COMMITTEE OF THE WHOLE – CITY OF MUSKEGO (Approved)
MINUTES OF MEETING HELD TUESDAY, MARCH 9, 2010
Mayor Johnson called the meeting to order at 7:00 p.m. and led those present in the Pledge of
Allegiance.

Treasurer Moyer. Ald. Fiedler (Absent)
STATEMENT OF PUBLIC NOTICE
The meeting had been noticed in accordance with the Open Meeting Law.
APPROVAL OF AGENDA
There were no issues with the agenda items listed.
APPROVAL OF MINUTES
Ald. Borgman moved to approve minutes of the February 23, 2010. Ald. Schneider seconded;
motion carried.
NEW BUSINESS
1. Proposed ordinance to amend Chapter 1, Section 1.04 regarding Appointed Officials.
Alderman Werner is bringing proposal forth as a result of serving on committees where
committee members had several absences. This has caused issues with decisions being made
without input from all members and in some instances a lack of quorum. Is there a mechanism to
remove members who are not attending meetings?
Mayor stated that State statues already have a procedure to allow removal for just cause to keep
the process going. This ordinance would clarify procedure at local level.
There was much discussion on correct verbiage regarding Mayor and/or Committee Chairman. It
was decided that Chapter 1, Section 1.04 (3) should read, “An absence excused by the Mayor or
Committee Chairperson for good cause shall not be considered an absence.” See attached.
Scheduled for first reading at next Council meeting.

PROPOSED ORDINANCE #xxxx
AN ORDINANCE TO AMEND CHAPTER 1,
SECTION 1.04,
OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO
(General Government - Appointed Officials)
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN DO ORDAIN AS FOLLOWS:
SECTION 1: Chapter 1, Section 1.04, of the Municipal Code of the City of Muskego is hereby amended to read as
follows:
1.04 APPOINTED OFFICIALS
(1) All appointed officials, when such offices are created by the governing body, shall be appointed by the
Mayor subject to confirmation by the Common Council.
(2) An appointed official may be removed by the Common Council for cause pursuant to Wisconsin
State Statutes.
(3) Three consecutive absences by a member of any board or commission from regularly scheduled
meetings shall operate to vacate the member’s office. An absence excused by the Mayor or
Committee Chairperson for good cause shall not be considered an absence here under.
SECTION 2: The several sections of this Ordinance are declared to be severable. If any section or portion thereof
shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such
decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the
validity of all other provisions, sections, or portion thereof of the Ordinance which shall remain in full force and effect.
Any other Ordinance whose terms are in conflict with the provisions of this Ordinance is hereby repealed as to those
terms that conflict.
SECTION 3: This Ordinance shall be in full force and effect from and after its passage and publication.
