-- l MINUTES OF MEETING HELD APRIL 27, 1965
CITY HALL
PRESENT: Mayor Jerome Gottfried, Aldermen Arthur Bostater, Edmund
Budish, Paul M. DeAngelis, Henry Hudziak, Myron Weaver, Donald

Wiesalmann, and Henry Wolf, Clerk Bette Bowyer, and Attorney Richard
Hippenmeyer.
The meeting was called to order by Mayor Gottfried at 7:4C P.M.
Minutes of the previous meeting were corrected on the third page,
9th paragraph, "Alderman Budish voted "No". Alderman Wolf moved,
as seconded by Alderman Hudziak, that the minutes as corrected be
approved. Motion carried.
COMMITTEE REPORTS
Alderman Wolf presented the minutes of the Finance Committee meeting
of April 21, 1965, and moved that the minutes be accepted and placed on file, Alderman Budish seconded and the motion was carried.
l Alderman Wieselmann presented the minutes of the Public Works Commit-
tee meeting of April 23, 1965, and moved that the minutes be accepted and placed on file, Alderman Weaver seconded and the motion was carried.
Alderman DeAngelis presented the minutes of the Public Welfare Committee meeting of April 20, 1965, and moved that the minutes be
accepted and placed on file, Alderman Budish seconded and the motion
was carried.
Alderman Wieselmann presented the minutes of the Public Safety Committee
meetings of April 8 and 22, 1965, and moved that the minutes be accepted and placed on file, Alderman Hudziak seconded and the motion was carried.
Alderman Weaver presented the minutes of the Rules, Laws & Ordinances
Committee meeting of April 15, 1965, and moved that the minutes be
accepted and placed on file, Alderman Wolf seconded and the motion
was carried.
Alderman Wolf reported that the Rules, Laws and Ordinances Committee
was working hard to originate a Gun Ordinance that would be acceptable
to the people of the city.
a The Clerk read the minutes of the Planning Commission meeting of
April 20, 1965, and same were received and placed on file.
COMMUNICATIONS FROM THE MAYOR
Mayor Gottfried presented a large scale map and pointed out the pro- posed North-South roads and noted their importance to Muskego's
industrial and commercial development.
Mayor Gottfried reported that the State Board of Health had 2 iven
final approval to the municipal sewer system. The Clerk rea a letter from the State Health Dept. setting forth the conditions under which the approval was given.
l RESOLUTION #42 The Clerk read a letter to the Aldermen from Mayor
Gottfried in connection with the Council's action on April 13th in regard to the recommendation of the City Planning Commission to dis-
approve the request for B-4 zoning of the lands owned by Mr. Gebhardt
and Mr. Basse along Highway 24, Section 10. The letter was received and placed on file.
0 Alderman Budish commented on the need for proper zoning in that area and Alderman Wolf expressed his concern that the Council had, in a
few brief moments, decided not to accept the decision of the Planning Commission.
UNFINISHED BUSINESS
ORDINANCE #9, amending the zoning ordinance for that property in
Section 7, known as the Duane Whitehouse property, was read by the
Clerk. Alderman Weaver moved to suspend the rules that interfere
with adoption of this ordinance, Alderman Hudziak seconded and the
motion carried.
Alderman Wolf questioned the necessity of moving to suspend the rules,
Mayor Gottfried read Rule #9 from the Rules of Order and explained
that all ordinances or resolutions presented to this body shall require
normal action after two readings or submittal to appropriate committee.
Alderman Weaver moved for the adoption of Ordinance #9, Alderman Wolf
seconded and the motion carried.
ORDINANCE #lo, amending the zoning ordinance for that property in
Section 25, known as the Leslie Meyer property, was read by the Clerk.
Alderman Budish moved, as seconded by Alderman DeAngelis, to suspend
the rules that interfere with adopting Ordinance #9. Motion carried.

ORDINANCE #ll, amending the zoning ordinance for that property in
Section 10, known as the Gebhardt - Basse property, was read by the Clerk. Alderman Weaver moved, as seconded by Alderman Budish, to
suspend with the rules that interfere with the adoption of this
ordinance. Motion carried.
Because of the uncertainty of the Highway 24 access points, the
Council felt that this Ordinance should have more thought, and Alderman
Weaver withdrew his motion and Alderman Budish consented to withdraw
his second.
Alderman DeAngelis moved,
Resolution #42,i. as seconded by Alderman Weaver, to hold
e. re-zoning of the Basse - Gebhardt property, for reconsideration at the next meeting, May 11th. Motion carried.
CHARTER ORDINANCE #7 was read by the Clerk. Alderman Wieselmann moved to adopt Ordinance #'i', i. e. to repeal Charter Ordinance #5, and Alderman Bostater seconded the motion. Roll call was taken and Aldermen Wieselmann and Bostater voted "A e" and Aldermen Budish
DeAngelis, Hudziak, Weaver, and Wolf vote: "No". Motion to adopt
Charter Ordinance #7 lost.
CHARTER ORDINANCE #8 was read by the Clerk. Alderman Wieselmann
moved to adopt Charter Ordinance #8, i.

Alderman Weaver expressed his opinion as follows:
"I personally feel that the repealin
proposed Charter Ordinances #7 and # %
action called for in the
would not be a wise move at this time. Much harm could come from not resolving the issues that Charter Ordinances #5 and #6 have seemed to have created. It is the
right of every citizen to be able to hear and read both sides of the reasoning behind a particular committee or Council's action. In all fairness, this Council should enlist the aid of the press to present
the majority opinion of the Council to the public - even if it must
be at our own personal expense, that we advertise in our local papers.
I recommend the action called for in Charter Ordinances #7 and #8 be tabled and that we proceed under State Statutes honoring the request
of the petitioners. Hold a referendum, let the public decide, not under pressure of half truths, emotional journalism or political sniping, but in the quiet of the polling place.

ALDERMAN DEANGELIS EXPRESSED HIS OPINION AS FOLLOWS:
"I FEEL THAT THE PURPOSE AND MEANING OF THE PROPOSED ORDINANCES
CAN BE SAID TO CORRELATE WITH THE REQUEST OF THE PETITION; HOW-
EVER, THEY DO NOT REPRESENT THE PETITION AND ARE ENTIRELY SEPA-
RATE ACTIONS. 1 THEREFORE FEEL THAT THE COUNCIL SHOULD FIRST
REVIEW THE PETITION AS PRESENTED TO THE CITY GLERK AND THEN IT
l BE ACTED UPON."
ALDERMAN WOLF MOVED TO TABLE CHARTER ORDINANCE #0, SECONDED
BY ALDERFMAN WEAVER, AND THE MOTION WAS CARRIED.
RESOLUTION #45, I. E. V.F.W. COUNTRY FAIR, HAD NO RECOMMENDA-
TION AS YET FROM THE PARK & RECREATION B~ERD. ALDERMAN WOLF
REPORTED THAT THERE HAD B.EEN NO REPLY OR ACTION ON THIS.
ALDERMAN WIESELMANN QUESTIONED THE STATUS OF THE OFFICE OF CITY
TREASURER AS OF MAY XST. MAYOR GOTTFRIED EXPLAINED THAT THE
OFFICE BECOMES GLEERK-TREASURER UNTIL IT IS CHANGED BY ANOTHER
CHARTER ORDINANCE EITHER BY DIRECT ACTION OF THE COUNCIL OR
REFERENDUM. ATTORNEY HIPPENMEYER INDICATED THAT HE WOULD SEND
