MINUTES OF MEETING HELD TUESDAY, APRIL 13, 1965, 7:35 P.M., CITY HALL
The meeting was called to order with President Budish presiding ,in the absence of Mayor Gottfried.

Upon roll call, Alderman Bostater, Budish, DeAngelis, Hudziak,
Weaver, Wieselmann and Wolf were present. Attorney Hippenmeyer
and City Clerk Bette Bowyer were also present.
Alderman Wolf moved, as seconded by Alderman Weaver, that the
minutes of the previous meeting be approved as mailed. Motion carried.
COMMITTEE REPORTS
Alderman Wolf moved, as seconded by Alderman Hudziak, that the Finance Committee',s report of April 5, 1965, be accepted and placed
on file. Motion carried.
Alderman Weaver presented the minutes of the Rules, Laws and Ordinances Committee meeting of April 1, 1965, and passed out state
application forms for the Council.?s review. Alderman Weaver moved,

placed on file. Motion carried.
Alderman Wieselmann presented the minutes of the Public Safety
Committee meeting of March 25, 1965. Alderman Wieselmann moved, as
seconded by Alderman Hudziak, that the minutes be accepted and placed
on file. Motion carried.
Alderman DeAngelis presented the minutes of the Public Welfare
Committee meeting of March 30, 1965. Alderman DeAngelis moved, as
seconded by Alderman Hudziak, that the minutes be accepted and placed
on file. Motion carried.
Alderman Wieselmann presented the minutes of the Public Works
Committee meeting held April 2, 1965. Alderman Wieselmann moved
that the minutes be accepted and placed on file. Motion carried.
UNFINISHED BUSINESS
Resolution #26 regarding repair of heating system in the building at Horn Field was read by the Clerk. Alderman DeAngelis moved, as
seconded by Alderman Wolf, that Resolution #26 be adopted. Motion
carried.
Resolution #40 regarding Planning Commission's recommendation to
approve rezoning of L. Meyer Property in Section 25 by the Over-
laying of 00s - Office and Special Service was read by Attorney
Hippenmeyer. Alderman Wolf moved, as seconded by Alderman Wiesel-
mann, to adopt Resolution #40. Motion carried.
Resolution #43, i. e. to approve the action of the Planning Commission
in withdrawing its petition to rezone the Mayer - Rose Enterprises,
Inc., Properties to General Business was read by Attorney Hippenmeyer.
Alderman Bostater moved, as seconded by Alderman DeAngelis, to adopt
Resolution #43.
l Alderman Wolf oppos.ed the Planning Commission's decision in with-
drawing its petition as he did not feel that this was proper zoning.
The Council unanimously agreed to suspend the rules that interfere
with proper procedure so that Mrs. Mary Mayer might be heard. Mrs.
Mayer stated that her dead and abstract showed the location as zoned
l for business, that an error had been made when the zoning maps were
made up,and she did not feel that she should have to submit her own
petition to the Planning Commission.

The minutes of the Planning Commission meeting pertaining to the
Mayer - Rose Properties were read by the Clerk.
A vote was taken on the motion to adopt Resolution #43 and the
motion lost.
Alilerman Weaver moved that Resolution #a, i. e. the rezoning of
the Mayer - Rose Properties be referred back to the Planning
Commission for further-study and renort. Motion seconded by
Alderman Hudziak and unanimously.aarried .
Resolution #41 regarding the Planning Commission's recommendation
to approve the rezoning of the Duane Whitehouse Property by the
Overlaying of OA Agricultural District was read by Attorney Hippen-
meyer.
It was unanimously agreed by the Council to have Citizen Duane
Whitehouse heard on his petition. Mr. Whitehouse informed the
Council that he would have information as to the Conditional Use
available at the hearing before the Planning Commission the 18th
of May.
Alderman Weaver moved that Resolution #41 be adopted. The motion
was seconded by Alderman Wolf and the motion carried.
Resolution #42, I. E. approval of the recommendation of the
Planning Commission to deny rezoning of the Gebhardt - Basse
Property from RS-2 to B-4 Highway Business was read by Attorney
Hippenmeyer.
Alderman Wieselmann moved that this parcel be rezoned from-R%2 to B-4. Alderman Hudziak seconded the motion.
That portion of the minutes of the Planning Commission meeting
regarding the Gebhardt - Basse Property were read by the Clerk at Alderman Wolf's request.
Alderman Wolf moved to defer action on this motion until the
next Council meeting, April 27. Alderman Weaver seconded the
motion. Upon roll call, Alderman Weaver and Wolf voted ~"'Aye%
and-'Aldermen Bostater, DeAngelis, Hudziak and Wieselmann voted 11 No" .
Resolution #42 amended with the words "be disapproved" in place
of "be approved" was read by Attorney Hippenmeyer. Motion carried
with Alderman Wolf opposing.
Resolution #29 i. e. Highway Department Employees was read by
Attorney Hippenmeyer and amended as follows:
#5. (4th sentence) Vacations must be taken during the CALENDAR
year AND AT THE CONVENIENCE OF THE DEPARTMENT HEAD.
(Added as last sentence) PREVIOUS EMPLOYMENT BY THE TOWN OF
MUSKEGO SHALL BE INCLUDED IN COMPUTING CONTINUOUS SERVICE.
#8. (Added as last sentence) CREDIT FOR TIME OF EMPLOYMENT BY
THE TOWN OF MUSKEGO SHALL BE INCLUDED IN COMPUTING MONTHS OF SERVICE.
Alderman Weaver moved, as seconded by Alderman Wieselmann, to adopt
Resolution #29 as amended. Motion carried.
Resolutions regarding Highway 24 Control Accesses were read by the
Clerk. Alderman Hudziak moved, as seconded by Alderman Wieselmann,aPProve
said,resolutions. Motion carried. $
Alderman Weaver requested that copies be made and placed in the
files of each Committee and Building Inspector.
NEW BUSINESS
Alderman Budish welcomed the public and directed the Clerk to read
correspondence from Mr. Clarence Walrath.
Alderman Wieselmann moved, as seconded by Alderman Weaver, that Citizen Walrath be heard. Mr. Walrath introduced himself as the Chairman of the Citizen+s Committee and presented petitions in accordance with State Statute 10.43 to the City Clerk.
c Alderman Wolf moved that vouchers for the period ending April 2, 1965, in the amount of $1963.22 be approved. Alderman Bostater seconded and the motion was carried.
l Alderman Wolf moved, as seconded by Alderman Bostater, that Operator's License for Geraldine Renner be approved. Motion carried.
Resolution #36 i. e. repair of the interior of the building at Horn Field was read by the Clerk. Alderman DeAngelis moved, as seconded by Alderman Wolf, to suspend with the rules that interfere with adoption of Resolution #36. Motion carried. Alderman DeAngelis moved to adopt Resolution #36, seconded by Alderman Hudziak, and motion carried.
Resolution #37 i. e. to accept bid of International Harvester Co. for dump truck was read by the Clerk. Alderman Wieselmann moved, as seconded by Alderman Wolf,to suspend with the rules that inter- fere with adoption of Resolution #37. Motion carried. Alderman Wieselmann moved, as seconded by Alderman Weaver, to adopt Reso- a lution #37. Motion carried. -
Resolution #38 i. e. bookkeeping system was read by the Clerk. Alderman Wolf moved that the rules be suspended that interfere with adoption of Resolution #38. Alderman DeAngeles seconded the motion and motion carried.
Alderman Wolf moved, as seconded by Alderman DeAngelis, for the adoption of Resolution #38.
Alderman Wieselmann questioned the need for such a service and Alderman Wolf explained that the Finance Committee felt that with such a system there would be more accurate reports as to expendi- tures of each budget. Alderman Bostater, speaking as a member of the Finance Committee, stated that after careful study they felt the chargeswere justified for benefits received.
Alderman Weaver moved to defer adoption of Resolution #38 until the next regular Council meeting. Hudziak seconded the motion. Roll LCJ call was taken on the motion and voting was as follows: Bostater, DeAngelis & Wolf voted "NO". Vote on the adoption of Resolution #38 by roll call as follows: Aldermen Bostater, DeAngelis, Hudziak, Weaver & Wolf - "Aye"
Alderman Wieselmann - "No". Motion carried.
Alderman Wieselmann moved to rescind Charter Ordinance #s and to amend Charter Ordinance #6 to read the same as the petition handed to the City Clerk, that the various offices of City Clerk, etc., be ele,oted instead of appointed and kept completely separate.
Attorney Hippenmeyer informed the Council that an Ordinance must

be submitted as a Resolution cannot amend an Ordinance.Alderman Bostater moved, as seconded by Alderman Wieselmann, to recess so that the proper Ordinance could be drawn up by the City Attorney. Motion carried and meeting recessed at 9:20 P.M.
Meeting reconvened at 9:$ P.M.
Alderman Wieselmann read Charter Ordinance #7 and moved to suspend
with the rules that interfere with adoption of Charter Ordinance #7.
Alderman Bostater seconded the motion and a roll call vote was taken.
Aldermen Bostater and Weiselmann voted:*:Aye" and Aldermen DeAngelis, Hudziak, Weaver and Wolf voted?5No". The motion to suspend the
rules to adopt Ordinance #7 was defeated.
Resolution #45 i. e. V. F. W. Post 8171 Muskego Country Fair was read by Alderman Wolf. Alderman Wolf moved, as seconded by Alderman Weaver, to pass this Resolution to the Park and Recreation
Board. Motion carried.
Alderman Wieselmann read Charter Ordinance #7 and Charter Ordinance
#8. It was unanimously agreed by the Council that this would be
considered the first reading of these Ordinances.
REPORT OF CITY OFFICIALS
Treasurer?,s re ort was read by the Clerk showing a cash balance in
the amound? of 8 193,230.36 as of March 31, 1965. Alderman Wieselmann
moved, as, seconded by Alderman Hudziak, to accept Treasurer!:s
report and place same on file,
It was unanimously agreed by the Council that City Treasurer be
heard in regard to Time Deposit Account #17371. She reviewed terms,
rate of interest, etc.
The Clerk read the Building Inspectorbs report of March, 1965, and
same to be placed on file.
Resolution #39 i. e. alteration of Tennyson Lane was reviewed
by Attorney Hippenmeyer. Alderman Weaver moved to suspend with
the rules that interfere with the adoption of Resolution #39, seconded by Alderman Weaver. Motion carried. Alderman Wolf
moved to adopt Resolution #39, seconded by Alderman Wieselmann,
and the motion was carried.
Attorney Hippenmeyer reviewed the amendments to the Zoning Ordinance.
Alderman Wolf moved as seconded by Weaver, that same be referred
to the Planning Commission and the Rules, Laws and Ordinance
Committee. Motion carried.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
County Board Supervisor Myron Weaver reported on the Park & Recreation
Board Surplus Funds.
Discussion followed in regard to an ordinance concerning the action
of the State Assembly as concerns horse sale barns and quarantine
laws.
Alderman Weaver also mentioned that there would be approximately 35 supervisors controlling the Waukesha County, based on 1960
census, and two supervisors for our area next spring.
Alderman Wolf moved, as seconded by Alderman Wieselmann, that the hearing for the OIP Overlay for American Lutheran Church and the
Community Church be held May 25, 1965, at 8:OC P.M. Motion was
seconded by Alderman Wieselmann and motion carried.
The following communications were read by the Clerk with disposition
as follows:
Wisconsin Dept. of Taxation as regarded taxes due C ,ity of Wauwatosa.
Alderman Wolf moved, seconded by Alderman DeAngelis, that the City
of Wauwatosa be paid. Motion carried.

State Highway Commission of Wisconsin as regards covering the !'No Parking Signs" during week of blood donations. Copies forwarded
to Muskego Health Council, Fire Dept. and Public Safety Committee.
Signed agreement as regards City of New Berlin handed to Attorney
Hippenmeyer.
Conununciation from Hillview Sand and Gravel referred to Public Works
Committee.
Communication from Bldg. Inspector Lee as regarded Adam Ignasiaks
dump referred to City Attorney for legal action as moved by
Alderman Wolf, seconded by Alderman Weaver and motion carried.
Communication concerning Linne Lac Dam referred to Public Welfare Committee.
Resolution concerning Cancer Control Month received and placed
on file.
Communication from Recreation Board Concerning Horn Field received
and placed on file.
Alderman Hudaak suggested that there be advertisement for Water
Patrolmen.
Alderman Wolf moved to adjourn, seconded by Alderman Hudziak and
meeting adjourned at lo:50 P.M.
