #81 (cont.)
The Recording Secretary read the letter to the Common Council from the Plan.Commnission dated June 22, 1965, recommending denial of the Accessory Use Permit and that portion of the Plan Commission minutes of June 15, 196.5, relative to the Asphalt Plant. Alderman Bostater suggested that if this Resolution #81 is approved and the Asphalt Plant expends the money to correct the nuisance, the Council would certainly be obligated to extend the permit for another year. & ~<A/
Aldennan DeAngelis suggested that there shouldfibe a public hearing and that the plant be given an opportunfty to rectify the @-&1!5
nuisance. The motion was oarrled to adopt Resolution x81.
FgssmoN$~ - The Deputy Clerk read Resolution #82, i. e. ,593.69 to McShane Road Acoount. Alderman Bostater moved POP the adoption of Resolution #82. Alderman Wolf seconded the motion and it carried unanimously upon roll call. Mayor Gottfried advised that a resolution would be presented at the next Council meeting authorizing the Clerk-Treasurer to invest City funds in either Bank Certificates of Deposit or United States Treasury Bills.
VOUCHER APPROVAL - Aldemnan Wolf moved that the Common Council approve for payment vouchers in the amount of $11,640.14 payable to August 4, 1965. Alderman Budish seconded the motion and it carried unanimously upon roll call.
LIGENSE APPROVAL - Alderman Wolf moved that the Common Council approve a Beer Picnic permit for August 28th and 29th, 196.5, to the Veterans ef Foreign Ware for the purpose of serving beer at the Muue- kego Country Fair. Alderman Weaver seconded the motion and it carried.
BUILDING INSPECTOR'S REPORT for July, 1965, was read by the Deputy Clerk and placed on fll e.

COMMUNIOATIONS - The following communioations were presented by the beputy Clerk with disposition as follows:

Communication from the Continental Baking Co. thanking the City of Muskego for its Interest in the relocation of their plant because of expressway development, placed on file.
Communication from Ruekert ZC Mielke, Ino., regarding roads'in Hillendale Heights, referred to Public Works Committee.
Communication from State Highway Commission advising of the approval of the extension of Moorland Road between Biway 24 and Bluemound Rd., referred to Public Works Committee.
Communication from the Planning Commission recavmending approval of the rezoning request of Alton Boldt, placed on file.

MISCELLANROUS RUSIBESS
Alderman Weaver commended Lloyd Peterson, Swmer Recreation Director, for the excellent program presented this season.
Alderman DeAngelis mentioned the Social Security Form regarding additional Social Security benefits to be held at City Hall August 28th, 1O:OO to 12:OQ A. M.
l Alderman Wolf reminded the Counail of the Publio Hearing ooncerning the Fire Arms Ordinanae to be held at the MUskego High School in the All Purpose room, Thursday evening, August 12th.
Gauntg Supervisor Gerald Fohr briefly mentioned aotivities of the County Board in couneotion with Okauchee Lake State Park, Fox River Study, and bids received on the University of Wisconsin.
