ZONING IN BEHALF OF ANDREW SCIANO, PETITIONER? PETITION AND PUBLIC HEARING NOTICE WAS READ BY CLERK. MR. SCIAN~ STATED THAT HE HAD PURCHASED THE LAND ABOUT 10 YEARS AGO AND UNBEKNOWN TO HIM THE LAND WAS REZONED BACK TO RS-2. MAYOR GOTTFRIED SPEAKING AS CHAIRMAN OF PLAN COMM., CONVEYED THE RECOMMENDATION OF THE PLAN COMM., WHICH WAS AS FOLLOWS: THAT THE REQUEST TO REZONE FROM RS-2 TO B-4 OF LANDS OWNED BY A. SCIANO, BE DENIED, BUT WOULD RECOMMEND THE LANDS BE REZONED FROM RS-2 TO B-2. MR. SCIANO STATED, "IF THE BOARD RECOMMENDS I WILL BE SATISFIED". No ONE APPEARED IN OPPOSITION TO THIS PETITION. USE STATUS BE GRANTED IN BEHALF OF HALES CORNERS SAND & GRAVEL CORP., FOR AN EXTRACTIVE OPERATION IN ACCORDANCE WITH SEC. 6.07 (7) ON PROPERTY GENERALLY DES- CRIBED BY THE SOUTH 10 ACRES OF THE w+ OF THE NE$ SEC. 12 AND 72.51 ACRES ON PT OF THE SE& - SEC. 12? THE CLERK READ THE PETITION, PUBLIC HEARING NOTICE AND RECOMMENDAT- ION OF THE PLAN COMMISSION ON ABOVE REQUEST. BERNARD FREUDENFELD, ATTORNEY, REPRESENTED PETITIONERS, SUB- MITTING NEW TOP0 MAP, MAP SHOWING PROPOSED 3-1 SLOPE TO LAKE, AFFIDAVIT OF AGREEMENT AND IN so DOING REVIEWED SAME. HE STATED THAT HIS PETITIONERS DO NOT FEEL DEMANDS OF CONDITIONS PLACED BY PLAN COMM., ARE UNREASONABLE. HE ALSO SUGGESTED THAT THE CITY AND PETITIONERS ENTER AN AGREEMENT WHEREAS AN x AMOUNT OF MONEY BE CHARGED PER YARD OF GRAVEL EXTRACTED AND PLACED INTO AN ESCROW ACCOUNT TO GUARANTEE RESTORATION. ALDERMAN WOLF ASKED HOW LARGE AN AREA PRESENT OPERATION COVERED? -a MR. FREUDENFELD ANSWERED, 13 ACRES. MR. SCHMELING STATED HE UNDERSTOOD PERMIT IS NOW ON A YEARLY BASIS AND PART OF THE RECOMMENDATION MADE BY THE COMMISSION WAS TO RESTORE PART OF THE AREA AND WILL THIS TAKE PLACE a FIRST BEFORE PERMIT IS ISSUED AND WHY ARE THE PETITIONERS SO CONCERNED OVER ESTABLISHING A LARGER BOND WHEN THEY SEEM TO BE SO WILLING TO COOPERATE AND WHO WOULD CHECK YARDAGE EXTRACTED IF THE CITY WOULD ENTER INTO SAID AGREEMENT? CHAIRMAN GOTTFRIED EXPLAINED THAT THE $5,000 BOND STIPULATED WOULD BE USED FO&ESTORATION. HR. MAGARICH FELT THAT PETITIONERS COULD STRAIGHTEN OFF GROUND AREA AROUND OFFICE, BUT FELT THEY SHOULD HAVE MORE TIME WITH THE SLOPPING. MR. GETTLEMAN SAID THAT HE UNDER- STANDS THAT THE PETITIONERS HAVEN'T DONE ANYTHING IN 8 YEARS AND JUST THE OTHER DAY, FOR THE FIRST TIME, THEY HAVE CLEANED UP THE AREA BECAUSE PRESSURE HAS BEEN EXERTED. ALDERMAN BUDISH ASKED, HOW MUCH TIME THEY WOULD NEED TO PUT AREA INTO CONDITION? ATTORNEY FREUDENFELD STATED, "I THINK THE COUNCIL HAS BEEN REASONABLE". MR. DOMBROWSKI ASKED WHY THEY DON'T TAKE A BULLDOZER AND TAKE DOWN THE OLD BUILDING. MRS. WILBRANDT ASKED WHETHER THE PEOPLE WOULD BE NOTIFIED WHEN THE SIX-MONTH PERIOD ENDED AND MAYOR GOTTFRIED SAID, "N 0 I'. HEARING DECLARED ADJOURNED AT 4:20 P.M.
