COMMITTEE OF THE WHOLE -Minutes 20100413 COMMITTEE OF THE WHOLE – CITY OF MUSKEGO (Approved) MINUTES OF MEETING HELD TUESDAY, APRIL 13, 2010 Mayor Johnson called the meeting to order at 6:45 p.m. and led those present in the Pledge of Allegiance. ROLL CALL Mayor Johnson, Aldermen Snead, Harenda, Borgman, Werner, Schneider, Schaumberg, Fiedler, Recording Secretary Kellie McMullen. Also present Community Development Director Jeff Muenkel and School Board Member Rick Petfalski. STATEMENT OF PUBLIC NOTICE The meeting had been noticed in accordance with the Open Meeting Law. APPROVAL OF AGENDA There were no issues with the agenda items listed. APPROVAL OF MINUTES Ald. Schneider moved to approve minutes of the March 9, 2010. Ald. Werner seconded; motion carried. NEW BUSINESS th 1.Discuss Policy on Full and Temporary Interest Acquisitions. Deferred to April 27 meeting - City Attorney had an emergency medical issue. 2. Discuss Bring Back the Lake timetable and proposed public informational meeting on May 4, 2010. Mayor Johnson stated that issues to be determined tonight are the informational meeting date and do we want to send out a notice out to entire community instead of posting information on City web site as would normally be done. Cost of the mailing would be around $2000.00. Mayor recommends holding a referendum. The City has ordinance Chapter 3.17 that relates to Public Works construction projects that states projects over 10 million should go to referendum. Earliest a special election could be held would be in late July. Could also be done at the primary in September or the regular November election. School board member, Rick Petfalski, said that the District has nothing planned at this time they might be looking at doing a referendum – earliest in November after conducting a citywide survey. His suggestion is that the City do a survey – his past experience in this area has shown that surveys give guidance as to what citizens want whereas a referendum is a yes or no answer. Estimated cost to do the survey is about $10,000. Ald Snead questioned if it was possible to send the survey out along with the notice of the public informational meeting and that if majority of results of the survey were negative would there be a need for a referendum. Ald Werner stated during the next month there would meetings held throughout the community in th addition to the May 4 meeting. He feels that results of these meetings would give the City an idea how the citizens feel. The sooner we share the information with the community the better and that the stakeholders in the project need to know what direction this is headed as soon as Committee of the Whole Page 2 possible. He is in favor of a special election. Ald Borgman suggested waiting until November then to spend money on a special election. . Determined that all were in agreement regarding mailing notices to all residents and to hold the public informational meeting on May 4, 2010 at 7:00 PM. Public informational meeting would give the Council an idea of how the public feels on the project and then the next step would be discussed. Jeff Muenkel, Community Development Director stated that the information for this project has now been posted on their website. The vision or concept is outlined. The financial data – debt service -how it affects the taxpayer and what’s being proposed for the buildings will be discussed th at the April 27 COW meeting. Mayor stressed importance of the wording of the referendum question and the date. Goal is to be tax neutral or positive. 3. Proposed ordinance to amend Chapter 1, Section 1.04 regarding Appointed Officials. This proposal is on the Council agenda for tonight. The City Attorney in review of ordinance has concerns regarding Sec 1.04 (2), which is already stated in state law – this is in conflict with our charter ordinance. Sec 1.04 (3) should be in Sec 1.05 instead of Sec 1.04. Mayor will recommend defeating motion on floor tonight and we will recreate 1.05 and go through the process again. ADJOURNMENT Ald.
